This End User License Agreement ("Agreement") is a legal agreement between you and NEXTINDIE Studio ("we," "us," or "our") for the video game Mesozoic Dawn, which includes the game software, associated media, any software updates, and any online services associated with the game (collectively, the "Game").
1. LICENSE GRANT AND RESTRICTIONS Subject to your compliance with this Agreement, NEXTINDIE Studio grants you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the Game for your personal, non-commercial entertainment use on a device that meets the system requirements. You may not:
Reverse engineer, decompile, or disassemble the Game software.
Use unauthorized third-party software, mods, or cheats to interfere with the Game.
Sell, rent, or lease the Game or your Game account for commercial purposes.
Exploit bugs or vulnerabilities to gain unfair advantages.
2. USER CONDUCT AND CONTENT You are responsible for all activities conducted through your account. You agree not to engage in harassment, bullying, or the distribution of illegal content. If the Game allows User-Generated Content (UGC), you retain ownership of your original creations but grant NEXTINDIE Studio a worldwide, perpetual license to use, modify, and distribute such content within the scope of the Game services.
3. VIRTUAL GOODS AND PURCHASES The Game may offer in-app purchases. All purchases are final unless required by local consumer protection laws. Virtual items have no cash value and cannot be exchanged for real currency. Real-money trading of virtual items outside of official systems is strictly prohibited.
4. PLAYER-HOSTED SERVERS Mesozoic Dawn may allow players to host custom servers. Server operators are responsible for maintaining a secure environment and complying with all applicable laws. NEXTINDIE Studio reserves the right to revoke server tokens for any violations.
5. DATA COLLECTION AND PRIVACY By using the Game, you acknowledge that we collect and process personal information (such as account IDs, game progress, and device info) in accordance with our Privacy Policy to provide and improve our services.
6. LIMITATION OF LIABILITY To the maximum extent permitted by law, NEXTINDIE Studio shall not be liable for any service interruptions, device compatibility issues, or disputes between players. Our total liability shall not exceed the amount you paid to us in the past six months.
7. TERMINATION This Agreement is effective until terminated by you or us. Your rights under this license will terminate automatically without notice if you fail to comply with any terms of this Agreement.
8. GOVERNING LAW AND DISPUTE RESOLUTION This Agreement shall be governed by the laws of the Hong Kong Special Administrative Region. Any dispute arising out of this Agreement shall be finally settled by arbitration in Hong Kong in accordance with the Arbitration Rules of the Hong Kong International Arbitration Centre (HKIAC Rules).
