# END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“User”) and Tyro, LLC (“Developer”) for the use of this video game software, including all related files, updates, content, artwork, audio, and documentation (collectively, the “Game”).
By installing, copying, accessing, or playing the Game, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not install or use the Game.

## 1. License Grant
Developer grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Game for personal, non-commercial entertainment purposes.
This license does not transfer ownership of the Game or any intellectual property rights.

## 2. Ownership
The Game, including all code, artwork, music, audio, writing, characters, designs, logos, trademarks, and other content, is owned by Developer or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.
All rights not expressly granted in this Agreement are reserved by Developer.

## 3. Restrictions
You agree that you will not:
* Copy, reproduce, distribute, or publicly display the Game except as permitted by law;
* Sell, sublicense, rent, lease, or commercially exploit the Game;
* Reverse engineer, decompile, modify, or attempt to derive the source code of the Game;
* Extract or reuse the Game’s assets, including models, textures, music, sound effects, or artwork;
* Use the Game in connection with unlawful, harmful, or fraudulent activity;
* Remove or alter copyright notices or proprietary markings.

## 4. User Content
If the Game allows creation or sharing of custom content, screenshots, videos, or mods, you retain ownership of your original content. However, by sharing such content related to the Game publicly, you grant Developer a non-exclusive, worldwide, royalty-free license to use, display, and promote that content in connection with the Game.

## 5. Updates and Changes
Developer may release patches, updates, balance adjustments, bug fixes, or other modifications to the Game at any time without notice.
Developer is not obligated to continue supporting or updating the Game.

## 6. Disclaimer of Warranties
THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVELOPER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
* MERCHANTABILITY,
* FITNESS FOR A PARTICULAR PURPOSE,
* NON-INFRINGEMENT,
* ACCURACY,
* RELIABILITY,
* OR UNINTERRUPTED OPERATION.
Developer does not guarantee that the Game will be free of bugs, errors, crashes, or interruptions.

## 7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE THE GAME.
THIS INCLUDES, BUT IS NOT LIMITED TO:
* LOSS OF DATA,
* LOSS OF SAVED GAME PROGRESS,
* COMPUTER FAILURE,
* HARDWARE DAMAGE,
* SOFTWARE CONFLICTS,
* OR LOST PROFITS.
YOUR USE OF THE GAME IS AT YOUR OWN RISK.

## 8. Health and Safety
Some users may experience discomfort, motion sickness, eyestrain, dizziness, or seizures triggered by flashing lights or visual patterns. If you experience any adverse symptoms while playing, stop use immediately and consult a medical professional if necessary.

## 9. Termination
This Agreement remains in effect until terminated.
Developer may terminate this Agreement if you violate any of its terms. Upon termination, you must stop using the Game and delete all copies in your possession.

## 10. Governing Law
This Agreement shall be governed and interpreted under the laws of the United States and the applicable laws of Guam, without regard to conflict of law principles.

## 11. Severability
If any provision of this Agreement is found unenforceable or invalid, the remaining provisions shall remain in full force and effect.

## 12. Entire Agreement
This Agreement constitutes the entire agreement between you and Developer regarding the Game and supersedes any prior agreements or understandings related to the Game.
