Terms of Use — Mars Directive

These Terms are an agreement between you and Cortextual AI LLC, the Florida publisher of Mars Directive and its online services (the "Game"). Our registered address is in §14. By installing, launching or playing the Game, you accept these Terms. If you disagree, do not install or play.

Blackdeep Technologies Ltd, Bulgaria, develops the Game and operates its servers and AI services. Both companies are joint controllers of player data. The Privacy Policy forms part of these Terms and explains our data practices and responsibilities.

1. Who may use the Game

1.1 Steam account. You need a valid Steam account in good standing and must meet Valve's account requirements.

1.2 Minimum age. You must be at least 13, or 16 in the EEA, UK and Switzerland unless your country sets a lower digital-consent age, no lower than 13.

1.3 Children. The Game is not directed to children under 13. If we learn we hold data from a child below the applicable minimum age, we delete the account and data (Privacy Policy §10).

1.4 Capacity. If you are under 18 or your local age of majority, a parent or guardian must be involved, consent to your use, accept these Terms on your behalf and take responsibility for it.

1.5 Accounts. Keep your credentials secure; you are responsible for activity on your account. Do not share, sell or transfer it. These responsibilities also apply to optional Discord linking.

2. Territorial availability

2.1 Restricted territories. The Game is not offered in, and may not be used in or from: Afghanistan, Belarus, Cuba, Hong Kong SAR, Iran, Macao SAR, Mainland China, Myanmar, North Korea (DPRK), Russia or Syria.

2.2 Basis. Restrictions reflect applicable sanctions, export controls, local licensing rules and our operational decisions. They may change.

2.3 Distribution. We limit the storefront markets in which the Game is available.

2.4 Your undertaking. You confirm you are not located in, ordinarily resident in, or accessing the Game from a restricted territory, or subject to applicable sanctions, including the U.S. OFAC Specially Designated Nationals and Blocked Persons list and EU or UK sanctions lists.

2.5 Enforcement. We may suspend or terminate accounts reasonably believed to breach §2.4. Deliberately bypassing territorial restrictions is a material breach.

3. Licence to play

3.1 Licence. Subject to these Terms, you receive a personal, limited, non-exclusive, non-transferable, revocable licence to install and play for private, non-commercial entertainment.

3.2 Restrictions. Except where applicable law permits despite these restrictions, you must not:

  • copy, distribute, rent, lease, lend, sublicense or make the Game publicly available;
  • reverse engineer, decompile, disassemble or attempt to derive its source code;
  • modify, cheat, hack, or use bots, scrapers, automation or unauthorised software;
  • bypass security, rate limits, credit accounting or content-safety features;
  • use the Game or its outputs to train, fine-tune or benchmark machine-learning models;
  • access servers or APIs through anything other than the official client; or
  • use the Game unlawfully.

3.3 Ownership. We or our licensors own the Game's software, authored content, assets and trademarks. You acquire no ownership in them. AI-generated dialogue is covered by §4.6.

3.4 Streaming. You may capture, stream and monetise gameplay footage if you comply with §4.5, do not imply our endorsement, and do not distribute the Game or substantial assets outside footage.

4. AI-generated content

4.1 AI characters. Characters' dialogue, voices and behaviour are generated by AI systems in response to your input. No human reads or responds to your messages during play.

4.2 Providers. Third-party AI providers process input for dialogue, transcription and speech. Privacy Policy §5 lists providers and the data each receives.

4.3 Reliability. AI output may be inaccurate, inappropriate, repetitive or inconsistent. It does not represent our views or advice. Do not rely on character dialogue as factual information or medical, legal, psychological, financial or other professional guidance.

4.4 Distress. Characters cannot provide crisis help. If you are in distress or experiencing thoughts of self-harm or suicide, contact local emergency services or a crisis helpline, such as those listed at Find A Helpline.

4.5 Your inputs. Do not submit unlawful content, infringe others' rights, include others' personal data, or try to generate illegal material, including child sexual abuse material, terrorist content, or content promoting self-harm or violence. You are responsible for your input. We may suspend or terminate accounts and report to authorities where legally required.

4.6 Input and output rights. We do not claim ownership of your input text. We do not guarantee that AI output qualifies for copyright protection or grants you exclusive rights; other players may receive identical or similar output.

5. Credits

5.1 Use. Each AI exchange consumes "credits" based on its computational cost, including any speech processing.

5.2 Free of charge. The Game and credits are currently free. New accounts receive an initial allocation; further grants are discretionary.

5.3 Credits have no monetary value. They are a limited, revocable, non-transferable licence to use a feature, not property, currency or a stored-value or payment instrument. You cannot redeem them for cash or value, sell, gift, trade or transfer them.

5.4 Paid options. We may introduce paid credits or change credit costs. Before purchases are available, we will update these Terms and the storefront. Purchases will be subject to Steam's payment and refund terms and applicable consumer rights (§6).

5.5 Expiry. Free credits expire when your account closes or is terminated, and may expire after inactivity on notice. Paid credits may be withdrawn only as permitted by law, however your account ends (§§7.3, 8.3).

5.6 Limits. We may set fair-use limits, rate limits and credit caps to protect availability.

6. Consumer rights (EEA / UK)

Nothing in these Terms excludes or limits mandatory consumer rights.

6.1 Conformity. We supply the Game in conformity with the contract. Statutory remedies for faulty digital content remain available under applicable law, including EU Directive 2019/770 and the UK Consumer Rights Act 2015.

7. Availability, changes and early-access status

7.1 Development. Features, content, credit costs and AI models may change. Routine changes may occur without notice; materially adverse changes are subject to §7.4. Applicable rights under Article 19 of Directive (EU) 2019/770 and the UK Consumer Rights Act 2015 remain unaffected.

7.2 Availability. Internet access, our servers and third-party AI services are required. Availability is not guaranteed; we may suspend service for maintenance, security or capacity.

7.3 Discontinuation. We may discontinue all or part of the Game. If this is permanent and you hold paid credits, we will give reasonable prior notice through the Steam store page and refund or compensate unused paid credits as required by law.

7.4 Terms changes. We give reasonable advance notice of material changes through the Game or a Steam announcement. If you disagree, you may stop playing and close your account. EEA and UK consumers materially and adversely affected may terminate free of charge within 30 days of notice; §7.3 applies to paid credits. Continued play after the effective date constitutes acceptance.

8. Suspension and termination

8.1 By you. Stop playing at any time; request account deletion at support@blackdeep.tech.

8.2 By us. We may suspend or terminate access for material breach, legal requirements or security, legal or operational risks, with notice where practicable. Serious breaches, including §4.5 content, cheating or sanctions and territorial violations, may lead to immediate action without prior notice.

8.3 Effect. Your licence ends and free credits are forfeited. Paid credits are not forfeited; they are dealt with under §§5.5 and 7.3 and applicable law. Sections 3.3, 4.3, 4.6, 5.3 and 9–12 survive termination.

9. Disclaimers

To the fullest extent permitted by law, the Game is provided "as is" and "as available", without express or implied warranties, including merchantability, fitness for purpose, non-infringement, accuracy or uninterrupted operation. AI content may be objectionable or unreliable. These exclusions apply only where lawful; mandatory consumer rights remain unaffected.

10. Limitation of liability

10.1 Exceptions. Nothing limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or other liability that law prohibits limiting.

10.2 Excluded loss. Subject to §10.1 and applicable law, we exclude liability for indirect, incidental, special, consequential, exemplary or punitive damages, or loss of profits, revenue, data, goodwill or credits.

10.3 Cap. Subject to §10.1, total liability relating to the Game and these Terms is limited to the greater of USD 100 or what you paid us in the 12 months before the event giving rise to the claim.

10.4 EEA and UK consumers. Liability for foreseeable loss from our breach or negligence is not excluded; §§10.2–10.3 apply only as permitted by mandatory consumer law.

11. Indemnity

If you are not acting as a consumer, and to the extent lawful, you indemnify us for claims, damages and reasonable costs arising from your breach, unlawful use or inputs violating §4.5.

12. Governing law and disputes

12.1 Law. Florida law governs, excluding conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.

12.2 Courts. Subject to §12.3, Miami-Dade County, Florida state and federal courts have exclusive jurisdiction, and you consent to personal jurisdiction there.

12.3 Consumers. EEA and UK consumers retain mandatory protections of their home country's law and may bring proceedings in the courts of their place of residence.

12.4 Informal resolution. Before filing a claim, please contact support@blackdeep.tech and allow 30 days to try to resolve it.

13. General

13.1 Agreement. These Terms and the Privacy Policy form the entire agreement regarding the Game.

13.2 Severability. If a provision is unenforceable, the rest remains in force.

13.3 No waiver. Failure to enforce a provision does not waive it.

13.4 Assignment. You may not assign these Terms. We may assign them to an affiliate or in a merger, acquisition or asset sale, on notice to you.

13.5 Third parties. Valve and Discord are not parties and have no obligations under these Terms. Their own terms govern your use of their services.

13.6 Force majeure. We are not liable for failure caused by events beyond our reasonable control, including third-party AI outages.
