This agreement is between you and Posh Toffee Games and governs your use of The American War ("the Game"). It supplements the Steam Subscriber Agreement; it does not replace your agreement with Valve or reduce your statutory consumer rights.

When you lawfully obtain the Game, Posh Toffee Games grants you a non-exclusive licence to install and play it for your personal entertainment in accordance with this agreement and the applicable Steam terms. The Game is licensed, not sold. Copyright and other intellectual property rights in the Game remain with Posh Toffee Games and the relevant third-party rights holders.

You must not distribute unauthorised copies of the Game, sell access to copied versions, or remove ownership notices. This does not prevent uses permitted by applicable law. You may share gameplay screenshots and videos, including monetised gameplay videos and streams, subject to the rights of any third-party material included.

When playing with others, you must not:

• Use cheats, unauthorised automation, or tools that provide an unfair competitive advantage.
  
• Deliberately exploit faults to disrupt matches or harm other players.
  
• Harass, threaten, discriminate against, or target other players with hateful abuse.
  
• Share unlawful material or disclose another person's private information without permission.
  
• Disrupt multiplayer services or evade a restriction imposed for a breach of these rules.

Where Posh Toffee Games administers multiplayer access, we may issue warnings or restrict that access for breaches of these rules. Action will be reasonable and proportionate to the seriousness and repetition of the conduct; serious abuse or cheating may result in a permanent multiplayer ban. Where reasonably possible, we will provide a reason and an opportunity to challenge the decision. To report an issue or appeal a restriction, contact poshtoffeegames@gmail.com.

These rules do not authorise us to remove unrelated Steam purchases or restrict your statutory rights. Valve and independently operated servers may apply their own rules.

Online multiplayer requires a suitable internet connection and other available players. Connection quality and player availability can affect your experience. Maintenance or technical faults may temporarily interrupt online features. This does not exclude our responsibility to provide the Game as described or any remedies available to you under applicable law.

The American War is a fictionalised portrayal of events surrounding the Vietnam War. While inspired by historical events, certain characters, situations and narratives have been adapted for artistic and entertainment purposes. It should not be treated as an authoritative historical account.

Posh Toffee Games does not endorse war crimes, atrocities or the mistreatment of individuals depicted or referenced in the Game. The Game contains depictions of violence, horror themes and references to war crimes. Please read the content information on its Steam store page before playing.

Nothing in this agreement excludes or limits your rights under applicable consumer law, including rights concerning faulty or misdescribed digital content, or your right to seek a remedy. Steam's refund process remains available alongside any statutory rights.

Nothing in this agreement excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

This agreement is not a privacy policy and does not ask you to consent to additional personal data collection. Valve's handling of personal data is described in the Steam Privacy Policy. Any personal data processing by Posh Toffee Games remains subject to applicable data protection law and any applicable privacy notice.
