LICENSAFTALE TIL BRUG AF MULTIMEDIEPRODUKT

Læs denne licensaftale omhyggeligt inden installation af spillet (“Multimedieprodukt”).
Denne licensaftale er en aftale mellem dig, “brugeren” og Ubisoft Entertainment og/eller deres licensudsteder og/eller deres begunstigede (”Ubisoft”) som giver Brugeren den ikke-eksklusive og ikke-overførbare ret til at bruge Multimedieprodukt.
Ved at installere Multimedieprodukt, forpligter brugeren sig til at overholde licensens betingelser og vilkår.


1- Licensen

Ubisoft giver brugeren en ikke-eksklusiv og ikke-overførbar licens til at bruge Multimedieprodukt, men forbliver ejer af alle rettigheder i forbindelse hermed.
Alle rettigheder som ikke er specifikt overført ved denne licens forbliver Ubisofts ejendom. Multimedieprodukt er licenseret, ikke solgt, til brugeren, til privat anvendelse.
Licensen afgiver ikke nogen rettighed eller titel til Multimedieprodukt og kan ikke opfattes som en overførsel af intellektuel ejendomsret til Multimedieprodukt.

MULTIMEDIEPRODUKTET KAN VÆRE BESKYTTET AF DRM-SOFTWARE (DIGITAL RIGHTS MANAGEMENT SOFTWARE). HVIS DET ER TILFÆLDET, ACCEPTERER BRUGEREN HERMED OG ERKENDER OG SAMTYKKER I FØLGENDE PUNKTER VEDRØRENDE DRM-SOFTWAREN: (I) AT INSTALLATIONEN AF MULTIMEDIEPRODUKTET VIL INSTALLERE DRM-SOFTWAREN PÅ BRUGERENS COMPUTER; (II) DRM-SOFTWAREN KAN BEGRÆNSE ANTALLET AF INSTALLATIONER AF MULTIMEDIEPRODUKTET; (III) DRM-SOFTWAREN KAN INSTALLERE YDERLIGERE KOMPONENTER PÅ BRUGERENS COMPUTER, SOM KRÆVES TIL KOPIBESKYTTELSE; OG (IV) UNDER INSTALLATION OG/ELLER START AF PROGRAMMET FØRSTE GANG KAN DER KRÆVES EN ONLINETILSLUTNING FOR AT OPLÅSE MULTIMEDIEPRODUKTET GENNEM DRM-SOFTWAREN. UBISOFT KAN UNDER INGEN OMSTÆNDIGHEDER HOLDES ANSVARLIG FOR KOMPONENTER, DER MÅTTE BLIVE INSTALLERET PÅ BRUGERENS COMPUTER AF EN DRM-SOFTWARE. YDERLIGERE OPLYSNINGER FINDES PÅ WEBSTEDET FOR DRM-SOFTWARE, DER VISES UNDER INSTALLATIONEN AF SPILLET.

2- Ejerskab af Multimedieprodukt

Brugeren anerkender, at alle rettigheder i forbindelse med Multimedieprodukt og dets komponenter (især titlerne, computerkoderne, temaerne, figurerne, figurnavnene, plottet, historierne, dialogerne stederne, koncepterne, billederne, fotografierne, animationen, videoerne, musikken og teksterne indeholdt i Multimedieprodukt), så vel som rettigheder i forbindelse med varemærket, royalties og copyrights, er Ubisofts ejendom og er beskyttet af franske regulativer eller andre love, traktater og internationale aftaler vedrørende intellektuel ejendomsret.

3- Anvendelse af Multimedieprodukt

Brugeren har tilladelse til at bruge Multimedieprodukt i overensstemmelse med de i manualen eller på Multimedieprodukts emballage angivne instruktioner.
Licensen gives udelukkende med henblik på privat brug.

Det er ikke tilladt:
 At tage kopier af Multimedieprodukt.
 At benytte Multimedieprodukt kommercielt.
 At bruge det i strid med den vedtagne moral eller gældende lovgivning.
 At ændre Multimedieprodukt eller skabe noget afledt værk.
 At overføre Multimedieprodukt via et telefonnetværk eller nogen andre elektroniske midler, undtagen gennem flerpersoners spil og/eller scenarier.
 At dekompilere, tilbagekonstruere eller demontere Multimedieprodukt.

Brugeren må ikke sælge, underlicensere eller lease Multimedieprodukt til tredjepart.
Brugeren må kun overføre Multimedieprodukt, såfremt modtageren erklærer sig indforstået med licensens vilkår og betingelser. I så fald forpligter brugeren sig til at overføre alle komponenter og dokumentation i forbindelse med Multimedieprodukt. Vedkommende forpligter sig desuden til at slette alle kopier af Multimedieprodukt på sin computer. I så fald bringes denne licens automatisk og øjeblikkeligt til ophør.

Brugeren accepterer, at Ubisoft kan indsamle og bruge visse brugerdata i overensstemmelse med dette websteds erklæring om beskyttelse af personlige oplysninger: http://www.ubi.com/DK/Info/Info.aspx?tagname=PrivacyPolicy .

4- Licensen ophør

Licensen træder i kraft fra den første gang Multimedieprodukt tages i anvendelse.
Den afsluttes uden varsel automatisk af Ubisoft, såfremt brugeren ikke overholder licensens vilkår og betingelser.

5- Garantibegrænsning
Ubisoft tilbyder Teknisk Support. Når du som bruger ringer, vær da venligst så præcis som muligt omkring problemet og hav nedenstående oplysninger klar.

- Navnet på producenten af dit computersystem
- Navnet og hastigheden på din processor.
- Hvor meget RAM din computer har.
- Din Windows version (højreklik på Denne Computer ikonet på skrivebordet og vælg egenskaber)
- Producentens navn og modelnummer på grafikkort, modem og lydkort.

Ubisoft garanterer til den originale køber af dette Multimedieprodukt, at CD’en der følger med produktet ikke viser nogle fejl gennem normal brug i 90 dage fra fakturadatoen hvor produktet er købt, eller gennem en lovmæssigt fastsat garantiperiode.

Returner venligst defekte Multimedieprodukter sammen med manualen og Deres registreringskort hvis dette ikke allerede er sendt til os. Venligst angiv Deres fulde navn og adresse (inklusiv postnummer), såvel som dato og sted for køb af Multimedieprodukt. Det er også muligt at bytte Multimedieprodukt hvor det er købt.

Hvis en CD returneres uden bevis på købet eller efter udløb af garantiperioden kan Ubisoft vælge enten at reparere Multimedieprodukt eller ombytte det på købers regning. Denne garanti er ikke gældende såfremt disken har været beskadiget gennem uagtsomhed, ulykke eller misligholdelse eller hvis det er blevet modificeret efter anskaffelse.

Brugeren anerkender udtrykkeligt at vedkommende anvender Multimedieprodukt for egen risiko.

Multimedieprodukt leveres som det fremstår. Brugeren er ansvarlig for enhver udgift i forbindelse med reparation og/eller indstilling af Multimedieprodukt.

I den udstrækning loven foreskriver afviser Ubisoft enhver garanti i forbindelse med multimediets markedsværdi, brugerens tilfredshed eller kapacitet til at præstere en specifik anvendelse.

Brugeren er ansvarlig for enhver risiko forbundet med tab af fortjeneste, tab af data, fejl og tabt arbejde eller anden information som resultat af at eje eller bruge Multimedieprodukt.

Da visse lovgivninger ikke tager førnævnte garantibegrænsninger i betragtning, er det muligt, at de ikke finder anvendelse på brugeren.
6- Ansvar
Ubisoft kan ikke under nogen omstændigheder holdes ansvarlig for nogen direkte, indirekte, tilfældig, speciel, supplerende eller andre skader, der opstår som følge af brugen eller manglende evne til at bruge Multimedieprodukt, eller som følge af ejerskab eller manglende funktion heraf, selv i tilfælde af at Ubisoft er blevet gjort bekendt med muligheden for sådanne skader.
I særdeleshed accepterer Ubisoft ikke noget ansvar i forbindelse med brug af Multimedieprodukt i strid med de forskrifter for brug, der er anvist i manualen og på emballagen.
Da visse lovgivninger ikke tillader ansvarsfritagelse i tilfælde af direkte eller hændelige skader, er det muligt at førnævnte undtagelser ikke finder anvendelse på brugeren.
Denne licens til anvendelse af Multimedieprodukt giver specifikke rettigheder til brugeren, og vedkommende kan have andre rettigheder afhængig af lovgivningen i vedkommendes stat/land.

If you acquired the software in the United States, Washington state law governs the interpretation of this agreement and applies to claims for breach of it, regardless of conflict of laws principles. b. Outside the United States. If you acquired the software in any other country, the laws of that country apply.
9. LEGAL EFFECT. This agreement describes certain legal rights. You may have other rights under the laws of your country. This limitation applies to
* anything related to the software, services, content (including code) on third party Internet sites, or third party programs; and
* claims for breach of contract, breach of warranty, guarantee or condition, strict liability, negligence, or other tort to the extent permitted by applicable law.
It also applies even if Microsoft knew or should have known about the possibility of the damages. The above limitation or exclusion may not apply to you because your country may not allow the exclusion or limitation of incidental, consequential or other damages.
