Battle Refrain Supplemental Terms for Embedded Software
These Supplemental Terms are an agreement between you and Katarienumono, Inc. ("we" or "us") governing your use of Unity runtime software (Unity Runtime) and Microsoft Corporation's Direct3D 12 and DirectStorage (together, the "Embedded Software") included in Battle Refrain (the "Game") provided by us. These Supplemental Terms do not change the Game's basic license, purchase or refund terms under the Steam Subscriber Agreement and Steam Refund Policy, or limit your rights or remedies against us or Valve.
1. Ownership
The Embedded Software is licensed, not sold, for use as part of the Game. Ownership and intellectual property rights in the Embedded Software remain with their respective owners and do not transfer to you.
In these Supplemental Terms, "Providers" means Unity Software Inc., together with its subsidiaries and other affiliates ("Unity"), Unity's licensors and service providers, and Microsoft Corporation and its suppliers, in each case with respect to the Embedded Software to which that Provider relates.
2. Restrictions
Except for copying necessary for the authorized installation, operation or updating of the Game, and activities permitted by applicable law, a separate license described in Section 5 or the relevant rights holder, you may not extract the Embedded Software from the Game for separate use; copy, modify, sell, distribute, rent, lend or sublicense it; reverse engineer, decompile, disassemble or otherwise attempt to derive its source code; circumvent technical usage restrictions or protections; or remove, alter, obscure or block proprietary notices. You may not use the Embedded Software for unlawful purposes or to create or propagate malware.
3. Disclaimer of Warranties
Subject to Section 5 and to the extent permitted by applicable law, each Provider supplies the Embedded Software to which it relates "as is" and "as available", without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. These Supplemental Terms do not create any obligation for a Provider to supply support, fixes or updates to you.
4. Limitation of Liability
This Section applies only to each Provider's own liability and does not limit your rights against us or Valve. Subject to Section 5 and to the extent permitted by applicable law, no Provider will be liable for any damages arising out of or relating to the Embedded Software to which it relates or its use in the Game, including direct, indirect, incidental, special or consequential damages, lost profits, or loss of data, under any legal theory, even if advised of the possibility of such damages.
5. Statutory Rights and Separate Licenses
Nothing in these Supplemental Terms excludes or limits any warranty, liability, refund or other right or remedy that cannot be excluded or limited under applicable consumer protection or other mandatory law. Liability for a Provider's own fraud, willful misconduct or gross negligence, for death or personal injury, and statutory product liability is preserved to the extent it cannot lawfully be excluded or limited. Regional warranties, liability provisions and user protections under the applicable Provider licenses included with the Game (including Microsoft's provisions for Germany and Austria) are preserved and take precedence over Sections 3 and 4.
Where open source or other third-party software is subject to its own license, nothing in these Supplemental Terms limits the rights granted under that license. Applicable copyright notices and licenses are included with the Game in ThirdPartyNotices.md and the ThirdPartyNotices folder.
