# FIBONEX END USER LICENSE AGREEMENT (EULA)
## INCLUDING PRIVACY NOTICE AND HEALTH & SAFETY INFORMATION

This End User License Agreement (“EULA” or “Agreement”) governs your use of the software product **Fibonex**, including the game, executable software, content, documentation, updates, patches, downloadable content, and other materials supplied by Fibonex in connection with the game (collectively, the “Software”).
This Agreement is between you (“User”, “you”, or “your”) and **Fibonex**, Austria (“Fibonex”, “Developer”, “we”, “us”, or “our”).

By downloading, installing, launching, accessing, or using the Software, you agree to this Agreement. If you do not agree, you must not use the Software.
Nothing in this Agreement limits any right or remedy that cannot lawfully be waived, excluded, or restricted under applicable law.

# PART I — END USER LICENSE AGREEMENT
## 1. Relationship to Steam
The Steam version of Fibonex is distributed through the Steam platform operated by Valve Corporation.
Your use of Steam, your Steam account, and transactions made through Steam are additionally governed by the **Steam Subscriber Agreement** and other applicable Steam terms.
Where a conflict concerns Steam platform functionality, Steam account use, Steam transactions, or rights and obligations governed by the Steam Subscriber Agreement, the Steam Subscriber Agreement controls to that extent.
Valve Corporation is not a party to this EULA between you and Fibonex.
Nothing in this Agreement authorizes any use of Steam contrary to Valve's applicable terms.

## 2. Purchases, Payment, Refunds, and Steam Licenses
Purchases made through Steam are processed according to Steam's applicable purchasing, payment, refund, and subscription rules together with mandatory consumer law.
Fibonex does not receive your complete payment-card information from ordinary Steam purchases.
Permission for educational use under this Agreement:
* does **not** make Fibonex free of charge;
* does **not** create an entitlement to free Steam keys;
* does **not** create an entitlement to complimentary, institutional, classroom, or volume licenses;
* does **not** authorize Steam account or credential sharing; and
* does **not** authorize simultaneous use beyond the licenses lawfully acquired.
Any separate institutional, site, classroom, volume, or commercial licensing arrangement must be expressly agreed with Fibonex where such an arrangement is required.

## 3. License Grant
Subject to your compliance with this Agreement and the applicable distribution-platform terms, Fibonex grants you a limited, non-exclusive, personal license to install, access, and use the Software for:
* personal entertainment;
* private use;
* permitted educational use under Section 4; and
* other uses expressly permitted by this Agreement.
The license is non-transferable except where mandatory applicable law expressly provides otherwise.
The Software is licensed, not sold. No ownership interest in the Software is transferred to you.
Commercial use is prohibited except where expressly permitted by this Agreement, including the content-creation rights set out in Section 8, or separately authorized by Fibonex in writing.

## 4. Educational Use
Fibonex expressly permits educational use of the Software, including:
* use by students, teachers, educators, and trainers;
* use in schools, universities, courses, workshops, and other learning environments;
* teaching, learning, research, demonstration, and training; and
* educational presentations or demonstrations.
Educational use is permitted only where the required copies, accounts, subscriptions, or licenses have been lawfully acquired.
Educational use does **not**:
* grant ownership of the Software;
* imply free access or free licenses;
* permit resale of the Software;
* permit sublicensing of the Software;
* permit unauthorized account sharing;
* permit redistribution of the Software; or
* permit commercial exploitation of Fibonex itself.
For avoidance of doubt, educational use expressly permitted by this Section is not considered prohibited commercial use merely because an educator receives ordinary compensation or an educational institution charges ordinary tuition or participation fees, provided that Fibonex itself is not being resold, sublicensed, or commercially exploited and all required licenses have been obtained.
Separate institutional licensing may be required for uses not covered by ordinary individual licenses or the applicable distribution-platform terms.

## 5. Minors and Age Requirements
Fibonex is designed to be suitable for educational and family-oriented use.
This does not override age requirements imposed by Steam, applicable platform rules, age ratings, or applicable law.
A person may use the Steam version of Fibonex only where that person is legally permitted to use the relevant Steam account and the Steam service.
Where applicable law requires consent or authorization from a parent or legal guardian before a minor may enter into this Agreement or use the Software, the required consent or authorization must be obtained.
Parents and legal guardians are responsible for supervising a minor's use of the Software where required or appropriate.
Nothing in this Agreement authorizes circumvention of Steam's age requirements or any applicable age restriction.
Additional provisions concerning minors and privacy appear in Part II of this document.

## 6. Ownership and Intellectual Property
Fibonex and its licensors retain all rights, title, and interest in and to the Software and all intellectual property embodied in it, including, where applicable:
* source code and object code;
* software architecture and protectable game mechanics;
* graphics, animations, user-interface elements, and visual designs;
* text, educational content, questions, exercises, and documentation;
* music, sound effects, and other audio;
* names, logos, and trademarks;
* databases and compilations;
* downloadable content and updates; and
* other protected assets.
Except for the limited rights expressly granted under this Agreement, no right or license is granted to you by implication, estoppel, or otherwise.

## 7. Third-Party and Open-Source Components
The Software may contain third-party software, libraries, assets, fonts, frameworks, open-source components, or other materials.
Those components may be subject to separate license terms, notices, attribution requirements, or copyright statements.
Where a third-party or open-source license grants rights that conflict with a restriction in this Agreement, the applicable third-party or open-source license governs the relevant component to the extent required by that license or applicable law.
This Agreement does not restrict rights granted directly to you under applicable open-source licenses.

## 8. Streaming, Videos, Screenshots, and Content Monetization
Subject to this Section, Fibonex permits you to:
* livestream gameplay;
* publish gameplay recordings;
* upload screenshots and gameplay clips;
* create reviews, tutorials, walkthroughs, educational demonstrations, and commentary; and
* monetize such content through ordinary platform advertising, subscriptions, sponsorships, or viewer donations.
This permission applies only to intellectual property that Fibonex has the authority to license.
You may not:
* claim ownership of Fibonex or its assets;
* redistribute the Software itself;
* distribute extracted game assets as standalone content;
* imply sponsorship, endorsement, certification, or partnership by Fibonex where none exists;
* use Fibonex content in violation of applicable law or third-party rights; or
* use separately licensed third-party material beyond the rights granted by the relevant rights holder.
Fibonex may withdraw this permission for specific content where reasonably necessary to address infringement, unlawful activity, fraud, or misuse of Fibonex intellectual property.

## 9. Modding
Fibonex permits the creation and use of modifications (“Mods”) subject to this Agreement.
You may:
* create Mods for Fibonex;
* use Mods privately;
* share Mods without charge;
* create educational Mods; and
* use official or documented modding interfaces where provided.
Unless separately authorized in writing, you may not:
* sell or license Mods for payment;
* require payment to access a Mod;
* redistribute Fibonex itself with a Mod;
* distribute extracted Fibonex assets as standalone asset packs;
* incorporate third-party material without the necessary rights;
* create or distribute malware or malicious code;
* circumvent DRM, access controls, security mechanisms, or platform restrictions through a Mod; or
* use Mods in violation of applicable law, Steam rules, or third-party rights.
You retain rights you lawfully hold in your original Mod content.
Fibonex retains all rights in the underlying Software and Fibonex assets.
Updates may modify or break compatibility with Mods. Fibonex has no obligation to preserve Mod compatibility.
If Mods are distributed through Steam Workshop or another third-party platform, that platform's applicable terms also apply.

## 10. Restrictions
Except where this Agreement expressly permits an activity, or mandatory applicable law permits it notwithstanding this Agreement, you may not:
* copy or redistribute the Software;
* sell, rent, lease, sublicense, or commercially exploit the Software;
* reverse engineer, decompile, disassemble, or attempt to derive source code from the Software;
* circumvent technological protection measures, DRM, security controls, or access restrictions;
* use unauthorized cheats, bots, automation, manipulation tools, or exploits;
* attempt to obtain unauthorized access to protected Software components or third-party systems;
* remove or alter copyright, trademark, attribution, or proprietary notices;
* misrepresent the origin or ownership of the Software; or
* use the Software for unlawful purposes.
Restrictions on reverse engineering, interoperability, security research, or similar activities apply only to the extent permitted by applicable law.
For avoidance of doubt, educational use expressly permitted under Section 4 is not prohibited commercial use.

## 11. Early Access, Beta, Preview, and Unfinished Versions
Fibonex may be distributed in Early Access, beta, preview, testing, or otherwise unfinished form.
Such versions may:
* contain defects, bugs, or incomplete functionality;
* have performance or compatibility issues;
* change substantially before final release;
* gain, lose, or change features;
* change game mechanics, balancing, educational content, or interfaces;
* require save-data migration;
* reset or invalidate progress; or
* never receive particular planned or discussed features.
Roadmaps, development plans, previews, statements of intent, and descriptions of possible future features are not guarantees unless expressly incorporated into a binding agreement where applicable law requires otherwise.
Nothing in this Section excludes mandatory statutory rights regarding digital content.

## 12. Updates, Patches, and Changes
Fibonex may provide updates, patches, security fixes, compatibility changes, balancing changes, content changes, or other modifications.
Some updates may be distributed through Steam and may be necessary to continue using the Software with the supported version of the Steam platform.
Where mandatory consumer law requires particular updates, notices, remedies, continued conformity, or rights relating to modifications of digital content, those mandatory rights remain unaffected.
Fibonex does not guarantee perpetual compatibility with every operating system, hardware configuration, driver, third-party modification, or obsolete version of the Software.

## 13. Single-Player Software
Fibonex is currently designed as a **single-player game**.
Fibonex does not currently provide:
* multiplayer gameplay;
* matchmaking;
* in-game voice or text chat;
* Fibonex user accounts;
* social-network functionality;
* public player profiles;
* leaderboards;
* cloud-based competitive statistics; or
* in-game communication between players.
Steam itself is a third-party platform and may provide platform-level functionality independently of Fibonex.
Any Steam functionality is governed by Valve's applicable terms and privacy practices.

## 14. Educational and Accessibility Disclaimer
Fibonex may be used as an educational or learning tool, but it is not a substitute for professional teaching, educational assessment, medical advice, psychological advice, or other professional services.
Unless expressly stated otherwise:
* no particular learning outcome is guaranteed;
* no academic result or qualification is guaranteed;
* educational content does not constitute professional advice; and
* teachers, parents, guardians, and institutions remain responsible for determining whether the Software is appropriate for their particular users and educational context.
Fibonex may provide accessibility-related settings or features.
Except where required by mandatory law, Fibonex does not warrant that the Software will satisfy every individual accessibility requirement or conform to a particular accessibility standard unless such conformity is expressly stated.

## 15. Health and Safety Warning
Video games and screen-based software can cause discomfort or adverse physical effects in some individuals.
Possible effects may include:
* eye strain;
* headaches;
* fatigue;
* dizziness;
* nausea;
* motion sickness;
* disorientation; or
* photosensitive seizures or seizure-like symptoms triggered by flashing lights, rapidly changing images, patterns, or other visual stimuli.
If you experience altered vision, dizziness, eye or muscle twitching, disorientation, loss of awareness, involuntary movement, convulsions, or other concerning symptoms, stop using the Software immediately and seek appropriate medical advice before resuming use.
Users should take reasonable breaks and use the Software in an appropriate environment.
Parents and guardians should supervise children's use as appropriate.
Fibonex is provided for entertainment and educational purposes. It is **not a medical device**, and Fibonex makes no medical or therapeutic claim concerning the Software.

## 16. Suspension and Termination
This Agreement remains in effect until terminated.
Fibonex may suspend or terminate rights granted under this Agreement where you materially breach this Agreement and, where applicable law requires an opportunity to cure the breach, fail to remedy it within the required or reasonable period.
Fibonex may take immediate action where reasonably necessary to prevent:
* fraud;
* unlawful activity;
* security threats;
* infringement; or
* serious harm to Fibonex or third parties.
Upon valid termination, you must cease use of the Software to the extent required by law and this Agreement.
Any statutory rights concerning refunds, digital-content conformity, termination, or remedies remain unaffected.

## 17. Warranty and Mandatory Consumer Rights
Nothing in this Agreement excludes, restricts, or modifies any warranty, guarantee, remedy, or consumer right that cannot lawfully be excluded, restricted, or modified.
To the maximum extent permitted by applicable law, and only insofar as mandatory rights do not apply, the Software is provided **“as is”** and **“as available.”**
Fibonex does not make additional warranties regarding:
* uninterrupted or error-free operation;
* compatibility with every device or system;
* preservation of Mods;
* particular educational outcomes; or
* suitability for every individual purpose.
For consumers, mandatory laws governing digital content, conformity, updates, remedies, refunds, and other consumer protections prevail over any inconsistent provision of this Agreement.

## 18. Limitation of Liability
Nothing in this Agreement excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
In particular, nothing excludes liability to the extent legally non-excludable for:
* intentional misconduct;
* gross negligence where it cannot lawfully be limited;
* death or personal injury;
* fraud;
* mandatory product liability; or
* other liability that applicable law requires to remain unrestricted.
To the maximum extent permitted by applicable law, Fibonex is not liable for indirect, incidental, special, exemplary, punitive, or consequential loss, including loss of profits, business opportunity, or data, where such damages may lawfully be excluded.
Where applicable law permits limitation of liability for ordinary negligence, Fibonex's liability shall be limited to reasonably foreseeable damage typical of the contractual relationship.
Any monetary liability cap applies only where lawful and shall not restrict mandatory consumer remedies.
Nothing in this Section reduces rights that consumers have under mandatory law in their country of residence.

## 19. Export Controls and Sanctions
You may not use, export, re-export, transfer, or make the Software available in violation of applicable export-control, trade-sanctions, embargo, or similar laws.
This Section does not require conduct prohibited by applicable law.

## 20. Governing Law and Jurisdiction
This Agreement is governed by the laws of the **Republic of Austria**, excluding its conflict-of-law rules and, to the extent applicable, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer, this choice of law does not deprive you of mandatory protections granted by the law that would otherwise apply in your country of habitual residence.
Nothing in this Agreement restricts a consumer's right to bring proceedings in a court that has jurisdiction under applicable mandatory law.
For users acting exclusively in the course of a trade, business, craft, or profession, the competent courts at Fibonex's registered seat shall have jurisdiction to the extent such an agreement is legally valid.

## 21. Severability
If any provision of this Agreement is invalid, unlawful, or unenforceable, that provision shall apply only to the maximum extent legally permissible.
The remaining provisions remain effective unless applicable law requires otherwise.
This Section shall not be interpreted to replace an invalid consumer term with a term that would itself be unlawful or unfair.

## 22. No Waiver
Failure by Fibonex to enforce a provision of this Agreement on one occasion does not constitute a waiver of that provision or of the right to enforce it later.

## 23. Assignment
You may not assign or transfer this Agreement or your rights under it except where applicable law expressly permits such transfer.
Fibonex may transfer this Agreement as part of a lawful merger, restructuring, sale of business, transfer of the Software, or similar transaction, provided mandatory consumer rights are respected.

## 24. Entire Agreement
This Agreement, together with applicable platform terms and any terms expressly incorporated by reference, constitutes the agreement between you and Fibonex concerning the license granted by Fibonex for the Software.
It does not replace the Steam Subscriber Agreement or agreements between you and third parties.

## 25. Changes to the EULA
Fibonex may update this EULA where reasonably necessary due to:
* changes in law;
* security requirements;
* technical changes;
* changes to the Software;
* new functionality; or
* changes to business or distribution arrangements.
Changes will not retroactively remove mandatory rights.
Where applicable law requires notice, separate acceptance, or another procedure before a material change becomes binding, Fibonex will follow that requirement.
The effective date of the current version is stated at the beginning of this document.

# PART II — PRIVACY NOTICE
## 26. Purpose and Status of This Privacy Notice
This Privacy Notice explains the limited circumstances in which Fibonex processes personal data in connection with the Software.
Fibonex is currently a single-player game and **does not operate gameplay analytics, player statistics, behavioral telemetry, advertising tracking, or in-game user accounts**.
The principal game-originated diagnostic information processed by Fibonex consists of **crash reports and associated technical diagnostic information**.
This Privacy Notice is included alongside the EULA for convenience.
Acceptance of the EULA is not, by itself, consent to optional processing of personal data.
Where applicable law requires consent for a particular form of processing, Fibonex will request that consent separately.

## 28. Information Fibonex Does Not Collect for Gameplay Analytics
Fibonex does not currently collect or maintain:
* gameplay progression analytics;
* player-performance statistics;
* level-completion statistics;
* feature-usage analytics;
* session-duration analytics;
* behavioral profiles;
* advertising identifiers;
* marketing profiles;
* player-location analytics;
* multiplayer data;
* chat or communication content;
* friends lists;
* Fibonex account credentials;
* public player profiles;
* leaderboard data; or
* cross-game or cross-service tracking data.
Fibonex does not use the Software to track users for advertising purposes.

## 29. Crash and Diagnostic Information
When the Software crashes or encounters a serious technical error, Fibonex may process a crash report.
Depending on the crash-reporting implementation and the nature of the error, a crash report may contain limited technical information such as:
* Fibonex version and build number;
* operating-system type and version;
* hardware or architecture information relevant to the crash;
* graphics or driver information relevant to the crash;
* error codes;
* exception information;
* stack traces;
* crash timestamps;
* technical logs associated with the crash; and
* other diagnostic information reasonably necessary to identify and correct the defect.
Crash reporting is used solely for purposes such as:
* reproducing crashes;
* diagnosing defects;
* improving stability;
* correcting compatibility problems;
* identifying recurring technical failures; and
* maintaining the security and reliability of the Software.
Fibonex does not intentionally attach your name, email address, gameplay progression, educational results, or behavioral profile to crash reports.
Crash reports are not used to create gameplay analytics or advertising profiles.
If crash reports are transmitted electronically, the infrastructure receiving the report may technically process connection information such as an IP address as part of transmitting or securing the request. Fibonex does not use such connection information for gameplay analytics, advertising, or behavioral profiling.

## 30. Support and Voluntary Communications
If you voluntarily contact Fibonex, for example by email, Fibonex may process:
* your email address;
* your name or display name if you provide it;
* the contents of your message;
* attachments you provide;
* technical information you voluntarily provide; and
* correspondence necessary to respond to the request.
You should avoid sending personal or sensitive information that is not necessary for the support request.
Support communications are separate from in-game data collection.

## 31. Payment Information
Payments for the Steam version of Fibonex are processed by Steam, Valve, and their applicable payment providers.
Fibonex does not receive your complete payment-card number or payment-card authentication credentials through ordinary Steam purchases.
Valve processes data relating to Steam accounts and Steam transactions in accordance with Valve's own terms and privacy documentation.

## 32. Purposes and Legal Bases
Where the GDPR, UK GDPR, or equivalent privacy legislation applies, Fibonex processes personal data only where an applicable legal basis exists.
### 32.1 Crash Diagnostics and Software Reliability
Limited crash and diagnostic information may be processed where necessary for Fibonex's legitimate interests in:
* diagnosing defects;
* maintaining software stability;
* correcting technical failures;
* maintaining compatibility; and
* protecting the integrity and security of the Software.
Where applicable, the legal basis may be Article 6(1)(f) GDPR or an equivalent provision, subject to the required balancing of Fibonex's interests against the rights and interests of the affected person.
Where another legal basis is required by applicable law, Fibonex will rely on that basis instead.
### 32.2 Support Requests
Information submitted in connection with a support request may be processed where necessary to:
* respond to the request;
* provide requested assistance;
* perform contractual obligations; or
* pursue the legitimate interest of providing customer support.
### 32.3 Legal Obligations
Fibonex may process information where necessary to comply with applicable legal obligations, binding court orders, or lawful governmental requests.

## 33. No Gameplay Analytics, Profiling, or Advertising
Fibonex does not currently operate gameplay analytics or usage-statistics systems.
In particular, Fibonex does not use crash reports to:
* measure player engagement;
* measure educational performance;
* rank players;
* profile player behavior;
* personalize advertising;
* target advertising;
* track users across applications or websites; or
* make automated decisions about users.
Fibonex does not sell personal data.
Fibonex does not share personal data for cross-context or behavioral advertising.

## 34. Children and Minors — Privacy
Fibonex is designed to be suitable for educational and family-oriented audiences.
The Steam version remains subject to Steam's applicable minimum-age and account requirements.
Fibonex does not provide in-game registration, social functionality, multiplayer communication, behavioral advertising, or gameplay profiling.
Fibonex does not knowingly request personal information from children through the Software.
Crash reporting is limited to technical diagnostic information and is not intended to identify the player.
Where Fibonex becomes aware that personal information relating to a child has been processed in circumstances in which parental authorization or another legal requirement was necessary but not satisfied, Fibonex will take the measures required by applicable law.

## 35. Educational Institutions
The ordinary Steam version of Fibonex does not require educational institutions to provide Fibonex with student:
* names;

* health information; or
* other student-profile information.
Schools and other educational institutions should not send such information to Fibonex unless genuinely necessary for a specific support request and legally permitted.
If Fibonex later introduces institutional accounts, classroom-management functionality, cloud synchronization, student profiles, or similar services, additional privacy and contractual terms may be required before those features are introduced.

## 36. Recipients and Service Providers
Personal data processed directly by Fibonex may be disclosed only where reasonably necessary to:
* crash-reporting or diagnostic service providers used by Fibonex;
* infrastructure providers necessary to receive or store crash reports;
* professional advisers where necessary;
* public authorities where disclosure is legally required; or
* a successor entity in connection with a lawful merger, restructuring, acquisition, or transfer of the Fibonex business or relevant assets.
Valve separately processes information relating to Steam under Valve's own terms and privacy practices.
Where applicable data-protection law requires it, processors acting on behalf of Fibonex are subject to appropriate contractual data-protection obligations.
Fibonex does not sell personal data.

## 37. International Data Transfers
Fibonex is based in Austria.
A crash-reporting or infrastructure provider may process crash-related information outside Austria, the European Economic Area, the United Kingdom, or Switzerland.
Where applicable data-protection law requires safeguards for such a transfer, Fibonex will use an appropriate legal transfer mechanism, which may include:
* an adequacy decision;
* Standard Contractual Clauses;
* an applicable UK transfer mechanism; or
* another legally recognized safeguard.

## 38. Data Retention
Fibonex retains identifiable crash and diagnostic information only for as long as reasonably necessary to:
* investigate the relevant defect;
* identify recurring technical failures;
* verify that a defect has been corrected;
* maintain security and software reliability; or
* comply with applicable legal obligations.
Support correspondence is retained only for as long as reasonably necessary to resolve the request and meet applicable legal or evidentiary requirements.
When identifiable information is no longer required, it will be deleted, anonymized, or otherwise handled in accordance with applicable law.
Information that has been irreversibly anonymized and can no longer reasonably identify an individual may be retained for technical purposes without being treated as personal data.

## 39. Data Security
Fibonex uses technical and organizational safeguards appropriate to the limited nature and risk of the processing.
Measures may include, where appropriate:
* access controls;
* restricted administrative access;
* data minimization;
* transport encryption;
* secure storage;
* software and infrastructure updates;
* backups; and
* security procedures.
No system can provide absolute security. This Section does not constitute a guarantee that a security incident can never occur.

## 40. Your Privacy Rights
Depending on your location and applicable law, you may have rights regarding personal data concerning you, including rights to:
* request access;
* request correction;
* request deletion;
* request restriction of processing;
* object to certain processing;
* receive portable data where applicable;
* withdraw consent where processing is based on consent;
* obtain information about processing; and
* lodge a complaint with a competent supervisory authority.
Not every right applies in every circumstance, and applicable legal exemptions may apply.

## 41. Automated Decision-Making

# PART I — END USER LICENSE AGREEMENT
## 1. Relationship to Steam
The Steam version of Fibonex is distributed through the Steam platform operated by Valve Corporation.
Your use of Steam, your Steam account, and transactions made through Steam are additionally governed by the **Steam Subscriber Agreement** and other applicable Steam terms.
Where a conflict concerns Steam platform functionality, Steam account use, Steam transactions, or rights and obligations governed by the Steam Subscriber Agreement, the Steam Subscriber Agreement controls to that extent.
Valve Corporation is not a party to this EULA between you and Fibonex.
Nothing in this Agreement authorizes any use of Steam contrary to Valve's applicable terms.

## 2. Purchases, Payment, Refunds, and Steam Licenses
Purchases made through Steam are processed according to Steam's applicable purchasing, payment, refund, and subscription rules together with mandatory consumer law.
Fibonex does not receive your complete payment-card information from ordinary Steam purchases.
Permission for educational use under this Agreement:
* does **not** make Fibonex free of charge;
* does **not** create an entitlement to free Steam keys;
* does **not** create an entitlement to complimentary, institutional, classroom, or volume licenses;
* does **not** authorize Steam account or credential sharing; and
* does **not** authorize simultaneous use beyond the licenses lawfully acquired.
Any separate institutional, site, classroom, volume, or commercial licensing arrangement must be expressly agreed with Fibonex where such an arrangement is required.

## 3. License Grant
Subject to your compliance with this Agreement and the applicable distribution-platform terms, Fibonex grants you a limited, non-exclusive, personal license to install, access, and use the Software for:
* personal entertainment;
* private use;
* permitted educational use under Section 4; and
* other uses expressly permitted by this Agreement.
The license is non-transferable except where mandatory applicable law expressly provides otherwise.
The Software is licensed, not sold. No ownership interest in the Software is transferred to you.
Commercial use is prohibited except where expressly permitted by this Agreement, including the content-creation rights set out in Section 8, or separately authorized by Fibonex in writing.

## 4. Educational Use
Fibonex expressly permits educational use of the Software, including:
* use by students, teachers, educators, and trainers;
* use in schools, universities, courses, workshops, and other learning environments;
* teaching, learning, research, demonstration, and training; and
* educational presentations or demonstrations.
Educational use is permitted only where the required copies, accounts, subscriptions, or licenses have been lawfully acquired.
Educational use does **not**:
* grant ownership of the Software;
* imply free access or free licenses;
* permit resale of the Software;
* permit sublicensing of the Software;
* permit unauthorized account sharing;
* permit redistribution of the Software; or
* permit commercial exploitation of Fibonex itself.
For avoidance of doubt, educational use expressly permitted by this Section is not considered prohibited commercial use merely because an educator receives ordinary compensation or an educational institution charges ordinary tuition or participation fees, provided that Fibonex itself is not being resold, sublicensed, or commercially exploited and all required licenses have been obtained.
Separate institutional licensing may be required for uses not covered by ordinary individual licenses or the applicable distribution-platform terms.

## 5. Minors and Age Requirements
Fibonex is designed to be suitable for educational and family-oriented use.
This does not override age requirements imposed by Steam, applicable platform rules, age ratings, or applicable law.
A person may use the Steam version of Fibonex only where that person is legally permitted to use the relevant Steam account and the Steam service.
Where applicable law requires consent or authorization from a parent or legal guardian before a minor may enter into this Agreement or use the Software, the required consent or authorization must be obtained.
Parents and legal guardians are responsible for supervising a minor's use of the Software where required or appropriate.
Nothing in this Agreement authorizes circumvention of Steam's age requirements or any applicable age restriction.
Additional provisions concerning minors and privacy appear in Part II of this document.

## 6. Ownership and Intellectual Property
Fibonex and its licensors retain all rights, title, and interest in and to the Software and all intellectual property embodied in it, including, where applicable:
* source code and object code;
* software architecture and protectable game mechanics;
* graphics, animations, user-interface elements, and visual designs;
* text, educational content, questions, exercises, and documentation;
* music, sound effects, and other audio;
* names, logos, and trademarks;
* databases and compilations;
* downloadable content and updates; and
* other protected assets.
Except for the limited rights expressly granted under this Agreement, no right or license is granted to you by implication, estoppel, or otherwise.

## 7. Third-Party and Open-Source Components
The Software may contain third-party software, libraries, assets, fonts, frameworks, open-source components, or other materials.
Those components may be subject to separate license terms, notices, attribution requirements, or copyright statements.
Where a third-party or open-source license grants rights that conflict with a restriction in this Agreement, the applicable third-party or open-source license governs the relevant component to the extent required by that license or applicable law.
This Agreement does not restrict rights granted directly to you under applicable open-source licenses.

## 8. Streaming, Videos, Screenshots, and Content Monetization
Subject to this Section, Fibonex permits you to:
* livestream gameplay;
* publish gameplay recordings;
* upload screenshots and gameplay clips;
* create reviews, tutorials, walkthroughs, educational demonstrations, and commentary; and
* monetize such content through ordinary platform advertising, subscriptions, sponsorships, or viewer donations.
This permission applies only to intellectual property that Fibonex has the authority to license.
You may not:
* claim ownership of Fibonex or its assets;
* redistribute the Software itself;
* distribute extracted game assets as standalone content;
* imply sponsorship, endorsement, certification, or partnership by Fibonex where none exists;
* use Fibonex content in violation of applicable law or third-party rights; or
* use separately licensed third-party material beyond the rights granted by the relevant rights holder.
Fibonex may withdraw this permission for specific content where reasonably necessary to address infringement, unlawful activity, fraud, or misuse of Fibonex intellectual property.

## 9. Modding
Fibonex permits the creation and use of modifications (“Mods”) subject to this Agreement.
You may:
* create Mods for Fibonex;
* use Mods privately;
* share Mods without charge;
* create educational Mods; and
* use official or documented modding interfaces where provided.
Unless separately authorized in writing, you may not:
* sell or license Mods for payment;
* require payment to access a Mod;
* redistribute Fibonex itself with a Mod;
* distribute extracted Fibonex assets as standalone asset packs;
* incorporate third-party material without the necessary rights;
* create or distribute malware or malicious code;
* circumvent DRM, access controls, security mechanisms, or platform restrictions through a Mod; or
* use Mods in violation of applicable law, Steam rules, or third-party rights.
You retain rights you lawfully hold in your original Mod content.
Fibonex retains all rights in the underlying Software and Fibonex assets.
Updates may modify or break compatibility with Mods. Fibonex has no obligation to preserve Mod compatibility.
If Mods are distributed through Steam Workshop or another third-party platform, that platform's applicable terms also apply.

## 10. Restrictions
Except where this Agreement expressly permits an activity, or mandatory applicable law permits it notwithstanding this Agreement, you may not:
* copy or redistribute the Software;
* sell, rent, lease, sublicense, or commercially exploit the Software;
* reverse engineer, decompile, disassemble, or attempt to derive source code from the Software;
* circumvent technological protection measures, DRM, security controls, or access restrictions;
* use unauthorized cheats, bots, automation, manipulation tools, or exploits;
* attempt to obtain unauthorized access to protected Software components or third-party systems;
* remove or alter copyright, trademark, attribution, or proprietary notices;
* misrepresent the origin or ownership of the Software; or
* use the Software for unlawful purposes.
Restrictions on reverse engineering, interoperability, security research, or similar activities apply only to the extent permitted by applicable law.
For avoidance of doubt, educational use expressly permitted under Section 4 is not prohibited commercial use.

## 11. Early Access, Beta, Preview, and Unfinished Versions
Fibonex may be distributed in Early Access, beta, preview, testing, or otherwise unfinished form.
Such versions may:
* contain defects, bugs, or incomplete functionality;
* have performance or compatibility issues;
* change substantially before final release;
* gain, lose, or change features;
* change game mechanics, balancing, educational content, or interfaces;
* require save-data migration;
* reset or invalidate progress; or
* never receive particular planned or discussed features.
Roadmaps, development plans, previews, statements of intent, and descriptions of possible future features are not guarantees unless expressly incorporated into a binding agreement where applicable law requires otherwise.
Nothing in this Section excludes mandatory statutory rights regarding digital content.

## 12. Updates, Patches, and Changes
Fibonex may provide updates, patches, security fixes, compatibility changes, balancing changes, content changes, or other modifications.
Some updates may be distributed through Steam and may be necessary to continue using the Software with the supported version of the Steam platform.
Where mandatory consumer law requires particular updates, notices, remedies, continued conformity, or rights relating to modifications of digital content, those mandatory rights remain unaffected.
Fibonex does not guarantee perpetual compatibility with every operating system, hardware configuration, driver, third-party modification, or obsolete version of the Software.

Fibonex is currently designed as a **single-player game**.
Fibonex does not currently provide:
* multiplayer gameplay;
* matchmaking;
* in-game voice or text chat;
* Fibonex user accounts;
* social-network functionality;
* public player profiles;
* leaderboards;
* cloud-based competitive statistics; or
* in-game communication between players.
Steam itself is a third-party platform and may provide platform-level functionality independently of Fibonex.
Any Steam functionality is governed by Valve's applicable terms and privacy practices.

* no academic result or qualification is guaranteed;
* educational content does not constitute professional advice; and
* teachers, parents, guardians, and institutions remain responsible for determining whether the Software is appropriate for their particular users and educational context.
Fibonex may provide accessibility-related settings or features.
Except where required by mandatory law, Fibonex does not warrant that the Software will satisfy every individual accessibility requirement or conform to a particular accessibility standard unless such conformity is expressly stated.

## 15. Health and Safety Warning
Video games and screen-based software can cause discomfort or adverse physical effects in some individuals.
Possible effects may include:
* eye strain;
* headaches;
* fatigue;
* dizziness;
* nausea;
* motion sickness;
* disorientation; or
* photosensitive seizures or seizure-like symptoms triggered by flashing lights, rapidly changing images, patterns, or other visual stimuli.
If you experience altered vision, dizziness, eye or muscle twitching, disorientation, loss of awareness, involuntary movement, convulsions, or other concerning symptoms, stop using the Software immediately and seek appropriate medical advice before resuming use.
Users should take reasonable breaks and use the Software in an appropriate environment.
Parents and guardians should supervise children's use as appropriate.
Fibonex is provided for entertainment and educational purposes. It is **not a medical device**, and Fibonex makes no medical or therapeutic claim concerning the Software.

## 16. Suspension and Termination
This Agreement remains in effect until terminated.
Fibonex may suspend or terminate rights granted under this Agreement where you materially breach this Agreement and, where applicable law requires an opportunity to cure the breach, fail to remedy it within the required or reasonable period.
Fibonex may take immediate action where reasonably necessary to prevent:
* fraud;
* unlawful activity;
* security threats;
* infringement; or
* serious harm to Fibonex or third parties.
Upon valid termination, you must cease use of the Software to the extent required by law and this Agreement.
Any statutory rights concerning refunds, digital-content conformity, termination, or remedies remain unaffected.

## 17. Warranty and Mandatory Consumer Rights
Nothing in this Agreement excludes, restricts, or modifies any warranty, guarantee, remedy, or consumer right that cannot lawfully be excluded, restricted, or modified.
To the maximum extent permitted by applicable law, and only insofar as mandatory rights do not apply, the Software is provided **“as is”** and **“as available.”**
Fibonex does not make additional warranties regarding:
* uninterrupted or error-free operation;
* compatibility with every device or system;
* preservation of Mods;
* particular educational outcomes; or
* suitability for every individual purpose.
For consumers, mandatory laws governing digital content, conformity, updates, remedies, refunds, and other consumer protections prevail over any inconsistent provision of this Agreement.

## 18. Limitation of Liability
Nothing in this Agreement excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
In particular, nothing excludes liability to the extent legally non-excludable for:
* intentional misconduct;
* gross negligence where it cannot lawfully be limited;
* death or personal injury;
* fraud;
* mandatory product liability; or
* other liability that applicable law requires to remain unrestricted.
To the maximum extent permitted by applicable law, Fibonex is not liable for indirect, incidental, special, exemplary, punitive, or consequential loss, including loss of profits, business opportunity, or data, where such damages may lawfully be excluded.
Where applicable law permits limitation of liability for ordinary negligence, Fibonex's liability shall be limited to reasonably foreseeable damage typical of the contractual relationship.
Any monetary liability cap applies only where lawful and shall not restrict mandatory consumer remedies.
Nothing in this Section reduces rights that consumers have under mandatory law in their country of residence.

## 19. Export Controls and Sanctions
You may not use, export, re-export, transfer, or make the Software available in violation of applicable export-control, trade-sanctions, embargo, or similar laws.
This Section does not require conduct prohibited by applicable law.

## 20. Governing Law and Jurisdiction
This Agreement is governed by the laws of the **Republic of Austria**, excluding its conflict-of-law rules and, to the extent applicable, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer, this choice of law does not deprive you of mandatory protections granted by the law that would otherwise apply in your country of habitual residence.
Nothing in this Agreement restricts a consumer's right to bring proceedings in a court that has jurisdiction under applicable mandatory law.
For users acting exclusively in the course of a trade, business, craft, or profession, the competent courts at Fibonex's registered seat shall have jurisdiction to the extent such an agreement is legally valid.

## 21. Severability
If any provision of this Agreement is invalid, unlawful, or unenforceable, that provision shall apply only to the maximum extent legally permissible.
The remaining provisions remain effective unless applicable law requires otherwise.
This Section shall not be interpreted to replace an invalid consumer term with a term that would itself be unlawful or unfair.

## 22. No Waiver
Failure by Fibonex to enforce a provision of this Agreement on one occasion does not constitute a waiver of that provision or of the right to enforce it later.

## 23. Assignment
You may not assign or transfer this Agreement or your rights under it except where applicable law expressly permits such transfer.
Fibonex may transfer this Agreement as part of a lawful merger, restructuring, sale of business, transfer of the Software, or similar transaction, provided mandatory consumer rights are respected.

## 24. Entire Agreement
This Agreement, together with applicable platform terms and any terms expressly incorporated by reference, constitutes the agreement between you and Fibonex concerning the license granted by Fibonex for the Software.
It does not replace the Steam Subscriber Agreement or agreements between you and third parties.

## 25. Changes to the EULA
Fibonex may update this EULA where reasonably necessary due to:
* changes in law;
* security requirements;
* technical changes;
* changes to the Software;
* new functionality; or
* changes to business or distribution arrangements.
Changes will not retroactively remove mandatory rights.
Where applicable law requires notice, separate acceptance, or another procedure before a material change becomes binding, Fibonex will follow that requirement.

When the Software crashes or encounters a serious technical error, Fibonex may process a crash report.

* hardware or architecture information relevant to the crash;
* graphics or driver information relevant to the crash;
* error codes;
* exception information;

Crash reporting is used solely for purposes such as:
* reproducing crashes;
* diagnosing defects;
* improving stability;

Fibonex does not intentionally attach your name, email address, gameplay progression, educational results, or behavioral profile to crash reports.
Crash reports are not used to create gameplay analytics or advertising profiles.
If crash reports are transmitted electronically, the infrastructure receiving the report may technically process connection information such as an IP address as part of transmitting or securing the request. Fibonex does not use such connection information for gameplay analytics, advertising, or behavioral profiling.
