Spaceglunk — End User Licence Agreement
This End User Licence Agreement (the "Agreement") covers your use of Spaceglunk (the "Game"). By installing, accessing or playing the Game you accept this Agreement in full. If you do not accept it, do not install or play the Game; if you have bought it, you may be able to request a refund under your platform provider's refund policy.

1. Who this Agreement is between
This Agreement is between you (the "Player", "you") and Louis Matthee, trading as Zitherian Studios ("Zitherian Studios", "we", "us", "our"), based in South Africa. It covers the Game in all its forms: the base game, any demo, any downloadable content or add-ons we release, and any updates or patches. Our website and store pages have their own separate terms, which this Agreement does not replace.

2. About Spaceglunk
Spaceglunk is a single-player, first-person survival and base-building game set on the icy moons of Jupiter and Saturn, in which you revive a wrecked outpost, grow food, mine and refine materials, research technology, repair and upgrade a ship, rescue a crew, and travel between worlds. The settings, characters, ships and technology in the Game are fictional; any resemblance to real people, places or organisations is coincidental.

3. Early Access
The Game is sold in Early Access. It is playable from start to finish, but it is still in active development: systems, content, balance and features will change, be added to, and sometimes be reworked between versions, and you should expect the occasional rough edge. Buying in Early Access does not entitle you to any particular future feature; what gets built, and in what order, is shaped in part by player feedback. We intend to carry the Game through to a full release but, as with any small studio, cannot guarantee a timeline.

4. Accounts and access
To play the Game you need an account with the platform you bought it from (for example Steam). That account is provided and governed by the platform, not by us, and your use of it is subject to the platform's own terms. Keep your login details secure; you are responsible for activity that results from your own actions or from failing to keep those details secure, but not for unauthorised use that happens through no fault of your own.

5. Purchases
The Game is sold as a one-time purchase. There are no microtransactions, subscriptions or paid loot mechanics, and we have no plans to add any; we may in future release paid downloadable content or add-ons. All payments are handled by your platform provider under their own terms — we do not collect or process your payment details — and refunds are handled under the platform's refund policy, not by us directly.

6. Updates
We may release patches, balance changes and content updates from time to time. We try to keep the core experience stable, but gameplay details, features and content may change between versions, and we do not guarantee that any given version will be supported indefinitely. If we ever need to wind down updates, we will try to give fair notice.

7. Licence and restrictions
We grant you a personal, non-exclusive, non-transferable licence to install and play the Game for your own private use. This Agreement does not transfer ownership of anything in the Game to you.

Except to the extent applicable law expressly allows you to do so regardless of this restriction, you may not:

copy, resell, rent, lend, sublicense or otherwise redistribute the Game or any part of it;
extract, rip or reuse the Game's assets, code, data or content outside the Game;
reverse-engineer, decompile, disassemble or otherwise attempt to derive the Game's source code or internal workings, or defeat, bypass or tamper with any technical protection, licensing or anti-tamper measure; or
modify the Game, or create or distribute tools whose purpose is to do any of the above.
Nothing here limits any right you have under mandatory law (for example, a right to decompile for interoperability where the law grants it).

8. Third-party and open-source components
The Game is built with the Unity engine and includes other third-party and open-source software and content (for example Steamworks.NET, and third-party assets used under their own licences, including CC0 assets). Those components remain the property of their respective owners and are provided under their own terms, copies or notices of which are included with the Game or its documentation. Nothing in this Agreement overrides those terms.

9. Your content, sharing and streaming
Streaming and video. You are welcome to record, stream and share footage of yourself playing the Game, including monetised videos, as long as you do not use it to misrepresent the Game or us.

Sharing in the Game. The Game lets you share and visit creations such as bases. You keep ownership of the original material you make; our tools and assets remain ours. When you share content through features or channels we provide, you give us a non-exclusive, worldwide, royalty-free licence to host, display, store and distribute it as part of operating and promoting the Game. You are responsible for what you share, and you must not share anything unlawful, infringing, or that you do not have the right to share. Shared content is used at your own risk, and we are not responsible for content created by other players. (Any wider modding or Steam Workshop support we add later will come with its own guidelines, which will form part of this Agreement.)

10. Feedback
If you send us feedback, bug reports or suggestions, you do so voluntarily, and we are free to use them to improve the Game without owing you anything in return.

11. Prohibited conduct
Do not use the Game to break the law, to infringe anyone's rights, to distribute malware, or to interfere with, attack or gain unauthorised access to our systems, the platform's systems, or other players. We may restrict or end your access for serious or repeated breaches of this Agreement, as far as the platform and the law allow.

12. Save data
The Game stores your save data on your device, and — where you have enabled it — syncs it through your platform's cloud save service. We do our best to keep saves working across updates, but we cannot guarantee against loss or corruption of save data, for example after a crash, a failed sync or a major update. Keep your own backup of anything you would not want to lose.

13. No warranty
The Game is provided "as is". We work to make it run well, but we cannot promise it will be free of bugs, crashes or compatibility problems on every system, or that access will be uninterrupted. To the extent the law allows, we disclaim the implied warranties of merchantability and fitness for a particular purpose. Nothing in this section removes or limits any conformity, quality or fitness rights you have as a consumer under mandatory law (for example the EU Digital Content Directive (EU) 2019/770 or the UK Consumer Rights Act 2015), which apply in addition to it.

14. Limitation of liability
To the maximum extent the law allows, we are not liable for indirect, incidental or consequential loss arising from your use of the Game — including hardware problems, lost data or lost time — even if we were told such loss was possible. Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid for the Game or ZAR 450. Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded or limited under applicable law, and nothing in it limits your statutory rights as a consumer; where mandatory law in your country of residence gives you greater rights, those rights apply.

15. Indemnification
To the extent the law allows, you agree to cover the reasonable costs we incur, including legal fees, from a claim arising out of your breach of this Agreement or your misuse of the Game — for example sharing content that infringes someone else's rights. This does not apply to our own negligence, wilful misconduct or breach, or where it would be unenforceable under mandatory consumer-protection law.

16. Ending this Agreement
You can end this Agreement at any time by uninstalling the Game and deleting all copies. Your licence ends if the Agreement ends or your access is permanently restricted. Sections 7, 8, 9, 10, 13, 14, 15, 17 and this Section 16 continue to apply after the Agreement ends.

17. Governing law and disputes
This Agreement is governed by the laws of the Republic of South Africa, and the courts of Johannesburg, South Africa have jurisdiction over any dispute, except that if you are a consumer, mandatory consumer-protection law in your country of residence may give you the right to bring proceedings in your local courts, and nothing here limits that right. If you have a problem, please contact us first at support@zitherian-studios.com so we can try to resolve it directly.

18. Changes to this Agreement
We may update this Agreement from time to time. Material changes will be presented for you to accept; minor changes, such as clarifications, take effect when posted, and we will update the date below. If you do not accept an update, you may stop using the Game; this does not affect rights you have under mandatory consumer law.

19. Export controls
You confirm that you are not located in, or a resident of, any country under a comprehensive trade embargo that applies to us, and are not on any applicable restricted-party list, and you agree not to use the Game in breach of applicable export-control or sanctions law.

20. Platform terms
If you got the Game through a platform provider, their terms also apply. Where those terms conflict with this Agreement and the platform requires its own to take priority, the platform's terms prevail to that extent.

21. General
If any part of this Agreement is found unenforceable, the rest stays in effect. We may transfer this Agreement to another company (for example if the Game is sold or published by a partner) as long as that does not reduce your rights; you may not transfer it except as your platform allows. If we do not enforce part of it straight away, we can still enforce it later. This Agreement is the entire agreement between you and us about the Game and replaces any earlier agreement on the subject.

22. Photosensitivity and motion warning
A very small number of people may experience seizures when exposed to flashing lights or patterns, including while playing video games, even with no previous history. Some players may also feel motion discomfort from first-person movement. If you or anyone playing feels dizziness, altered vision, disorientation or nausea, stop playing, and consult a doctor if symptoms persist.

23. Who we are
Spaceglunk is developed and published by Louis Matthee, trading as Zitherian Studios, Centurion, South Africa. Questions about this Agreement can be directed to support@zitherian-studios.com.
