Please read this End User License Agreement carefully before installing or playing Light of Atlantis (the "Game"). By installing, accessing or using the Game, you agree to be bound by this Agreement. If you do not agree, do not install or use the Game.
This Agreement is between you ("you" or the "User") and Duck ‘n’ Run Games GbR, a partnership under German civil law (Gesellschaft bürgerlichen Rechts), Foorthkamp 50, 22419, Hamburg, Germany (the "Licensor", "we", "us"). Contact: lightofatlantisgame@gmail.com.
2.1 The Licensor grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Game on devices that you own or control, for your personal, non-commercial entertainment purposes, in accordance with this Agreement and the Steam Subscriber Agreement.
2.2 The Game is licensed, not sold. All rights not expressly granted to you are reserved by the Licensor.
2.3 Your purchase and use of the Game through Steam is also governed by the Steam Subscriber Agreement and Steam's rules of use. In case of conflict regarding purchase, payment, refunds and account matters, the Steam Subscriber Agreement prevails.
Unless expressly permitted by mandatory law, you may not:
You may record, stream and publish videos, screenshots and similar content of your gameplay, including on monetized platforms, provided that you do not present the content in a misleading way, do not imply an official endorsement by the Licensor, and do not use the content to distribute or extract the Game's assets. We may revoke this permission for content that is unlawful, defamatory, hateful or otherwise harmful.
5.1 The Game, including all artwork, characters, animations, text, music, sound effects, code and other content, is protected by copyright and other intellectual property laws and is owned by the Licensor or its licensors.
5.2 The Game uses third-party software components, including the Unity engine and the Spine Runtimes. Such components are subject to their respective license terms, and the required notices are included in the Game's credits or accompanying materials. Nothing in this Agreement limits your rights under those licenses to the extent they apply to you.
6.1 The Game is a single-player game and has no online functions. The Game itself does not collect, store or transmit personal data to the Licensor.
6.2 The Game may use Steam Cloud to synchronize save games. This is provided and operated by Valve Corporation. Valve's processing of data is governed by Valve's privacy policy, and the Licensor has no access to data stored in Steam Cloud. You can disable Steam Cloud in your Steam settings.
6.3 Information on data processing on our website and contact channels can be found in our separate Privacy Policy.
We may provide updates, patches or changes to the Game. Where required for the Game to function, updates form part of the Game and are covered by this Agreement. We do not guarantee that the Game will be available on any particular platform or in any particular region at all times.
8.1 Statutory warranty rights remain unaffected. Nothing in this Agreement limits your mandatory rights as a consumer, including the rights under the German Civil Code (BGB) concerning digital products (Sections 327 et seqq. BGB).
8.2 Video games may contain flashing lights, patterns or effects that can trigger discomfort in some people. If you experience dizziness, nausea or similar symptoms, stop playing and consult a doctor.
9.1 The Licensor is liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where a liability cannot be excluded by law.
9.2 In cases of slight negligence, the Licensor is liable only for the breach of essential contractual obligations (obligations whose fulfilment enables the proper performance of the Agreement and on which you may regularly rely), and in that case only for foreseeable damage typical for this type of contract.
9.3 Any further liability is excluded. This does not affect the liability under Section 9.1.
10.1 This Agreement remains in effect until terminated. You may terminate it at any time by uninstalling the Game and deleting all copies.
10.2 The Licensor may terminate this Agreement for good cause, in particular if you materially breach it. Upon termination, you must stop using the Game and delete all copies. Sections 3, 5, 9, 11 and 12 survive termination.
We may amend this Agreement where there is a valid reason, such as changes in law, changes in the Game or the closing of regulatory gaps, and where the change is reasonable for you. We will inform you of material changes in an appropriate way (for example via the Steam store page or an in-game notice). If you do not agree with the change, you may stop using the Game.
12.1 This Agreement is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law applies only to the extent it does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence.
12.2 If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Hamburg, Germany. Mandatory consumer jurisdiction rules remain unaffected.
12.3 Information on online dispute resolution: We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
If any provision of this Agreement is or becomes invalid or unenforceable, the remaining provisions remain unaffected. The invalid provision will be replaced by a valid one that comes closest to its economic purpose.
