END USERS LICENCE AGREEMENT
Please read the following terms and conditions carefully before using this Software Product. Your use, distribution or installation of this copy of Northern Tales indicates your acceptance of this License.
NORTHERN TALES is licensed, not sold.
This End User License Agreement ( "EULA" ) is a binding agreement between you and Galaxy Studio. This EULA governs your use of the Northern Tales software product.
Acknowledgement
By downloading, installing, copying or otherwise using Northern Tales, you agree to the terms of this EULA and agree to be bound by it.
Northern Tales is being licensed to you and you hereby acknowledge that no title or ownership in Northern Tales is being transferred or assigned and this EULA should not be construed as a sale of any rights in Northern Tales software product.
Grant Of Limited License
Subject to the terms of the EULA, Galaxy Studio hereby grants you a personal, limited, non-exclusive, non-transferable, revocable limited right and license to install and use one copy of Northern Tales on one computer hard drive at any given time solely for your personal use, pursuant to this agreement. Any commercial use is prohibited.
Your acquired rights are subject to your compliance with this EULA.
The term of this EULA shall commence on the date that you install or otherwise use Northern Tales, and shall end on the earlier date that you dispose of Norhern Tales, or Galaxy Studio's termination of this EULA.
License Conditions
You agree not to distribute, sell, lease, rent, loan or otherwise transfer or assign Northern Tales, or any copies of Northern Tales.
You agree not to copy, reproduce, decompile, disassemble, derive source code from or reverse engineer, in whole or in part, Northern Tales, or to prepare derivative works based on Northern Tales without the express prior permission of Galaxy Studio.
You agree not to modify or cause to be modified any files that are part of Northern Tales in any way not expressly authorized by Galaxy Studio.
You agree not to make a copy of Northern Tales on a network that is accessible by users other than yourself, including but not limited to public file sharing networks.
You agree not to remove or alter any trademark, logo, copyright or other proprietary notices, legends, symbols, or labels in Northern Tales.
You agree not to transport, export or re-export into any country that may result in a violation of local import/export laws or regulations.
Software Product here means Software, image files, all accompanying files, data and materials received with your order of Northern Tales.
You may not disclose to other persons the data or techniques relating to this software product that you know or should know that it is a trade secret of the Galaxy Studio in any manner that will cause damage to Galaxy Studio.
If you do not agree to any of the terms of this License, then do not buy nor install, or use the software product.
This software product, all accompanying files, data and materials, are distributed "AS IS" and without warranty of any kind, whether express or implied. The user must assume all risk of using the program.
Any liability of Galaxy Studio will be limited exclusively to refund of purchase price. In addition, in no event shall Galaxy Studio be liable for any incidental, consequential, punitive or any other damages whatsoever relating to the use of this software product.
Reservation Of Rights
Galaxy Studio reserves all right, title and interest in Northern Tales including but not limited to all copyrights, trademarks, trade names, patents, titles, characters, character names, stories, story lines, locations, location names, artwork and graphics, audio, animations, text assets and any other intellectual property therein.
Seizure Warning
In rare instances, some users may experience seizures when exposed to certain light patterns or flashing lights. Exposure to certain light patterns or backgrounds on a video monitor may induce an epileptic seizure, even in persons who have no history of prior seizures or epilepsy.
Expiration and Termination of Agreement
This EULA is effective until terminated.
Galaxy Studio may terminate this agreement immediately without prior notice if you fail to comply or otherwise violate the terms of this EULA, or if you infringe the intellectual property rights of any third party.
You may terminate this agreement at any time by removing all content of this software product and discontinuing use of the Northern Tales video game, and informing Galaxy Studio by sending an email to MXTechHelp@gmail.com
Governing Law, Legal Jurisdiction, and Interpretation of Agreement
This Agreement constitutes the entire statement of the Agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings, purchase orders, agreements and arrangements. This Agreement shall be governed by the laws of Canada.
This software product and all services provided may be used for lawful purposes only.
