These Terms of Service ("Terms") are an agreement between you and Vincae Ltda. for your access to and use of Madhearts. By installing, launching, accessing, using online features, creating or signing into a Madhearts account, or accepting these Terms in the game or related services, you agree to these Terms and to the Madhearts Privacy Policy.

If you do not agree to these Terms, you must not use Madhearts or its online features. Some features may require you to accept the current versions of these Terms and the Privacy Policy before they are available to you.


Company responsible for Madhearts

Madhearts is developed and operated by Vincae Ltda., a company based in Blumenau, Santa Catarina, Brazil. In these Terms, "Vincae," "we," "us," and "our" refer to Vincae Ltda.

What the Service includes

In these Terms, "Madhearts" and the "Service" mean the Madhearts game and the related services operated by Vincae, including the Madhearts website, game client, accounts, player profiles, gameplay, online features, support, playtests, beta access, updates, and related content or features.

The Service may change over time. Some parts of Madhearts may require an internet connection, a supported device, a supported platform account, and continued access to third-party platform services.


Eligibility

You must be at least 13 years old to use Madhearts online features. Additional age requirements may apply in your country or on the platform you use to access Madhearts. If you are under the age of majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf and is responsible for your use of the Service.

Madhearts accounts

Some parts of Madhearts require a Madhearts account. You may sign in through Steam or another supported platform or authentication provider. When you sign in, we may create or update a Madhearts account linked to your platform account.

Your Madhearts account may include profile, platform, gameplay, progress, and online feature information used to provide the Service, as described in the Madhearts Privacy Policy.

Your account responsibilities

You are responsible for your account activity and must:

• provide accurate information when the Service asks for it;
  
• keep your platform account and login credentials secure;
  
• not sell, rent, share, transfer, or provide access to your account except as allowed by the platform you use;
  
• not impersonate another person, company, player, or member of the Madhearts team;
  
• not use account names, display names, avatars, or profile information that violate these Terms or applicable law;
  
• tell us promptly if you believe your Madhearts account has been compromised.

Free-to-play access

Madhearts is, and will remain, free-to-play. Vincae does not charge a purchase price for the base game. Accessing Madhearts through Steam or another platform does not mean that you buy or own the game, software, account, content, or online services.

Your license

Subject to these Terms and any platform rules that apply to you, Vincae grants you a limited, personal, revocable, non-exclusive, non-transferable license to install, access, and play Madhearts for your personal entertainment.

This license does not give you ownership of Madhearts or any rights not expressly granted in these Terms.

Vincae ownership

Vincae and its licensors own Madhearts, including the game, software, content, audiovisual materials, characters, worlds, names, marks, designs, systems, documentation, and related intellectual property. All rights not expressly granted to you are reserved by Vincae and its licensors.

License restrictions

You must not, except where applicable law gives you a right that cannot be waived:

• copy, sell, rent, sublicense, transfer, distribute, or commercially exploit Madhearts;
  
• modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to derive source code from Madhearts;
  
• bypass, disable, tamper with, or interfere with security, authentication, access controls, rate limits, or platform protections;
  
• use Madhearts to infringe rights, violate law, or harm Vincae, players, platforms, or third parties.

Fair play

Madhearts is built for fair competition and respectful play. You must not use the Service in a way that gives you an unfair advantage, disrupts other players, interferes with the Service, or harms Madhearts, Vincae, platforms, or third parties.

Prohibited conduct

You must not:

• cheat, exploit bugs, abuse unintended behavior, or use unauthorized tools, scripts, bots, automation, modifications, or assists;
  
• tamper with or interfere with the game client, servers, network traffic, accounts, matchmaking, rankings, progression, or online features;
  
• create, use, share, or coordinate accounts to manipulate matchmaking, rankings, progression, restrictions, or fair play, including through alternate accounts, deranking, boosting, or similar behavior;
  
• harass, threaten, abuse, stalk, defame, impersonate, dox, or target other players, Vincae staff, platform staff, or third parties;
  
• use hate speech, discriminatory content, sexually explicit content, illegal content, or other harmful content in names, profiles, communications, or submissions;
  
• attempt to bypass suspensions, bans, platform restrictions, security measures, rate limits, region restrictions, or access controls;
  
• interfere with the Service through attacks, scraping, spam, fraudulent activity, false reports, or other disruptive behavior;
  
• encourage, assist, sell, advertise, or distribute cheats, exploits, unauthorized access, account abuse, or other violations of these Terms.

Reports and enforcement

We may review gameplay, account, platform, service, and report information to protect Madhearts, players, fair play, and the Service. We may act based on player reports, platform signals, automated systems, manual review, or other relevant information available to us.

If we reasonably believe you violated these Terms, platform rules, applicable law, or these fair play rules, we may warn you, restrict features, remove or change content, reset or adjust progress or rankings, suspend or terminate access, block future access, report behavior to a platform, or take other appropriate action.


Your content

You are responsible for content and information that you provide, display, send, or make available through the Service or to Vincae, including profile information, communications, reports, support requests, bug reports, and other materials ("User Content").

You must not provide User Content that violates these Terms, violates applicable law, infringes someone else's rights, contains private or confidential information you are not allowed to share, or is abusive, harmful, misleading, or disruptive.

License to operate the Service

You keep any rights you have in your User Content. By providing User Content, you grant Vincae a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display, transmit, moderate, remove, and otherwise use that User Content as needed to operate, protect, improve, and support Madhearts and the Service. We will use this license only for those purposes.

Feedback

If you send us ideas, suggestions, bug reports, playtest notes, or other feedback about Madhearts, you allow Vincae to use that feedback for any purpose related to Madhearts without payment or obligation to you. This does not give Vincae ownership of unrelated content you created outside the feedback you chose to send us.

Fan content and community creations

We are happy when players create and share content about Madhearts. You may create and share screenshots, videos, livestreams, guides, fan art, edits, memes, and other community creations based on Madhearts, as long as you follow these Terms and make it clear when your work is unofficial. Ordinary platform monetization for videos, livestreams, and social posts is allowed if your content otherwise follows these Terms.

Your community creations must not imply that they are created, approved, sponsored, or endorsed by Vincae unless we say so in writing. They must not be illegal, pornographic, hateful, harassing, deceptive, harmful to others, harmful to Vincae or Madhearts, or used to promote cheats, exploits, account abuse, scams, or other misconduct.

This permission does not transfer ownership of Madhearts or let you sell Madhearts assets, create official-looking products, or use Madhearts names, logos, characters, or other content in a way that confuses people about what is official. We may ask you to change or remove community creations that do not follow these Terms or that create risk for Madhearts, Vincae, players, platforms, or third parties.

Moderation

We may review, remove, restrict, or refuse User Content if we reasonably believe it violates these Terms, platform rules, applicable law, or the safety, integrity, or quality of Madhearts or the Service. Madhearts-related community spaces, including Steam community features, Discord servers, forums, social media, and other public community spaces, may also be governed by their own rules, platform terms, and moderation decisions.


The Madhearts Privacy Policy explains what information we collect, how we use it, how we share it, how long we keep it, and what privacy rights may be available to you. By using Madhearts, you acknowledge that Vincae will process information as described in the Privacy Policy.

Madhearts may use account, platform, gameplay, support, and service information to operate, protect, maintain, analyze, and improve the Service. Online features may require us to process information and share limited information with platforms, service providers, or other trusted parties involved in operating Madhearts.

If you do not want information processed as described in the Privacy Policy, you may not be able to use some or all online features. Privacy requests should be sent using the contact information in the Privacy Policy or this page.


Steam and other platforms

Madhearts may be distributed through Steam and other third-party platforms. Your use of those platforms is governed by their own terms, policies, and account rules, such as the Steam Subscriber Agreement and Steam Privacy Policy.

When Steam or another platform handles installation, access, store pages, launcher, account, social, community, support, or other platform features, that platform's rules apply to that part of your relationship unless applicable law says otherwise. These Terms govern the parts of Madhearts operated by Vincae, including Madhearts accounts, online features, player conduct, game content, support, and enforcement.

Services and links

Madhearts may rely on, integrate with, link to, or be discussed through third-party services, websites, tools, and communities. These may include Discord, social media, hosting providers, analytics providers, support tools, platform services, and other services that Vincae does not own or control.

Third-party services may have their own terms, privacy policies, account rules, community standards, technical requirements, moderation decisions, and availability. Your use of those services is between you and the third party, unless applicable law says otherwise.

Vincae does not control third-party services or content, and linking to or integrating with a third-party service does not mean that Vincae endorses it. Some parts of Madhearts may not work if a required third-party service is unavailable, suspended, changed, or no longer supported.

Claims involving third parties

To the extent permitted by applicable law, you are responsible for third-party claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to:

• your violation of these Terms, platform rules, or applicable law;
  
• your User Content, including claims that it infringes, misappropriates, or violates someone else's rights;
  
• your misuse of Madhearts or the Service;
  
• your cheating, exploit use, unauthorized tools, account abuse, or other unfair or disruptive activity;
  
• your violation of another person's rights or your harm to another person, platform, service provider, or third party.

This responsibility applies only to the extent those claims are caused by you. Nothing in this section requires you to cover Vincae where doing so would be unlawful or would limit rights that cannot be waived under applicable law.


Changes to Madhearts

Madhearts is free-to-play and may change over time at Vincae's discretion. We may patch, update, rebalance, add, remove, suspend, limit, reset, or modify features, content, rules, progression, rankings, modes, regions, servers, technical requirements, and other parts of the Service.

Some changes may happen for design, development, business, operational, technical, legal, platform, security, fair play, or community reasons. Other changes may happen simply because we decide Madhearts should change.

Availability

We work to keep Madhearts available, but we do not guarantee that the Service or every feature, mode, region, platform, server, account-related feature, ranking, support channel, or version will always be available, uninterrupted, secure, or error-free.

Access may be affected by maintenance, outages, technical problems, security issues, platform services, internet connectivity, regional availability, legal requirements, or events outside our control.

Support

Support for Madhearts is provided as a courtesy unless applicable law requires otherwise. We may choose how support is offered, change or stop support channels, prioritize or decline requests, and decide how to respond to issues.

We do not guarantee any response time, resolution, bug fix, account recovery, progress restoration, ranking adjustment, feature restoration, or particular support outcome. We may limit or refuse support for abusive, fraudulent, bad-faith, repetitive, or unrelated requests.

Progress and live operations

We may adjust, reset, correct, or remove account progress, rankings, rewards, records, profile information, match results, or access when needed for fair play, balance, security, operations, bug correction, abuse response, or the integrity of Madhearts.

We may make urgent changes with limited or no advance notice when needed for security, fair play, legal compliance, platform requirements, or service operations.

Ending the Service

We may pause, suspend, or permanently discontinue Madhearts or any part of the Service, including online features, servers, accounts, support channels, supported regions, or supported platforms, at any time, with or without notice, where permitted by law.

Because Madhearts is free-to-play, access to free features does not create a right to continued operation, continued support, or compensation if Madhearts or any part of the Service changes or ends, except where applicable law gives you a right that cannot be waived.


Your choice to stop using Madhearts

You may stop using Madhearts at any time. If you want to request account deletion or exercise privacy rights, use the contact information in the Madhearts Privacy Policy or this page.

Suspension or termination by Vincae

We may suspend, restrict, or terminate your access to some or all of Madhearts if we reasonably believe that you violated these Terms, platform rules, or applicable law, created risk or harm for players, Vincae, platforms, or third parties, or interfered with the safety, integrity, fair play, or operation of the Service.

Access may also be affected if your platform account is unavailable, suspended, terminated, or no longer connected to Madhearts, or if a required platform or third-party service is no longer available or supported.

After access ends

If your access ends, you must stop using the parts of Madhearts you are no longer allowed to access. We may keep certain records or User Content as needed for legal, security, anti-abuse, support, dispute, moderation, platform, or service integrity purposes, as described in the Privacy Policy.

Any parts of these Terms that by their nature should continue after access ends will continue, including ownership, license restrictions, User Content and feedback rights, privacy, disclaimers, limitations of liability, dispute terms, and contact provisions.


To the fullest extent permitted by applicable law, Madhearts and the Service are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory.

Vincae does not promise that Madhearts or the Service, including online features, servers, accounts, matchmaking, rankings, progression, events, support, or content, will be uninterrupted, secure, error-free, compatible with every device or platform, available in every region, or free from loss, delay, corruption, attack, interference, or similar problems.

Vincae does not promise any particular outcome, ranking, reward, progression, match result, matchmaking quality, player experience, availability, performance, or continued support for any feature, mode, platform, region, version, season, event, or content.

Some laws do not allow certain disclaimers or exclusions. Nothing in these Terms limits any consumer rights or other rights that cannot be waived under applicable law. Where a disclaimer is not allowed, it applies only to the maximum extent permitted by law.


To the fullest extent permitted by applicable law, Vincae and its owners, directors, officers, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for lost profits, lost revenue, lost data, lost progress, lost rankings, account loss, service interruption, device or software issues, third-party services, security incidents, or inability to access or use Madhearts or the Service.

To the fullest extent permitted by applicable law, Vincae's total liability for all claims relating to Madhearts, the Service, or these Terms will not exceed USD 50 or the minimum amount required by applicable law, whichever is greater.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, non-waivable consumer rights, or any other liability that cannot be excluded or limited under applicable law.


Informal resolution

If you have a concern or dispute about Madhearts, please contact us first at madhearts@vincae.com so we can try to resolve it informally. If your concern relates to Steam or another platform feature, that platform's support or dispute process may also apply.

Governing law

These Terms and any dispute relating to Madhearts or the Service are governed by the laws of Brazil, excluding conflict-of-law rules, unless applicable law requires otherwise.

Courts

To the extent permitted by applicable law, disputes that cannot be resolved informally will be brought in the competent courts of Blumenau, Santa Catarina, Brazil. This does not limit any mandatory consumer rights or other rights you may have to bring claims in another place or under another law that cannot be waived by contract.


We may update these Terms from time to time. When we do, we will update the "Last updated" date on this page. If we make material changes, we may provide notice through the Madhearts website, the game, a platform, email, an in-service prompt, or another reasonable method.

The updated Terms will apply from the effective date stated in the notice or on this page. Where permitted by law, your continued use of Madhearts or the Service after updated Terms take effect means that you accept the updated Terms.

Some online, account, or platform-connected features may require you to accept the current version of these Terms and the Madhearts Privacy Policy before you can use those features. If you do not agree to updated Terms, you must stop using Madhearts and its online features.


Entire agreement

These Terms, together with the Madhearts Privacy Policy and any additional terms presented for a specific feature, event, playtest, platform, or service, form the agreement between you and Vincae for your use of Madhearts and the Service.

Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part will be enforced to the maximum extent permitted by law, and the rest of these Terms will remain in effect.

No waiver

If Vincae does not enforce a part of these Terms right away, that does not mean Vincae waives the right to enforce it later. Any waiver must be in writing and signed by Vincae to be effective.

Assignment

You may not assign or transfer your rights or obligations under these Terms without Vincae's prior written consent. Vincae may assign or transfer these Terms as part of a merger, acquisition, reorganization, sale of assets, operation of law, or other business transaction, provided that doing so does not reduce any rights you have that cannot be waived under applicable law.

Headings and language

Section headings are for convenience only and do not affect how these Terms are interpreted. These Terms may be translated for convenience. If there is a conflict between translations, the English version controls unless applicable law requires otherwise.
