STEMMIES / CELL SPLITTERS 2
END USER LICENSE AGREEMENT
Also covering the Titan Engine, Neural Core DLC, and related online servicesEffective Date: September 19, 2026
Last Updated: September 19, 2026
READ THIS AGREEMENT CAREFULLY. This End User License Agreement (the "EULA" or "Agreement") is a legally binding contract between you ("you," "your," or "User") and Skyboard Studios / Lenn Dolling ("Developer," "we," "us," or "our") governing your download, installation, access, and use of the software products branded Stemmies and/or Cell Splitters 2, the underlying Titan Engine, any downloadable content (including the optional "Neural Core" DLC), patches, updates, tools, documentation, and related online features (collectively, the "Software").
BY INSTALLING, COPYING, ACCESSING, LAUNCHING, OR OTHERWISE USING THE SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS EULA AND THE STEAM SUBSCRIBER AGREEMENT. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE SOFTWARE, AND UNINSTALL IT IMMEDIATELY.
THIS SOFTWARE IS LICENSED, NOT SOLD. You acquire no ownership of the Software. You receive only the limited license described below.
1. ACCEPTANCE; RELATIONSHIP TO STEAM; CONSUMER RIGHTS
1.1 Acceptance. You accept this EULA by (a) clicking "Accept," "I Agree," or a similar control; (b) installing or launching the Software; or (c) otherwise using the Software.
1.2 Steam Subscriber Agreement. The Software is distributed through Valve Corporation's Steam platform. Your use of Steam, your Steam account, purchases, refunds, billing, entitlements, and platform-level features is also governed by the Steam Subscriber Agreement ("SSA") and Valve's applicable policies. If there is a conflict between this EULA and the SSA regarding Steam accounts, billing, refunds, or platform entitlements, the SSA controls those Steam matters. This EULA controls the license to the Software itself and your conduct in connection with the Software.
1.3 Intended third-party beneficiaries. Valve Corporation and its affiliates ("Valve" or "Steam"), operating-system vendors, hardware vendors, and the open-source and third-party licensors identified in Section 10 are intended third-party beneficiaries of the disclaimers, limitations of liability, restrictions, and indemnities in this EULA to the extent those provisions protect them. You agree not to bring any claim against Valve arising out of the Software except as the SSA independently permits against Valve for Steam platform services.
1.4 Non-waivable rights. This EULA applies to the maximum extent permitted by applicable law. Nothing in this EULA excludes, restricts, or modifies any non-waivable consumer, statutory, or other right that cannot lawfully be limited in your jurisdiction (including, where applicable, rights under Australian Consumer Law, UK/EU consumer law, Quebec consumer law, or similar statutes). Where a limitation is unenforceable, it is enforced to the maximum lawful extent and the remainder of this EULA continues in force.
1.5 Capacity. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization. If you lack legal capacity to contract, you may not use the Software.
2. ELIGIBILITY AND AGE
2.1 You must meet Steam's age requirements and any age rating displayed for the Software on Steam. If you are under the age of majority in your jurisdiction, you may use the Software only with the consent and supervision of a parent or legal guardian who agrees to this EULA on your behalf and is responsible for your use.
2.2 You represent that you are not prohibited from receiving or using the Software under the export, sanctions, or other laws of any applicable jurisdiction, and that you are not located in a comprehensively sanctioned country or on a restricted-party list.
3. GRANT OF LICENSE
3.1 Limited license. Subject to your continuous compliance with this EULA and the SSA, Developer grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use one (1) copy of the Software on devices you own or control, solely for your personal, non-commercial entertainment purposes, and solely through a legitimate Steam entitlement associated with your account.
3.2 Copies. You may make one backup copy solely for archival purposes, provided the backup remains in your possession and is not used concurrently with the installed copy except as Steam's client technically requires.
3.3 No other rights. All rights not expressly granted are reserved by Developer and its licensors. There is no implied license by estoppel, exhaustion beyond applicable law, or otherwise.
3.4 Virtual items and DLC. Any in-game items, currency, progression, leaderboard standings, DLC, or similar features are licensed, have no real-world cash value, are not redeemable for money, and may be modified, rebalanced, or withdrawn. Purchases are processed by Steam under the SSA.
4. OWNERSHIP AND INTELLECTUAL PROPERTY
4.1 The Software, Titan Engine, names, logos, characters, art, audio, code, data, documentation, and all copies are and remain the exclusive property of Developer and its licensors. This includes all copyrights, trademarks, trade dress, trade secrets, patents, and other intellectual property.
4.2 You will not remove, obscure, or alter proprietary notices. You will not register or use any mark, domain, social handle, or store page that is confusingly similar to "Stemmies," "Cell Splitters," "Titan Engine," "Neural Core," "Skyboard Studios," or related marks.
4.3 Feedback. If you provide ideas, suggestions, or bug reports, you grant Developer a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose without compensation or attribution.
5. LICENSE RESTRICTIONS
Except as expressly permitted by this EULA or by non-waivable law, you shall not, and shall not permit any third party to:
- copy, distribute, publicly display, rent, lease, lend, sell, resell, sublicense, or commercially exploit the Software or any of its assets;
- reverse engineer, decompile, disassemble, translate, or otherwise attempt to derive source code, underlying ideas, or data formats from the Software, except to the limited extent that applicable law expressly prohibits this restriction;
- modify, adapt, or create derivative works of the Software except through official in-game tools provided for User-Generated Content;
- circumvent, disable, or interfere with copy protection, Steamworks, anti-cheat, authentication, matchmaking, economy, or other technical measures;
- use cheats, exploits, bots, automation, packet sniffers, memory editors, or unauthorized third-party software that interacts with the Software;
- host, emulate, or intercept the Software's network protocols, sidecar server, or master servers except as the Software itself locally requires for normal play;
- use the Software to develop, train, fine-tune, evaluate, or improve any machine-learning or generative-AI model, dataset, or service, other than running the Software's own bundled local models as intended;
- extract, scrape, or harvest assets, neural weights, voice models, market data, or player data for use outside the Software;
- use the Software, its simulations, or its outputs as a medical device, clinical tool, laboratory instrument, educational credential, scientific authority, or substitute for professional advice;
- use the Software for any unlawful purpose, or to create, store, transmit, or share content that is illegal, infringing, defamatory, or that exploits minors;
- impersonate Developer, Valve, or any other person, or misrepresent your affiliation; or
- use the Software on a network or service bureau basis for third parties, or in any commercial production, research-for-hire, or institutional setting without a separate written license from Developer.
Any attempt to do the foregoing automatically voids the license to the maximum extent permitted by law.
6. BACKGROUND PROCESSES AND LOCAL NETWORKING (SIDECAR SERVER)
6.1 To provide authoritative lock-free physics, Entity Component Systems (ECS), and secure matchmaking, the Software may launch a localized background server process (for example, Stemmies.exe or a Go backend) concurrently with the game client.
6.2 By installing or playing the Software, you consent to that process running on your hardware. You acknowledge that it requires local network access (including WebSockets and/or UDP) and may cause your operating system or firewall to prompt for permission. Granting or denying that permission is your responsibility. If you deny it, some or all features may fail, and that is not a defect entitling you to a claim against Developer or Valve.
6.3 The background process is intended to terminate when the Software is closed. You are responsible for ending any orphaned process through ordinary operating-system tools if it does not. Developer is not liable for firewall configuration, antivirus false positives, port conflicts, or other local-environment issues.
6.4 You will not expose the sidecar process to untrusted public networks, reverse its protocol, or use it as a general-purpose server for third-party software.
7. ARTIFICIAL INTELLIGENCE AND GENERATIVE CONTENT
7.1 Certain features, including the optional Neural Core DLC, use local artificial intelligence, small language models, speech models, and/or generative visual or audio models executing on your hardware to produce text, audio, images, or other content in real time ("AI Output").
7.2 Unpredictability and no control. Because inference runs locally on your hardware from probabilistic models, Developer cannot predict, review, filter, or control AI Output in every case. AI Output may be inaccurate, offensive, inconsistent with lore, biased, incomplete, or nonsensical. YOU USE AI FEATURES AND AI OUTPUT ENTIRELY AT YOUR OWN RISK.
7.3 No professional or scientific advice. AI Output is entertainment only. It is not medical, legal, financial, scientific, educational, or professional advice. You must not rely on it as a source of truth or as a substitute for a qualified professional or validated scientific method.
7.4 Your inputs and your liability. You are solely responsible for prompts, settings, scenarios, and other inputs you provide, and for every subsequent use, publication, or reliance on AI Output. You will not input personal data of others, confidential information, or content you do not have the right to use.
7.5 RAIL-M and other model restrictions. Generative visual subsystems may use derivative models of Stable Diffusion or similar models released under the CreativeML Open RAIL-M license or a successor OpenRAIL license. By using those subsystems you agree to comply with that license's use-based restrictions, including that you will not use the models or their derivatives:
- in any way that violates applicable law;
- to exploit, harm, or attempt to exploit or harm minors;
- to generate or disseminate verifiably false information with the purpose of harming others;
- to generate or disseminate personal information that can be used to harm an individual;
- for defamation, harassment, or discrimination;
- to fully automate decisions that legally or similarly affect a person;
- to exploit vulnerabilities of a specific group to cause physical or psychological harm;
- to provide medical advice or interpret medical results; or
- for any other restricted use listed in Attachment A of the applicable RAIL-M / OpenRAIL license.
You assume all liability for output generated via these neural weights on your local hardware. Developer does not claim ownership of raw AI Output solely generated by you, but also assumes no responsibility for it.
7.6 Additional model licenses. Local neural weights may include Llama 3.2 (Meta Llama Community License), Hermes 3 (Nous Research), Stable Audio (Stability AI Community License), Piper TTS voice models (including en_US-hfc_female-medium under CC-BY-SA-4.0), and other models listed in Section 10. You must comply with each applicable license. Where a model license is more restrictive than this EULA, the model license controls your use of that model.
7.7 No Developer indemnity for AI. Developer will not defend or indemnify you for any claim arising from AI Output, model weights, prompts, or your use of generative features.
7.8 Deepfakes and likeness. You will not use the Software to create non-consensual intimate imagery, to impersonate a real person in a misleading way, or to generate content that violates publicity, privacy, or personality rights.
8. ENTERTAINMENT SIMULATION; NO SCIENTIFIC OR MEDICAL USE
8.1 The Software depicts stylized, fictional, and/or simplified biological, molecular, cellular, economic, and physical systems for entertainment. Nothing in the Software is a scientific instrument, laboratory protocol, curriculum, clinical decision tool, or representation of real-world biological safety.
8.2 You will not treat in-game "cells," "molecules," "scenarios," market data, or generated architectures as accurate models of living systems, pathogens, chemistry, or economics. You will not use the Software to design, test, manufacture, or deploy real-world biological, chemical, or medical interventions.
8.3 DEVELOPER DISCLAIMS ALL LIABILITY FOR ANY REAL-WORLD ACT, OMISSION, INJURY, LOSS, REGULATORY VIOLATION, OR DAMAGE ARISING FROM RELIANCE ON, OR MISUSE OF, THE SOFTWARE, ITS SIMULATIONS, OR ITS OUTPUTS.
9. TELEMETRY, ONLINE FEATURES, AND CONNECTIVITY
9.1 Certain features require an internet connection and a valid Steam session, including synchronization of global market data (including any ATP economy), player statistics, Steamworks leaderboards, matchmaking, and anti-abuse systems with master servers (including servers Developer may describe as Vanguard or equivalent).
9.2 Developer may collect and process non-personally identifying or limited technical telemetry concerning performance, crashes, economy interactions, scenario completion, asset utilization, cheat signals, and connection quality, for stability, balancing, fraud prevention, and service operation. Where personal data is processed, it will be handled in accordance with Developer's privacy notice (if published) and applicable law, and in coordination with Steam's Privacy Policy for platform data.
9.3 Online features are not guaranteed. Servers may be interrupted, rate-limited, relocated, or discontinued. Developer has no obligation to operate online services for any period. Loss of online features is not a basis for damages against Developer.
9.4 You will not manipulate markets, leaderboards, statistics, or matchmaking, including through alternate accounts, collusion, packet tampering, or automation.
10. THIRD-PARTY AND OPEN-SOURCE COMPONENTS
10.1 This software utilizes open-source libraries, neural weights, and technologies. We gratefully acknowledge the developers, researchers, and open-source communities who made them possible. Those components are licensed to you under their own terms, which are incorporated by reference. Acknowledgments include, without limitation:

Acoustic Cortex (Stable Audio 3)
Environmental audio synthesis is powered by Stable Audio 3.0, distributed under the Stability AI Community License.
10.2 Third-party components are provided "AS IS" by their authors. Developer is not obligated to provide support for them. Nothing in this EULA limits rights you may have under an OSI-approved open-source license in the corresponding open-source files themselves; however, those rights do not extend to Developer's proprietary game content, brands, or assets.
10.3 Steamworks and related Valve technologies are licensed or made available under Valve's terms, not this EULA.
11. USER-GENERATED CONTENT
11.1 The Software may allow you to create, export, upload, or share custom biological scenarios, molecular structures, architectures, text, audio, images, mods, or other materials ("UGC").
11.2 You retain whatever ownership you lawfully have in your UGC. You grant Developer a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, sublicensable license to host, reproduce, adapt, moderate, promote, distribute, publicly perform and display, and otherwise use your UGC in connection with the Software and Developer's business, without further notice or compensation.
11.3 You represent and warrant that you have all rights needed to grant that license; that your UGC does not infringe any third-party right; that it does not contain illegal, harmful, or RAIL-M-prohibited material; and that it does not include personal data of others without a lawful basis.
11.4 Developer has no duty to monitor UGC, and may remove, disable, or refuse UGC at any time for any reason. Developer does not endorse UGC and is not liable for it.
11.5 Steam Workshop or similar platform hosting, if used, is also subject to Valve's Workshop and SSA terms.
12. UPDATES, PATCHES, AND CHANGES TO TERMS
12.1 Developer may provide patches, hotfixes, content updates, rebalances, or mandatory updates. You authorize Steam and the Software to download and install them. Some updates may be required to continue playing.
12.2 Developer may modify this EULA. Material changes will be presented through Steam EULA acceptance, an in-game notice, or a store page update. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using and uninstall the Software. Changes do not apply retroactively to disputes already pending except as law requires.
13. ASSUMPTION OF RISK; YOUR HARDWARE AND ENVIRONMENT
You assume all risk of: hardware or software incompatibility; heat, power, or performance impact from local AI inference or physics simulation; data loss; eye strain or other ordinary use effects; your network and firewall configuration; third-party antivirus or overlay software; and any decision you make based on the Software. You are responsible for backing up your data and for maintaining adequate hardware cooling and electrical safety.
14. DISCLAIMER OF WARRANTIES
14.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE, ONLINE SERVICES, AI FEATURES, UGC TOOLS, SIDECAR PROCESSES, DOCUMENTATION, AND ALL RELATED MATERIALS ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
14.2 DEVELOPER AND ITS LICENSORS, AND VALVE TO THE EXTENT PERMITTED BY THE SSA, DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
14.3 DEVELOPER DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, SECURE, UNINTERRUPTED, COMPATIBLE WITH YOUR HARDWARE, FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED, OR THAT AI OUTPUT OR SIMULATIONS WILL BE ACCURATE, APPROPRIATE, OR FIT FOR ANY REAL-WORLD USE.
14.4 Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions apply only to the fullest extent permitted, and any implied warranty that cannot be excluded is limited to the shorter of ninety (90) days or the minimum period required by law.
15. LIMITATION OF LIABILITY
15.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEVELOPER, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, SUCCESSORS, LICENSORS, OR VALVE (COLLECTIVELY, THE "PROTECTED PARTIES") BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES; OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, DATA USE, BUSINESS, OR ANTICIPATED SAVINGS; OR COST OF SUBSTITUTE GOODS OR SERVICES; OR DAMAGES ARISING FROM PERSONAL INJURY TO THE EXTENT DISCLAIMABLE; WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
15.2 WITHOUT LIMITING SECTION 15.1, THE PROTECTED PARTIES SHALL HAVE NO LIABILITY FOR: (A) YOUR MISUSE OF THE SOFTWARE; (B) ANY ILLEGAL, HARMFUL, OR UNAUTHORIZED ACT BY YOU OR ANY THIRD PARTY; (C) AI OUTPUT OR YOUR RELIANCE ON IT; (D) UGC CREATED BY YOU OR OTHER USERS; (E) SERVER OUTAGES, MARKET MANIPULATION BY THIRD PARTIES, OR DISCONTINUATION OF ONLINE FEATURES; (F) THIRD-PARTY COMPONENTS, MODELS, OR LICENSES; (G) FIREWALL, NETWORK, OR OPERATING-SYSTEM PROMPTS OR FAILURES; (H) LOSS OF SAVE DATA, RANK, ITEMS, OR ECONOMY BALANCE; OR (I) ANY CLAIM THAT THE SOFTWARE SHOULD HAVE PREVENTED YOU FROM HARMING YOURSELF OR OTHERS.
15.3 TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE PROTECTED PARTIES ARISING OUT OF OR RELATING TO THE SOFTWARE OR THIS EULA SHALL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU ACTUALLY PAID TO STEAM FOR THE SPECIFIC SOFTWARE PRODUCT GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE CLAIM, OR (II) TEN UNITED STATES DOLLARS (US $10.00). IF YOU OBTAINED THE SOFTWARE AT NO CHARGE, THE CAP IS US $10.00.
15.4 The limitations in this Section allocate risk between the parties and are a fundamental basis of the bargain. Developer would not license the Software on these terms without them.
15.5 Nothing in this EULA limits liability that cannot be limited under applicable law, including (where such a limit is prohibited) liability for fraud, fraudulent misrepresentation, or death or personal injury caused by gross negligence or willful misconduct.
16. INDEMNIFICATION (YOUR RESPONSIBILITY FOR MISUSE)
16.1 To the maximum extent permitted by law, you will defend, indemnify, and hold harmless the Protected Parties from and against any and all claims, demands, actions, damages, losses, costs, fines, and expenses (including reasonable attorneys' fees) arising out of or related to:
- your use or misuse of the Software, sidecar processes, online features, or AI features;
- your UGC, prompts, inputs, or AI Output, including any allegation that they are illegal, infringing, defamatory, unsafe, or non-consensual;
- your violation of this EULA, the SSA, a third-party or open-source license (including RAIL-M / OpenRAIL, Meta Llama, Stability AI, or CC-BY-SA terms), or any law;
- your attempt to treat the Software as a scientific, medical, or professional tool;
- your circumvention of technical measures, cheating, market manipulation, or unauthorized server access; and
- any claim by a third party whose rights you allegedly violated.
16.2 Developer may assume exclusive defense of any indemnified matter at your expense. You will reasonably cooperate. You will not settle a claim imposing any obligation on a Protected Party without that party's prior written consent.
16.3 If you are a consumer in a jurisdiction that restricts indemnities against consumers, this Section applies only to the extent permitted (for example, to losses caused by your willful misconduct, your UGC, or your violation of law).
17. TERM AND TERMINATION
17.1 This EULA is effective from acceptance until terminated.
17.2 You may terminate at any time by permanently uninstalling the Software and destroying all copies in your possession.
17.3 Developer may suspend or terminate the license immediately if you materially breach this EULA, cheat, infringe intellectual property, threaten the integrity of online services, or as otherwise permitted by law or the SSA. Developer may also terminate if it withdraws the Software from distribution, subject to any non-waivable rights you have in a paid copy already lawfully obtained.
17.4 Upon termination the license ends and you must cease all use and destroy copies. Sections that by their nature should survive (including 4, 5, 7-11, and 13-22) survive termination.
17.5 Refunds, if any, are solely as provided by Steam under the SSA and Steam refund policy. Developer is not independently obligated to refund except where non-waivable law requires.
18. EXPORT, SANCTIONS, AND GOVERNMENT RIGHTS
You will comply with all export, import, and sanctions laws. You will not export, re-export, or provide the Software to prohibited countries, entities, or persons. If you are a U.S. government end user, the Software is "commercial computer software" and "commercial computer software documentation" provided with only those rights set forth in this EULA, consistent with FAR 12.212 and DFARS 227.7202.
19. PRIVACY
Developer processes limited data as described in Section 9. Steam processes account and purchase data under Valve's Privacy Policy. Do not submit sensitive personal data through UGC or AI prompts. Where GDPR, UK GDPR, PIPEDA, CCPA/CPRA, or similar laws apply, you may have rights of access, correction, deletion, or objection, which you may exercise by contacting Developer at the notice address below, and, for Steam account data, through Steam's tools.
20. DISPUTE RESOLUTION; GOVERNING LAW
20.1 Governing law. Except where prohibited by non-waivable consumer law of your country of residence, this EULA and any dispute arising out of it or the Software are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
20.2 Venue. Except where prohibited, the courts located in Vancouver, British Columbia, Canada shall have exclusive jurisdiction. Consumers in the EEA, UK, Australia, and other jurisdictions that grant a mandatory right to sue in the consumer's home courts may bring proceedings in those courts to the extent that right cannot be waived.
20.3 Informal resolution. Before filing a claim against Developer, you agree to contact Developer and attempt in good faith to resolve the dispute informally for thirty (30) days.
20.4 Individual claims. To the maximum extent permitted by law, you and Developer agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim must be severed and proceed in court, and the remainder of this Section continues.
20.5 Injunctive relief. Nothing in this Section limits Developer's right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property or the integrity of online services.
20.6 Limitation period. To the maximum extent permitted by applicable law, any claim arising out of or relating to this EULA or the Software must be filed within one (1) year after the claim accrues, or within the minimum period required by non-waivable law if that period cannot be shortened.
21. MISCELLANEOUS
21.1 Entire agreement. This EULA, together with the SSA as it applies to Steam matters and any official privacy notice, is the entire agreement between you and Developer regarding the Software and supersedes prior or contemporaneous communications on that subject.
21.2 Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable. If modification is not possible, it will be severed. The remaining provisions continue in full force.
21.3 Waiver. Failure to enforce a provision is not a waiver. Waivers must be in writing to be effective.
21.4 Assignment. You may not assign this EULA. Developer may assign it to an affiliate or successor. Any attempted assignment by you is void.
21.5 No third-party beneficiaries except as expressly stated for the Protected Parties in Sections 1.3 and 15-16.
21.6 Force majeure. Developer is not liable for delay or failure caused by events beyond reasonable control, including infrastructure failures, labor disputes, cyberattacks, utility failures, or legal changes.
21.7 Language. The controlling language of this EULA is English. Any translation is for convenience only.
21.8 Headings are for convenience only and do not affect interpretation.
21.9 Notices. Developer may notify you via Steam overlay, store page, in-game message, or the email associated with your Steam account. You may notify Developer at:
