WILDARIA END USER LICENSE AGREEMENT (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("you" or "Player") and SpaceFudge ("SpaceFudge," "we," "us," or "our"), the developer and publisher of the game Wildaria, including all associated software, art, audio, code, updates, patches, and documentation (collectively, the "Game").
By installing, accessing, or playing the Game, you agree to be bound by this Agreement. If you do not agree, do not install or play the Game.
This Agreement supplements, and does not replace, the Steam Subscriber Agreement (https://store.steampowered.com/subscriber_agreement/) and any other terms imposed by the platform through which you obtained the Game (e.g., Valve/Steam). In the event of a conflict specifically regarding platform purchase, refunds, or account terms, the platform's agreement controls for that subject matter.
1. LICENSE GRANT
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the Game for your personal, non-commercial entertainment use. The Game is licensed, not sold, to you. We and our licensors retain all right, title, and interest in and to the Game, including all intellectual property rights.
You may not:
- Copy, redistribute, sell, rent, lease, sublicense, or commercially exploit the Game or any part of it
- Reverse engineer, decompile, or disassemble the Game, except to the extent such restriction is expressly prohibited by applicable law
- Remove or alter any copyright, trademark, or proprietary notices
- Use the Game to create a competing product, or extract assets for use outside the Game without written permission
2. EARLY ACCESS / WORK-IN-PROGRESS NOTICE
Wildaria is an Early Access title. It is an incomplete, actively-developed work in progress. By playing, you specifically acknowledge and agree that:
- The Game may contain bugs, glitches, unfinished features, missing content, and placeholder art or systems
- Features, mechanics, balance, pricing, biomes, pets, bosses, and content described on the Steam store page or elsewhere are planned, not guaranteed, and may change, be delayed, or be removed entirely at our sole discretion
- The Game's price may increase as content is added during Early Access, as disclosed on the Steam store page
- There is no guarantee that Wildaria will reach a "1.0" or full release, or that any specific feature (including multiplayer) will ship, although that is our current intention
- Save data, characters, procedurally generated worlds, and progress may be reset, corrupted, or lost as a result of updates, migrations, or changes to world-generation systems during Early Access, and we are not liable for such loss
If you are not comfortable with these risks, you should wait for a later, more complete version of the Game before purchasing.
3. "AS IS" — NO WARRANTY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.
Nothing in this section limits any consumer protection rights you may have under the mandatory law of your country of residence that cannot be excluded by agreement.
4. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SPACEFUDGE, ITS OWNERS, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, SAVE FILES, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE GAME, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT ANY LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THIS AGREEMENT OR THE GAME SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE GAME IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
5. PROCEDURALLY GENERATED CONTENT
Wildaria generates worlds, biomes, and certain in-game content algorithmically. You acknowledge that:
- Procedurally generated content is created by our software systems and is owned by us, not co-authored by you, even though your inputs (seed choices, exploration, taming decisions) may influence the specific output you see
- We do not guarantee that any specific generated world, layout, or content will remain accessible, unchanged, or reproducible across updates
6. COMMUNITY CONTENT, FEEDBACK, AND SUGGESTIONS
Wildaria's development is community-driven through our Discord and other community channels. If you submit feedback, bug reports, balance suggestions, feature ideas, fan art, or other content to us through Discord, Steam discussions, social media, or any other channel ("Feedback"):
- You grant us a perpetual, worldwide, royalty-free, irrevocable, sublicensable license to use, modify, and incorporate that Feedback into the Game and related materials without payment, credit, or further obligation to you
- You confirm the Feedback is your own original contribution and does not infringe any third party's rights
- You understand that we may already be independently developing similar ideas, and submitting Feedback does not entitle you to compensation, credit, or ownership of any resulting feature
7. USER-GENERATED CONTENT (CHARACTER NAMES, CUSTOM CONTENT)
If the Game allows you to create or input content (character names, chat messages, custom text, etc.), you agree not to submit content that is unlawful, infringing, harassing, or that impersonates others. We reserve the right to remove or restrict such content and, in the case of online/multiplayer features, to suspend accounts that abuse this.
8. THIRD-PARTY SERVICES
The Game is distributed via Steam and relies on Valve's Steamworks platform (achievements, cloud saves, multiplayer matchmaking if/when implemented), and community discussion happens via Discord. Your use of those platforms is governed by their own terms and privacy policies, which we do not control:

9. MULTIPLAYER & ONLINE FEATURES (FUTURE)
If and when online/multiplayer features are added, additional terms may apply (e.g., an acceptable use policy, code of conduct, and separate privacy disclosures for any data transmitted). We will update this Agreement or provide supplemental terms at that time.
10. PRIVACY
SpaceFudge does not directly collect personal data from you through the Game. Some information (such as your Steam ID, playtime, and achievement progress) may be processed by Valve/Steam as part of the Steamworks platform in order to run cloud saves, achievements, and store functionality — that collection is governed by Valve's own Privacy Policy (https://store.steampowered.com/privacy_agreement/), not by SpaceFudge. If this changes in the future (for example, if we add analytics, accounts, or newsletter signup), we will update this section and publish a separate Privacy Policy at that time.
11. CONTENT NOTICE
Wildaria features stylized combat against wildlife and fantasy creatures, including boss-scale "animal gods," within a pixel-art fantasy setting. It is not intended to depict or promote real-world animal cruelty. Content descriptor: Fantasy Violence.
12. TERMINATION
We may suspend or terminate your license to use the Game if you materially breach this Agreement (for example, through unauthorized redistribution, cheating in online features, or abusive conduct toward the community). Sections 3, 4, 5, 6, and 13 survive termination.
13. GOVERNING LAW & DISPUTES
This Agreement is governed by the laws of the State of California, USA, without regard to conflict-of-law principles.
14. CHANGES TO THIS AGREEMENT
We may update this Agreement as the Game evolves during and after Early Access. Continued use of the Game after changes are posted constitutes acceptance of the revised Agreement. We'll update the "Last Updated" date above when changes are made.
