END USER LICENSE AGREEMENT FOR
VR SOFTWARE "TINY LOVE"
IMPORTANT - Please read these End User License Agreements (“EULA(s)”) carefully before installing this VR Software Product, “Tiny Love”. By downloading, installing, copying, and/or otherwise using the Software Product you agree to be bound by the terms of any and all EULAs that pertain to its use. We are only prepared to license you to use the VR Software Product, “Tiny Love” on the terms of the relevant EULAs. Before installing this VR Software Product, “Tiny Love” please make sure that your computer meets the minimum technical specifications for the proper operation of this Software Product.
IF YOU ACCEPT TO BE BOUND BY THIS EULA PLEASE CLICK "I AGREE" AT THE END OF THIS EULA AT WHICH POINT THE VR SOFTWARE PRODUCT “TINY LOVE” WILL BE INSTALLED ONTO YOUR HARD DRIVE. IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS OF THIS EULA DO NOT CLICK "I AGREE " BUTTON AND THE VR SOFTWARE PRODUCT “TINY LOVE” WILL NOT BE DOWNLOADED AND/OR INSTALLED ONTO YOUR HARD DRIVE AND NO LICENSE SHALL BE GRANTED TO YOU IN RESPECT OF THE SOFTWARE PRODUCT.
Copyright and other intellectual property laws and treaties protect this Software Product. The Software Product is licensed, not sold.
ALTERINDIE LLC grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the Application solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.
This VR SOFTWARE PRODUCT, “Tiny Love” is for personal use only and may be installed and used by on only one computer. Its component parts may not be separated for use on more than one computer. VR SOFTWARE PRODUCT “Tiny Love” may be accessed through a network only after obtaining a site license. All components accompanying the software are copyrighted by ALTERINDIE LLC and may not be taken apart, modified, used or published with other software or means except with the VR SOFTWARE PRODUCT “Tiny Love” software and may not be distributed or copied to make any commercial use or to exploit the VR SOFTWARE PRODUCT “Tiny Love” or any of its part for any commercial purpose, including without limitation (a) use at a cyber café, computer gaming center or any other location-based site, or in any manner whatsoever;
You agree not to, and you will not permit others to:
a) License, sell, rent, lease, transfer, sublicense, loan, exploit for profit or gain, copy, modify, adapt, merge, translate, use, reproduce, assign, transmit, host, outsource, disclose or otherwise commercially exploit the Application or make the Application available to any third party, distribute, broadcast, publicly perform, store in a retrieval system or otherwise deal in the Software Product or any part thereof in any way;
b) Except as the applicable law expressly permits, to reverse engineer, derive source code, modify, decompile, disassemble, or create derivative works based on the whole or any part of this VR SOFTWARE PRODUCT, “Tiny Love”, in whole or in part. You may not make access to the VR SOFTWARE PRODUCT, “Tiny Love” available to others in connection with a service bureau, application service provider, or similar business, or use this VR SOFTWARE PRODUCT, “Tiny Love” in a business to provide file compression, decompression, or conversion services to others. There are no third-party beneficiaries of any promises, obligations or representations made by ALTERINDIE LLC herein. Where applicable law expressly permits any such acts, and any lawful modifications, adaptations and Improvements and all copyrights therein shall be deemed assigned to and shall belong to, vest in and be the exclusive property of ALTERINDIE LLC and/or its licensors on creation to the maximum extent permitted by law and you hereby waive all or any moral rights in such creations;
c) Remove, disable or circumvent any security protections or any technical measures that control access to the Software Product and/or are designed to prevent or inhibit the infringement of any copyright or other intellectual property right in the Software Product;
d) Remove, modify, deface or circumvent any proprietary notices or labels contained on or within the Software Product;
e) Export or re-export the Software Product or any copy or adaptation in violation of any applicable laws or regulations; or
f) Create data or executable programmes that mimic data or functionality in the Software Product.
Your consent to the use by us of certain Data:
We may from time to time during your gameplay collect anonymous, non-personally identifiable information (i.e. information which neither identifies you nor is linked to, associated with or capable of being used to identify, you) about your hardware system including how you are using the Software Product (including information about your successful installation and removal of the Software Product). This information may also include your internet protocol (I.P.) address (a numeric number assigned by your internet service provider to identify your PC). This information may be used not only to help you play the game on the Software Product over the Internet (where the Software Product contains Online Features) but also to help us better understand how our customers are using the Software Product, their behaviour and preferences, so that we can improve our computer games and services in the future. This information will not, however, be used to personally identify you without you being aware of it and without your separate consent. This information and any other data which may be provided by you to us or which may be collected by us in connection with your installation and use of the Software Product or any Online Features will be collected, stored, retrieved, used and distributed by ALTERINDIE LLC. By clicking the Accept button you unconditionally and irrevocably agree to the terms of the Privacy Policy and Cookies Policy as varied and/or amended from time to time.
Modifications to Application:
ALTERINDIE LLC reserves the right to modify, suspend or discontinue, temporarily or permanently, the Application or any service to which it connects, with or without notice and without liability to you.
Term and Termination:
This Agreement shall remain in effect until terminated by you or ALTERINDIE LLC
ALTERINDIE LLC may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.
This Agreement will terminate immediately, without prior notice from ALTERINDIE LLC, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Application and all copies thereof from your mobile device or from your desktop.
Upon termination of this Agreement, you shall cease all use of the Application and delete all copies of the Application from your mobile device or from your desktop.
Severability:
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Injunction:
Because ALTERINDIE LLC. would be irreparably damaged if the terms of this EULA were not specifically enforced, you agree that we shall be entitled, without bond or other security or proof of damages, to take such action as may be required, including without limitation seeking an injunction and other equitable remedies, in addition to any other remedies available to us under law.
Indemnity:
You agree to indemnify, defend and hold harmless ALTERINDIE LLC, its partners, affiliates, contractors, licensors, officers, directors, employee and agents from all claims, damages, costs and expenses (including reasonable legal fees) arising directly or indirectly from your acts of omissions in connection with using the VR Software Product, “Tiny Love” or any breach by you of the terms of this EULA.
Amendments to this Agreement:
You agree and acknowledge that all title, ownership rights, and intellectual property rights connected with the VR Software Product, “Tiny Love” and any and all copies thereof (including but not limited to any derivative works, titles, computer code, themes, objects, characters, character names, stories, dialogs, catch phrases, locations, concepts, artwork, graphics, animation, sounds, musical compositions, audio-visual effects, text, screen displays, methods of operation, moral rights, “applets” incorporated into the VR Software Product “Tiny Love” and any related documentation) are owned by ALTERINDIE LLC or its licensors.
ALTERINDIE LLC reserves the right, at its sole discretion, to modify, amend or replace this EULA at any time. If a revision is material we will most likely communicate such changes to you prior to any new terms taking effect. You accept that such unilateral changes may be necessary to take account of, for example, changes to any digital rights management system used, or, where applicable, changes to the STEAM™ service where STEAM™ software is used. If any such future changes to this EULA are unacceptable to you or cause you to no longer be in compliance with this EULA you may terminate this EULA in accordance with the above Termination provisions. Your installations and use of any updates or modifications to the VR Software Product or your continued use of the Product Software following notice of changes to this EULA will constitute your acceptance of any and all such changes to the terms of this EULA. What constitutes a material change will be determined at our sole discretion.
Ownership
You only own the media on which the Software Product is recorded. ALTERINDIE LLC and/or its licensors shall at all times retain ownership of the Software Product as recorded on the media and all subsequent copies regardless of form.
This VR SOFTWARE PRODUCT, “Tiny Love”, all accompanying files, data and materials, are distributed "AS IS" and with no warranties of any kind, whether express or implied. The user must assume all risk of using the program. This disclaimer of warranty constitutes an essential part of the agreement.
In no event shall ALTERINDIE LLC, or its principals, shareholders, officers, employees, affiliates, contractors, subsidiaries, or parent organizations, be liable for any incidental, consequential, punitive or any other damages whatsoever relating to the use of the VR SOFTWARE PRODUCT, “Tiny Love”
In addition, in no event does ALTERINDIE LLC authorize you to use this VR SOFTWARE PRODUCT, “Tiny Love” in applications or systems where VR SOFTWARE PRODUCT's “Tiny Love”, failure to perform can reasonably be expected to result in a physical injury, or in loss of life. Any such use by you is entirely at your own risk, and you agree to hold ALTERINDIE LLC harmless from any claims or losses relating to such unauthorized use.
This Agreement constitutes the entire statement of the Agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings, purchase orders, agreements and arrangements. This Agreement shall be governed by the laws of YOUR COUNTRY OR STATE.
ALTERINDIE LLC the owner of the copyright of this VR SOFTWARE PRODUCT, “Tiny Love”, all of its derivatives, title and accompanying materials are the exclusive property of ALTERINDIE LLC. All rights of any kind, which are not expressly granted in this License, are entirely and exclusively reserved to and by ALTERINDIE LLC.
You may not disclose to other persons the data or techniques relating to this VR SOFTWARE PRODUCT, “Tiny Love” that you know or should know that it is a trade secret of ALTERINDIE LLC in any manner that will cause damage to ALTERINDIE LLC.
This VR SOFTWARE PRODUCT, “Tiny Love” and all services provided may be used for lawful purposes only.
Transmission, storage, or presentation of any information, data or material in violation of any COUNTRY, State or City law is strictly prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. You agree to indemnify and hold ALTERINDIE LLC harmless from any claims resulting from the use of this VR SOFTWARE PRODUCT, “Tiny Love”, which may damage any other party.
