This End User License Agreement and Terms of Service ("Agreement" or "Terms") is a binding agreement between you ("you" or the "User") and Lights Out Global Ventures Pvt. Ltd., a company incorporated in India (CIN U58203HR2025PTC136949) ("Lights Out", "we", "us" or "our"), governing your download, installation, access to, and use of the Paddock360 desktop application and related services (collectively, the "Service").
BY INSTALLING, ACCESSING, OR USING PADDOCK360, YOU AGREE TO BE BOUND BY THIS AGREEMENT. If you do not agree, do not install or use the Service. Because Paddock360 is distributed through Steam, your use is also subject to the Steam Subscriber Agreement and Valve Corporation's applicable policies, which apply in addition to these Terms.
1. DEFINITIONS
- "Application" / "Paddock360" means the Paddock360 desktop software, including all updates, patches, and accompanying documentation.
- "Supported Title" means a third-party racing or simulation game that Paddock360 is configured to work with by reading telemetry data that the game itself makes available through its officially published interfaces.
- "Telemetry Data" means the numeric performance and session data (for example lap times, speed, throttle, brake, gear, and similar values) that a Supported Title broadcasts or exposes during play, and which the Application records and displays.
- "User Content" means Telemetry Data, session records, notes, profile information, and other content you create, capture, or upload through the Service.
- "Subscription" means a paid, recurring plan that unlocks premium features of the Service, billed through Steam.
2. THE SERVICE — WHAT PADDOCK360 DOES
Paddock360 is a companion desktop application for sim-racing enthusiasts. When you play a Supported Title on your own computer, Paddock360 reads the telemetry data that the game makes available through its officially published interfaces, then records, visualises, and helps you analyse that data — for example as live graphs and numeric readouts shown alongside your driving, and as saved session summaries. Paddock360 supports both home simulator setups and public sim-centre setups, and lets you save your own racing data and also share to social media at your choice.
Paddock360 does not modify, patch, inject code into, decompile, or interfere with any Supported Title, and it does not copy, reproduce, or redistribute any game's content. It runs as a separate application and only consumes performance data that the game already exposes for third-party companion tools (such as dashboards and telemetry displays). Paddock360 is an independent product and is not affiliated with, endorsed by, or sponsored by the publishers of any Supported Title.
Live feature scope. The features described in this Agreement reflect the Service as currently offered. Additional features, additional Supported Titles, and other capabilities may be introduced over time; where the Service is offered in Early Access, you acknowledge it is under active development and features may change, be added, or be removed.
3. LICENCE GRANT
Subject to your compliance with this Agreement, Lights Out grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use one copy of the Application on devices you own or control, for your personal, non-commercial use, or — where you operate a licensed sim-centre or venue — for use in providing sim-racing experiences to your patrons in accordance with any applicable commercial terms agreed with us. All rights not expressly granted are reserved by Lights Out.
4. ACCOUNTS & REGISTRATION
Certain features require a Paddock360 account and/or a linked Steam account. You agree to provide accurate information, to keep your credentials secure, and to be responsible for activity under your account. You must be old enough to form a binding contract and to hold a Steam account in your jurisdiction; the Service is not directed to children under the age of 13 (or the minimum age required in your jurisdiction), and such persons must not use it.
5. FREE AND PAID TIERS; SUBSCRIPTIONS & BILLING
Paddock360 is offered with a free tier and one or more paid Subscription tiers that unlock premium features. All payments and Subscriptions are processed through Steam using Valve's in-application billing. By purchasing a Subscription you authorise Steam to charge the applicable recurring fee (for example monthly) to your Steam account until you cancel.
- Auto-renewal. Subscriptions renew automatically for successive billing periods at the then-current price unless cancelled before the renewal date.
- Cancellation. You may cancel a Subscription at any time through Steam or through the Service; cancellation takes effect at the end of the current paid period, and you retain premium access until then.
- Price. We may change Subscription prices prospectively; any change applies to billing periods after we give notice as required by Steam and applicable law. Introductory or launch pricing may be time-limited.
- Refunds. Payments are handled by Steam and are subject to Valve's refund policy. Except where required by law, fees are otherwise non-refundable.
- Free tier limits. The free tier may include usage limits (for example a limit on the number of stored sessions). Reaching a limit does not delete your access; it may restrict the creation of new records until you upgrade or free up capacity, as described in the Application.
6. THIRD-PARTY GAMES, TRADEMARKS & INTEROPERABILITY
You are responsible for lawfully obtaining and licensing any Supported Title you use. Paddock360 works with a Supported Title only by reading the telemetry data that the title exposes through its own officially published interfaces, in the manner those interfaces are intended to be used by companion applications. Paddock360 does not grant you any rights in any Supported Title.
All game names, logos, and trademarks referenced in or by the Service are the property of their respective owners. Any such reference is nominative — used only to identify the games Paddock360 is compatible with — and does not imply any affiliation, endorsement, sponsorship, or partnership between Lights Out and the owner of that title unless expressly stated in writing.
7. ACCEPTABLE USE & RESTRICTIONS
You agree that you will not, and will not permit others to:
- copy, modify, translate, reverse engineer, decompile, or disassemble the Application, or attempt to derive its source code, except to the extent this restriction is prohibited by applicable law;
- use the Service to cheat in, tamper with, modify, or gain an unfair advantage in any game, competition, or online service, or in any way that violates a Supported Title's own terms;
- rent, lease, sell, sublicense, distribute, or commercially exploit the Application except as expressly permitted;
- remove or alter any proprietary notices, or circumvent tier limits, licensing, or security measures;
- use the Service for any unlawful purpose, or to infringe the intellectual property or privacy rights of others; or
- upload or share content that is unlawful, or that you do not have the right to share.
8. USER CONTENT & TELEMETRY DATA
You own your User Content. As between you and Lights Out, you retain all rights in the Telemetry Data and other User Content you create through the Service. You grant Lights Out a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, and display your User Content solely to operate, provide, secure, and improve the Service for you — for example to record your sessions, generate your analytics and visualisations, sync your data, and enable features you use.
Sharing is your choice. Any sharing of your racing data or results to social media or third-party platforms is initiated by you, and once shared it is governed by that platform's terms. You are responsible for ensuring you have the right to share what you share.
We may generate and use aggregated or de-identified data (which does not identify you) for analytics, benchmarking, and product improvement.
9. INTELLECTUAL PROPERTY
The Application, including its software, design, user interface, branding, "Paddock360" and "Lights Out" names and logos, and all related intellectual property, is owned by Lights Out or its licensors and is protected by law. Except for the limited licence granted in Section 3, nothing in this Agreement transfers any ownership to you.
10. PRIVACY
Your use of the Service is subject to the Paddock360 Privacy Policy, available at https://paddock360.com/privacy/, which explains what personal data we collect and how we handle it. By using the Service you acknowledge the Privacy Policy.
11. UPDATES & AVAILABILITY
We may update, change, suspend, or discontinue the Service (or any feature) at any time, including to add or remove Supported Titles or features. We may deliver updates automatically through Steam. We do not guarantee uninterrupted or error-free operation.
12. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law. We do not warrant that the Telemetry Data captured or displayed will be complete, accurate, or suitable for any competitive, professional, or safety-critical purpose.
13. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Lights Out and its officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to the Service or this Agreement. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid to us (through Steam) for the Service in the twelve (12) months before the event giving rise to the claim, or (b) INR 5,000. Nothing in this Agreement excludes liability that cannot be excluded under applicable law.
14. INDEMNIFICATION
You agree to indemnify and hold harmless Lights Out from and against any claims, damages, and reasonable expenses arising out of your breach of this Agreement, your misuse of the Service, your User Content, or your violation of any law or third-party right.
15. TERM & TERMINATION
This Agreement applies for as long as you use the Service. We may suspend or terminate your access if you breach this Agreement or use the Service in a way that may cause harm or legal liability. You may stop using the Service at any time and uninstall the Application. Sections that by their nature should survive termination (including Sections 8–9 and 12–17) will survive.
16. CHANGES TO THESE TERMS
We may update this Agreement from time to time. If we make material changes, we will provide reasonable notice (for example through the Service, the Steam store page, or the update notes). Your continued use of the Service after changes take effect constitutes acceptance of the updated Agreement.
17. GOVERNING LAW & DISPUTE RESOLUTION
This Agreement is governed by the laws of India, without regard to conflict-of-laws rules. Subject to any mandatory rights you have as a consumer, the courts at Gurugram, Haryana, India will have exclusive jurisdiction over any dispute arising out of or relating to this Agreement, and the parties will first attempt to resolve any dispute amicably by good-faith discussion.
18. RELATIONSHIP WITH VALVE / STEAM
Paddock360 is distributed via Steam. Valve Corporation is not a party to this Agreement and is not responsible for the Service. Your use of Steam, and any purchase or Subscription made through Steam, is additionally governed by the Steam Subscriber Agreement and Valve's related policies. In the event of a conflict specifically concerning payment, refunds, or the Steam platform, Valve's applicable terms control for those matters.
