BLIGHTENED: RELIC KEEPER
END USER LICENSE AGREEMENT
1. About this agreement
This agreement is between you and Xombis LLC, a Florida limited liability company ("Xombis," "we," or "us"). It governs your use of Blightened: Relic Keeper, including its software, updates supplied by us, and included content (the "Game"). Included content encompasses the eight unlockable Blightened comic issues made available through the Game.
Please read this agreement before accepting it. By selecting an acceptance option presented with this agreement, you agree to its terms. If you do not agree, do not accept or use the Game; you may request a refund under the applicable Steam refund policy and any rights provided by law. Nothing here limits rights that the law does not allow a contract to exclude or restrict.
2. Your license
When you lawfully obtain the Game, we grant you a limited, nonexclusive license to install and play it for your personal use and to access its included content through the features provided. You may install it on devices you own or control, subject to Steam's applicable account and access rules. Sharing, transfer, or backup expressly supported by Steam is permitted under its applicable rules. Mandatory rights under applicable law remain unaffected.
The Game and included content are licensed, not sold as intellectual property. Your payment does not transfer copyright, trademark rights, or ownership of the underlying software or content. This license continues unless ended as described below. The permission for recordings and reviews in Section 5 is an express exception to the personal-use restriction.
3. Ownership and third-party materials
To the extent applicable, Xombis and its licensors retain their respective intellectual property rights in the Game, including its code, artwork, characters, writing, comics, music, and other materials. Rights not expressly granted remain with their owners. We do not claim ownership of material or rights that belong to others or are not legally protectable.
Third-party components may carry separate license terms or notices supplied with the Game. Those terms govern the relevant components and take precedence over this agreement where they grant additional rights or conflict with it. This agreement does not restrict rights granted under an applicable open-source license.
4. Restrictions and legal exceptions
Except as this agreement, a separate applicable license, Steam's authorized features, or the law permits, you must not:
- Redistribute, sell, rent, sublicense, or make the Game or its included content available to others.
- Extract and distribute comic issues, comic pages, artwork, music, or other assets as standalone products or collections, whether free or paid.
- Copy, modify, or create derivative works from the Game or its included content beyond the permissions granted here.
- Reverse engineer, decompile, or disassemble the Game, or unlawfully bypass access controls.
- Remove or misrepresent copyright, trademark, or other ownership notices.
These restrictions do not prevent fair use, fair dealing, accessibility activities, interoperability work, security research, or other conduct to the extent applicable law permits that conduct notwithstanding a contractual restriction. They also do not restrict lawful criticism or reviews.
5. Gameplay videos, streaming, and reviews
You may create, publish, and monetize videos, livestreams, screenshots, and reviews featuring your gameplay, including through advertising, subscriptions, donations, or sponsorships. This permission covers Game material that Xombis owns or is authorized to license for that purpose. You remain responsible for obtaining any necessary permissions for third-party material outside that authority and for following the rules of your chosen platform.
You may show comic content incidentally during gameplay or use reasonable excerpts for commentary or review. This permission does not authorize publishing complete comic issues, page-by-page reproductions, or recordings primarily intended to substitute for reading the comics through the Game. Statutory exceptions remain unaffected.
Do not falsely imply that your content is official or endorsed by Xombis. Creating or sharing your content does not, by itself, grant Xombis permission to reuse it in advertising or other marketing. Any separate permissions you grant to a hosting platform are governed by that platform's terms.
6. Steam and refunds
Steam is operated by Valve. Your Steam account, purchases, downloads, and platform services are governed by the Steam Subscriber Agreement and applicable Steam policies. If implemented, Steam achievements and cloud saves are also subject to the applicable platform terms. This agreement does not promise that any optional Steam feature is included.
For Steam purchases, refund requests may be submitted through Steam Support under Steam's refund policy. This agreement does not replace or reduce that policy or any statutory refund or other remedy. If there is a conflict concerning Steam's platform services or purchase and refund procedures, the applicable Steam terms control, subject always to mandatory law.
7. Warranties and your statutory rights
You may have mandatory rights concerning satisfactory quality, fitness for purpose, conformity with the description, and remedies for defective digital content. Those rights remain in force, including any legally required repairs, updates, replacements, price reductions, or refunds.
ONLY WHERE PERMITTED BY APPLICABLE LAW, AND SUBJECT TO THOSE RIGHTS, THE GAME IS PROVIDED "AS IS" WITHOUT ADDITIONAL EXPRESS OR IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. This disclaimer does not override an express commitment we have made or a binding description of the Game. The disclaimer in this paragraph does not apply to consumers in the European Union or United Kingdom.
8. Liability
Nothing in this agreement excludes or limits liability for fraud, fraudulent misrepresentation, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that applicable law does not allow us to exclude or limit.
Subject to that protection, and only where lawful, Xombis is not liable for indirect or consequential losses arising from use of the Game, and our total liability arising from the Game or this agreement is limited to the amount you paid for the Game. These exclusions and this monetary limit do not apply to consumers in the European Union or United Kingdom, or to claims under mandatory consumer guarantees or other nonwaivable rights. Where a restriction is prohibited, the applicable law governs instead.
9. Ending this agreement
You may end this agreement by stopping use of the Game and deleting copies under your control. Doing so does not itself create or remove any refund right.
We may terminate this license for a material breach of this agreement. Where the breach can reasonably be corrected, we will give notice describing it and at least 30 days to correct it before termination. Immediate termination is reserved for a material breach that cannot reasonably be corrected or circumstances where applicable law permits immediate action to prevent serious harm.
After valid termination, you must stop using and delete the Game and included content, except where retention is legally permitted. Termination does not remove accrued statutory rights. Provisions concerning ownership, liability, and disputes continue only to the extent relevant and lawful.
10. Governing law and contact
Florida law governs this agreement, but this choice does not deprive consumers of mandatory protections available under the law of their usual residence. Disputes may be brought in any court with lawful jurisdiction, including consumer courts available to you under applicable law. This agreement does not require arbitration or waive class-action rights.
If a provision is unenforceable, the remaining provisions continue where lawful. A failure to enforce a term is not a waiver of it. Changes to this agreement will not reduce existing rights retroactively; any changes requiring your consent will take effect only with valid consent.
