Game Name: End User License Agreement for the Original Soundtrack DLC of "Doll House Fantasy Night"
Important Notice: Please read this End User License Agreement ("Agreement") carefully. By purchasing, downloading, installing, or using the soundtrack music collection of "Puppet Theater Fantasy Night" ("OST" or "this music collection"), you agree to be bound by the terms of this agreement. If you do not agree to all the terms of this agreement, please do not purchase, download, install, or use this music collection.
1. Copyright Statement
1.1 Everlasting Game Production Team ("Licensor") is the copyright owner or exclusive licensee of all music works, recordings, and related content (collectively referred to as "Music Works") in this music collection. All music works are protected by the Copyright Law of the People's Republic of China, international copyright treaties, and other applicable laws and regulations.
The sale of this OST DLC does not constitute a transfer of copyright to the music work. The licensor reserves all rights, ownership, and interests in the music work, unless expressly granted in this agreement.
2. License granted
2.1 Subject to your compliance with all terms and conditions of this Agreement, the Licensor hereby grants you a global, non exclusive, non transferable, non sublicensable, limited, revocable license to use this music collection only for the following personal, non-commercial purposes:
*(a) Personal Collection: Download and store this music collection file on devices that you personally own or control.
*(b) Personal listening: Play this music collection file on your personal device for your personal enjoyment.
*(c) Personal gaming experience: Experience the music included in the game while running your legally owned copy of the game "Puppet Hall Fantasy Night".
2.2 This license is strictly limited to personal use and is only for the purchaser themselves.
3. Strictly prohibited behaviors
You expressly agree not to and have no authority to engage in any of the following actions:
3.1 Dissemination: Provide, disseminate, and share any part or all of the files in this music collection to any third party (whether for a fee or not) in any form (including but not limited to uploading, downloading, sharing, distributing, broadcasting, network transmission, P2P file sharing, sharing through cloud storage links, burning physical copies for distribution).
3.2 Public Performance/Display: Play, perform, and display this music collection publicly in places open to the public or through the internet (such as live broadcasts, video websites, podcasts, public events), unless otherwise authorized in writing by the licensor.
3.3 Commercial Use: Use this music collection or any part thereof for any commercial or for-profit purpose, including but not limited to:
*Used in advertising and promotional materials.
*Used in movies, TV dramas, videos, games (whether profitable or not), or other media projects (unless expressly authorized by the licensor).
*Play in commercial places such as shops, restaurants, and companies.
*As background music, it is used in online live broadcasts or videos to generate revenue (such as advertising revenue, tipping).
*Recreate music (mix, adapt, etc.) and use it for commercial purposes.
*Resale, rent, and sublicense this music collection.
3.4 Modification and Reverse Engineering: Modify, decode, decompile, disassemble, crack, or perform any form of reverse engineering on this music collection file.
3.5 Avoidance of Technical Measures: Attempting to circumvent, damage, or bypass any copy protection, digital rights management (DRM), or other technical restrictions that may be applied to this music collection.
3.6 Claiming Ownership: Claiming ownership or copyright of this music collection or any part thereof.
4. Termination of License
4.1 If you violate any of the terms of this Agreement, the license granted to you under this Agreement shall automatically terminate immediately without notice from the licensor.
4.2 Upon termination of the license, you must immediately and permanently delete all copies of this music collection files and their copies on all devices owned or controlled by you.
5. No guarantee
This music collection is provided as is and as available. The licensor expressly disclaims any express or implied warranties, including but not limited to any warranties of merchantability, fitness for a particular purpose, completeness of rights, and non infringement.
6. Limitation of Liability
To the maximum extent permitted by law, the licensor shall not be liable for any direct, indirect, incidental, special, punitive or consequential damages (including but not limited to data loss, loss of profits, business interruption) arising from the use or inability to use this music collection.
7. Breach of Contract and Legal Remedies
7.1 You understand and agree that any violation of this agreement (especially the prohibited behavior in Article 3) will constitute a serious infringement of the licensor's copyright.
7.2 The licensor reserves the right to take legal action against any violation of this agreement, including but not limited to:
*Send a warning letter requesting the cessation of infringement and the removal of infringing content;
*Initiate infringement complaints to relevant platforms (such as video websites and cloud storage service providers);
*Initiate a lawsuit in accordance with the law to the people's court with jurisdiction;
*Hold the infringer liable for civil compensation (including but not limited to the actual losses of the licensor, the illegal gains of the infringer, and reasonable rights protection expenses such as lawyer fees, notary fees, etc.);
*When the infringement constitutes a crime, report to the public security organs in accordance with the law and pursue their criminal responsibility.
7.3 You agree to compensate the licensor for any claims, damages, losses, costs, and expenses (including reasonable attorney fees) arising from or related to your breach of this agreement or infringement of the licensor's intellectual property rights.
8. Applicable Law and Dispute Resolution
8.1 The formation, validity, interpretation, performance, and dispute resolution of this agreement shall be governed by the laws of the People's Republic of China (excluding its conflict of laws rules).
8.2 Any disputes arising from or related to this agreement shall be resolved through friendly negotiations between the parties first; If the negotiation fails, either party has the right to submit the dispute to the people's court with jurisdiction in Shanghai for litigation resolution.
9. Complete Agreement
This agreement constitutes the entire agreement between you and the licensor regarding the license of this music collection and supersedes all prior or contemporaneous oral or written agreements, proposals, or representations.
