END USER LICENSE AGREEMENT (EULA) AND MULTIPLAYER REGULATIONS FOR "SIMRAIL - THE RAILWAY SIMULATOR" ON STEAM

This End User License Agreement ("EULA") is a legally binding agreement between you, the end user ("User"), and SimRail S.A. ("Developer"), regarding the use of "SimRail - The Railway Simulator" ("Game") purchased on the Steam platform. Before installing, accessing, copying, or using the Game, please read the following terms carefully. By installing, copying, or otherwise accessing the Game, you agree to abide by all the terms of this Agreement as well as the terms of service of the Steam platform.

1. LICENSE
1.1. Grant of License: The Developer grants the User a non-exclusive, non-transferable license to install and use "SimRail - The Railway Simulator" on one or more devices in accordance with the purchase terms on the Steam platform, solely for personal, non-commercial use.

1.2. Scope of EULA: This EULA applies to all DLCs and any content added to the Game by the Developer. Use of such DLCs and content is subject to the same terms as the base Game.

1.3. License Restrictions: The User may not:
-copy, modify, distribute, sell, sublicense, decompile, reverse-engineer, or otherwise exploit the Game, DLCs, or any content added by the Developer, except as expressly permitted by applicable law,
-use the Game in any way that infringes applicable law or the rights of third parties,
-rent, lease, or sublicense the Game.

1.4. Steam Policies:
Use of the Game, DLCs, and any content added by the Developer is also subject to the Steam platform's terms of service. The User must comply with both this EULA and Steam's policies, available at: https://store.steampowered.com/.

2. INTELLECTUAL PROPERTY
2.1. All copyright and other intellectual property rights in the Game, DLCs, and all copies and content added by the Developer are owned by the Developer or its licensors. All rights not expressly granted to the User under this Agreement are reserved by the Developer.

3. MULTIPLAYER REGULATIONS
3.1. Access to Multiplayer Mode: To access the multiplayer mode in "SimRail - The Railway Simulator", the User must have a valid Steam account and log in using that account. This account is required for authorization, synchronization, and maintaining online gameplay security.

3.2. User Behavior: When using the multiplayer mode, the User agrees to adhere to the following rules:
-No use of obscene, offensive, hateful, racist, or discriminatory language or behavior.
-No engagement in any form of cheating, exploits, hacking, or other dishonest activities.
-No spamming, excessive repetition of messages, or actions that may obstruct other players' enjoyment of the Game, particularly intentional disruption of railway traffic in the game, blocking communication channels, or actions inconsistent with the game’s included tutorials on railway operations.
-No impersonation of Developer staff or other players.
-No use of nicknames that are offensive, vulgar, or otherwise related to totalitarian regimes.
-No actions or behaviors that violate Polish law or the law of the country where the game is distributed.
-Users are required to comply with the instructions of moderators who call for adherence to the rules and proper conduct in the multiplayer mode.

3.3. Consequences of Violations:
In case of violation of any of the provisions of these Multiplayer Regulations, the Developer reserves the right to impose penalties, including temporary or permanent suspension of accounts, loss of access to multiplayer mode or other game features, and reporting violations to Steam, which may result in additional sanctions imposed by Steam. The Developer also reserves the right to report any illegal activities of Users to the appropriate law enforcement authorities.

4. UPDATES AND CHANGES TO THE GAME
4.1. The Developer reserves the right to provide updates, patches, and other changes to "SimRail - The Railway Simulator" at any time. Updates may be automatically installed by the Steam platform without additional notice to the User.

5. LIABILITY AND WARRANTY
5.1. The Game is provided "as is". The Developer makes no express or implied warranties regarding the operation of "SimRail - The Railway Simulator", its reliability, fitness for a particular purpose, accuracy, or availability.

5.2. To the maximum extent permitted by applicable law, the Developer shall not be liable for any damages arising from the use or inability to use the Game, including direct, indirect, incidental, or consequential damages. This also applies to damages resulting from issues related to the Steam platform.

6. FINAL PROVISIONS
6.1. This EULA is governed by Polish law, and any disputes will be resolved by the courts competent for the Developer’s registered office.

6.2. If any provision of this Agreement is found to be invalid, the remaining provisions will remain in effect.

6.3. Matters Not Covered by EULA: Any matters not addressed in this EULA will be resolved in accordance with Steam’s regulations and applicable Polish law.

By accepting this EULA, the User confirms that they have read, understood, and agree to all the terms contained in this Agreement, as well as the Steam platform's policies.
