Moonbound Alpha Tester Agreement

Thank you for helping test Moonbound. Please read this agreement. Click "I agree" only if you accept it. If you don't, click "Decline" and you won't be able to play the alpha.
This agreement is between you and Scrolls.io, the developer of Moonbound ("Scrolls.io", "we", "us"). You must be at least 18, or the age of majority where you live, to accept it.
1. What you get
• We give you a personal, limited, revocable, non-transferable, non-exclusive license to install and play the Moonbound alpha for testing and giving feedback, for as long as the alpha runs or until we end your access.
• That license is all you get. Moonbound is licensed, not sold. We, and our licensors, keep every right, title and interest in the game: its code, art, models, animations, sounds, music, story, characters, names, logos, levels, data, servers and builds, and anything made from them.
• Your account, characters, items, gold and other in-game things belong to us and are not property you own. Alpha progress may be wiped at any time, and will be wiped before release.
2. What you agree not to do
You agree not to, and not to help anyone else to:
• copy, extract, rip, export, datamine or redistribute any part of the game, including its models, textures, animations, sounds, music, text, data files or builds;
• reuse any of the game's assets in another game, mod, 3D print, NFT, AI training set or any other product or project;
• decompile, disassemble or reverse engineer the game, its network protocol or its servers, except where the law clearly allows it despite this agreement;
• share, sell, lend or upload the game client, your account, your login or your access key, or let anyone else play on your account;
• use cheats, bots, automation, exploits or modified clients, or attack, overload or probe our servers or other players;
• harass, threaten or abuse other players or the team, or post illegal, hateful or sexual content in the game.
3. Confidentiality
• The alpha is confidential. Unless we say otherwise in writing, keep what you see in it private: don't publish screenshots, video, streams, builds, data or details about content, features or bugs.
• We may announce that some sharing is allowed (for example streaming, or screenshots in our Discord). If we do, only that sharing is allowed, and only within the limits we announce.
• This doesn't cover information that is already public through no fault of yours.
• These confidentiality duties last until we publicly release the game, or for 2 years after you accept this agreement, whichever comes first.
4. Feedback
You don't have to send feedback. If you do send any feedback, ideas, suggestions or bug reports, you give us a perpetual, worldwide, royalty-free, irrevocable right to use, change and build on them in any way, without paying or crediting you. You won't send us anything you don't have the right to share.
5. Traceable builds
To protect the game, builds and screens may carry visible or hidden marks tied to your account. We may use them to find the source of a leak.
6. Ending access
• We can suspend or end your access, or end the alpha, at any time, for any reason or none. You can stop at any time.
• If you break sections 2 or 3, your access ends at once and we may take legal action, including asking a court to stop the breach.
• When your access ends, delete every copy of the game you have.
• Sections 1 (our ownership), 2, 3, 4, 7, 8 and 9 still apply after this agreement ends.
7. No warranty
The alpha is unfinished and is provided "as is" and "as available". It may crash, lose progress or contain bugs. To the extent the law allows, we make no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
8. Limit of liability
To the extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data or progress. Our total liability to you for anything related to the alpha is limited to US $50. Some places don't allow these limits, so they may not fully apply to you.
9. General
• We collect your account details, IP address and gameplay data to run and secure the alpha and to keep a record that you accepted this agreement.
• This agreement is governed by the laws of the State of Texas and the United States, without regard to conflict-of-law rules. Any dispute goes to the state or federal courts located in Texas, except that we may ask any court for an order to stop a breach of sections 2 or 3.
• We may update this agreement. If we do, the game will show you the new version, and you'll need to accept it to keep playing.
• If a court finds part of this agreement unenforceable, the rest still applies. If we don't enforce a term right away, we haven't given up the right to enforce it later. You may not transfer this agreement; we may.
• This is the whole agreement between you and us about the alpha.
