# End User License Agreement (EULA) – Ballerspiel
> **Preliminary version of 2026-10-26 – legal review in progress.**
> Translation of the German version.
Last updated: October 26, 2026
This agreement is between you and Luckywood Studios UG (haftungsbeschränkt),
Berkenbrücker Chaussee 13, 14943 Luckenwalde, Germany ("we"), and covers the
game Ballerspiel including updates and the server software (together "the
game"). The terms of the platform you bought the game on also apply (Steam
Subscriber Agreement or Epic Games Store EULA). Mandatory consumer protection
law takes precedence over anything in this agreement.
## 1. Licence
With your purchase you receive a non-exclusive, non-transferable, perpetual
right to install and play the game for private purposes. All rights in the
game remain with us or our licensors.
**Videos, streams and reviews are expressly allowed.** You may show footage and
screenshots of the game, stream it live, publish videos and reviews and earn
money with them (for example through ad revenue, subscriptions, donations or
the platforms' partner programs). You do not need to ask us. Please do not give
the impression that you are an official partner of ours if you are not.
## 2. Your own servers
You may run the dedicated server software we ship or publish free of charge,
including publicly, for your community or a LAN party. Donations, sponsorship
and membership fees (for example of a club or clan) to fund your server are
allowed. Only admission or fees for being allowed to play on your server
require our prior consent in text form (e.g. by email). Commercial game server
providers may rent out Ballerspiel servers; this needs neither our consent nor
any payment to us. Whoever runs a server is responsible for it and for the data processed on it.
## 3. What is not allowed
- Selling, renting or otherwise commercially exploiting the game, except as
permitted above.
- Decompiling or modifying the game, except where the law expressly allows it.
- Using or distributing cheats, third-party bots or other programs that give an
unfair advantage or disrupt the game.
- Insulting, threatening or harassing other players in chat, or spreading
unlawful content.
Server administrators (including us on our official servers) may remove, ban or
mute players who break these rules.
## 4. Online services
Online play uses platform services (Steam, Epic Online Services) and our
official servers. We aim for reliable operation; we do not promise any
particular availability of official servers. Should we ever stop running
official servers, we intend to announce this at least three months in advance.
LAN play, your own servers and play against bots are not affected. The
statutory rights of users, in particular in case of defects of the game, remain
unaffected.
## 5. Updates
Updates are free. We provide the updates required by law, in particular
security updates (Section 327f BGB). Beyond that, updates may add or change
content or adjust game balance; material disadvantages to you from such changes
are governed by Section 327r BGB. Statutory warranty rights remain unaffected.
## 6. Warranty and liability
Statutory warranty rights apply.
We are liable without limitation for intent and gross negligence, for injury to
life, body or health, and under the German Product Liability Act. For slight
negligence we are liable only for breach of an essential contractual obligation
and limited to the foreseeable, typical damage. Otherwise liability is excluded.
Statutory rights in case of defects (warranty) are not affected by these
liability rules.
## 7. Third-party software
The game uses the Unreal® Engine. Unreal® is a trademark or registered trademark
of Epic Games, Inc. in the United States of America and elsewhere. Unreal®
Engine, Copyright 1998–2026, Epic Games, Inc. All rights reserved.
Further licences (fonts, art and sound assets) are listed in the game's credits
menu and at ballerspiel.org/licenses.html. The game ships the text of the SIL
Open Font License in its `Licenses` folder.
## 8. Final provisions
German law applies, excluding the UN Convention on Contracts for the
International Sale of Goods. If you are a consumer habitually resident in
another country, the protection of that country's mandatory law remains
unaffected. If any provision is invalid, the rest of this agreement remains in
force.
