END USER LICENSE AGREEMENT
Effective Date: October 26th, 2026
This End User License Agreement (this "Agreement") is a legal contract between Pluestar Studios LLC (the "Company" or "We"), a Massachusetts Limited Liability Company located in Massachusetts, United States, and you, the individual or entity (the "User") downloading, installing, or using Push Wars (the "Game") on Steam (the "Platform").
By downloading, installing, launching, or otherwise using the Game, you agree to be bound by this Agreement. If you do not agree to all of the terms and conditions in this Agreement, do not download, install, or use the Game, and promptly delete any copy in your possession.
This Agreement is made between you and Company only. It does not create any privity of contract with the Platform, its operator, or any third party.
1. License Grant
A. Subject to the terms and conditions of this Agreement, the Company hereby grants to you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install, access, and use one copy of the Game solely for your personal, non-commercial entertainment purposes on the device or system for which it was intended.
B. This license is a right to use, not a sale of the Game. You do not acquire any ownership interest in the Game, its software, or its content. All rights not expressly granted herein are reserved by Company.
2. Intellectual Property Ownership
A. Pluestar Studios LLC owns all rights in the Game, including its software, original assets, design, character names, and overall arrangement. Certain assets in the Game are dedicated to the public domain under CC0 1.0 (as listed in our credits); Pluestar Studios LLC uses them under that license and does not claim exclusive ownership of them. Nothing in this Agreement gives you any ownership interest in the Game.
3. Restrictions
A. You can't copy, modify, redistribute, sell, or sublicense the Game. You can't reverse engineer it (except as otherwise allowed by law). You can't strip the copyright notices or other markings. You can't use it to do anything illegal.
4. Steam Connectivity
A. The Game integrates with Steamworks technology by Valve Corporation for certain features (including, but not limited to, overlay functionality, lobbies, and Steam Datagram Relay). The overall Game does not require Steam connectivity. Use of these features is subject to Steam's Subscriber Agreement. In the event of a conflict between this Agreement and the Steam Subscriber Agreement with respect to Steam services, the Steam Subscriber Agreement prevails. Any data collected or processed by Steam in connection with its networking services is governed by Valve's Privacy Policy, not this Agreement.
5. Peer to Peer Networking
A. The Game supports two multiplayer modes through Peer to Peer networking:
a. Steam SDR - Online play relayed through Steam's infrastructure. Requires a Steam account and is subject to the Steam Subscriber Agreement.
b. LAN - Direct play between devices on the same local network. You enter the host's local IP manually; there is no auto-discovery. No Steam account or internet connection needed.
I. LAN Mode Specific Terms - Your local IP address is visible to other devices on the same network. You are responsible for your own network and device security. LAN Mode is not designed for, or supported on, the public internet (including through port forwarding or UPnP). Gameplay data transmitted in this mode is insecure. You are responsible for complying with any rules of the network you connect to.
6. User Data
A. The Company does not collect, store, or process any personal information or usage data from users through the Game. The Game operates without transmitting any data to the Company’s servers. Any data collected is done so solely by third-party platforms (e.g., Steam) and is subject to their respective privacy policies.
7. Acceptable Use
A. We do not have the ability to identify individual users or monitor in-game activity. You are solely responsible for your interactions with other users. We are not liable for the conduct of any user. You agree you will not:
a. Harass or abuse other users. Using language or behavior that demeans, threatens, or harasses other players.
b. Cheat or exploit. Using hacks, bots, scripts, or third-party software to gain an unfair advantage, or exploiting bugs and glitches for competitive gain.
c. Violate intellectual property. Distributing the Game or its assets via file-sharing, extracting or sharing the Game's content, creating unauthorized derivative works, or reverse-engineering the Game.
d. Break the law. Using the Game for any purpose that violates applicable law or regulation.
B. If a violation is reported to us or to Steam, we may report the matter to Valve for action under the Steam Subscriber Agreement.
8. Disclaimer of Warranty
A. The Game is provided "AS IS" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose.
B. The Company does not warrant that the Game will meet your requirements or that the operation of the Game will be uninterrupted or error-free.
C. Multiplayer quality depends on your connection, other players' connections, and (for Steam SDR) Steam's infrastructure. We make no warranty that sessions will be uninterrupted or free from errors. We are not responsible for other players' conduct or your network conditions. We may modify, replace, or discontinue either mode at any time without notice or compensation.
9. Limitation of Liability
A. To the maximum extent permitted by applicable law, in no event shall the Company be liable for any direct, indirect, special, incidental, or consequential damages arising out of or in connection with the use or inability to use the Game, even if the Company has been advised of the possibility of such damages. In no event shall the Company's aggregate liability, whether arising in contract, tort, strict liability or otherwise, exceed the total fees paid by you for the Game. These limitations with respect to liability apply even if any remedy fails to provide adequate compensation.
10. Indemnity
A. Indemnification by You
a. You agree to indemnify, defend, and hold harmless Company, and its officers, directors, employees, agents, and successors (collectively, "Indemnified Parties"), from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
I. Your use of the Game in breach of this Agreement;
II. Your violation of any applicable law or regulation;
III. Your violation of any third-party right, including any intellectual property right, arising from your use of the Game.
b. You shall be responsible for the defense of any claim subject to indemnification under this Section, at your sole cost and expense. Company may, at its sole discretion and at its own expense, assume the defense of any such claim, in which case you shall cooperate reasonably in such defense.
11. Termination
A. This Agreement will terminate automatically if you fail to comply with any of the terms and conditions of this Agreement. Upon termination, you must immediately cease all use of the Game and destroy all copies of the Game in your possession.
12. Severability
A. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions continue in full force and effect.
13. Governing Law
A. This Agreement is governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws principles. Any dispute arising under this Agreement that cannot be resolved amicably shall be resolved in the state or federal courts located in Massachusetts.
14. Surviving Clauses
A. The Intellectual Property Ownership (Section 2), Restrictions (Section 3), Disclaimer of Warranty (Section 8), Limitation of Liability (Section 9), Indemnity (Section 10), Severability (Section 12), and Governing Law (Section 13) sections survive termination of this Agreement.
15. Changes to These Terms
A. We may update these Terms at any time or for any reason.
16. Entire Agreement
A. This Agreement constitutes the entire agreement between you and us regarding the Game and supersedes all prior or contemporaneous agreements, representations, or understandings, whether written or oral.
If you have any questions or concerns about this EULA, please contact Pluestar Studios LLC at legal@pluestarstudios.com.
