ROCKBEASTS
END USER LICENCE AGREEMENT FOR STEAM
This agreement is between you and LICHTHUND S.A., Aleja 3 Maja 2 / 49, 00-391 Warsaw, Poland, registered in the National Court Register under KRS 0000881308 ("Lichthund", "we", "us"). Lichthund is the publisher and licensor of ROCKBEASTS. These terms cover the Steam version of the game, its updates and any demo supplied under these terms. Contact: contact@lichthund.com.
1. YOUR AGREEMENT WITH US
By installing, launching or playing the game after you have been given an opportunity to read this agreement, you accept these terms. Please read and retain them. If you do not agree, do not install or use the game; contact Steam about any refund available under its rules and applicable law.
If you lack legal capacity to enter this agreement, a parent or legal guardian must act for you where the law requires it. Follow the game's age rating and Steam's age requirements.
The Steam Subscriber Agreement (https://store.steampowered.com/subscriber_agreement/) and other applicable Steam terms govern your Steam account, purchases, payments and platform services. This agreement governs the licence we grant and our relationship with you concerning the game. Neither document reduces your mandatory consumer rights.
2. THE LICENCE
We grant you a personal, non-exclusive licence to install and play a lawfully obtained copy on compatible devices, subject to this agreement and Steam's rules. Sharing and use through authorised Steam features remain permitted within those rules and applicable law.
The licence does not transfer ownership of the game, its music, artwork, characters, software or other content. Those rights remain with Lichthund or the relevant rights holders. Buying the game does not grant a separate licence to exploit its soundtrack or other assets.
3. PERMITTED USE AND RESTRICTIONS
You may make copies needed for authorised installation, operation and backup. Any transfer of a copy or licence is subject to Steam's terms and rights that applicable law gives you.
Except where we authorise it or the law permits it, you must not:
a) distribute, sell, rent or sublicense the game or extracted assets;
b) bypass protection against unauthorised access or copying;
c) decompile, reverse engineer or modify the game beyond rights allowed by applicable law;
d) use the game to infringe another person's rights, introduce malicious software or disrupt connected services.
These restrictions do not limit statutory rights concerning interoperability, error correction, lawful backup or other protected uses.
4. TECHNICAL REQUIREMENTS AND ONLINE FEATURES
Check the requirements on the Steam store page before obtaining the game. Some platform features, downloads and updates require a connection or a valid Steam account. Online features, including retrieving community choice percentages and sending bug reports, require internet access.
5. UPDATES AND CHANGES TO THE GAME
We provide updates required by applicable law, including updates needed to maintain conformity and security, and inform you when they are available. Installing an update can be necessary for compatibility or an online feature.
We may make other changes for a valid reason, such as addressing a security risk, correcting errors, improving compatibility or adapting to a legal or platform requirement. We will comply with applicable rules on notice, cost and your rights if a change adversely affects access to or use of the game. This clause does not permit us to disregard the game's agreed characteristics or your statutory remedies.
6. YOUR PRIVACY
Lichthund is the controller of the personal data it processes for gameplay telemetry and voluntary in-game bug reports. The ROCKBEASTS Game Privacy Notice (https://lichthund.com/rockbeasts-game-privacy/) explains the data we process, legal bases, service providers, international transfers, retention and your rights, including how to object, withdraw consent relating to a bug report or request deletion.
Accepting this agreement does not constitute consent to processing for which separate consent is required, and does not waive your privacy rights. Steam's own processing is covered by its privacy information.
7. GAMEPLAY TELEMETRY
The game sends gameplay data and related technical information to the analytics services we use. We use this information to detect and fix bugs, progression problems and related balance or stability issues, and to produce aggregate choice statistics. Where the GDPR applies, we rely on our legitimate interests in these purposes under Article 6(1)(f).
SEND STATS is enabled by default. You can stop further transmission of gameplay telemetry at any time by switching off SEND STATS in the game's settings. Doing so does not prevent you from playing the game. The Game Privacy Notice explains how to exercise your rights in relation to information already collected.
8. COMMUNITY CHOICE STATISTICS
We use data about choices made in the game to produce aggregate statistics that may be presented to players. The statistics presented do not identify individual players.
The collection of data used to produce these statistics is subject to the telemetry rules above, including the SEND STATS setting.
9. VOLUNTARY BUG REPORTS
You can voluntarily send a bug report to help us investigate and resolve a problem. The scope of the data to be sent is presented before you submit the report. The Game Privacy Notice explains how this data is processed.
By selecting Send report after the reporting information has been displayed, you consent to the processing of personal data contained in the report and its attachments to investigate the issue and develop or test a fix. You may withdraw this consent at any time as explained in the Game Privacy Notice. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
Bug reporting is separate from gameplay telemetry. You can voluntarily send a report when SEND STATS is off, and doing so does not switch telemetry back on.
10. PROBLEMS WITH THE GAME AND CONSUMER RIGHTS
If the game does not work as it should, you may also contact contact@lichthund.com with the game version and a description of the problem. Using the in-game reporting tool is not a condition for exercising your statutory rights.
Your statutory rights concerning supply, conformity, updates, remedies and withdrawal remain in force. Purchase and refund requests may also be addressed to Steam under its refund policy (https://store.steampowered.com/steam_refunds/) and applicable law. Our support channel does not replace or restrict claims against the responsible seller or trader. This agreement does not itself obtain or record any consent or acknowledgement required to start supplying digital content during a statutory withdrawal period.
11. RESPONSIBILITY
Our responsibility is determined by applicable law. Nothing here excludes or limits liability that cannot lawfully be excluded or limited, including liability for intentional misconduct or any non-excludable consumer remedy.
You are responsible for using the game lawfully and following reasonable security instructions. Using Steam or another service provider does not transfer responsibility for our own legal obligations to that provider.
12. ENDING THE LICENCE
You may stop using the game and uninstall it at any time. This does not prevent you from using a valid statutory remedy or obtaining a refund where available.
We may terminate this licence for a material breach. Where the breach can be remedied, we will first give reasonable notice and an opportunity to remedy it. Immediate action is reserved for cases where it is legally justified, including serious unlawful use or a security threat. If the licence is lawfully terminated, you must stop using the game under that licence, subject to your statutory rights.
Termination does not remove rights or obligations that already arose, including mandatory consumer rights. Stopping the game or uninstalling it does not by itself constitute a request to erase previously collected data; the Game Privacy Notice explains how to make such a request.
13. CHANGES TO THESE TERMS
We may propose changes where required by law, a relevant platform change or a material change to a covered feature. We will identify the change and explain when it applies, using the notice and acceptance process required by law.
An updated document does not retrospectively remove your rights. Where a change requires agreement, merely posting the new text does not replace that agreement. Updating this agreement does not replace any separate consent required for a new use of personal data.
14. LAW, LANGUAGE AND CONTACT
Polish law applies, subject to the mandatory protections available under the law of your habitual residence. Nothing in this agreement requires a consumer to bring a claim in a court contrary to applicable jurisdiction rules.
The English version is the original version of this agreement. Versions in other languages are translations. If there is any discrepancy, the English version prevails to the extent permitted by applicable law. Where mandatory law requires another language version to prevail or be used for interpretation, that requirement applies. This clause does not limit your mandatory consumer rights.
