An Update

An additional update is available. For the record, I (-David) don't agree with this nor believe it's a good use of a small teams resources to immediately replace any asset.

I was just contacted by the artist responsible (he just woke up to all of this - Eastern part of the world) for the Automatic Shotgun (which is what appears most in fans-submitted comparisons) feels absolutely horrible and has contacted me to inform me that he would feel more comfortable in remaking said weapon regardless of what I do about Activision or how we proceed. So no matter what happens going forward, that weapon will be visually different.

He feels terrible that his piece of art resulted in these events that have affected so many things and he has started production on it this evening to remedy anything he can do directly.

What Activision is claiming isn't a valid or legal use of DMCA. If they were alleging that we had actually RIPPED the Black Ops 3 weapons FROM their game and used them exactly - their shipped meshes, their shipped textures - that is a DMCA case. And the fact that they made an artist feel this way when it's ALL they do is absolute crap.

What they are alleging is that our very own, separately created content is "too visually" or "artistically similar". That is *NOT* what the DMCA covers. That is a form of copyright and IP infringement dispute. Their lawyers know this, but filed this anyways.

We will be seeking resolution for all damages wrongly inflicted towards us FROM Activision via this malicious and overly aggressive tactic.

Our desire to remove said content is purely for our own benefit. We are a small indie team, any minute the game is not for sale during the biggest event is a stake to the heart. Us willing to remove any offensive content and to get it back for sale is to protect our selves, our company and our IP.

Our Response

The Facts
I received the DCMA request after its removal from Steam with no warning/contact from either Valve/Steam or any developer associated with Call of Duty nor anyone from Activision.

I never was provided specific examples of assets, or screenshots of what offended them - nor given the chance to rectify or remove any offensive content prior to having our game removed from sale.

We assumed which pieces of content based on what they self-labeled of their own as well as community-provided assets.

We immediately offered to remove ANY offensive content (as it wasn't specified) and this was not accepted.


The Events
I was informed by Steam that accordingly to their policy, Activision has 10 business days (until July 7th, 2016 - basically a month due to the Holiday) to act or do anything.

If Steam doesn't receive a copy of a legal complaint within 10 business days, then our game will be re-instated.

What this means is that Activision has maliciously and erroneously used a DMCA request to aggressively attack a small, independent development team during the BIGGEST Sale Event of the entire year, the Steam Summer Sale.


Our Comments
The sight is the only similarity we can see. Even if it was a 1:1, that's not enough for a design infraction, even by legal standards and by a significant amount.

And the sight is just a futuristic M1 Garand, so either way both are homaging a real world property, the only thing that could actually hold up and is the only one without a dog in this fight.

Regardless, an invalid and malicious act from Activision on wrong or non-existant evidence. They are are multi-billion dollar company coming over what is currently a 50 cent game, without contacting us or requesting anything of us NOR providing any specific assets or images of the offensive content to begin with

That being said, if our community finds our weapons or content offensive we are of course always listening and will integrate feedback/suggestions based on such. If you want weapons changed, we are a developer that reads what you write. We've demonstrated this for many years now across a variety of products:

In Short
Orion is a game all about homages. It's what it's always been, since it was announced as a retro homage to the classic 90's games with a modern take. It’s GI Joes action figures versus your Jurassic Park toys. It’s Halo meets Turok. It's what we all did as kids in our heads.

I just can’t believe of all things, it was over a generic sci-fi weapon. Regardless what it was over, the most important thing was that we were not warned, contacted by either party nor able to remedy it. We were given no specific information relating to assets, only left to guess or use fan-submitted content/links to decipher.

We offered immediately to remove any offensive content right off the bat, this was rejected.

We are happy to read any feedback about the game. Any ORION fan knows we do this regularly. We are always reading and listening and if fans find any of our content offensive we have and will always replace it.

Very poorly optimized.

Framerate is poor and drops constantly. Specially when the dinos come.

To the minds behind orion: Activision is horrible. That's why they make games named after fish. (Call Of Duty. COD. A fish nobody likes).
In the event that they actually get the game off steam, know that the community- myself included- thinks that it's a completely absurd tactic used to stifle indie games. If they knock orion off steam, then the other indie devs are next. I hope that Activision fails miserably.

And since I'm on this soap box, I'd like to point out that unless you're using the same sprites, they have NO case. And if you took the time and effort of spending sixty bucks on COD and combing the files for those what, three sprites? Then Activision profited already, so you pretty much payed for it.

AND so I don't get downvoted blah blah blah
This game is amazing, gameplay is great, the bugs (none of which I've encountered, by the way. .-.) are being patched, and it's really worth your two fifty cents.

For one dollar, it's definitely worth it. Think of it as an arena-styled game with some Halo-like vehicles and Borderlands-esque graphics. Though its not the most engaging game ever, its very fun at times and has rewarding gameplay. Mowing down hordes of dinos is always fun as you continue to gain credits in order to get better weapons and even vehicles. Great value and good fun for a dollar and you'll definitely get some enjoyment out of this for its price.

I have now found the ultimate reason to go on in life. I shall forever be a knight in the holy crusade against the blasphemous dinosaurs. I hereby devote my very existence to driving a tank and shooting velociraptors on the ground and failing at taking pterodactyls out of the sky. ORION: Prelude is the pinnacle achievement of humanity.

So what is
ORION: Prelude?

It is an FPS (first person shooter) with dinosaurs, your goal is to defend the generator from the dinosaurs. As you defend the generator and kill the dinosaurs you get money to uppgrade your weapons (all sorts) and get more abillitys for your character. This game is pretty hard sometimes but very challenging.

Classes
You can spawn as 3 classes, the Assult, Support and Recon (every class start with diffrent guns). As almost everygame the diffrent classes has abilitys. The Assult have a jetpack wich you can fly a decent amount of time untill it needs to recharge, support have a heal gun (you can heal players and the generator with it) not much more to say about the support class. The recon can be invisible for a decent amount of time from the dinosaurs, (you can not shoot dinosaours while your invisible).

Weapons
So many weapons of all diffrent kinds.. What one should I buy? Thats totally up to you but I really like the bow and rocket launcher and also when you have choosen a class you spawn with a pistol not anyting more. You'll get better and better weapons for points (you get points from the dinosaours by killing them).

Vehicles
It exist many vehicles which is awesome feature for this game, from small vehicles to big helicopters. They all are rideable.

General Impression
ORION: Prelude could quite possibly be the most affordable game that involves both dinosaur hunting and multiplayer fun. And as of 2016, it is in fact a prequel to ORION. It is definitely best played with a few friends by your side. The singleplayer mode features some pretty worthless bots so don’t expect much help from the AI. Graphics are a sight to behold, even with the occasional glitch popping in. The sheer diversity of weaponry and vehicles at your disposal as well as the dinosaurs themselves, will have you entertained for hours on end while the inclusion of both Achievements and Trading Cards seems the perfect cherry on top, to an already great deal. Buy this game and you won’t regret it.

Strong Points
+ Beautiful graphics.
+ Steam Trading Cards & Achievements.
+ Great price for what it offers.
+ MP mode is quite enjoyable

Weak Points
- Lack of tutorials and a storyline.
- SP mode is less fun since the bots’ AI is weak.

After playing too many hours on end, this game is pretty damn amazing.

Pros:
-3 Class Combat
-Jetpacks, rocket launchers,machine guns, Lasers, Bows, Snipers, Shotguns (You can carry an ENTIRE ARSENAL of weapons)
-Trex, Triceratops, Stegasaur,pteradons, raptors, compys, spinysaur
-Mechs, Tanks, Hover bikes, Mounted Jeeps, Helicopters, turrents
-Simple Combat, simple controls
-Mow Down ENDLESS hordes of dinosaurs
-Hand cramps(from all the damn flying and shooting)
-Physics do not exist (I stood on a flying helicarier while shooting a giant plasma beam)
-Helmet graphics (Freezing, Raindrops, flying dirt) are highly immersive in the combat experience
-Its really Easy, and its really hard
-DINOSAURS

Cons:
-Highly unrendered, graphics can be ALOT better, if you can look past it
-servers are sometimes buggy
- HUGGGEE Lack of instruction & tutorials (took me a while to understand the controls and shops)
-Bots are stupid (Though they make up in shear numbers and high attack)
-Lack of Backstory/any story


*my Love for this game was its simplicity, I always turn to this game to blow steam because it doesnt reqire alot of strategy, just alot of slaughtering. This game uses Left 4 Dead combat with a Halo Themed people, and a Jurrassic Park enviornment. You will never feel more clenched when you're dropping missiles at a Dino Boss in your helicopter while a hundred pteradons are knocking the crap out of your ship.

The game Forces you to stay alive as long as possible, upon death you have to wait around 30 seconds for a respawn and you drop all the weapons you collected in the levels. Though your weapons can be picked up again when you respawn, if you rememberd where you died of course. If you dont buy this, then you have NOOOOOOOOOOO idea what you are missing out on.

A strangely fun FPS game enjoyed best with friends. The assets look like they were taken off of a Halo knock-off, but the gameplay of wave-based dino shooting and vehicle driving has a simple satisfaction that other AAA games don't always seem to provide.

That, and for less than a McChicken!
