Terms of Service
These Terms of Service (the "Terms") set out the rights and obligations between Monogames and you, and the conditions under which Monogames provides its games (the "Game"). Before using the Game, please read these Terms in full and agree to them.
When you start playing the Game, an agreement for the use of the Game under these Terms is deemed to have been formed between Monogames and you. If you do not agree to these Terms, please stop using the Game.
1. Application
1.1. These Terms set out the conditions for providing the Game and the rights and obligations between Monogames and you regarding the use of the Game. They apply to every relationship between Monogames and you relating to the use of the Game.
1.2. Any rules for using the Game and the Privacy Policy that Monogames posts on its website form part of these Terms.
1.3. If these Terms differ from the rules in the preceding paragraph or any other description of the Game outside these Terms, these Terms prevail.
2. Rights
Except for the rights granted to you under these Terms, all rights, title, ownership and intellectual property rights in and to (i) the Game (including, whether individually or in combination, all text, graphics, music or sound, characters, names, themes, costumes, still images, video, audiovisual effects and other elements that make up all or part of the Game) and all copies of it, (ii) the intellectual property rights relating to the service, including trademarks, logos, trade names, service marks, patentable subject matter and other forms of intellectual property of Monogames and relating to the Game, and (iii) any other rights relating to the Game, belong to Monogames. The Game is protected by Japanese and international laws and copyright treaties.
3. Restrictions on Use
3.1. When using the Game, you must not:
(i) violate any applicable law, regulation or these Terms;
(ii) act against public order or morals;
(iii) use the Game for commercial or political purposes;
(iv) copy, scrape, reproduce, redisplay, reverse engineer, decompile, otherwise analyze, hack or modify the service, including the servers or networks used to provide the Game;
(v) access, or attempt to access, an account that is not your own;
(vi) interfere with other users' use of the service;
(vii) cheat or gain an unfair advantage in the Game or any other Monogames service;
(viii) use any software, service, tool or scheme to cheat or gain an unfair advantage without Monogames' prior written consent (including, without limitation, creating, developing, modifying, distributing, using, promoting, advertising, selling or commercializing such items);
(ix) interfere with the Game's security features;
(x) imitate or access the Game through unauthorized servers;
(xi) intercept, mine or collect information from the Game or its users without Monogames' prior written consent;
(xii) infringe the intellectual property rights or other rights of Monogames or any third party;
(xiii) remove any trademark, copyright or other intellectual property notice relating to the Game;
(xiv) be an antisocial force (meaning organized crime groups, their members, extremist political organizations, other antisocial forces and persons equivalent to them; the same applies below), or have any interaction with or involvement in antisocial forces, such as cooperating in or being involved with their maintenance, operation or management through funding or otherwise.
3.2. If you violate any item in the preceding paragraph or any other provision of these Terms, Monogames may immediately suspend or stop your access to the Game.
4. Use of the Game by Children
4.1. Monogames does not knowingly collect personal information from anyone under the age of 13 (or any other applicable minimum age where you live) without verifiable, express consent from a parent or guardian as required by law. Children aged 13 (or any other applicable minimum age where you live) or older but under 18 (or any other applicable age of majority where you live) must obtain consent from a parent or guardian before using the Game.
4.2. Parents and guardians of children under 18 (or the age of majority where you live) should read these Terms carefully before allowing their children to use the Game.
This English version is a translation provided for convenience. If there is any inconsistency between the Japanese and English versions, the Japanese version prevails.
