Aviso para el Usuario



Muy importante: Lea este documento antes de empezar a usar el software adjunto, en adelante el “Programa”. Al instalar y ejecutar el Programa, declara que ha leído el Contrato de Licencia de software a continuación y que acepta sus condiciones. Este constituye un acuerdo legalmente vinculante entre usted (el Usuario) y Techland.



Preámbulo



Las partes del presente Contrato de Licencia son: el Usuario final del Programa y Techland. Al instalar o aceptar la instalación del Programa, el Usuario se convierte en parte de este Contrato de Licencia. El Contrato de Licencia se rige de conformidad con la legislación polaca.



1. Concesión de licencia

Tras efectuar el pago de las tasas pertinentes, el Usuario tiene derecho a ejecutar el Programa en un ordenador, de manera independiente, perteneciente al Usuario o bajo su posesión. El Programa está destinado a un uso no comercial. El Usuario no tiene derecho a realizar cambios ni a traducir el Programa o su documentación sin el consentimiento previo de Techland. Para evitar el uso no autorizado, algunos productos de Techland están protegidos con un código de desbloqueo o requieren una clave de seguridad. En dicho caso, la clave de seguridad sigue siendo propiedad de Techland durante la vigencia del Contrato de Licencia.



2. Copiado del Programa

El Usuario no puede copiar el Programa ni la documentación vinculada a este. Además, el Usuario no debe, en ningún caso, distribuir o exhibir públicamente el Programa sin el consentimiento previo de Techland.



3. Propiedad

El Programa y toda su documentación relacionada son propiedad exclusiva de Techland y los otorgantes de licencias de Techland, y como tal quedan sujetos a la misma protección que la propiedad intelectual, independientemente de los cambios realizados por o para el Usuario. El Usuario acepta por la presente que no tiene derechos sobre el Programa y su documentación relacionada, excepto los derechos expuestos en este Contrato. Techland confirma por la presente que tiene derecho a otorgar la licencia del Programa.



4. Duración

El Contrato entra en vigor en el momento en que se instala el Programa. En particular, el Contrato pierde su validez si usted:

a) destruye todas las copias del Programa y toda la documentación en su posesión, o

b) infringe alguna de las condiciones de este Contrato, o

c) pierde o destruye las claves de seguridad, en el caso de que sean necesarias para la correcta ejecución del Programa, o

d) lleva a cabo acciones que pongan en duda los derechos de autor de Techland sobre el Programa y su material relacionado.



En caso de que este Contrato expire, el Usuario debe destruir de inmediato todas las copias del Programa y la documentación sobre el mismo que esté en posesión del Usuario, y debe devolver las claves de seguridad en su posesión a Techland.



5. Limitación de responsabilidad

El Programa se proporciona “tal cual”.



Techland garantiza al usuario original que los soportes en los que se ha entregado el Programa, así como las claves de seguridad, no presentan defectos y funcionan correctamente en condiciones normales.



La única obligación de Techland en virtud de la garantía es reemplazar los soportes y claves de seguridad defectuosos a la dirección remitente proporcionada en hasta 30 días desde la recepción del soporte o clave defectuosos.



Techland renuncia a todas las garantías en la medida máxima permitida por la legislación en relación al Programa, y toda documentación y hardware proporcionados. En particular, Techland no ofrece garantía alguna con respecto al software del Programa y se desliga de toda responsabilidad por errores que puedan producirse como consecuencia del uso de este software utilizando el Programa o de cualquier otra forma.



Todo derecho de garantía ofrecido por Techland se desprende únicamente de este Contrato de Licencia.



TECHLAND, sus otorgantes de licencias y proveedores se eximen, al máximo permitido por la legislación, de toda responsabilidad por cualquier pérdida sufrida por el Usuario (financiera, organizativa, de información o cualquier otra pérdida) debido al uso o a la incapacidad de usar el Programa, incluso si Techland ya ha sido previamente advertida de la posibilidad de dichos daños. En cualquier caso, la responsabilidad de Techland se limita a la cantidad abonada por el Usuario para la licencia suministrada.



Techland no garantiza la correcta operación del Programa en ciertos casos con respecto al Programa y la documentación. La garantía no se aplica a la ausencia total de errores en el Programa, y en particular a que cumpla con los requisitos o expectativas del Usuario o no sea compatible con otros programas elegidos por el Usuario. La responsabilidad de la correcta elección y las consecuencias del uso del Programa recae en el Usuario.



6. Actualizaciones

Toda licencia otorgada para versiones futuras del Programa está sujeta al Contrato de Licencia y los cargos aplicables en vigor en el momento de la finalización del Contrato de venta de una versión determinada del Programa.



7. Efectos del Contrato de Licencia

Este Contrato de Licencia contiene el acuerdo entre las partes y reemplaza cualquier acuerdo previo, oral o escrito, en relación con el Programa. Solo se pueden realizar cambios en este Contrato de Licencia por acuerdo de las partes expresado por escrito.



8. Descargo de responsabilidades

Todos los derechos no otorgados expresamente por Techland quedan reservados.



Por el presente documento declara que ha leído este acuerdo, comprende sus términos y confirma que está de acuerdo con todas las condiciones. También acepta que es un acuerdo legalmente vinculante entre usted y Techland.

These license terms are an agreement between Microsoft Corporation (or based on where you live, one of its affiliates) and you. Please read them. They apply to the software named above, which includes the media on which you received it, if any. The terms also apply to any Microsoft

for this software, unless other terms accompany those items. If so, those terms apply.

BY USING THE SOFTWARE, YOU ACCEPT THESE TERMS. IF YOU DO NOT ACCEPT THEM, DO NOT USE THE SOFTWARE.

If you comply with these license terms, you have the rights below.

1. INSTALLATION AND USE RIGHTS. You may install and use any number of copies of the software on your devices.

2. Scope of License. The software is licensed, not sold. This agreement only gives you some rights to use the software. Microsoft reserves all other rights. · rent, lease or lend the software;

· transfer the software or this agreement to any third party; or

3. BACKUP COPY. You may make one backup copy of the software. You may use it only to reinstall the software.

4. DOCUMENTATION. Any person that has valid access to your computer or internal network may copy and use the documentation for your internal, reference purposes.

5. Export Restrictions. The software is subject to United States export laws and regulations. You must comply with all domestic and international export laws and regulations that apply to the software. These laws include restrictions on destinations, end users and end use. For additional information, see www.microsoft.com/exporting <http://www.microsoft.com/exporting>.

6. SUPPORT SERVICES. Because this software is “as is,” we may not provide support services for it.

7. Entire Agreement. This agreement, and the terms for supplements, updates, Internet-based services and support services that you use, are the entire agreement for the software and support services.

8. Applicable Law.

a. United States. If you acquired the software in the United States, Washington state law governs the interpretation of this agreement and applies to claims for breach of it, regardless of conflict of laws principles. The laws of the state where you live govern all other claims, including claims under state consumer protection laws, unfair competition laws, and in tort.

b. Outside the United States. If you acquired the software in any other country, the laws of that country apply.

9. Legal Effect. This agreement describes certain legal rights. You may have other rights under the laws of your country. You may also have rights with respect to the party from whom you acquired the software. This agreement does not change your rights under the laws of your country if the laws of your country do not permit it to do so.

10. Disclaimer of Warranty. The software is licensed “as-is.” You bear the risk of using it. Microsoft gives no express warranties, guarantees or conditions. You may have additional consumer rights under your local laws which this agreement cannot change. To the extent permitted under your local laws, Microsoft excludes the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

11. Limitation on and Exclusion of Remedies and Damages. You can recover from Microsoft and its suppliers only direct damages up to U.S. $5.00. You cannot recover any other damages, including consequential, lost profits, special, indirect or incidental damages.

This limitation applies to

· anything related to the software, services, content (including code) on third party Internet sites, or third party programs; and

· claims for breach of contract, breach of warranty, guarantee or condition, strict liability, negligence, or other tort to the extent permitted by applicable law.

It also applies even if Microsoft knew or should have known about the possibility of the damages. The above limitation or exclusion may not apply to you because your country may not allow the exclusion or limitation of incidental, consequential or other damages.

11. LIMITATION ON AND EXCLUSION OF REMEDIES AND DAMAGES. You can recover from Microsoft and its suppliers only direct damages up to U.S. $5.00. You cannot recover any other damages, including consequential, lost profits, special, indirect or incidental damages.
