Territorium – End User License Agreement (EULA)
Last updated: October 5, 2026
1. Purpose and Scope
This End User License Agreement ("EULA") is entered into between you and Bastien Vanhoutte, sole proprietorship (entrepreneur individuel / EI) doing business as Broussen Studio, SIRET 105 664 346 00019, 7 rue du Maquis, 52600 Torcenay, France, contact@broussen.fr ("we", "us", "our", or the "Publisher"). It governs your use of the Territorium desktop application distributed via Steam (the "Software") and the online multiplayer video game and services accessible through it (the "Service").
Installing, downloading, launching, or using the Software constitutes your acceptance of this EULA. This agreement supplements our Terms of Service (https://territorium.gg/terms-of-service.html) and our Privacy Policy (https://territorium.gg/privacy-policy.html), both of which are incorporated herein by reference. Your use of the Steam platform is governed separately by the Steam Subscriber Agreement (SSA).
The Software is distributed and purchased through Steam. Payment processing, transactions, and refund requests are handled exclusively by Valve Corporation in accordance with Steam's refund policies. The Software is provided in Early Access: it remains under active development, may contain software bugs or balance defects, and gameplay elements are subject to ongoing modification.
2. License Grant
Subject to your continuous compliance with this EULA, we grant you a personal, non-exclusive, non-transferable, revocable, and limited license to download, install, and execute the Software on authorized personal devices solely for your personal, non-commercial entertainment purposes.
3. Open Source Components and Intellectual Property
Territorium is built upon the open-source codebase of OpenFront (copyright OpenFront and Contributors). Territorium is an independent project and is neither affiliated with nor endorsed by OpenFront or its contributors.
The game engine source code is licensed under the GNU Affero General Public License v3 (AGPLv3), and associated inherited visual assets are licensed under Creative Commons Attribution-ShareAlike 4.0 International (CC BY-SA 4.0). Nothing in this EULA shall be construed as limiting, restricting, or overriding any rights granted to you under the terms of those open-source licenses; in the event of any conflict, those licenses shall strictly govern with respect to their corresponding components.
The name, logo, visual identity, trademarks, and distinctive branding of Territorium, the name and logo of Broussen Studio, and all proprietary assets not governed by the aforementioned open-source licenses remain our exclusive property and may not be copied, reproduced, or exploited without our prior written authorization.
4. Prohibited Uses and Anti-Cheat Enforcement
Except as expressly permitted by mandatory statutory law or the applicable open-source licenses, you shall not:
- Sell, lease, rent, sublicense, redistribute, or commercially exploit the Software or the Service;
- Use, design, distribute, or operate cheats, hacks, automation scripts, bots, macros, or unauthorized third-party software, or intentionally exploit glitches or bugs;
- Decompile, reverse engineer, disassemble, or modify the Software to cheat, bypass copy protection, circumvent security measures, or access the Service in an unauthorized manner;
- Interfere with, overload, attack, or compromise our servers, networks, or the integrity of other players' matches;
- Sell, trade, transfer, or exchange game accounts, in-game items, or virtual currencies for real-world currency ("Real Money Trading").
To ensure fair competition, our game servers automatically analyze gameplay actions received during matches (specifically action frequency, inputs, and synchronization states). This analysis is conducted exclusively server-side: no local anti-cheat surveillance software or kernel-level drivers are installed on your device. Suspicious telemetry may result in an immediate match disconnection; suspected infractions are subsequently reviewed by our moderation staff, and no punitive sanctions are applied automatically.
5. Online Service, Connectivity, and Account
The Software is an online service requiring an active Internet connection to interact with our game servers. Authentication is performed via your Steam account, and match progression is tied to your Territorium profile. Because the game is in active development, online functionality may change over time, and the Service may experience scheduled or emergency downtime for updates or maintenance.
You agree to adhere to the code of conduct outlined in our Terms of Service, including rules governing acceptable player behavior, pseudonyms, clan tags, and interactions with other users.
6. Virtual Currency, Microtransactions, and Add-ons
The Service incorporates two virtual currencies:
- Medals: Earned exclusively through gameplay achievements.
- Emeralds: Purchased with real money or granted via in-game milestones.
Both currencies exist solely within the game environment, carry no monetary value, and cannot be redeemed for legal tender, refunded, or transferred across accounts, except where mandated by applicable law. Territorium does not operate on a "pay-to-win" mechanic; microtransactions unlock cosmetic items and convenience features only.
In-game Emerald purchases are processed directly through the Steam overlay using your Steam Wallet. Transactions are subject to both Steam's terms and our Terms of Sale. Because Emeralds are delivered digitally and instantly, you acknowledge and agree that upon completing your purchase, the digital content is made available immediately, and to the fullest extent permitted by applicable law, you expressly waive any statutory 14-day withdrawal or cancellation period.
The "Conqueror" Deluxe Edition and the Conqueror Pack, sold via Steam, unlock exclusive cosmetic content and grant one (1) complimentary month of the "Lord" subscription tier. These entitlements are attributed automatically, once per Steam account, to the linked Territorium account. If an active subscription is already in place, the complimentary month is appended to the existing billing cycle. These items cannot be converted into cash or transferred. Purchases and refund requests remain subject to Steam's standard transaction policies.
7. Patches and Updates
We may deploy mandatory or optional updates, patches, and enhancements to the Software and server infrastructure via Steam. Certain updates may be mandatory to preserve multiplayer compatibility and continue accessing the online Service.
8. Privacy and Platform Integrations
We process your Steam ID (SteamID64) and operational game telemetry solely as necessary to operate, secure, and maintain the game, in compliance with our Privacy Policy. Territorium contains no commercial third-party advertising frameworks or tracking beacons.
If enabled, the desktop application communicates local presence states (such as current menu, match room, active game mode, or map) directly to Steam and Discord on your computer to update your "Rich Presence" profile for friends. These external services process this information in accordance with their respective privacy policies.
9. Term, Termination, and Account Actions
You may terminate this EULA at any time by uninstalling the Software and deleting your Territorium account through your in-game profile or by emailing contact@broussen.fr.
In the event of a breach of this EULA or the Terms of Service (including cheating, payment fraud, griefing, or harassment), we reserve the right, based on the severity of the conduct and following administrative review, to:
- Issue a formal written warning;
- Temporarily or permanently ban your account from ranked matchmaking;
- Invalidate and roll back distorted ranked match results;
- Suspend, restrict, or permanently terminate your Territorium account pursuant to our Terms of Service.
10. Disclaimer of Warranties and Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW (INCLUDING UNITED STATES FEDERAL AND STATE LAWS):
A. AS-IS BASIS: THE SOFTWARE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND DEFECTS, WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
B. LIMITATION OF LIABILITY: IN NO EVENT SHALL THE PUBLISHER, ITS AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, NOR FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SOFTWARE OR SERVICE.
C. MONETARY CAP: TO THE EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SOFTWARE OR THIS EULA SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE ON STEAM DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY EUROS (50 EUR), WHICHEVER IS GREATER.
EUROPEAN UNION / CONSUMER STATUTORY PROTECTION NOTICE:
NOTHING IN THIS SECTION OR THIS EULA SHALL LIMIT, EXCLUDE, OR PREJUDICE MANDATORY CONSUMER PROTECTIONS OR STATUTORY LEGAL WARRANTIES GRANTED TO YOU UNDER APPLICABLE LOCAL CONSUMER PROTECTION LAWS (INCLUDING, WITHOUT LIMITATION, THE STATUTORY LEGAL GUARANTEE OF CONFORMITY FOR DIGITAL CONTENT AND SERVICES UNDER FRENCH AND EU LAW).
11. Amendments
We reserve the right to amend or update this EULA at our discretion to reflect technical, regulatory, or operational changes. You will receive reasonable advance notice of material revisions before they take effect. If you do not accept the updated terms, you must discontinue using the Software and may delete your account.
12. Governing Law, Dispute Resolution, and Jurisdiction
A. Governing Law
This EULA, and any disputes or claims arising out of or in connection with it, shall be governed by and construed in accordance with the laws of France, without regard to conflict of law principles. However, if you are a consumer residing in the European Union or the United States, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country or state of habitual residence.
B. Amicable Settlement and European Mediation
In the event of a dispute, you agree to contact us first at contact@broussen.fr to seek an amicable resolution. If you are a consumer residing in the European Economic Area (EEA), you may also submit your claim to a consumer mediation service under the terms specified in our Terms of Sale.
C. Forum and Jurisdiction
Subject to applicable mandatory consumer protection laws:
- Consumers residing in France or the European Union may bring proceedings either before the courts of France or before the courts of their place of habitual residence.
- For non-consumer claims or users residing outside the European Union (including the United States), any litigation arising from this agreement shall be brought exclusively before the competent courts within the judicial district of the Publisher's registered address in France.
D. Class Action Waiver (U.S. Residents)
TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY PROCEEDINGS TO RESOLVE DISPUTES IN ANY FORUM WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR THE PUBLISHER SHALL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY. (This clause applies strictly where enforceable and does not affect non-waivable rights under French/EU consumer law).
