END USER LICENSE AGREEMENT FOR STEAM DECK® IMAGE

THIS END USER LICENSE AGREEMENT (“AGREEMENT”) IS ENTERED INTO BETWEEN VALVE CORPORATION (“VALVE”) AND THE CUSTOMER THAT ACCEPTED THIS AGREEMENT (“YOU”). YOU SHOULD CAREFULLY READ THIS AGREEMENT BEFORE INSTALLING THE SOFTWARE INCLUDED IN THIS IMAGE. THIS AGREEMENT CONTAINS IMPORTANT TERMS THAT AFFECT YOUR LEGAL RIGHTS. BY CLICKING THE BUTTON OR INSTALLING ANY SOFTWARE FROM THE STEAM DECK IMAGE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, PLEASE DO NOT INSTALL THE SOFTWARE.

The Steam Deck image is comprised of the Steam Operating System ("SteamOS") and the Steam Client. SteamOS is a collection of various pieces of software, including operating system executable code, embedded software, firmware, fonts, and data, including any updates. SteamOS includes free and open source software ("FOSS") as well as third party software subject to proprietary licenses. A list of SteamOS packages along with their respective FOSS or proprietary licenses as well as source code for FOSS packages can be found at https://gitlab.steamos.cloud/.

The Steam Client is proprietary to Valve. Installation and use of the Steam Client is subject to the terms below:

1. Steam Client License and Restrictions

In the Steam Deck image, Steam Client is the primary user interface of SteamOS and provides functionality to interact with Steam content and services. Steam Client is the copyrighted work of Valve or its suppliers. All rights are reserved, except as expressly stated herein. Steam Client is provided by Valve solely for installation by end users according to the terms of this Agreement. All use of Steam Client and Steam content and services is governed by the terms of the Steam Subscriber Agreement located at www.steampowered.com/agreement (the "SSA"), as such terms may be updated from time to time, which terms are incorporated into this Agreement by this reference. Any use, reproduction or redistribution of Steam Client not in accordance with the terms of the Agreement and the SSA is expressly prohibited.

1.1 License Grant. Valve hereby grants, and by installing Steam Client you hereby accept, a limited, non-exclusive, non-redistributable, non-sublicenseable license to install and use Steam Client on your computers solely for your personal use.

1.2 Restrictions. You may not, in whole or in part: (a) copy, reproduce, translate, reverse engineer (unless expressly permitted by law), derive source code from, modify, disassemble, decompile, or create derivative works from Steam Client; (b) remove any proprietary notices or labels on Steam Client; (c) publicly display, license, sell, grant a security interest in, rent, lease or redistribute Steam Client; or (d) attempt in any manner to circumvent any security measures designed to control access to Steam Client. Any redistribution of Steam Client, including packaging Steam Client with or pre-installing Steam Client on hardware, is prohibited without first obtaining a separate license from Valve. Steam Client is licensed to you as a single product. Its component parts may not be separated for use on more than one computer.

1.3 Ownership; Reservation of Rights. All title, ownership rights and intellectual property rights in and to Steam Client and any and all copies thereof (including but not limited to any titles, computer code, themes, objects, characters, character names, stories, dialog, catch phrases, locations, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, any related documentation, and "applets" incorporated into Steam Client) are owned by Valve or its licensors. Steam Client is protected by the copyright laws of the United States, international copyright treaties and conventions and other laws. All rights are reserved. Steam Client is licensed, not sold. Your license confers no title or ownership in the Steam Client or copies thereof. Steam Client contains certain licensed materials and Valve's licensors may protect their rights in the event of any violation of this Agreement.

1.4 WARRANTY DISCLAIMERS; LIMITATION OF LIABILITY; NO GUARANTEES. VALVE DOES NOT GUARANTEE CONTINUOUS, ERROR-FREE, VIRUS-FREE OR SECURE OPERATION AND ACCESS TO STEAM OR THE STEAM CLIENT. DISCLAIMERS OF WARRANTY AND LIMITATIONS ON LIABILITY SET FORTH IN THE SSA APPLY TO YOUR USE OF THE SOFTWARE. AS NOTED IN THE SSA, FOR EU CUSTOMERS, SUCH PROVISIONS DO NOT REDUCE YOUR MANDATORY CONSUMERS' RIGHTS UNDER THE LAWS OF YOUR LOCAL JURISDICTION.

2. Termination. This Agreement is effective until terminated. You may terminate this Agreement at any time by destroying Steam Client. Valve may terminate this Agreement at any time upon notice to you. This Agreement will automatically terminate in the event that you fail to comply with the terms and conditions contained herein. In such event, you must immediately destroy Steam Client. The provisions of Sections 1.3, 2, 3, and 4 will survive any termination of this Agreement.

3. Export Controls. The Software may not be re-exported, downloaded or otherwise exported into (or to a national or resident of) any country to which the U.S. has embargoed goods, or to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Table of Denial Orders. By installing the Software, you are agreeing to the foregoing and you are representing and warranting that you are not located in, under the control of, or a national or resident of any such country or on any such list.

4. Miscellaneous. Provisions relating to applicable law and jurisdiction, and dispute resolution, set forth in the SSA shall apply to any disputes arising under this Agreement. This Agreement and the SSA’s terms incorporated herein may be amended, altered or modified at any time by Valve in Valve's sole discretion, except if you are a consumer with place of residence in Germany, in which case the provisions found under this link apply to you: http://store.steampowered.com/subscriber_agreement_de/. In the event that any provision of this Agreement shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, such provision will be enforced to the maximum extent permissible and the remaining portions of this Agreement shall remain in full force and effect. This Agreement and the SSA constitute and contain the entire agreement between the parties with respect to the subject matter hereof and supersede any prior oral or written agreements.

By downloading or installing the Software and/or accepting these terms, you acknowledge that you have read and understand the foregoing License Agreement and the Steam Agreement and agree to be bound by the terms and conditions of the License Agreement and the Steam Agreement.
