Privacy Policy
1. WHAT THIS PRIVACY POLICY REGULATES
1.1 This Privacy Policy applies to our video game “Deathless Heroes” and all related services, including (not exclusively) www.deathlessheroes.wz.cz website, Deathless Heroes user accounts, esports tournaments and other events, customer and technical support, wikis, blogs, and social media services.
1.2 Specifically, this Privacy Policy governs personal data (further “data”) or, as it is called in the United States, “personally identifiable information”, which we collect from you when you are using Deathless Heroes. It essentially means information which, on its own, or in combination with other information, can be used to identify you.
1.3 We respect your right to privacy and will only process your data in accordance with applicable legislation in the EU and other countries where we offer our games and services.
2. PROTECTING DATA OBTAINED FROM MINORS
2.1 You must be 18 years old or older to register for Deathless Heroes and to play it. We do not deliberately process any personal data of minors below 16 years of age.
3. HOW WE COLLECT YOUR DATA
3.1 We may collect or process your data directly from you or through our Trusted Partners. This is basically:(a) data you give us via Deathless Heroes, or which you give to our partners in connection with Deathless Heroes;(b) data you give us when you contact us or report a problem with Deathless Heroes;(c) data about your activity as a user of Deathless Heroes (collected automatically);(d) data you put in our voluntary surveys conducted for research purposes.
3.2 We and our partners also collect data about you via cookies. You can find out more about this, as well as manage your consents, by following the link to “Cookie Declaration” you will find in the footer of our websites.
4. HOW WE USE YOUR DATA
4.1 We may use your data for several purposes, relying on specific legal bases:
(a) to perform the agreement with you (art. 6.1.b GDPR):
● to provide you with Deathless Heroes,
● to maintain, improve and develop Deathless Heroes,
● to keep the ranking of Deathless Heroes players,
● to maintain technical support services,
● for tax, legal and accounting purposes
● for the accountability purposes as defined by EU legislation (GDPR)
● to defend from or pursue legal claims,
● to provide you with marketing information about products or services that you request from us and which we feel may interest you (newsletters),
● to target and personalize our marketing communication, offers and advertisements that we display on our websites and services as well as those of third parties based on the combined data we have collected about you (profiling).
For potential other purposes, we may also ask for your consent to process your data. Whenever we process your data based on your consent, you are entitled to withdraw your consent at any time. This will not invalidate the processing conducted before the withdrawal.
4.2. When we transfer your data outside the European Economic Area, we do so on the bases described in section 8 “Our Trusted Partners”.
We will use your data to operate Deathless Heroes and continue to improve it, as well as to communicate with you (e.g. via newsletters)
4.3 Whenever we’re personalizing or targeting our marketing communications, offers and advertisements, we may profile your data. This means that we may adjust the communication addressed to you basen on the data, to better meet your needs. That being said, we don’t use your data for automated decision-making that could affect your legal situation (i.e. we do not use algorithms to make decisions which would have an impact on your individual legal rights or affect your legal status or rights under the agreement between us). For example, we do not make automatic offers based on your behaviour in the game). You can object to the profiling at any time.
4.4 We might process some aggregated and general non-personal data on user behaviour (e.g. sales per region) with our partners who assist us in the process of running Deathless Heroes or, for example, with payment providers. We may also share non-personal data with data analysis services to help us run Deathless Heroes. For example, this may happen in case we need information about what kinds of kegs are the most popular in a given region.
4.5 You can check the details of the data we collect about you in section 14 “What Data We Collect” at the end of this Privacy Policy.
5. HOW WE HANDLE YOUR DATA
5.1 We store your data on our servers in Europe or – if necessary – outside of Europe.
5.2 We will store your personal data for as long as we need it to fulfil the purposes outlined in this Privacy Policy. In more detail:
(a) we will keep the data associated with your Deathless Heroes account until you close your Deathless Heroes account (i.e. for as long as we have a contract in place);
(b) after that, we may keep some of your data for a longer period, not exceeding 6 years, for tax and/or accounting purposes;
(c) we may also keep some of your data to defend ourselves from or to pursue legal claims, for no longer than 10 years;
(d) we will keep your data used for marketing purposes until you withdraw your consent (unsubscribe) - it may take us up to 30 days to delete the data;
(e) we will keep your data collected from cookies for as long as indicated in the Cookie Declaration (link in the footer of our websites);
(f) when we no longer require your data we will delete or anonymize it.
6. WHO HAS ACCESS TO YOUR DATA
6.1 In general only our authorized personnel have access to your data.
6.2 Some Deathless Heroes services may involve interacting with our Trusted Partners. In such cases we may need to share some of your personal data with them.
6.3 Please be aware that we are subject to various laws and may be required to release personal data to comply with law enforcement requests and/or other legal requirements.
6.4 If Deathless Heroes game or any parts will be selled, we may transfer personal data. Then all securing and privacy policy can be changed.
6.5 When you create a Deathless Heroes account, some basic data about you (your username, card collection, and statistics) will form a part of your public profile and it will be visible to everyone who views your profile.
7. OUR TRUSTED PARTNERS
7.1 We may share your data with the following Trusted Partners (formally called “data processors”). We always provide them with just the data that they need to perform their Deathless Heroes-related services:
● Alchemy Bohemia - current game developer,
● partners who provide us with software and support ticket system to help us managing your customer support requests (like Unity3D engine),
● partners who provide us with error tracking and crash reporting tools,
● partners who provide us with internal management and data-sharing tools,
● partners who help us in data analysis by providing us with analytical tools,
● partners who help us manage our newsletters and email communications by providing us with email marketing tools,
● network and data hosting providers whose services we use to support Deathless Heroes infrastructure,
● professional advisors who assist us with legal, tax, audit or accounting matters,
● social media platforms, for the purpose of personalized and targeted marketing.
7.2 When required by law, we may also share your data with the police or other government authorities (including your IP address and details of suspected unlawful or fraudulent activity).
7.3 Deathless Heroes account registration involves the use of Google’s reCAPTCHA service. This plugin checks if you are a person in order to prevent the service from being abused by spam bots. Use of the reCAPTCHA service is subject to the Google Privacy Policy and Terms of Use.
7.4 Your data may be processed, stored and transferred to countries outside the European Economic Area (EEA), such as Switzerland or the United States. Privacy laws in these countries may not offer the same level of protection as in your country or in the EEA. But whenever we share your personal data outside the EEA, we will do so on the basis of EU standard contractual clauses or other lawful measures, to ensure security of your data.
8. THIRD PARTY SERVICES
Deathless Heroes may, contain or connect you with third party content or services. Our Privacy Policy does not extend to external sites or companies, so please refer directly to their privacy policies.
9. YOUR RIGHTS AND COMPLAINTS
9.1 You have the right to object to the processing of your personal data at any time, such as for marketing reasons.

● You have the right to access data held about you;
● You may contact us to request that we delete your data from our system;
● You may ask us to rectify/correct your data, if appropriate;
● You may ask us to restrict the processing of your data;
● You have the right to transfer your data to another entity;
● You have the right to file a complaint with a data protection authority.
9.3 To exercise your rights or in case of any concerns or questions about your privacy, please contact us and we will do our best to assist you.
10. CHANGES TO THIS PRIVACY POLICY
10.1 We may change this Privacy Policy. If we do so, we will make the altered Privacy Policy available online.
10.2 Once we change the Privacy Policy, it will become legally binding 30 days after we post it online. During that period, you are welcome to contact us if you have specific questions about the changes.
10.3 If you don't agree to the changes (regardless of whether you contact us), you should stop using Deathless Heroes. This stems from the need to have every player observing the same rules, so our services can function properly.
11. WHAT DATA WE COLLECT
When you sign up for, download, use or play Deathless Heroes, or are involved in Deathless Heroes esports events we collect certain data about you.
When you play Deathless Heroes we collect basic data about you and your activity on your account:
● email address
● name and surname;
● date of birth
● any username used to identify yourself, avatars
● Steam-ID
● GooglePlay-ID
● log of user activity within Deathless Heroes (login time, logout time, log of matches played, number of wins and losses, gathered experience points)
● account of in-game virtual goods and currencies
● Matchmaking Rating (MMR)
● IP address
● location, language (inferred from your IP address)
● country of origin
● network latency
● users segment identifiers
● information about your gameplay and in-game behaviour
● data about your device/platform
● any other data which you submit to us through Deathless Heroes.
When you buy Deathless Heroes content we additionally collect:
● data about purchases made with virtual or real currency (including transaction dates, currencies, transaction value, purchased items)
We do not receive nor store any of your payment details. This is fully handled by the relevant payment platform.
If you contact our technical support we additionally collect:
● other data required to help you with your issue, such as data collected in crash logs that are gathered by your device or the technical parameters of the device you use to play Deathless Heroes.
1.1 Minimum requirements. Deathless Heroes will have minimum requirements depending on your chosen device/system, which you will be notified of. Please make sure you meet these requirements before downloading the game! To play Deathless Heroes online you will need Internet access too (which is your responsibility to obtain and maintain). There is no DRM or copy-protection of any kind in Deathless Heroes.
1.2 Monitoring. In order to prevent cheating and other things prohibited by Section 8 below and to protect the integrity of Deathless Heroes and enforce this Agreement, game developer can deploy anti-cheat and/or other software tools that run in the background of your device or related devices/peripherals when you use Deathless Heroes.
2. A SPECIAL NOTE ABOUT MINORS
2.1 If you are over 18, then welcome to Deathless Heroes! If you are between 16 and 18 before we extend an equally warm welcome, please ask your parent or guardian to review and approve this Agreement on your behalf (because in some countries people under a certain age cannot legally enter fully into contracts like this Agreement), plus they should supervise your use of Deathless Heroes. Deathless Heroes has age ratings, which will be displayed when you purchase the game. We are sorry to say that, but if you are under 16 you are not allowed to download, play or otherwise access Deathless Heroes.
3. USING Deathless Heroes
3.1 Although it may sound strange since Deathless Heroes is free to play, we need to give you permission to play it! Therefore, developer of the game gives you a personal, limited, revocable, non-exclusive, non-transferable and non-assignable licence to display, view, download, install, play and use Deathless Heroes on authorized devices/platforms. This licence is for your personal use only (so you cannot give, ‘sell’, lend, gift, assign, sub-license or otherwise transfer it to someone else) and does not give you any ownership rights in Deathless Heroes.
4. USER ACCOUNTS NEEDED
4.1 In order to play Deathless Heroes on PC you need to create a Steam user account and download/install Steam client and to download/install game to play. Please bear in mind Steam services have their own terms and conditions. Rules concerning playing on your mobile platform are described below.
4.2 Protecting user accounts. You are responsible for protecting your user account and for your account activities. In particular, keep your password secure! In order to protect Deathless Heroes, Deathless Heroes users and ourselves, developer of game reserves the right if really necessary to reject any user account if it would breach this Deathless Heroes User Agreement or other legal rules linked to in this document.5. ABOUT THIS AGREEMENT
5.1 This Agreement is a legally binding contract between you, and developer David Kos. This Agreement applies to our video game Deathless Heroes, both its multiplayer mode and single player campaigns, any game key or code giving you access to it or any parts of it, Deathless Heroes Virtual Goods and Virtual Currency (defined below), esports tournaments and events, plus any and all official products and services related to Deathless Heroes, including (but not limited to) user accounts, customer and technical support, plus official forums, wikis, blogs and social media services (we will refer to Deathless Heroes to cover all these things). This Agreement will be binding on you and us once you download, install or use Deathless Heroes. If you do not agree to it, please do not use Deathless Heroes.
6. PATCHES, UPDATES AND CHANGES
6.1 Our right to patch, update and change Deathless Heroes. We reserve the right to patch, update or change Deathless Heroes over time (for example to add or remove features, to resolve software bugs or to balance the game or adjust the game economy), which might result in mandatory and/or automatic updates (older, updated versions may become unusable over time as a result). Yes, this may eventually mean card nerfs – they are part of keeping the game alive and fresh. As part of these patches, updates or changes, we may need to impose limits on, or remove/restrict access to, certain game features (without notice or liability). We need these rights in order to keep Deathless Heroes running efficiently.
7. OWNERSHIP AND INTELLECTUAL PROPERTY RIGHTS
7.1 Deathless Heroes ownership. Deathless Heroes, including (but not limited to) its visual components, characters, story, items, music, graphics, computer code, user interface, look and feel, game mechanics, gameplay, audio, video, text, layout, databases, data and all other content and all Intellectual Property Rights (defined below) and other legal and exploitation rights regarding them, are either owned by developer or we license them from third parties. All rights in Deathless Heroes are reserved except as we have explained in this Agreement. You may not use or exploit any part of Deathless Heroes except as explained in this Agreement. Deathless Heroes and its Intellectual Property Rights are protected by intellectual property laws worldwide.
7.2 “Intellectual Property Rights" means any and all copyright, trademarks, service marks, logos, design rights, database rights, patents, rights in inventions, know-how, trade secrets and confidential information, rights in databases, rights in computer software, moral rights, publicity rights, performance rights, synchronisation rights, mechanical rights, publishing, rental, lending and transmission rights and other intellectual property and exploitation rights of a similar or corresponding character which may now or in the future subsist in any part of the world, in all cases whether or not registered or registrable including all granted applications and all applications for registration, division, continuation, reissuance, renewals, extensions, restorations and reversions regarding any of the same.
7.3 Third party property. Images and textures in game can be generated by AI. If you believe that your work has been infringed in Deathless Heroes, please contact us via email [is in contact&support section at this website].
8. RULES FOR USING Deathless HeroesThere are some more rules to follow if you want to play Deathless Heroes, including (but not limited to) our Fan Content Guidelines. Please read the rules below and the Fan Content Guidelines carefully since failure to follow them (particularly those in relation to cheating) will be considered a material breach of this Agreement, which could lead to cancellation or suspension of your access to Deathless Heroes. In particularly serious cases we retain the right to prohibit your future access to the game.
Rules:
1. Personal enjoyment. Only use Deathless Heroes for your personal enjoyment and not for any commercial or political purposes.
2. Restricted access. Do not attempt to copy, rent, sell, lend, lease, sublicense, distribute, publish or publicly display Deathless Heroes, Virtual Currency, Virtual Goods or your user account or any of your rights under this Agreement to any other party in any way not expressly authorized under this Agreement.
3. Technical misuse. Do not modify, merge, distribute, translate, reverse engineer, or attempt to obtain or use source code of, decompile or disassemble Deathless Heroes unless you are specifically allowed by applicable law.
4. Hacking/griefing. Do not hack, harm, grief, harass, threaten or misuse Deathless Heroes, other Deathless Heroes users, games, services, community members or staff.
5. Cheating. Do not create, use, make available and/or distribute cheats, exploits, automation software, robots, bots, mods, hacks, spiders, spyware, cheats, scripts, trainers, extraction tools or other software that interact with or affect Deathless Heroes in any way (including, without limitation, any unauthorized third party programs that intercept, emulate, or redirect any communication between Steam or their partners and Deathless Heroes and/or any unauthorized third party programs that collect information about Deathless Heroes by reading areas of memory used by Deathless Heroes to store information). Do not cause or take deliberate and repetitive advantage of bugs. We remind you of the serious consequences of cheating (see section 8 above).
6. Account misuse. Do not share, ‘buy’, ‘sell’, transfer, gift, lend, steal or misappropriate user accounts or Deathless Heroes access keys/codes (all of which is our property). If you are concerned that any of this has happened to you, contact us.
7. Power-levelling. Do not request/perform in-game services for others like power-levelling, boosting or ladder-climbing, whether or not in exchange for payment (real money or otherwise) from others.
8. No advertising. Do not communicate or facilitate any commercial advertisement, promotion, spam or unsolicited messages through Deathless Heroes.

10. Interfering with servers. Do not interfere with or disrupt Deathless Heroes or third party network software or servers, including via tunneling, code injection or insertion, denial of service, modifying or changing the software, using any other similar software together with Deathless Heroes software, through protocol emulation, or through creation or use of private servers or any analogous services regarding Deathless Heroes.
11. Accessing servers. Do not access or attempt to access areas of Deathless Heroes or Deathless Heroes servers that have not been made available to the public.
12. Data mining. Do not intercept, mine or otherwise collect data or information from Deathless Heroes using unauthorized third-party software.
13. Accounts and virtual content. Only use user accounts, Virtual Goods or Virtual Currency (defined below) for their intended purpose.
14. Broadcast/events. You can broadcast, publicly perform or stream Deathless Heroes or run any events, competitions, tournaments or leagues regarding Deathless Heroes or host Deathless Heroes games as long as it is permitted by our Community Tournament Guidelines and Fan Content Guidelines (which as a quick reminder permits non-commercial activities – see the link for more details).
15. Names/trademarks. Do not use ‘Deathless Heroes’ or other AlchemyBohemia product names or logos or trademarks for any unauthorized purposes.
16. Infringing Content. We ask you not to do anything in connection with Deathless Heroes that infringes any copyright, trademark, patent, trade secret, privacy, publicity, or other right of others.
17. Malicious Code. Do not post or upload any files that contain any malicious code, including viruses, spyware, Trojan horses, worms, time bombs, intentionally corrupted data, any other files that contain malicious code or that may in any way damage or interfere with the operation of Deathless Heroes.
18. Geographic/regional restrictions. We ask you to follow any applicable geographic or regional, language or location-based restrictions, requirements or rules regarding Deathless Heroes.
19. Be nice! Do not do or say anything that is or may be considered racist, harassing, xenophobic, sexist, discriminatory, abusive, defamatory or otherwise offensive or illegal. This applies especially in any communications between users. Do not spoil the experience of other players by unsportsmanlike or otherwise inadequate behaviour.
9. SHARED USER CONTENT AND COMMUNITY Deathless Heroes CONTENT
9.1 Shared User Content. Deathless Heroes may give you the ability to share content in-game (for example to share text, photos or links with users) – we will call this “Shared User Content". Note this is different to stuff which you can make using Deathless Heroes assets. If you do share Shared User Content, then it is at your responsibility and risk. Deathless Heroes (but not the obligation) to check and remove any inappropriate or illegal Shared User Content. But to game developer Alchemy Bohemia does not assume any responsibility or liability for Shared User Content. As far as we and you are concerned, you own any Shared User Content you created, but we need you to give us certain rights over it so that we can actually transmit it via Deathless Heroes. So, when you make your Shared User Content available through Deathless Heroes you give us a non-exclusive, permanent, irrevocable, worldwide, sub-licensable, royalty-free licence to use, modify, reproduce, create derivative works from, distribute, transmit, communicate and publicly display/perform your Shared User Content in connection with Deathless Heroes.
9.2 Fan Content. Please refer to our Fan Content Guidelines for information on how you can make community-generated Deathless Heroes content and do related Deathless Heroes stuff like make fan art or websites or blogs, create videos/streams/Let’s Plays.
10. VIRTUAL CURRENCY AND GOODS
10.1 How to use Virtual Goods and Virtual Currency. Deathless Heroes allows you to acquire virtual, in-game digital items and content including but not limited to Deathless Heroes card packs, cosmetic and in-game enhancements, campaigns and other downloadable content (“Virtual Goods”). You may at our discretion be able to acquire certain Virtual Goods with “real world” money, or virtual currencies such as 'Garnets' or 'Platinum'. Only Deathless Heroes users can use Virtual Goods and Virtual Currency.
10.2 Payments and refunds. Any content purchased in the Deathless Heroes in-game store or a store of the platform you use to access Deathless Heroes will be purchased from the applicable platform and will be subject to the terms and conditions of the given platform. Please check those terms and conditions as well as law applicable in your jurisdiction in case you would like to get a refund and follow them accordingly. We reserve the right to delete, edit or add any Virtual Goods or Virtual Currency.
10.3 Legal requirements. Virtual Goods and Virtual Currency are digital items only with no cash-value or real world existence and cannot be ‘bought’, ‘sold’, gifted, transferred or redeemed, whether or not for other Virtual Goods, Virtual Currency, ‘real world’ money, goods, services or items of monetary value. Trading Virtual Goods or Currency is prohibited (unless we specifically permit otherwise in Deathless Heroes). Your right to use any Virtual Goods and Virtual Currency that you obtain is limited to a limited, non-exclusive, non-assignable, non-transferable, non-sublicensable, revocable licence to use such Virtual Goods and Virtual Currency solely for your personal entertainment and non-commercial use in Deathless Heroes only. You have no property interest or right or title in any Virtual Goods or Virtual Currency, which remain this game developers property.
10.4 Limits. In order to protect Deathless Heroes, Deathless Heroes users and to stop fraud, we may impose limits on use of Virtual Goods and Virtual Currency (including transaction limits and balance amounts).
10.5 Expiry. Virtual Goods and Virtual Currency do not expire, but we reserve the right to change or amend that if necessary. We are not obliged to provide Virtual Goods or Virtual Currency to you.
10.6 Virtual Goods/Currency may change. The existence of a particular offer for Virtual Goods or Virtual Currency is not a commitment by us to maintain or continue to make the Virtual Goods or Virtual Currency or that offer available in the future. The scope, variety and type of Virtual Goods and Virtual Currency that you may obtain can change at any time and we have the right to manage, regulate, control, modify or remove Virtual Currency or Virtual Goods in our sole discretion if we consider any of this necessary for the ongoing operation of Deathless Heroes or for other legitimate reasons, in which case we will have no liability to you or anyone for the exercise of such rights. We will endeavor where possible to give you reasonable notice of any such changes and to explain the reasons why. Additionally we may, in our sole discretion, completely and indefinitely withdraw any and all offers and availability of all Virtual Goods and Virtual Currency. Where possible, we will try to give you at least sixty (60) days advance notice of such withdrawal of all Virtual Goods and Virtual Currency by posting a note on deathlessheroes.wz.com.
11. TERMINATION
11.1 Your termination rights. You can terminate this Agreement by permanently stopping use of Deathless Heroes at any time. Termination will not affect already existing rights or obligations of us or you.
11.2 Our termination rights. We may cancel or suspend your access to Deathless Heroes if you materially breach this Agreement, which includes but is not limited to a breach of this Agreement which is serious and/or which could cause real harm to Deathless Heroes users or other matters governed under this Agreement. In particular, it applies to the Deathless Heroes rules we specify in section 8 above (for example, no cheating or account misuse). If we cancel or suspend your account in this way, we will try reasonably to contact you to explain why we have done this and what (if anything) you can do as a result. Cancellation or suspension will include you losing access to Virtual Goods and Virtual Currency. If we cancel or suspend your account under this section, then we will not have any obligations or liabilities to you at all.
11.3 Stopping Deathless Heroes. While it is unlikely, Deathless Heroes might become unplayable after a certain period of time. If we have to stop providing access to Deathless Heroes permanently (not because of any breach by you or temporary issues) on a certain platform or on all platforms, we will try to give you at least sixty (60) days advance notice by posting a note on deathlessheroes.wz.cz. In this case, we will not have any future obligations or liabilities to you (this does not affect any pre-existing obligations or liabilities.
11.4 Game server can be whenever shutted down to maintenance or update.
12. FORCE MAJEURE
12.1 Neither of us will be liable to the other regarding any performance, or non-performance, or delay, in whole or in part, due to Force Majeure.
“Force Majeure" means any cause preventing a party from performing any or all of its obligations which arises from or is attributable to acts, events, omissions or accidents beyond the reasonable control of the party so prevented including strikes, lock-outs or other industrial disputes (other than any such dispute involving the workforce of the party so prevented), nuclear accident or acts of God, war or terrorist activity, riot, civil commotion, malicious damage (excluding malicious damage involving the employees of the affected party or its sub-contractors), compliance with any law or governmental order, rule, regulation or direction, industrial action by employees of any providers of electrical power, failure of technical facilities, hacking, denial of service or other IT attack, deployment of IT virus malware or similar technology, fire, flood, or storm or default of suppliers or sub-contractors.

2.1 You must be 18 years old or older to register for Deathless Heroes and to play it. We do not deliberately process any personal data of minors below 16 years of age.
3. HOW WE COLLECT YOUR DATA
3.1 We may collect or process your data directly from you or through our Trusted Partners. This is basically:(a) data you give us via Deathless Heroes, or which you give to our partners in connection with Deathless Heroes;(b) data you give us when you contact us or report a problem with Deathless Heroes;(c) data about your activity as a user of Deathless Heroes (collected automatically);(d) data you put in our voluntary surveys conducted for research purposes.
3.2 We and our partners also collect data about you via cookies. You can find out more about this, as well as manage your consents, by following the link to “Cookie Declaration” you will find in the footer of our websites.
4. HOW WE USE YOUR DATA
4.1 We may use your data for several purposes, relying on specific legal bases:
(a) to perform the agreement with you (art. 6.1.b GDPR):
● to provide you with Deathless Heroes,
● to maintain, improve and develop Deathless Heroes,
● to keep the ranking of Deathless Heroes players,
● to maintain technical support services,
● for tax, legal and accounting purposes
● for the accountability purposes as defined by EU legislation (GDPR)
● to defend from or pursue legal claims,
● to provide you with marketing information about products or services that you request from us and which we feel may interest you (newsletters),
● to target and personalize our marketing communication, offers and advertisements that we display on our websites and services as well as those of third parties based on the combined data we have collected about you (profiling).
For potential other purposes, we may also ask for your consent to process your data. Whenever we process your data based on your consent, you are entitled to withdraw your consent at any time. This will not invalidate the processing conducted before the withdrawal.
4.2. When we transfer your data outside the European Economic Area, we do so on the bases described in section 8 “Our Trusted Partners”.
We will use your data to operate Deathless Heroes and continue to improve it, as well as to communicate with you (e.g. via newsletters)
4.3 Whenever we’re personalizing or targeting our marketing communications, offers and advertisements, we may profile your data. This means that we may adjust the communication addressed to you basen on the data, to better meet your needs. That being said, we don’t use your data for automated decision-making that could affect your legal situation (i.e. we do not use algorithms to make decisions which would have an impact on your individual legal rights or affect your legal status or rights under the agreement between us). For example, we do not make automatic offers based on your behaviour in the game). You can object to the profiling at any time.
4.4 We might process some aggregated and general non-personal data on user behaviour (e.g. sales per region) with our partners who assist us in the process of running Deathless Heroes or, for example, with payment providers. We may also share non-personal data with data analysis services to help us run Deathless Heroes. For example, this may happen in case we need information about what kinds of kegs are the most popular in a given region.
4.5 You can check the details of the data we collect about you in section 14 “What Data We Collect” at the end of this Privacy Policy.
5. HOW WE HANDLE YOUR DATA
5.1 We store your data on our servers in Europe or – if necessary – outside of Europe.
5.2 We will store your personal data for as long as we need it to fulfil the purposes outlined in this Privacy Policy. In more detail:
(a) we will keep the data associated with your Deathless Heroes account until you close your Deathless Heroes account (i.e. for as long as we have a contract in place);
(b) after that, we may keep some of your data for a longer period, not exceeding 6 years, for tax and/or accounting purposes;
(c) we may also keep some of your data to defend ourselves from or to pursue legal claims, for no longer than 10 years;
(d) we will keep your data used for marketing purposes until you withdraw your consent (unsubscribe) - it may take us up to 30 days to delete the data;
(e) we will keep your data collected from cookies for as long as indicated in the Cookie Declaration (link in the footer of our websites);
(f) when we no longer require your data we will delete or anonymize it.
6. WHO HAS ACCESS TO YOUR DATA
6.1 In general only our authorized personnel have access to your data.
6.2 Some Deathless Heroes services may involve interacting with our Trusted Partners. In such cases we may need to share some of your personal data with them.
6.3 Please be aware that we are subject to various laws and may be required to release personal data to comply with law enforcement requests and/or other legal requirements.
6.4 If Deathless Heroes game or any parts will be selled, we may transfer personal data. Then all securing and privacy policy can be changed.
6.5 When you create a Deathless Heroes account, some basic data about you (your username, card collection, and statistics) will form a part of your public profile and it will be visible to everyone who views your profile.
7. OUR TRUSTED PARTNERS
7.1 We may share your data with the following Trusted Partners (formally called “data processors”). We always provide them with just the data that they need to perform their Deathless Heroes-related services:
● Alchemy Bohemia - current game developer,
● partners who provide us with software and support ticket system to help us managing your customer support requests (like Unity3D engine),
● partners who provide us with error tracking and crash reporting tools,
● partners who provide us with internal management and data-sharing tools,
● partners who help us in data analysis by providing us with analytical tools,
● partners who help us manage our newsletters and email communications by providing us with email marketing tools,
● network and data hosting providers whose services we use to support Deathless Heroes infrastructure,
● professional advisors who assist us with legal, tax, audit or accounting matters,
● social media platforms, for the purpose of personalized and targeted marketing.
7.2 When required by law, we may also share your data with the police or other government authorities (including your IP address and details of suspected unlawful or fraudulent activity).
7.3 Deathless Heroes account registration involves the use of Google’s reCAPTCHA service. This plugin checks if you are a person in order to prevent the service from being abused by spam bots. Use of the reCAPTCHA service is subject to the Google Privacy Policy and Terms of Use.
7.4 Your data may be processed, stored and transferred to countries outside the European Economic Area (EEA), such as Switzerland or the United States. Privacy laws in these countries may not offer the same level of protection as in your country or in the EEA. But whenever we share your personal data outside the EEA, we will do so on the basis of EU standard contractual clauses or other lawful measures, to ensure security of your data.
8. THIRD PARTY SERVICES
Deathless Heroes may, contain or connect you with third party content or services. Our Privacy Policy does not extend to external sites or companies, so please refer directly to their privacy policies.
9. YOUR RIGHTS AND COMPLAINTS
9.1 You have the right to object to the processing of your personal data at any time, such as for marketing reasons.

● You have the right to access data held about you;
● You may contact us to request that we delete your data from our system;
● You may ask us to rectify/correct your data, if appropriate;
● You may ask us to restrict the processing of your data;
● You have the right to transfer your data to another entity;
● You have the right to file a complaint with a data protection authority.
9.3 To exercise your rights or in case of any concerns or questions about your privacy, please contact us and we will do our best to assist you.
10. CHANGES TO THIS PRIVACY POLICY
10.1 We may change this Privacy Policy. If we do so, we will make the altered Privacy Policy available online.
10.2 Once we change the Privacy Policy, it will become legally binding 30 days after we post it online. During that period, you are welcome to contact us if you have specific questions about the changes.
10.3 If you don't agree to the changes (regardless of whether you contact us), you should stop using Deathless Heroes. This stems from the need to have every player observing the same rules, so our services can function properly.
11. WHAT DATA WE COLLECT
When you sign up for, download, use or play Deathless Heroes, or are involved in Deathless Heroes esports events we collect certain data about you.
When you play Deathless Heroes we collect basic data about you and your activity on your account:
● email address
● name and surname;
● date of birth
● any username used to identify yourself, avatars
● Steam-ID
● GooglePlay-ID
● log of user activity within Deathless Heroes (login time, logout time, log of matches played, number of wins and losses, gathered experience points)
● account of in-game virtual goods and currencies
● Matchmaking Rating (MMR)
● IP address
● location, language (inferred from your IP address)
● country of origin
● network latency
● users segment identifiers
● information about your gameplay and in-game behaviour
● data about your device/platform
● any other data which you submit to us through Deathless Heroes.
When you buy Deathless Heroes content we additionally collect:
● data about purchases made with virtual or real currency (including transaction dates, currencies, transaction value, purchased items)
We do not receive nor store any of your payment details. This is fully handled by the relevant payment platform.
If you contact our technical support we additionally collect:
● other data required to help you with your issue, such as data collected in crash logs that are gathered by your device or the technical parameters of the device you use to play Deathless Heroes.
USER AGREEMENTS
1. MINIMUM REQUIREMENTS AND MONITORING1.1 Minimum requirements. Deathless Heroes will have minimum requirements depending on your chosen device/system, which you will be notified of. Please make sure you meet these requirements before downloading the game! To play Deathless Heroes online you will need Internet access too (which is your responsibility to obtain and maintain). There is no DRM or copy-protection of any kind in Deathless Heroes.
1.2 Monitoring. In order to prevent cheating and other things prohibited by Section 8 below and to protect the integrity of Deathless Heroes and enforce this Agreement, game developer can deploy anti-cheat and/or other software tools that run in the background of your device or related devices/peripherals when you use Deathless Heroes.
2. A SPECIAL NOTE ABOUT MINORS
2.1 If you are over 18, then welcome to Deathless Heroes! If you are between 16 and 18 before we extend an equally warm welcome, please ask your parent or guardian to review and approve this Agreement on your behalf (because in some countries people under a certain age cannot legally enter fully into contracts like this Agreement), plus they should supervise your use of Deathless Heroes. Deathless Heroes has age ratings, which will be displayed when you purchase the game. We are sorry to say that, but if you are under 16 you are not allowed to download, play or otherwise access Deathless Heroes.
3. USING Deathless Heroes
3.1 Although it may sound strange since Deathless Heroes is free to play, we need to give you permission to play it! Therefore, developer of the game gives you a personal, limited, revocable, non-exclusive, non-transferable and non-assignable licence to display, view, download, install, play and use Deathless Heroes on authorized devices/platforms. This licence is for your personal use only (so you cannot give, ‘sell’, lend, gift, assign, sub-license or otherwise transfer it to someone else) and does not give you any ownership rights in Deathless Heroes.
4. USER ACCOUNTS NEEDED
4.1 In order to play Deathless Heroes on PC you need to create a Steam user account and download/install Steam client and to download/install game to play. Please bear in mind Steam services have their own terms and conditions. Rules concerning playing on your mobile platform are described below.
4.2 Protecting user accounts. You are responsible for protecting your user account and for your account activities. In particular, keep your password secure! In order to protect Deathless Heroes, Deathless Heroes users and ourselves, developer of game reserves the right if really necessary to reject any user account if it would breach this Deathless Heroes User Agreement or other legal rules linked to in this document.5. ABOUT THIS AGREEMENT
5.1 This Agreement is a legally binding contract between you, and developer David Kos. This Agreement applies to our video game Deathless Heroes, both its multiplayer mode and single player campaigns, any game key or code giving you access to it or any parts of it, Deathless Heroes Virtual Goods and Virtual Currency (defined below), esports tournaments and events, plus any and all official products and services related to Deathless Heroes, including (but not limited to) user accounts, customer and technical support, plus official forums, wikis, blogs and social media services (we will refer to Deathless Heroes to cover all these things). This Agreement will be binding on you and us once you download, install or use Deathless Heroes. If you do not agree to it, please do not use Deathless Heroes.
6. PATCHES, UPDATES AND CHANGES
6.1 Our right to patch, update and change Deathless Heroes. We reserve the right to patch, update or change Deathless Heroes over time (for example to add or remove features, to resolve software bugs or to balance the game or adjust the game economy), which might result in mandatory and/or automatic updates (older, updated versions may become unusable over time as a result). Yes, this may eventually mean card nerfs – they are part of keeping the game alive and fresh. As part of these patches, updates or changes, we may need to impose limits on, or remove/restrict access to, certain game features (without notice or liability). We need these rights in order to keep Deathless Heroes running efficiently.
7. OWNERSHIP AND INTELLECTUAL PROPERTY RIGHTS
7.1 Deathless Heroes ownership. Deathless Heroes, including (but not limited to) its visual components, characters, story, items, music, graphics, computer code, user interface, look and feel, game mechanics, gameplay, audio, video, text, layout, databases, data and all other content and all Intellectual Property Rights (defined below) and other legal and exploitation rights regarding them, are either owned by developer or we license them from third parties. All rights in Deathless Heroes are reserved except as we have explained in this Agreement. You may not use or exploit any part of Deathless Heroes except as explained in this Agreement. Deathless Heroes and its Intellectual Property Rights are protected by intellectual property laws worldwide.
7.2 “Intellectual Property Rights" means any and all copyright, trademarks, service marks, logos, design rights, database rights, patents, rights in inventions, know-how, trade secrets and confidential information, rights in databases, rights in computer software, moral rights, publicity rights, performance rights, synchronisation rights, mechanical rights, publishing, rental, lending and transmission rights and other intellectual property and exploitation rights of a similar or corresponding character which may now or in the future subsist in any part of the world, in all cases whether or not registered or registrable including all granted applications and all applications for registration, division, continuation, reissuance, renewals, extensions, restorations and reversions regarding any of the same.
7.3 Third party property. Images and textures in game can be generated by AI. If you believe that your work has been infringed in Deathless Heroes, please contact us via email [is in contact&support section at this website].
8. RULES FOR USING Deathless HeroesThere are some more rules to follow if you want to play Deathless Heroes, including (but not limited to) our Fan Content Guidelines. Please read the rules below and the Fan Content Guidelines carefully since failure to follow them (particularly those in relation to cheating) will be considered a material breach of this Agreement, which could lead to cancellation or suspension of your access to Deathless Heroes. In particularly serious cases we retain the right to prohibit your future access to the game.
Rules:
1. Personal enjoyment. Only use Deathless Heroes for your personal enjoyment and not for any commercial or political purposes.
2. Restricted access. Do not attempt to copy, rent, sell, lend, lease, sublicense, distribute, publish or publicly display Deathless Heroes, Virtual Currency, Virtual Goods or your user account or any of your rights under this Agreement to any other party in any way not expressly authorized under this Agreement.
3. Technical misuse. Do not modify, merge, distribute, translate, reverse engineer, or attempt to obtain or use source code of, decompile or disassemble Deathless Heroes unless you are specifically allowed by applicable law.
4. Hacking/griefing. Do not hack, harm, grief, harass, threaten or misuse Deathless Heroes, other Deathless Heroes users, games, services, community members or staff.
5. Cheating. Do not create, use, make available and/or distribute cheats, exploits, automation software, robots, bots, mods, hacks, spiders, spyware, cheats, scripts, trainers, extraction tools or other software that interact with or affect Deathless Heroes in any way (including, without limitation, any unauthorized third party programs that intercept, emulate, or redirect any communication between Steam or their partners and Deathless Heroes and/or any unauthorized third party programs that collect information about Deathless Heroes by reading areas of memory used by Deathless Heroes to store information). Do not cause or take deliberate and repetitive advantage of bugs. We remind you of the serious consequences of cheating (see section 8 above).
6. Account misuse. Do not share, ‘buy’, ‘sell’, transfer, gift, lend, steal or misappropriate user accounts or Deathless Heroes access keys/codes (all of which is our property). If you are concerned that any of this has happened to you, contact us.
7. Power-levelling. Do not request/perform in-game services for others like power-levelling, boosting or ladder-climbing, whether or not in exchange for payment (real money or otherwise) from others.
8. No advertising. Do not communicate or facilitate any commercial advertisement, promotion, spam or unsolicited messages through Deathless Heroes.

10. Interfering with servers. Do not interfere with or disrupt Deathless Heroes or third party network software or servers, including via tunneling, code injection or insertion, denial of service, modifying or changing the software, using any other similar software together with Deathless Heroes software, through protocol emulation, or through creation or use of private servers or any analogous services regarding Deathless Heroes.
11. Accessing servers. Do not access or attempt to access areas of Deathless Heroes or Deathless Heroes servers that have not been made available to the public.
12. Data mining. Do not intercept, mine or otherwise collect data or information from Deathless Heroes using unauthorized third-party software.
13. Accounts and virtual content. Only use user accounts, Virtual Goods or Virtual Currency (defined below) for their intended purpose.
14. Broadcast/events. You can broadcast, publicly perform or stream Deathless Heroes or run any events, competitions, tournaments or leagues regarding Deathless Heroes or host Deathless Heroes games as long as it is permitted by our Community Tournament Guidelines and Fan Content Guidelines (which as a quick reminder permits non-commercial activities – see the link for more details).
15. Names/trademarks. Do not use ‘Deathless Heroes’ or other AlchemyBohemia product names or logos or trademarks for any unauthorized purposes.
16. Infringing Content. We ask you not to do anything in connection with Deathless Heroes that infringes any copyright, trademark, patent, trade secret, privacy, publicity, or other right of others.
17. Malicious Code. Do not post or upload any files that contain any malicious code, including viruses, spyware, Trojan horses, worms, time bombs, intentionally corrupted data, any other files that contain malicious code or that may in any way damage or interfere with the operation of Deathless Heroes.
18. Geographic/regional restrictions. We ask you to follow any applicable geographic or regional, language or location-based restrictions, requirements or rules regarding Deathless Heroes.
19. Be nice! Do not do or say anything that is or may be considered racist, harassing, xenophobic, sexist, discriminatory, abusive, defamatory or otherwise offensive or illegal. This applies especially in any communications between users. Do not spoil the experience of other players by unsportsmanlike or otherwise inadequate behaviour.
9. SHARED USER CONTENT AND COMMUNITY Deathless Heroes CONTENT
9.1 Shared User Content. Deathless Heroes may give you the ability to share content in-game (for example to share text, photos or links with users) – we will call this “Shared User Content". Note this is different to stuff which you can make using Deathless Heroes assets. If you do share Shared User Content, then it is at your responsibility and risk. Deathless Heroes (but not the obligation) to check and remove any inappropriate or illegal Shared User Content. But to game developer Alchemy Bohemia does not assume any responsibility or liability for Shared User Content. As far as we and you are concerned, you own any Shared User Content you created, but we need you to give us certain rights over it so that we can actually transmit it via Deathless Heroes. So, when you make your Shared User Content available through Deathless Heroes you give us a non-exclusive, permanent, irrevocable, worldwide, sub-licensable, royalty-free licence to use, modify, reproduce, create derivative works from, distribute, transmit, communicate and publicly display/perform your Shared User Content in connection with Deathless Heroes.
9.2 Fan Content. Please refer to our Fan Content Guidelines for information on how you can make community-generated Deathless Heroes content and do related Deathless Heroes stuff like make fan art or websites or blogs, create videos/streams/Let’s Plays.
10. VIRTUAL CURRENCY AND GOODS
10.1 How to use Virtual Goods and Virtual Currency. Deathless Heroes allows you to acquire virtual, in-game digital items and content including but not limited to Deathless Heroes card packs, cosmetic and in-game enhancements, campaigns and other downloadable content (“Virtual Goods”). You may at our discretion be able to acquire certain Virtual Goods with “real world” money, or virtual currencies such as 'Garnets' or 'Platinum'. Only Deathless Heroes users can use Virtual Goods and Virtual Currency.
10.2 Payments and refunds. Any content purchased in the Deathless Heroes in-game store or a store of the platform you use to access Deathless Heroes will be purchased from the applicable platform and will be subject to the terms and conditions of the given platform. Please check those terms and conditions as well as law applicable in your jurisdiction in case you would like to get a refund and follow them accordingly. We reserve the right to delete, edit or add any Virtual Goods or Virtual Currency.
10.3 Legal requirements. Virtual Goods and Virtual Currency are digital items only with no cash-value or real world existence and cannot be ‘bought’, ‘sold’, gifted, transferred or redeemed, whether or not for other Virtual Goods, Virtual Currency, ‘real world’ money, goods, services or items of monetary value. Trading Virtual Goods or Currency is prohibited (unless we specifically permit otherwise in Deathless Heroes). Your right to use any Virtual Goods and Virtual Currency that you obtain is limited to a limited, non-exclusive, non-assignable, non-transferable, non-sublicensable, revocable licence to use such Virtual Goods and Virtual Currency solely for your personal entertainment and non-commercial use in Deathless Heroes only. You have no property interest or right or title in any Virtual Goods or Virtual Currency, which remain this game developers property.
10.4 Limits. In order to protect Deathless Heroes, Deathless Heroes users and to stop fraud, we may impose limits on use of Virtual Goods and Virtual Currency (including transaction limits and balance amounts).
10.5 Expiry. Virtual Goods and Virtual Currency do not expire, but we reserve the right to change or amend that if necessary. We are not obliged to provide Virtual Goods or Virtual Currency to you.
10.6 Virtual Goods/Currency may change. The existence of a particular offer for Virtual Goods or Virtual Currency is not a commitment by us to maintain or continue to make the Virtual Goods or Virtual Currency or that offer available in the future. The scope, variety and type of Virtual Goods and Virtual Currency that you may obtain can change at any time and we have the right to manage, regulate, control, modify or remove Virtual Currency or Virtual Goods in our sole discretion if we consider any of this necessary for the ongoing operation of Deathless Heroes or for other legitimate reasons, in which case we will have no liability to you or anyone for the exercise of such rights. We will endeavor where possible to give you reasonable notice of any such changes and to explain the reasons why. Additionally we may, in our sole discretion, completely and indefinitely withdraw any and all offers and availability of all Virtual Goods and Virtual Currency. Where possible, we will try to give you at least sixty (60) days advance notice of such withdrawal of all Virtual Goods and Virtual Currency by posting a note on deathlessheroes.wz.com.
11. TERMINATION
11.1 Your termination rights. You can terminate this Agreement by permanently stopping use of Deathless Heroes at any time. Termination will not affect already existing rights or obligations of us or you.
11.2 Our termination rights. We may cancel or suspend your access to Deathless Heroes if you materially breach this Agreement, which includes but is not limited to a breach of this Agreement which is serious and/or which could cause real harm to Deathless Heroes users or other matters governed under this Agreement. In particular, it applies to the Deathless Heroes rules we specify in section 8 above (for example, no cheating or account misuse). If we cancel or suspend your account in this way, we will try reasonably to contact you to explain why we have done this and what (if anything) you can do as a result. Cancellation or suspension will include you losing access to Virtual Goods and Virtual Currency. If we cancel or suspend your account under this section, then we will not have any obligations or liabilities to you at all.
11.3 Stopping Deathless Heroes. While it is unlikely, Deathless Heroes might become unplayable after a certain period of time. If we have to stop providing access to Deathless Heroes permanently (not because of any breach by you or temporary issues) on a certain platform or on all platforms, we will try to give you at least sixty (60) days advance notice by posting a note on deathlessheroes.wz.cz. In this case, we will not have any future obligations or liabilities to you (this does not affect any pre-existing obligations or liabilities.
11.4 Game server can be whenever shutted down to maintenance or update.
12. FORCE MAJEURE
12.1 Neither of us will be liable to the other regarding any performance, or non-performance, or delay, in whole or in part, due to Force Majeure.
“Force Majeure" means any cause preventing a party from performing any or all of its obligations which arises from or is attributable to acts, events, omissions or accidents beyond the reasonable control of the party so prevented including strikes, lock-outs or other industrial disputes (other than any such dispute involving the workforce of the party so prevented), nuclear accident or acts of God, war or terrorist activity, riot, civil commotion, malicious damage (excluding malicious damage involving the employees of the affected party or its sub-contractors), compliance with any law or governmental order, rule, regulation or direction, industrial action by employees of any providers of electrical power, failure of technical facilities, hacking, denial of service or other IT attack, deployment of IT virus malware or similar technology, fire, flood, or storm or default of suppliers or sub-contractors.
