END‑USER LICENSE AGREEMENT ("EULA")

This End‑User License Agreement (“Agreement”) is a legal agreement between you (“User”, “you” or “your”) and Eternal Delta Games (“Developer”, “we”, “us”, “our”) regarding your use of the software Pasture Palette (the “Game”).

By downloading, installing, or otherwise using the Game (or any updates, patches, or components thereof), you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not install or use the Game, and delete any copies in your possession.

1. LICENSE GRANT

1.1 Limited, non‑exclusive license. Subject to your compliance with this Agreement, the Developer grants you a worldwide, non‑exclusive, non-transferable right to install and use one (1) copy of the Game on a compatible device for your personal, non-commercial entertainment purposes.
1.2 Restrictions. You may not:

Rent, lease, lend, sublicense, distribute, or otherwise transfer the Game (or your rights under this Agreement) to any third party;

Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Game, except to the extent permitted by applicable law;

Modify, adapt, translate, or create derivative works of the Game;

Remove or alter any copyright, trademark, or other proprietary notices on or in the Game;

Use the Game in any manner that infringes third‑party rights or violates any law or regulation;

Use the Game for commercial purposes (e.g., as part of a service, charging access, etc.), except where expressly permitted in writing by the Developer.

2. OWNERSHIP

The Game (including all components, modifications, patches, updates, and derivative works) is licensed, not sold. Developer retains all rights, title, and interest, including all copyrights, trademarks, trade secrets, and other intellectual property rights.

3. UPDATES, PATCHES & DLC

3.1 The Developer may from time to time provide updates, patches, downloadable content, or enhancements to the Game (collectively, “Updates”). You agree that Updates may be automatically installed without further notice, and that this Agreement applies to all Updates.
3.2 DLC (if any) may be subject to additional terms; in case of conflict, those terms prevail.

4. USER DATA & PRIVACY

4.1 The Game may collect usage data, diagnostic information, crash logs, and other telemetry. The use and handling of this data is governed by the Developer’s Privacy Policy.
4.2 You represent that you have the right to provide any data submitted via the Game, and you grant Developer a non‑exclusive, royalty‑free right to use such data for improving the Game, analytics, and related purposes.

5. RESTRICTIONS & PROHIBITED USE

You may not use the Game (or authorize another party to use it) to:

Facilitate cheating or hacking, including modifying game code or behavior in multiplayer, if applicable;

Distribute or create hacks, bots, tools, or scripts that interact with the Game;

Circumvent any digital rights management or anti‑tamper features;

Use the Game in a way that is defamatory, obscene, abusive, or otherwise objectionable;

Gain unauthorized access to servers, networks, or third‑party systems.

6. TERMINATION

6.1 This Agreement is valid until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term of this Agreement.
6.2 Upon termination, you must cease all use of the Game, uninstall and delete all copies (including backups), and destroy all related materials.
6.3 Sections concerning Ownership, Disclaimer of Warranty, Limitation of Liability, and any other provisions which by their nature survive termination shall continue in force.

7. NO WARRANTY

The Game is provided “AS IS” and “WITH ALL FAULTS,” with no warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non‑infringement, or uninterrupted service. The Developer does not warrant that the Game will be error-free or that defects will be corrected.

8. LIMITATION OF LIABILITY

To the maximum extent allowed by applicable law, in no event shall Developer, its officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, punitive or exemplary damages (including loss of profits, revenue, data, use, or goodwill), arising out of or relating to your use or inability to use the Game, even if Developer has been advised of the possibility of such damages.
In jurisdictions that do not allow the exclusion or limitation of certain damages, the above may not fully apply, and liability shall be limited to the greatest extent permitted by law.

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Developer, its affiliates, officers, agents, and employees from any claims, losses, damages, liabilities, costs or expenses (including reasonable attorneys’ fees) arising out of or related to your breach of this Agreement, violation of law, or use of the Game.

10. EXPORT CONTROL, GOVERNING LAW & GENERAL PROVISIONS

10.1 Export control. You shall not export or re-export the Game in violation of applicable export laws and regulations.
10.2 Governing law & venue. This Agreement is governed by the laws of [Your Jurisdiction — e.g. the State of California, USA], without regard to its conflict of laws principles. You and Developer submit to the exclusive jurisdiction of the courts located in [appropriate county or city].
10.3 Severability. If any provision of this Agreement is held invalid or unenforceable, the remainder shall remain in full force and effect.
10.4 Waiver. No waiver by Developer of any breach or right under this Agreement is effective unless in writing.
10.5 Assignment. You may not assign or transfer this Agreement or your rights hereunder without Developer’s prior written consent. Developer may assign this Agreement without restriction.
10.6 Entire agreement. This Agreement (together with any Privacy Policy or DLC terms you agree to) constitutes the entire agreement between you and Developer concerning the Game, superseding any prior or contemporaneous agreements or understandings.
