Article 1 (Application)
  1. These Terms set forth the rights and obligations between Hyper Index Inc. (hereinafter referred to as the "Company") and users (hereinafter referred to as the "User") in connection with the use of this game provided by the Company.
  2. The User shall be deemed to have agreed to these Terms and all of the related documents listed below at the time the game is launched.
Article 2 (Definitions)
  1. "Software" refers to all programs, data, images, audio, text, documents, and any other content that constitutes this game.
  2. "User-Generated Content (UGC)" refers to audio, text, images, videos, and any other information input, posted, or transmitted by the User through the functions of this game.
Article 3 (License)
  1. The Company grants the User a non-exclusive, non-transferable, non-sublicensable right to use the Software worldwide, only in accordance with these Terms.
  2. The User shall not engage in any of the following acts:
    1. Reproducing, modifying, adapting, reverse engineering, decompiling, or disassembling the Software or any part thereof
    2. Commercial use (including business use or providing the game for profit at internet cafes), redistribution, sale, or lending
    3. Using cheat tools, macros, BOTs, or exploiting vulnerabilities
    4. Publishing or streaming screenshots, videos, or audio of the Software in a manner that violates the Video Streaming Guidelines
Article 4 (Handling of User-Generated Content)
  1. The User guarantees that UGC will not infringe upon the rights of third parties and will not violate laws or public order and morals.
  2. The User is deemed to have granted the Company a free, non-exclusive right to use UGC (including reproduction, public transmission, translation, modification, and secondary use) for the following purposes:
    • Display, streaming, and advertising within this game and related Company services
    • Introduction in media coverage, official social media, press releases, etc.
    • For audio data, the Company will not use such data unless the User presses the "post" button to submit it, as stipulated in the Privacy Policy
  3. The User agrees not to exercise moral rights of authorship with respect to UGC against the Company or its designees.
Article 5 (Use of External Services)
  1. This game uses external services such as speech recognition SaaS (AmiVoice / Microsoft Azure) and generative AI APIs (OpenAI ChatGPT / Google Gemini).
  2. This game depends on external services (e.g., AmiVoice provided by Advanced Media, Inc., ChatGPT provided by OpenAI, Gemini provided by Google) to operate. Due to specification changes, service termination, malfunctions, server outages, etc., it may become impossible to continue some or all of the game.
  3. The Company assumes no liability for any damages caused by the use of external services. The User shall review and agree to each service’s terms of use and policies before using them.
Article 6 (Prohibited Acts)
The User shall not engage in any act that falls under or may fall under any of the following:
  1. Acts that violate laws or public order and morals
  2. Acts that infringe upon the rights of the Company or third parties
  3. Acts that harm the fairness of the game through unauthorized access, cheats, macros, etc.
  4. Acts that place excessive load on the game’s servers or networks
  5. Excessive use that significantly exceeds the scope of personal use intended by the Company
  6. Acts of harassment, defamation, or threats toward other Users or third parties
  7. Acts involving defamation, discrimination, or sexual/violent expressions that cause discomfort to others
  8. Acts that may adversely affect minors
  9. Acts that violate these Terms, the Video Streaming Guidelines, or other rules established by the Company
  10. Other acts deemed inappropriate by the Company
Article 7 (Accounts)
  1. The User shall manage their Steam account at their own responsibility and shall not transfer, lend, or share it with third parties.
  2. The Company is not responsible for any damages suffered by the User due to account mismanagement, unauthorized use of the device, or use by third parties.
Article 8 (Payments and Refunds)
  1. Purchases of this game, DLC, and additional content shall follow the payment methods and refund policies set by Steam.
  2. If the User is a minor, they must obtain the consent of their legal guardian (such as a parent) before making purchases.
Article 9 (Disclaimer and Warranty Disclaimer)
  1. This game is provided “as is” with no warranty of operation or liability for defects.
  2. The Company shall not be liable for any direct, indirect, special, or consequential damages arising from the User’s use or inability to use this game.
  3. Even if the Company is liable, the scope of such liability shall be limited to the actual purchase price paid by the User for this game.
Article 10 (Suspension, Modification, and Termination of Service)
  1. The Company may suspend, interrupt, or modify all or part of the game without prior notice to Users when necessary for legal compliance, system maintenance, disasters, or other unavoidable reasons.
  2. The Company may terminate this game with prior notice within a reasonable period via Steam News or the store page.
  3. Any features announced as future plans are not guaranteed to be implemented and may be changed or discontinued without notice.
Article 11 (Response to Violations of the Terms)
  1. If the User violates these Terms, the Company may take necessary and appropriate measures, including warnings, functional restrictions, temporary suspension, permanent bans, or legal action, without prior notice.
  2. If the violation causes damage to the Company or third parties, the Company may claim compensation from the User.
Article 12 (Changes to the Terms)
  1. The Company may modify these Terms as necessary. If changes are made, the User will be required to agree to the new Terms when the game is launched.
Article 13 (Governing Law and Jurisdiction)
  1. These Terms shall be governed by the laws of Japan.
  2. If a dispute arises between the Company and the User in connection with this game or these Terms, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.

Regarding AmiVoice Terms of Use
Audio and text sent to AmiVoice may be used by the company for research and quality improvement purposes (see Article 7, Paragraph 2 of the AmiVoice Terms of Use). However, it will not be used in a form that can identify individuals.
3. Purpose of Use
  1. User Input Information, Automatically Collected Information, Multiplayer Audio: To provide, maintain, and improve the Service
  2. User Input Information: For AI to evaluate answers to prompts
  3. Profile: To display ranking functions (publishing player names and scores)
  4. User Input Information, Profile: To introduce outstanding or humorous answers in the "Everyone's Answers" section
  5. Automatically Collected Information: For troubleshooting and prevention of misconduct or misuse
  6. User Input Information: For research and quality improvement by the Company or contractors (e.g., AmiVoice)
  7. Submission Data: To display submitted answers in the answer submission section
4. Third-Party Provision / Contractors
For the purposes stated above, the Company outsources data processing to the following entities. All contractors are selected after confirming they have an adequate personal information protection system, and only the minimum necessary information is transmitted.

5. Information Disclosed by Users
  • "Everyone's Answers"
    Selected answer text will be displayed in-game for all players to view. Audio files will not be published.
  • Ranking
    Player names and scores may be displayed on the ranking screen.
6. Compliance with Laws
The Company complies with the Act on the Protection of Personal Information of Japan (Act No. 57 of 2003, as amended) and other relevant laws and guidelines. For residents of the European Economic Area (EEA), the Company also respects rights under the GDPR.
7. User Rights and Choices
  1. Opt-Out
    If voice input is turned off in the settings, microphone audio will not be transmitted (keyboard input only).
  2. Requests for Disclosure, Correction, or Deletion
    After identity verification, the Company will respond promptly in accordance with laws.
  3. No Use for Advertising Purposes
    The Company does not use collected information for targeted advertising.
8. Retention Period
  • When a game account is deleted, related data will be promptly erased or anonymized (within 90 days at the latest).
  • Logs and crash data will be deleted within 13 months after statistical processing.
9. Information Security
Communication is encrypted with TLS 1.2 or higher, and AWS WAF, etc., is used to prevent unauthorized access. Internal access follows the principle of least privilege.

11. Changes to the Policy
This Policy will be revised as necessary. In the event of significant changes, we will notify users via in-game announcements or on the Company website. Continued use of the Service after revision constitutes agreement to the changes.
