Effective date: 1 October 2026.
This date does not make the Agreement binding before it was properly presented and accepted. For a player who accepts it later, it applies from that acceptance, subject to applicable law, and does not retrospectively make earlier conduct a breach of this Agreement.
This End User License Agreement ("Agreement") is between you and Motocross Digital Services, a French société par actions simplifiée (SAS) with share capital of EUR 1,000, registered with the Annecy Trade and Companies Register under number 941 392 904, whose registered office is 5 rue de l'Industrie, 74000 Annecy, France ("MXDS", "we", "us").
Support, legal notices, reports and appeals: MTG support form. You may also send written complaints or legal notices to our registered office below.
Privacy Notice: MTG Privacy Policy.
This Agreement governs the Motocross the Game software, its updates and downloadable content (the "Game"), and the multiplayer, account, leaderboard and community features we operate for the Game (the "Services"). It applies to features actually made available to you and does not promise that any particular feature exists or will be released.
Read this Agreement before accepting it. By selecting the clearly labelled acceptance control presented with this Agreement, you agree to its terms. If you do not agree, do not accept or start using the Game under this Agreement. Contact the seller about any available refund; your statutory rights remain unaffected.
You must have legal capacity to enter this Agreement. If applicable law requires a parent or legal guardian to authorize your participation, obtain that authorization through the applicable process before accessing the Game or Services. Age ratings, platform age restrictions and local minimum-age rules also apply.
Your purchase is also governed by the terms of the seller through which you purchased the Game. Your use of Steam or another platform is governed by that platform's terms. This Agreement governs our Game and Services and does not grant us control over your platform account or override the platform's rules. Mandatory law prevails over conflicting terms. Third-party software license rights are addressed in Section 14.
Additional event, testing or modding terms apply only when properly presented and accepted where acceptance is required. They cannot retrospectively remove rights already acquired or override mandatory protections.
Subject to this Agreement and the rights associated with your purchase, we grant you a limited, personal, non-exclusive license to install and use an authorized copy of the Game for personal entertainment on supported devices. Authorized platform family-sharing and household-use features are permitted within the platform's rules. Transfers remain subject to applicable law and the seller's lawful terms.
The Game is licensed, not a transfer of ownership of its intellectual property. MXDS and its licensors retain their respective rights in software, audiovisual works, tracks, bikes, rider models, sounds, branding and other protected material. No license to extract or reuse those elements in a separate product is granted by purchasing the Game.
Except as expressly permitted here, separately authorized in writing, or permitted by applicable law, you must not copy, redistribute, rent, sublicense, sell access to, or commercially exploit the Game or its protected elements. Lawful backup copies and other non-waivable rights remain permitted.
Except to the extent expressly permitted by mandatory law, you must not:
Mandatory exceptions take priority. Nothing in this Agreement prohibits lawful observation, study or testing, necessary backup copies, qualifying interoperability work, lawful security research, or any other activity that applicable law does not allow us to restrict. In particular, the non-waivable exceptions under Articles 5 and 6 of Directive 2009/24/EC and Article L.122-6-1 of the French Intellectual Property Code remain available, subject to their legal conditions. Prior permission, notification, or a confidentiality agreement is not required where imposing it would contradict those rights. We will not sanction conduct solely because it exercises such a right.
If you discover a vulnerability, we encourage a private report through the contact above. This Agreement does not itself authorize intrusion into our servers, access to other players' data, service disruption, or exploitation beyond your lawful authority. A good-faith report is not itself misconduct and does not create a bounty entitlement.
Modding is not authorized under this Agreement unless and until MXDS expressly enables it for the relevant Game version, platform, tool and content category, or grants you specific written permission. A roadmap, community discussion, technical possibility, absence of detection, or third-party upload is not authorization.
Subject to Section 3's mandatory exceptions, before that authorization you must not create, install, load, use, publish, distribute, sell or otherwise make available unauthorized modifications or tools designed to modify the Game. This includes cosmetic replacements as well as changes to physics, bike or rider behavior, tracks, collisions, traction, suspension, power, timing, progression, audio, textures, models, liveries or interfaces. The restriction applies to offline and online use, private and public distribution, and free and paid mods.
The following remain permitted when used as intended: settings exposed by the Game; official customization and content tools; official updates and DLC; and ordinary platform, controller, accessibility, recording and streaming features that do not alter protected Game components, bypass safeguards or provide an unfair competitive advantage. Merely having a general-purpose development tool on your device is not a violation.
If official mod support launches, permission extends only to the scope announced and the applicable mod terms. Permission for one tool, platform, mode or content category does not authorize others. A privately operated server does not create additional permission. Future support does not automatically authorize previously unauthorized distribution or waive earlier actionable breaches.
Unauthorized modding may result in removal of affected results or content, suspension, and, for serious or repeated breaches, permanent restrictions or termination under Section 10. Copyright or other legal remedies may also apply where the facts meet the requirements of the relevant law.
You must not cheat or deliberately undermine fair play. Prohibited conduct includes:
Reporting a bug in good faith, losing a race, having a poor connection or using an authorized accessibility feature is not, by itself, cheating.
Treat players, staff, volunteers and event participants with respect. These rules apply to your behavior and content in the Game, Services and official communities we operate, including names, messages, voice communications, profiles and uploads.
You must not engage in bullying, repeated unwanted contact, stalking, sexual harassment, discriminatory abuse, hate speech, credible threats, incitement to violence, doxxing, extortion, scams, impersonation, or organized harassment. Child sexual exploitation, grooming and any sexual exploitation or abuse of minors are strictly prohibited. You must not disclose another person's private information or share intimate material without lawful authority and required consent.
Do not use the Game or Services to distribute illegal material, malware or infringing content; spam; submit knowingly false reports; fabricate evidence; or retaliate against someone for reporting misconduct or appealing a decision.
Serious behavior outside our Services may be considered only where reliable evidence connects it directly to a concrete safety, security or integrity risk within the Game or Services, such as threats against a player or organizing cheating in the Game. We do not claim general authority over your unrelated private conduct.
Good-faith criticism, negative reviews, lawful complaints, legitimate refund requests and disagreement with MXDS are not violations merely because they are unfavorable to us.
Use the reporting contact above to report misconduct. Include available identifiers, approximate date and time, and relevant evidence. Do not obtain evidence by invading privacy or breaking the law.
Keep your login credentials secure and report suspected compromise promptly. Do not buy, sell, rent or transfer accounts contrary to applicable law and the relevant platform rules, impersonate someone else, or use stolen or fraudulently obtained licenses or payment details.
When investigating account activity, we will consider credible evidence of compromise and will not treat an account holder as automatically responsible for every unauthorized act solely because it occurred through their account.
You must not evade an active restriction through alternate accounts, another person's account, manipulated identifiers, or another device. Buying another copy does not cancel a valid restriction on your use of the affected Services. We may extend a restriction to accounts reliably shown to be controlled by you and used to evade it. A shared IP address or shared household alone is insufficient to establish common control.
Purchases must be authorized and made with a legitimate payment method. Prices, delivery, cancellation and refund conditions are those disclosed by the seller, subject to applicable law. For Steam purchases, use Steam's applicable purchase and refund processes; MXDS cannot determine a bank's or platform's decision.
You must not knowingly submit false payment disputes, falsely claim that an authorized purchase was unauthorized, use stolen payment details, seek duplicate reimbursement for the same loss, or deliberately retain access by circumventing entitlement removal after a valid refund or payment reversal.
A chargeback or refund request is not automatically fraud. You retain all lawful rights to dispute an unauthorized charge, seek remedies for defective or undelivered content, complain to a payment provider or authority, and request a refund. Contacting us first is encouraged but is not a condition of exercising those rights.
Where payment is reversed or fails, the entitlement funded by that transaction may be temporarily restricted while its status is verified and may be removed if the transaction is cancelled, refunded or remains unpaid. Any interim restriction must be necessary and proportionate and must not obstruct statutory remedies. Unrelated valid purchases are not automatically forfeited.
Reliable evidence of deliberate payment fraud may justify restrictions on purchasing or online access and, for serious or repeated fraud, permanent suspension or termination under Section 10. A disputed charge alone is not sufficient evidence of deliberate fraud. If a reversal is corrected or we made an error, we will promptly reassess the restriction and restore valid entitlements as appropriate.
We may seek recovery of an amount lawfully owed and proven losses caused by fraud, together with costs only where legally recoverable. This Agreement imposes no automatic chargeback fine, investigation fee or punitive debt. We will not collect the same loss twice.
You retain any rights you hold in original content you submit through authorized Game or Service features. You must have the necessary rights and permissions, including for third-party logos, likenesses, music and designs. Submission does not authorize otherwise prohibited mods.
To operate the feature through which you submit content, you grant MXDS a non-exclusive, worldwide, royalty-free license to host, store, reproduce, technically adapt, display and transmit that content only as reasonably necessary to provide, secure and moderate that feature. This license lasts while the content is available through the feature and for limited subsequent periods needed for backups, legal obligations or dispute handling, consistently with applicable law and the Privacy Notice. It does not transfer ownership or authorize unrelated advertising use of your identity. Non-waivable moral rights remain intact.
You may publish screenshots and gameplay videos from publicly released versions, including monetized commentary and livestreams, provided you comply with this Agreement and obtain any third-party rights you need. This permission does not authorize asset extraction, publication of someone else's private information, false endorsement, or distribution of the Game itself. Lawful review, quotation and other statutory exceptions remain available.
Private alpha, beta, embargoed and confidential access is subject to confidentiality obligations only where separately and clearly agreed or otherwise imposed by law. This EULA does not turn public gameplay or previously public information into confidential information. Revocation of test access does not by itself cancel separate paid purchase or reward entitlements.
We may investigate credible indications of a breach and take necessary, proportionate measures based on the evidence, seriousness, intent, impact, repetition, account-compromise evidence and risk to others. Measures may include:
A prior warning is not required where immediate action is reasonably necessary, including serious cheating, distributing circumvention tools, credible threats, exploitation of minors, deliberate fraud, severe harassment, security attacks or ban evasion. Where law requires notice or an opportunity to remedy the breach, we will provide it. A minor first breach will not automatically result in permanent termination.
An online restriction does not by itself terminate access to lawfully acquired offline features. We will identify the affected features and duration. Terminating the entire license requires grounds sufficient for that broader action. Any consequence for a separate purchase must have its own contractual and legal basis.
We do not control Valve's or another platform's sanctions. Steam's public Game Ban system is reserved for qualifying multiplayer cheating under Valve's rules; it will not be used merely for harassment, chargebacks, criticism or unauthorized offline cosmetic modding. Other Game-specific restrictions are separate from that system.
There is no automatic contractual right to reimbursement solely because a lawful sanction was imposed for your breach. Statutory refund, conformity, cancellation and other remedies, and applicable platform rights, remain unaffected. We do not impose contractual fines for rule violations.
If this license is lawfully terminated, stop using the affected Game and delete copies you are no longer entitled to retain, subject to legal rights to retain evidence or records. Provisions protecting ownership, accrued lawful claims, privacy and dispute rights continue to the extent relevant.
You may stop using the Game and request closure of an MXDS account at any time. Account closure does not itself create a refund right or cancel a separate platform account. Any subscription cancellation rights remain governed by applicable law and the disclosed subscription terms, if any.
We will normally notify you of a sanction through the Game, account interface or available contact address, explaining the rule involved, main reason, affected features, duration and how to appeal. An urgent interim restriction may precede the notice. We may withhold specific detection details or third-party information where reasonably necessary to protect security, privacy or a lawful investigation, without limiting information or evidence rights required by law.
You may request human review using the contact above and provide relevant information, including evidence of account compromise. Submit an appeal promptly; no short contractual deadline removes your statutory remedies. Where practicable, a person not responsible for the original decision will review it. Good-faith appeals will not trigger retaliation or extra sanctions.
We will assess the available evidence and correct erroneous decisions, restore affected valid access and results where reasonably possible, and provide any further remedy required by law. Our internal decision does not prevent an external complaint, payment dispute, mediation or court action. Your legal rights are not conditional on first exhausting this appeal process.
We may use integrity checks, server validation, reports and anti-cheat measures to protect the Game and Services, but only as lawfully implemented and disclosed. Relevant personal-data processing must be explained in the Privacy Notice, including actual data categories, purposes, lawful bases, recipients, retention and your rights. Acceptance of this Agreement is not blanket consent to device surveillance or unrelated data collection.
A feature that collects device identifiers, process information, chat content or other personal data must have the required notice and lawful basis before collection begins. We do not claim permission here to inspect unrelated private files or continuously record microphone audio. Separate permissions or consent will be obtained where required. Applicable safeguards for automated decisions, including human intervention where required, remain available.
We may preserve proportionate evidence needed to investigate abuse, enforce lawful restrictions, comply with legal obligations or establish or defend legal claims, for a justified period. Disclosures to platforms, service providers or authorities must have a lawful basis and appropriate safeguards. We do not maintain a public blacklist of personal identifiers under this Agreement.
Where conduct constitutes an actionable breach of contract, intellectual-property infringement, unlawful circumvention, fraud, unauthorized access, unlawful harassment or another legal wrong, MXDS may use remedies available under applicable law. Depending on the facts, these may include a demand to cease the conduct, lawful takedown procedures, an application for an injunction, and a claim for proven loss or other damages and legal costs recoverable under the relevant law. Recovery is subject to applicable proof, causation and procedural requirements.
Where there are reasonable grounds to suspect a criminal offense, we may report the facts and lawfully disclose relevant evidence to competent authorities. Only the authorities and courts determine criminal liability and criminal penalties. A breach of this Agreement is not automatically a criminal offense.
These remedies may accompany a justified Game restriction, but this Agreement does not create a fixed financial penalty, an automatic entitlement to punitive damages, or an obligation to pay every expense we choose to incur. We will not use legal threats to obstruct legitimate criticism, protected research or consumer remedies.
The Game includes third-party components and content subject to the applicable notices and licenses supplied with it. If a component's license grants rights beyond this Agreement, those rights apply to that component; restrictions here do not remove them.
Unreal Engine technology incorporated in the Game may be used only as an inseparable object-code part of the Game and only as necessary for uses permitted under this Agreement, subject to mandatory law and any independent license you hold. This Agreement grants no right to extract or incorporate that technology into another product.
To the maximum extent permitted by applicable law, all representations, warranties and conditions relating to the Unreal Engine technology incorporated in the Game, whether express, implied or statutory, including merchantability, fitness for a particular purpose, title and non-infringement, are disclaimed, and liability relating to that technology is excluded. These exclusions do not affect non-excludable rights or liabilities, including your mandatory consumer rights against MXDS or the seller. Epic Games and its suppliers do not undertake an additional contractual promise to you under this Agreement to maintain or support the Game.
We may supply updates necessary for security and conformity and require compatible versions to access online features. We may also make changes for specified valid reasons: correcting defects, preventing abuse, maintaining fair competition, adapting to supported technology or legal requirements, or improving capacity and compatibility. Such changes remain subject to our purchase commitments and applicable law.
For changes to continuously supplied digital content or services beyond those needed to maintain conformity, we will provide clear information, impose no additional cost for the change itself, and give advance notice on a durable medium and cancellation or other remedies where required. Where applicable law grants a right to terminate because a change has a more-than-minor negative effect, that right remains available, including the applicable statutory time period.
Early Access and testing versions may contain disclosed unfinished features and defects. Their advertised scope and specific limitations must be disclosed before purchase. An Early Access label is not a waiver of legal guarantees. General plans do not guarantee every future feature or release date, but this statement does not cancel binding promises or pre-contractual representations.
Availability can be affected by maintenance, security incidents and third-party systems. We will meet applicable supply, update and conformity obligations. We will give reasonable advance notice of a planned permanent closure where practicable and any longer notice or remedy required by law. This Agreement does not authorize unrestricted removal of paid functionality without the notice and remedies required by law.
Nothing in this Agreement excludes mandatory consumer protections, including applicable guarantees of conformity for digital content and services, required updates, remedies for non-supply or defects, price reduction, termination, refund, and withdrawal rights where available. Relevant French protections include Articles L.224-25-12 and following of the Consumer Code. The identity of the seller and each party's legal role determine who owes a particular purchase remedy.
Any waiver of a statutory withdrawal period for immediately supplied digital content must be obtained through the legally required express consent and acknowledgment process. Accepting this EULA alone is not that waiver.
MXDS is responsible for breaches of its legal and contractual obligations in accordance with applicable law, including reasonably foreseeable loss caused by such a breach. To the extent permitted by law, we are not responsible for loss attributable solely to your unlawful modification, another person's independent wrongdoing, or external equipment or services for which we have no legal responsibility. This does not excuse our own breach or override mandatory allocation of responsibility.
We do not exclude liability that cannot lawfully be excluded, including for fraud, intentional misconduct, gross negligence where non-excludable, or death or personal injury caused by negligence where applicable. No blanket "as is" disclaimer or purchase-price cap removes your mandatory protections.
French law governs this Agreement, without depriving consumers of mandatory protections of the law of their habitual residence where those protections apply. Courts having jurisdiction under applicable law may hear disputes, including courts available to consumers in their home jurisdiction. This Agreement does not impose mandatory arbitration, a class-action waiver, or exclusive Annecy jurisdiction on consumers.
For a complaint, contact us using the details above or write to the registered office. After a prior written complaint to MXDS that has not resolved the dispute, eligible consumers may use the competent consumer mediation scheme free of charge under the applicable conditions:
Société Médiation Professionnelle (SMP)
Postal correspondence: Alteritae, 5 rue Salvaing, 12000 Rodez, France.
Website and online mediation request: https://www.mediateur-consommation-smp.fr/.
Mediation is voluntary and does not remove access to courts or other lawful remedies.
We may propose changes to address changes in law, security risks, supported features or operational requirements. We will identify the changes, version and effective date and give reasonable advance notice of material changes, except where an urgent legal or security reason requires a shorter period. We will obtain renewed acceptance where required and preserve statutory rights if you decline. New rules do not retrospectively turn previously permitted conduct into a breach.
If a provision is invalid or unenforceable, it will not bind you to that extent, and the remainder continues only where it can lawfully do so. Failure to enforce a provision on one occasion is not a general waiver. We may transfer this Agreement as part of a lawful business transfer only where this does not reduce your protections and any required notice or consent is provided.
This Agreement does not supersede binding purchase commitments, non-waivable rights, component licenses or separately agreed confidentiality obligations within their proper scope. Translations must preserve those rights; no language-priority provision limits protections required by local law.

This Agreement governs the Motocross the Game software, its updates and downloadable content (the "Game"), and the multiplayer, account, leaderboard and community features we operate for the Game (the "Services"). It applies to features actually made available to you and does not promise that any particular feature exists or will be released.
1. Acceptance, eligibility and other terms
2. License and ownership
3. Reverse engineering, extraction and circumvention
Except to the extent expressly permitted by mandatory law, you must not:
- Reverse engineer, decompile, disassemble or otherwise attempt to reconstruct the Game's source code or non-public internal implementation.
- Extract, decrypt, rip or redistribute protected Game assets, databases, encryption keys or non-public content, including unreleased tracks, bikes, models, textures, audio and animations.
- Circumvent or interfere with licensing, ownership checks, access controls, encryption, anti-cheat systems, bans or other technical protections.
- Use unauthorized debugging, hooking, injection, memory manipulation, packet alteration or protocol manipulation to modify the Game, defeat protections, access restricted content or interfere with the Services.
- Develop, market, sell, distribute or knowingly facilitate tools or instructions whose purpose is to enable the prohibited conduct described above.
4. Modding is prohibited until expressly authorized
5. Fair competition and service security
You must not cheat or deliberately undermine fair play. Prohibited conduct includes:
- Cheats, trainers, unauthorized automation, input scripts or tools that provide an unfair advantage; manipulation of simulation speed, physics, timing, collision or race results; and bypassing competitive restrictions.
- Knowingly exploiting bugs to obtain an unfair advantage, unlock unpaid content, falsify records or damage other players' experience; sharing exploits to facilitate that abuse.
- Match fixing, collusion to falsify rankings, account boosting through prohibited methods, impersonating competitors or knowingly submitting fabricated replay or telemetry evidence.
- Deliberate race sabotage, repeated targeted ramming or obstruction unrelated to legitimate racing, and abusing resets, spawning or track boundaries to harass or manipulate results. An accidental collision or ordinary racing mistake is not, by itself, a breach.
- Attacks against accounts, clients, servers or infrastructure; malware, phishing, credential theft, denial-of-service attacks, unauthorized access, or deliberate interference with authentication or security.
- Operating unauthorized services that impersonate our infrastructure or bypass licensing or protected access. Community hosting is permitted only to the extent supported or separately authorized.
Reporting a bug in good faith, losing a race, having a poor connection or using an authorized accessibility feature is not, by itself, cheating.
6. Player conduct and protection from harassment
7. Accounts, access and ban evasion
8. Payments, refunds and chargebacks
9. Player content, videos and confidential tests
10. Enforcement, suspension and termination
We may investigate credible indications of a breach and take necessary, proportionate measures based on the evidence, seriousness, intent, impact, repetition, account-compromise evidence and risk to others. Measures may include:
- A warning or request to stop or correct the conduct.
- Removal or restriction of unlawful or prohibited content; resetting demonstrably invalid results, progression or rewards attributable to the breach.
- Communication restrictions, removal from a session, restrictions on official events, or temporary suspension of affected online features.
- Permanent exclusion from affected multiplayer, leaderboard, communication or other Services for serious or repeated breaches.
- Termination of this license for a sufficiently serious material breach, subject to applicable notice, cure and other legal requirements.
- Account or, where lawful and technically supported, device restrictions necessary to enforce a valid ban and prevent evasion, subject to the disclosed privacy safeguards and review of collateral effects on other users.
11. Notice, evidence and appeals
12. Integrity checks and privacy
13. Legal remedies and reports to authorities
14. Third-party software and Unreal Engine
15. Updates, Early Access and availability
16. Consumer guarantees, refunds and liability
17. French law, complaints and consumer mediation
18. Changes to this Agreement and general provisions
