Please read this End User License Agreement (the "Agreement") carefully before installing or using NekoTrak (the "Software"). By installing, copying, or using the Software, you acknowledge that you have read and understood this Agreement and agree to be bound by it. This Agreement applies in addition to the Steam Subscriber Agreement. If the terms conflict, the terms governing Steam account services or other Valve services apply to those services, while this Agreement governs the Software itself.
1. License Grant
Bocchi The Dev (the "Developer", "we", or "us") grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software obtained through Steam on personal computers that you own or control. You may use the Software for personal or commercial purposes, subject to this Agreement, the Steam Subscriber Agreement, and applicable law.
This license does not transfer ownership of the Software or any intellectual-property rights to you. You may make a reasonable number of backup copies for your own use, provided that all copyright and proprietary notices remain intact.
2. Software Functionality
NekoTrak is a Windows desktop application for local activity tracking, time records, task management, focus sessions, Pomodoro timers, reminders, desktop-pet features, media recognition, Overlay Clock features, and optional Steam or Discord Rich Presence integrations.
The Software may change as it is updated through Steam. Individual features can depend on Windows permissions, Steam availability, third-party services, hardware, or settings that you choose. We do not promise that every feature will be available on every device or in every region.
3. Privacy and Data
3.1 Local-first processing and no Developer-server upload
The Software is designed to operate locally. Bocchi The Dev does not operate a user-account server, advertising network, analytics SDK, Sentry integration, or automatic telemetry upload for NekoTrak. We do not routinely receive or upload your activity database, task history, focus history, pet data, or settings to a server controlled by Bocchi The Dev.
This statement does not mean that all information always remains on your device. Information can leave your device when you enable or use an optional integration or make a request to a third party, as described below. Valve, Discord, websites, network providers, proxy providers, and support-channel providers process information under their own terms and privacy policies.
3.2 Information the Software may read, create, or store
Depending on the features you enable, the Software may read, derive, or store the following information:
(a) Application activity: foreground application names, process information, full executable paths, application categories, application switches, usage duration, and window titles. Paths and titles may contain personal information such as a Windows account name or document name.
(b) Input and idle activity: counts of keyboard presses and mouse clicks, idle periods, and related session timing. The Software does not record the keys you press, the text you type, mouse coordinates, or clipboard contents.
(c) Website activity: when Website Tracking is enabled, the domain, full URL, page title, and related page details from supported browsers. A URL may contain search terms, document identifiers, or other information supplied by the website.
(d) Tasks and focus records: Todo text, notes, subtasks, completion state, priority, reminders, repetition settings, linked applications, Pomodoro counts, session start and end times, pauses, idle duration, application switches, input counts, self-assessments, and calculated focus scores.
(e) Media information: playback state and metadata exposed by Windows System Media Transport Controls or supported legacy-player window titles, such as song title, artist, album, source application, and timing information.
(f) Pet and application settings: pet name and behavior settings, reminder settings, application preferences, Presence selections, timer preferences, backup preferences, and other settings needed to provide the Software.
(g) Steam information: when Steamworks features are used, the Software may read your SteamID, Steam persona name, avatar, current game, local Steam library metadata, and achievement state. It may write Rich Presence and achievement changes through Steamworks.
(h) Diagnostics and local support files: application logs, database backups, configuration files, website icon caches, text crash reports, and Windows Error Reporting (WER) dumps may be created or retained locally. These files are not automatically uploaded to the Developer.
3.3 Purposes of processing
The Software uses the information above to:
(a) record local application activity, timelines, statistics, heatmaps, and focus analysis;
(b) provide Todo management, Pomodoro and other timer modes, reminders, pet behavior, and Overlay Clock features;
(c) calculate session and daily focus information and display it in the application;
(d) recognize media and retrieve website names or icons when those features are enabled;
(e) show user-selected activity in Steam or Discord Rich Presence and synchronize Steam achievements;
(f) encrypt, back up, restore, migrate, and maintain local application data; and
(g) identify errors and support reliability when local logs or crash files are reviewed by you or voluntarily submitted by you.
3.4 Local storage, encryption, and retention
The main activity database and database backups use SQLCipher encryption. Encryption reduces risk but does not guarantee that local data cannot be accessed if an attacker obtains your files or the identifiers needed to derive the key.
Not every file is protected by SQLCipher. In particular, configuration files, the database manifest, logs, website icon caches, text crash reports, and WER dumps are not SQLCipher databases and are not promised to have application-level encryption. Windows account security, device security, and Steam account security also affect protection.
Activity, task, focus, pet, settings, and related database records remain on your device until you delete them, replace or remove the database, or uninstall the Software. Automatic backups run according to your settings and may remain until you delete them or the retention limit removes them. Steam Cloud may retain copies outside the Developer's control.
3.5 User controls in Settings
You can control future processing through the Software's Settings and related controls. Available controls include:
(a) enabling or disabling application tracking, keyboard/mouse input counting, media recognition, and Website Tracking;
(b) enabling Privacy Mode to prevent application and website titles or full URLs from being retained or displayed;
(c) enabling or disabling Steam Rich Presence, Discord Rich Presence, and desktop-pet reminders;
(d) selecting which application, title, media, Todo, timer, clock, timestamp, or custom fields may appear in Presence;
(e) applying title-display controls to individual applications or websites;
(f) changing, deleting, or clearing Todo, application, website, and backup records;
(g) changing or disabling automatic backups and adjusting backup retention.
Disabling a setting stops or limits future processing. It does not automatically delete information that was already stored or sent. To delete information held by Valve, Discord, a website, Steam Cloud, or another provider, you must use that provider's controls or contact that provider.
1. Steam, Discord, and Website Services
4.1 Steam
Steam Rich Presence and Steamworks achievements operate according to your configuration and Steam's availability. Depending on the Presence fields you select, the Software may send Valve an application name, selected window title, media title or artist, Todo or focus status, timer or clock information, custom text, and timestamps. Steam determines how that information is displayed and who can see it under your Steam privacy settings.
If Steam Cloud or Steam Auto-Cloud is enabled both for the release and in your Steam settings, Steam may store and synchronize NekoTrak files between devices. Synchronized files may include the encrypted database, configuration, and the database manifest. Valve controls Steam Cloud availability, storage, and retention. Deleting a local copy or uninstalling the Software does not by itself delete a Steam Cloud copy.
Valve's handling of Steam account, Presence, achievement, and Cloud data is governed by the [Steam Privacy Policy](https://store.steampowered.com/privacy_agreement/) and the [Steam Subscriber Agreement](https://store.steampowered.com/subscriber_agreement/).
4.2 Discord
Discord Rich Presence is disabled by default. If you enable it, the Software sends the activity fields you select through the Discord Social SDK. Discord may display those fields on your profile, friends list, or server member list according to your Discord settings. The Software does not use this integration to read Discord messages, contacts, voice, or video.
Discord's handling of this information is governed by the [Discord Privacy Policy](https://discord.com/privacy). You can stop new Discord Presence updates by disabling the feature in NekoTrak or Discord.
4.3 Website metadata requests
When Website Tracking creates a website entry, or when you explicitly preview or refresh metadata, the Software may request the website page, web manifest, and same-origin icon resources. These requests can expose the requested URL, request time, IP address, User-Agent, and normal connection information to the target website, network provider, or proxy. The Software does not send your local activity database to the website.
Each website and network provider processes request information under its own terms. Disabling Website Tracking prevents automatic creation of new website activity records but does not delete existing records or cached icons.
5. Third-Party Components
The Software includes open-source and third-party components. Each component is governed by its own license. The complete notices and license texts are shipped with the Software in `THIRD_PARTY_NOTICES.txt` and the accompanying license files. Those terms remain applicable to the relevant components, and this Agreement does not limit rights granted by an applicable open-source license.
Third-party services, including Steam, Discord, Windows, websites, proxies, and cloud-storage providers, are independent of the Developer. Their availability, content, security, and privacy practices are outside the Developer's control.
6. User Content
The Software allows you to create or enter task text, notes, custom status text, application labels, website labels, pet names, and other content. You retain ownership of content that you provide, subject to any rights held by third parties.
You are responsible for ensuring that your content and any status you publish through Steam or Discord comply with applicable law, the rights of others, the Steam Subscriber Agreement, Discord's terms, and any relevant platform rules. Do not use the Software to publish unlawful, infringing, deceptive, abusive, or harmful content.
7. Restrictions
You may not:
(a) reverse engineer, decompile, or disassemble the Software except to the extent expressly permitted by applicable law;
(b) remove, alter, or obscure copyright, trademark, license, or proprietary notices;
(c) rent, lease, sublicense, sell, or commercially redistribute the Software as a standalone product;
(d) interfere with Steamworks, Discord, Windows, or other third-party services, or bypass technical restrictions imposed by those services;
(e) use the Software to violate applicable law, the Steam Subscriber Agreement, Discord terms, or platform conduct rules; or
(f) use the Software to infringe intellectual-property, privacy, publicity, or other rights of another person.
8. Intellectual Property
All rights in the Software, excluding third-party components and user content, are owned by Bocchi The Dev or its licensors. NekoTrak, its name, branding, interface, original artwork, source code, and documentation are protected by applicable intellectual-property laws.
Except for the limited license granted in Section 1 or rights granted by third-party licenses, no rights are granted to you by implication, estoppel, or otherwise.
9. Age Requirement and Minors
The Software is not directed to children under 13, or to a higher minimum age where local law requires one. If you are below the applicable minimum age, you may not use the Software. Parents and legal guardians are responsible for evaluating the Software's suitability and supervising use by minors in their care.
The Developer does not knowingly seek or receive personal information directly from children through the desktop Software. If you believe a child has submitted information directly to the Developer, contact us using Section 17.
10. Export Control and Sanctions
You may not use, export, re-export, or transfer the Software in violation of applicable export-control, sanctions, or import laws. You are responsible for determining whether the laws of your country permit you to obtain and use the Software and its encryption features.
11. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, RELIABILITY, ACCURACY, AND ERROR-FREE OPERATION. THE DEVELOPER DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, DEFECT-FREE, OR FREE OF HARMFUL COMPONENTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR SERVICE AVAILABILITY, ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS AGREEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER'S TOTAL CUMULATIVE LIABILITY ARISING FROM THE SOFTWARE OR THIS AGREEMENT WILL NOT EXCEED THE AMOUNT YOU PAID THROUGH STEAM TO OBTAIN THE SOFTWARE.
These exclusions and limitations do not apply to liability that cannot be excluded or limited under mandatory law.
13. Termination
(a) This Agreement begins when you first install or use the Software and continues until terminated.
(b) Your license ends automatically if you materially breach this Agreement or applicable third-party terms.
(c) Upon termination, you must stop using the Software and delete copies in your possession, except for copies retained by Steam or required by law.
(d) Sections concerning privacy, third-party services, intellectual property, restrictions, disclaimers, liability, dispute resolution, and general terms survive termination to the extent necessary to give them effect.
14. Dispute Resolution
(a) Steam distribution, payment, account, Steamworks, and Steam Cloud disputes are subject to the procedures and terms between you and Valve in the Steam Subscriber Agreement.
(b) Any other dispute between you and the Developer should first be raised in good faith through the contact details in Section 17. If the dispute cannot be resolved, it will be handled through the courts or other process required by the mandatory law of your jurisdiction.
(c) Nothing in this Section limits consumer-protection rights or other rights that cannot be waived under the law applicable to you.
15. Amendments
We may revise this Agreement when the Software, its data practices, or applicable legal requirements change. The revised Agreement will show a new last-updated date and may be distributed with a Steam update or posted through an appropriate Steam community channel. Continued use after the effective date constitutes acceptance of the revised Agreement. If you do not agree, stop using and uninstall the Software.
16. Severability and Entire Agreement
If a court or authority finds a provision of this Agreement invalid or unenforceable, the remaining provisions will remain in effect, and the affected provision will be interpreted or replaced to the maximum extent permitted to reflect its original purpose.
This Agreement, together with the applicable Steam Subscriber Agreement and third-party license notices, is the entire agreement between you and the Developer concerning the Software and supersedes prior representations about the Software. If a third-party license grants you additional rights, that license controls for its component.
