1. Parties and Acceptance

This EULA is between you and the maintainer of ECHO operating under the public project name "Moekotori" (the "Licensor") for ECHO Steam. By downloading, installing, launching, or using ECHO Steam, you accept this EULA. If you do not accept it, do not use and uninstall ECHO Steam.

If you are not old enough to enter this EULA independently where you live, a parent or legal guardian must review and accept it. Nothing in this EULA limits consumer rights that cannot lawfully be waived.

Your use of Steam is also governed by the Steam Subscriber Agreement and applicable Valve rules. Valve is not the licensor of the ECHO software under this EULA.

2. Limited License

While you comply with this EULA, hold a valid ECHO Steam license, and satisfy applicable Steam entitlement requirements, the Licensor grants you a limited, non-exclusive, non-transferable, non-sublicensable license to install, run, and use ECHO Steam through supported Steam accounts and devices for personal use and internal uses permitted by Steam.

This EULA grants a right to use the software. It does not transfer ownership of ECHO, its source code, branding, icons, interface, documentation, or other materials, and it grants no rights in music, lyrics, artwork, Workshop content, or third-party service content.

3. Lawful Use and Restrictions

Unless this EULA, a separate applicable license, or law expressly permits it, you must not:

  • copy, sell, rent, sublicense, redistribute, publicly host, or provide ECHO Steam or its installer to third parties;
  • remove or alter copyright, trademark, attribution, security, integrity, entitlement, or diagnostic notices;
  • bypass Steam ownership, DLC, Pro entitlement, signature, integrity, or other access controls;
  • use ECHO Steam to infringe copyright, privacy, contract, access-control, or other legal rights;
  • use ECHO Steam, Steamworks, remote services, or Workshop content to distribute malware, obtain unauthorized access, or interfere with systems; or
  • use the ECHO, Moekotori, Valve, Steam, or third-party names or marks to imply unconfirmed sponsorship, certification, or partnership.

This section does not restrict interoperability, audit, security research, reverse engineering, backup, or other rights that applicable law expressly permits and a contract cannot exclude. Source-code activities are separately governed by the ECHO Source-Available License; rights it expressly grants for source review, study, or local builds are not reduced by this EULA.

4. User Media, Remote Sources, and Third-Party Services

You are responsible for having the right to access, copy, organize, play, or display music, lyrics, artwork, playlists, and other content imported into ECHO Steam. ECHO provides playback and management tools; it does not grant a license to third-party media or guarantee that a use qualifies as fair use, private copying, or another legal exception.

When you configure WebDAV, Jellyfin, Emby, Subsonic/Navidrome, SMB, SSHFS, direct radio streams, Last.fm, Discord, OPRA, or another third-party service, you must follow that service's terms and are responsible for accounts, credentials, server addresses, and access permissions. Third-party services may change, interrupt, or end, and the Licensor does not control their continued availability.

5. Steamworks, Purchases, Refunds, and Pro DLC

ECHO Steam downloads, updates, ownership checks, Steam Cloud, Rich Presence, achievements, stats, leaderboards, and Workshop features depend on the local Steam client and Valve services. Features may be unavailable because of Steam settings, privacy settings, account state, region, network conditions, service outages, or Valve rules.

Purchases, refunds, payments, and withdrawal rights through Steam are handled through Valve's transaction process, the Steam Refund Policy, and applicable law. This EULA does not reduce any refund or consumer right available under law or Steam rules.

ECHO Pro is unlocked in the same ECHO executable through DLC or another clearly identified Steam entitlement. The Pro license is associated with the Steam account that owns the entitlement. A refund, revocation, loss of ownership, or inability to verify entitlement may lock Pro features, but does not remove base-edition data or rights that law requires to remain. You must not bypass or falsify entitlement checks.

6. Steam Cloud and Data

When Steam Cloud is available and enabled, ECHO Steam may synchronize an allowlisted projection of portable settings. The library, music files, absolute paths, playback history, device information, and credentials are excluded. See the ECHO Steam Privacy Policy for data handling, controls, and deletion boundaries.

This EULA does not turn optional processing described in the Privacy Policy into mandatory consent. Stats, leaderboards, third-party accounts, and other features that require a separate choice must still be enabled through their corresponding settings.

7. Steam Workshop

Workshop items are provided by their authors and are governed by the Steam Subscriber Agreement, Steam Workshop rules, the license shown on the item page, and applicable law. Except for ECHO-owned items, the Licensor does not claim ownership of third-party items or grant rights beyond the item's license.

ECHO Steam validates, isolates, and limits Workshop capabilities, but cannot guarantee that all third-party content is accurate, suitable, continuously available, or defect-free. ECHO may reject, quarantine, disable, or stop applying an item that is damaged, incompatible, exceeds its declared permissions, or violates security boundaries. Subscription does not automatically enable an item; enable only content you trust.

If ECHO later opens public submission to ordinary users, you may submit only content you own or have the right to distribute and must accept the submission terms required by Steam. Without separate express terms, this EULA itself does not grant ECHO an additional commercial license to your work.

8. Updates, Changes, and Support

Official ECHO Steam application files are normally updated through Steam. Updates may address security, compatibility, defects, feature changes, or platform and legal requirements. Planned platform or feature support is not a promise of availability; only released versions and their documentation describe current capability.

The Licensor may add, change, or remove features in future versions, but an update will not retroactively remove acquired rights that applicable law makes non-waivable. Support, maintenance, online services, and compatibility are not guaranteed to remain permanent or uninterrupted. Additional acceptance will be requested where required for a security update or material terms change.

9. Third-Party Components and Separate Licenses

ECHO Steam includes third-party libraries, fonts, codecs, SDKs, and other components governed by their own licenses. Copyright, license, and notice information is provided in THIRD_PARTY_NOTICES.md and the licenses/ directory supplied with the app or repository. If a third-party license conflicts with this EULA, that third-party license controls only for the corresponding component.

10. Backups, Audio Devices, and Use Risk

Keep reasonable backups of your library, playlists, settings, and important files before importing, migrating, bulk editing, or clearing data. ECHO uninstall and cleanup features should not delete original music files, but file-system operations, remote services, hardware, drivers, and third-party tools can still create data risk.

EQ, DSP, gain, exclusive output, ASIO, DSD/DoP, and experimental audio features may change volume, signal, or device behavior. Start at a safe listening level and follow device-manufacturer instructions. ECHO status messages do not replace hearing protection, hardware safety guidance, or professional advice.

11. Disclaimer of Warranties

To the extent permitted by applicable law, ECHO Steam is provided "as is" and "as available," without a promise that it will be error-free, uninterrupted, suitable for a particular professional purpose, or compatible with every file, driver, device, server, or Workshop item.

This section does not exclude or limit any statutory warranty, quality guarantee, refund, repair, replacement, or other consumer remedy that cannot lawfully be excluded.

12. Limitation of Liability

To the extent permitted by applicable law, the Licensor is not responsible for indirect or consequential loss that was not reasonably foreseeable. The Licensor does not use this EULA to exclude or limit liability that law does not allow to be excluded or limited, including applicable liability for fraud, intentional misconduct, gross negligence, death or personal injury, or mandatory consumer obligations.

Any limitation must be interpreted in light of actual loss, risks reasonably foreseeable to the parties, and mandatory law where you live. This EULA does not require you to waive a remedy that law expressly grants and makes non-waivable.

13. Termination

You may stop using and uninstall ECHO Steam at any time. If you materially breach this EULA, the Licensor may terminate the license granted here to the extent permitted by applicable law. Where law requires notice or an opportunity to cure, the Licensor will follow that requirement.

After termination, you must stop using copies of ECHO Steam covered by the terminated license. Non-terminable rights, existing consumer claims, and provisions that by their nature should survive—including ownership, third-party licenses, liability limits, and dispute provisions—remain unaffected. Steam accounts, purchases, and cloud data remain subject to Valve rules.

14. Changes to This EULA

The Licensor may update this EULA for future versions and will identify a new version number and effective date. Material changes affecting your rights or obligations will be presented with reasonable notice and renewed acceptance where law requires. An update will not retroactively change terms governing an existing dispute or reduce mandatory consumer rights.

15. Applicable Law, Severability, and Entire Terms

This EULA is interpreted under the laws applicable to the relationship between you and the Licensor. No choice-of-law or dispute arrangement deprives you of mandatory consumer protection where you live or your right to bring a claim before a court or regulator with mandatory jurisdiction.

If a provision is invalid or unenforceable, it will be limited to the extent permitted by law and the remaining provisions continue in effect. This EULA, the Privacy Policy, third-party licenses, and applicable Steam terms together govern their respective subjects. Conflicts are interpreted according to applicable law, the specific subject of each term, and non-waivable rights.
