Loot Hole End User Licence Agreement

Effective: 24 October 2026. Version 1.1.

This End User Licence Agreement ("EULA") is between you and Yilmaz Kiymaz, trading as Salted Caramel Games, Sonninstr. 7, 20097 Hamburg, Germany ("we", "us"; email support@saltedcaramelgames.com). It applies to the game Loot Hole in every version: the Steam and Epic Games Store versions, the Meta Quest version, the iPhone, iPad and Android apps, and the web game on game portals and on our website, with its updates and online features (the "Game").

How this EULA becomes part of our agreement

This EULA forms part of your agreement with us only if we have drawn your attention to it and given you a reasonable opportunity to read and save it before that agreement is concluded, and you have agreed to it, for example in the dialog Steam shows before the first start, or on the store page or at the purchase where the store presents it. Installing, starting or playing the Game does not by itself mean that you accept terms first shown to you after you acquired the Game, and declining such terms does not take away rights you already acquired.

1. The stores' and portals' terms

If you got the Game through a store or portal, its own terms with you still apply: Valve's Steam Subscriber Agreement, the Epic Games Store End User License Agreement, Meta's terms for the Meta Horizon Store, Apple's Media Services Terms, Google Play's Terms of Service, or the terms of Poki, CrazyGames or Playgama.

Payment and store-administered refunds follow the store's checkout terms and procedures. Who your seller is, and who is responsible for particular consumer obligations, depends on the store and the transaction. You may use the store's refund process where it applies, without losing any statutory right of withdrawal, refund or other right you have against us or another party legally responsible. This EULA adds our terms as the Game's maker; it does not move our legal obligations onto a store or portal.

Epic Games Store: this EULA is in addition to Epic's End User License Agreement. Where they conflict, Epic's agreement prevails.

2. Your licence

We grant you a personal, non-exclusive, non-transferable licence to install and use the Game for your own non-commercial entertainment, on the devices and in the ways your store or portal allows (for the version on our website: in a supported web browser on your own devices). The Game is licensed, not sold: we and our licensors keep all rights in it, including its code, art, models, sounds, music and text. The licence lasts until it ends under section 10.

You may make and share videos, streams and screenshots of the Game, including monetised ones, as long as you do not claim they are made or endorsed by us and do not use them to share the Game's files.

3. What you may not do

Except where the law allows it regardless of this EULA, you may not:

  • copy, sell, rent, lend, sublicense or redistribute the Game or any part of it;
  • modify the Game or create derivative works of it, except as section 2 allows;
  • decompile, disassemble or reverse-engineer the Game, or extract its models, textures, sounds, music or other assets to use them outside the Game (some are licensed to us by others whose licences forbid it);
  • use the Game or its assets or text to train or as input to artificial intelligence or machine learning systems;
  • cheat in online play, interfere with other players or the online services, exploit bugs to harm others, or use the online features to harass, threaten, impersonate or deceive anyone, or to share unlawful or offensive content;
  • get around the Game's or a store's technical protections, or reach the online services other than through the Game.

Nothing in this EULA limits what you may do under Articles 5 and 6 of the EU Software Directive (2009/24/EC) or the German Copyright Act (sections 69d and 69e UrhG), such as making a back-up copy, or observing and testing how the Game works.

4. Online features

Some versions of the Game have optional online play (co-op rooms with friends or strangers, and Neighbours races). On Steam, the Epic Games Store and in the iPhone, iPad and Android apps it runs over Epic Online Services, a service of Epic Games: on Steam the Game signs in to it with your Steam account (no Epic account needed); on the Epic Games Store with the Epic account the Epic Games Launcher signed you in with; in the apps with an id made for your device (no account needed).

Other players in your room see your display name, your character, what you do and what you write in chat. Follow section 3 and do not share personal information. The safety controls depend on the version: the web game's co-op lets you mute players; Steam, Epic Games Store and app co-op let you mute, block and report players, and a host can remove guests from their own yard. We may restrict your access to the online features if you breach section 3, but only to the extent and for as long as reasonably necessary, taking into account how serious the breach is, its effects, earlier breaches and the interests of everyone affected. We will normally warn you first and give you a reasonable chance to stop or put right the breach; we may restrict your access at once for a time where that is needed to prevent serious harm. Permanent exclusion needs an important reason that, all circumstances and both sides' interests considered, makes continuing unreasonable, and lesser measures must be insufficient. We will tell you the reason and extent of a restriction and review it if you challenge it at support@saltedcaramelgames.com. Ending your licence to the Game is covered separately by section 10.

Online features depend on third-party services and may be interrupted from time to time, including for maintenance. We remain responsible for our own contractual and statutory obligations, and this section gives us no right to stop an agreed online feature before our obligation to provide it ends. Any discontinuation will follow the applicable law, including notice, termination and reimbursement rights. We will announce a planned discontinuation at least 30 days in advance, or longer where the law requires; if advance notice is impossible, we will tell you as soon as we can. The Game played alone does not depend on these services.

5. Updates, changes and your progress

We provide, and tell you about, the updates needed to keep the Game in conformity with our agreement, including security updates. Where the Game is supplied continuously, this lasts for the whole supply period; otherwise for the period you can reasonably expect given the Game's nature and purpose and the circumstances of the contract. Updates for store and portal versions come through the store or portal; the version on our website loads the current version when you load or reload it. Some updates may be needed to keep using the online features.

Versions marked Early Access are still being developed. This does not reduce your statutory rights, and it does not give us a general right to remove agreed features or reset your progress. Beyond what is needed to keep the Game in conformity, we may change it only where one of these reasons reasonably justifies it: carrying out the Early Access development described when you got the Game; correcting imbalances that materially disrupt the intended progression or fair online play; preventing exploits, abuse or security threats; or adapting the Game to changed operating systems, hardware, store requirements or third-party service interfaces. Each change must be proportionate to its reason, take your interests into account, cost you nothing extra and be clearly explained in the update notes. It does not allow us to replace the Game's essential character or remove agreed core features. We do not make changes that impair your access to or use of the Game more than insignificantly. Your statutory rights, including to have the Game brought into conformity, to a price reduction or reimbursement, or to end the contract, stay unaffected.

The Game saves your progress on your device (and in your store's or portal's cloud copy if you use one). We design updates to keep your progress.

6. Your feedback and reports

If you send us ideas or feedback, you allow us to use them to improve the Game, free of charge. Web versions other than Poki's, and all other versions, send error reports when the Game fails, but only if you agree (the Game asks you once, and you can change your answer in its settings); the Windows, macOS, Linux, Steam Deck and PC VR versions can also send crash dumps, which can contain parts of the Game's memory; and a player report is sent when you use Report in Steam, Epic Games Store or app co-op. Our privacy policy explains what these contain, why, on what legal basis and for how long.

7. Warranty

If you are a consumer, you have the statutory rights for digital products of the country you live in. In the European Union these include that the Game is as described and gets the updates it needs (in Germany, sections 327 ff. of the German Civil Code, BGB). This EULA does not limit those rights. Beyond them, and as far as the law allows, the Game is provided "as is".

Epic's materials. The Steam and Epic Games Store versions and the iPhone, iPad and Android apps include Epic Games' Epic Online Services software development kit and use related Epic services (together, the "Epic Materials"). Subject to the exceptions in the next paragraph, all representations, warranties, conditions and liabilities relating to the Epic Materials are expressly disclaimed in favour of Epic Games, Inc., its affiliates and its licensors.

This disclaimer does not exclude or limit liability for intent or gross negligence, for culpable injury to life, body or health, for fraudulently concealed defects, under guarantees actually given, or under mandatory product-liability or data-protection law. For slightly negligent breaches of essential contractual obligations, liability remains for the loss typical and foreseeable for the contract. Any other liability the applicable law does not allow to be excluded or limited also remains. This paragraph creates no guarantee and does not affect our own responsibility under sections 7 and 8.

The Epic Materials include third-party software whose licence notices are shipped in the file EOS-ThirdPartySoftwareNotice.txt beside the Game and shown in the Game's Credits and licences screen.

8. Liability

We are liable without limit for damage caused intentionally or by gross negligence, for injury to life, body or health, for fraudulently concealed defects, under the German Product Liability Act (Produkthaftungsgesetz) and where we have given a guarantee.

For slight negligence we are liable only if we breach an obligation that is essential to this agreement, one whose fulfilment makes the proper use of the Game possible in the first place and on which you may regularly rely; our liability is then limited to the damage that is typical and foreseeable for a contract of this kind. Otherwise we are not liable for slight negligence.

These limits also apply to our representatives and helpers. They do not apply to compensation claims under Article 82 GDPR or other mandatory data-protection liability, and they do not restrict your statutory rights to have a defective digital product brought into conformity, to a price reduction or reimbursement, or to end the contract. They do not affect mandatory consumer law that gives you more protection.

9. Privacy

How the Game handles personal data, including what goes to the stores and to Epic, is described in our privacy policy: https://saltedcaramelgames.com/legal/loot-hole/privacy/.

10. Ending this EULA

You may stop using or uninstall the Game at any time. Uninstalling it, deleting a copy or closing the web game does not by itself give up your licence or any right to reinstall or play it under your store's or portal's terms. If you want to end your licence, tell us at support@saltedcaramelgames.com and delete your copies of the Game. Your statutory rights to withdraw from or end a contract, and any reimbursement they give, stay unaffected. We may end your licence only for an important reason: all circumstances and both sides' interests considered, continuing the agreement must be unreasonable, and lesser measures (such as restrictions on the online features) must be insufficient. Where the reason is a breach of this EULA, we first warn you or give you a reasonable time to put it right; we skip that only where the law allows it, for example where you seriously and finally refuse to comply, or where special circumstances, both sides' interests considered, justify ending it at once. When the licence ends you must delete the Game. Sections 3, 6, 7, 8 and 11 continue to apply.

11. Changes, law and disputes

We may propose changes to this EULA; we will explain what changes and from when. A change to an existing agreement needs your express agreement: silence, not objecting and continuing to play do not count as agreement. If you do not agree, the version you accepted before keeps applying to your existing rights. Changes to the Game itself are covered by section 5 and the law.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory law of the country where you live, and you may bring claims in the courts there.

We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).

If a part of this EULA is invalid, the rest remains in force.

12. Meta Horizon Store

If you got the Game from the Meta Horizon Store: we, not Meta or its affiliates, grant your licence to the Game. Meta and its affiliates are not parties to this EULA and take on no obligations or liability under it; their own obligations to you under the law and their agreements with you remain. Meta's Supplemental Meta Platforms Technologies Terms of Service prevail over anything in this EULA that conflicts with them.

13. Google Play

If you got the Game from Google Play: notwithstanding sections 2 and 3, you may display and use the Game and change the colours of or add themes to its app icons as Google Play allows, and eligible members of your family group may use a shared copy under Google Play's family-sharing rules. Nothing in this EULA restricts the user licence we grant under section 5.3 of the Google Play Developer Distribution Agreement; that licence prevails over anything here that conflicts with it. This EULA is between you and us: Google is not a party to it and has no obligations or liability under it; Google's own obligations under the law and its agreements with you remain.

14. Apple App Store

If you got the Game from Apple's App Store, these terms also apply:

  • This EULA is between you and us, not Apple. We, not Apple, are solely responsible for the Game and its content.
  • Your licence is limited to using the Game on Apple-branded products you own or control, as the Usage Rules in Apple's Media Services Terms allow; the Game may also be used by other accounts associated with you through Family Sharing or volume purchasing.
  • We are solely responsible for maintenance and support under this EULA and the law, and for any product warranties not validly disclaimed. Apple has no obligation to provide maintenance or support for the Game.
  • If the Game fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the extent the law allows, Apple has no other warranty obligation for the Game; any other claims, losses, liabilities, damages, costs or expenses due to a failure to conform to a warranty are our responsibility, as this EULA provides.
  • We, not Apple, are responsible for addressing any claims by you or a third party relating to the Game or your possession or use of it, including product liability claims, claims that it fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
  • If a third party claims that the Game or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Questions, complaints and claims about the Game go to us: Yilmaz Kiymaz, trading as Salted Caramel Games, Sonninstr. 7, 20097 Hamburg, Germany; support@saltedcaramelgames.com; telephone +49 176 21731221.
  • You must comply with applicable third-party terms when using the Game.
  • You and we agree that Apple and its subsidiaries are third-party beneficiaries of this EULA, and that once you accept it, Apple has the right (and is deemed to have accepted the right) to enforce it against you as a third-party beneficiary.
