END USER LICENSE AGREEMENT
GENERAL TERMS
This End User License Agreement (hereinafter referred to as "Agreement") is a legal agreement between you and Donkey Crew sp. z o.o., with registered office located at Stanisławowska 47, 54-611 Wrocław, Poland, NIP (VAT ID): PL8943127238, ("Donkey Crew") which governs your use of the game: LAST OASIS (hereinafter referred to as “Game”). Game here means Software, image files, all accompanying files, data and materials received with your downloading of "Game".
Please read the following Agreement before installing Game. By installing, copying, and/or otherwise using the Game, you agree to be bound by the terms of this Agreement as stipulated by Donkey Crew.
Your use of the Game is also subject to the terms and conditions set forth in the steam™ subscriber agreement and/or any other terms in relation to the steam service.
If you agree to the terms of this Agreement, please select "I accept" to install the Game and to indicate your acceptance of these terms and your understanding of the conditions of use of the Game.
If you do not agree to the terms of this Agreement, please select "I do not accept" and Donkey Crew shall not grant to you the License to the Game.
OWNERSHIP AND INTELLECTUAL PROPERTY RIGHTS
You agree and acknowledge that all title, ownership rights, and intellectual property rights connected with the Game and any and all copies thereof (including but not limited to any derivative works, titles, computer code, themes, objects, characters, character names, stories, dialogs, catch phrases, locations, concepts, artwork, graphics, animation, sounds, musical compositions, audio-visual effects, text, screen displays, methods of operation, moral rights, “applets” incorporated into the Game Software, and any related documentation) are owned by Donkey Crew or its licensors.
You are not entitled to distribute, rent, lease, transfer, modify, translate, reverse engineer, de-compile, disassemble or create derivative works based on this Game.
Copyright and other intellectual property laws and treaties protect this Game. The Game is licensed, not sold.
LICENSE CONDITIONS and RESTRICTIONS
Donkey Crew shall grant you a non-transferable to any third party, non-exclusive, for the term of this agreement and for the purpose of performance of this Agreement license to use the Game delivered under this Agreement solely for your personal entertainment and non-commercial use (hereinafter referred to “License”).
All rights of any kind, which are not expressly granted in this License, are entirely and exclusively reserved to and by Donkey Crew.
You agree to only use the Game, or any part of it, in a manner that is in line with this License and it is prohibited (especially) to:
a. sell, assign collateral in the form of the Game to third parties or transfer duplicate versions of the Game to third parties in a manner not expressly provided for in this Agreement, or lend, rent or license the Game to third parties to use it;
b. sell, sublicense, assign, lease, rent or otherwise transfer the Game, except as expressly permitted by this Agreement;
c. use reverse engineering, decompile, disassemble or otherwise reverse engineer the source code or game data from the Game or reduce the Game to a human readable form, except as expressly permitted by applicable law;
d. copy, photocopy, or reproduce the Game, in whole or in part; provided, however, that you may make one (1) copy of the Game instructions solely for your own archival purposes;
e. modify, translate or create derivative works based on or using the Game,
f. remove or modify any copyright or other proprietary rights contained in or relating to the Game,
g. use cheats, automated software (bots), hooks, mods, or other unauthorized third-party software, tools, or content designed to modify the Game,
h. use the Game, or any part thereof, for any commercial purpose except if otherwise permitted within this agreement.
i. use unauthorized third party software that intercepts, extracts or otherwise collects information from, within or through the Game, which includes without limitation any software that reads the RAM areas used by the Game to store information about characters, items specific to the Game or the Software environment, and Donkey Crew may, in its sole discretion, permit the use of certain third party interfaces;[KWiP1]
j. modify or allow or cause to be modified the files being part of the Game in any way without Donkey Crew’s express written consent in each case;
k. facilitate, establish, or maintain connections to the Game without permission, including without limitation: (i) any connection to unauthorized servers that emulate or attempt to emulate the Service, and (ii) any connection using programs or tools the use of which has not been expressly authorized in writing by Donkey Crew in each case;
l. create other software or content that contains the Game or any part thereof.
Furthermore, you agree that you shall abide by the safety information, maintenance instructions or other relevant notices contained in the manual that is included with the Game.
Donkey Crew gives you permission to livestream and create fan work (especially such as ‘Let’s Play’ or other videos, artwork and fan mods) regarding Game, unless our Terms say differently.
You do not need permission of Donkey Crew to monetize use of such fan work on streaming or video-sharing websites. Please remember that you are responsible for your fan works (especially any content which you make or which involves third parties).
TECHNICAL REQUIREMENTS
Before installing this Game (Software Product) please make sure that your computer meets the minimum technical specifications for the proper operation of this Software Product.
WARRANTY
The Game and services (technical support, if any) are provided on an “as is” basis and at your own risk. To the maximum extent permitted by applicable law, Donkey Crew and its licensors disclaim all other representations, warranties, conditions or other terms, either express or implied, including, but not limited to implied warranties and/or conditions of merchantability, satisfactory quality, non-infringement of intellectual property rights and fitness for a particular purpose, with regard to the Game and each and every part thereof.
Without prejudice to the generality of the foregoing, Donkey Crew does not warrant that the Game is error-free or that it will operate without interruption, nor that Donkey Crew will repair any errors in the software product.
Moreover Donkey Crew further does not warrant that the Game will operate in all types of computers.
LIABILITY
Donkey Crew shall not be liable for any losses or damage of any kind resulting from the Game or its use, including but not limited to loss of data, computer failure or malfunction, or resulting from other losses (including lost profits) or damage.
Furthermore, Donkey Crew shall not be liable for delays, interruptions, service failures or other problems related to the use of the Internet and electronic communication or other systems.
The terms of this Agreement are without prejudice to any terms and conditions governing your use of any third party proprietary software product including without limitation any STEAM™ software or any open source software that may be incorporated into any separate plugins, delivery systems or other software programs.
The entire risk of use (including without limitation, (a) any damage to your computer hardware, data or software or (b) as a result of the failure to adhere to any precautions resides with you.
Some jurisdictions do not permit the warranty disclaimers or limitations on liability set forth in this agreement. Nothing in this agreement shall affect your statutory rights as a consumer which under the applicable law are not capable of exclusion or limitation. These statutory rights may vary among different jurisdictions.
TECHNICAL SUPPORT/REQUIREMENTS
If you require technical support, please become acquainted with instructions within terms and conditions set forth in the steam™ subscriber agreement and/or any other terms in relation to the steam service, where you will find the e-mail addresses and other contact information for technical support and/or where you may be redirected to technical support.
Donkey Crew does not guarantee that technical support will be available at any time.
SOFTWARE UPDATES AND PATCHES
Donkey Crew may share or provide patches, updates and modifications to the Game that you should install in order to continue playing the Game. Donkey Crew may remotely update the Game, including, but not limited to, the Game located on your computer, without notifying you, and you hereby grant Donkey Crew your consent to make available and install such patches, updates and modifications.
TERMS AND TERMINATION
The term of this Agreement starts on the date you first indicate your acceptance of these terms, and will continue in effect until otherwise terminated according to this Agreement.
You may terminate this Agreement at any time by (i) uninstalling and discontinuing use of the Game, (ii)permanently destroying all copies of the Game in your possession or control.
The License shall terminate automatically if you fail to comply with its terms and conditions. In such event, you must uninstall and destroy all copies of the Game.
Donkey Crew may terminate this Agreement in accordance with the terms provided in Steam agreement and in case of any breach of this agreement by the user. Upon termination of this Agreement, all licenses granted to you under this Agreement will terminate immediately, and you must immediately and permanently uninstall and destroy all copies of the Game in your possession and control.
The Sections entitled “General Terms”, “Ownership and Intellectual Property Rights” “License Conditions and Restrictions,” “Liability”, “Applicable Law”, “Dispute Resolution”, “Miscellaneous” shall survive any termination of this License.
APPLICABLE LAW
This Agreement shall be governed by and construed in accordance with the laws of Poland.
The Parties agree that the United Nations on Contracts for the International Sale of Goods shall not apply to this Agreement.
DISPUTE RESOLUTION
In case of any dispute arising from this Agreement, the Parties shall endeavour to amicably settle any potential disputes arising from or related to the Agreement. In the event of the failure to reach an agreement, Polish courts shall have exclusive jurisdiction over all disputes resulting from this Agreement.
AMENDMENTS TO THIS AGREEMENT
Donkey Crew is entitled to amend this Agreement unilaterally at any time in its sole discretion. In such case, you will be informed during next game launch of any amendment to this Agreement made by Donkey Crew.

MISCELLANEOUS
Donkey Crew informs you that it will use the data provided by you on Steam and made available to Donkey Crew by Steam for the marketing purposes to the extent limited by Steam's PRIVACY POLICY and any consents you may have given to Steam.
By accepting this Agreement, you accept Donkey Crew’s Privacy Policy. You can view the Donkey Crew’s Privacy Policy at any time at: https://www.donkey.team/privacy
This Agreement constitutes the entire statement of the agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings, agreements and arrangements.
If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable, and the remaining provisions of this Agreement shall remain in full force and not be affected.
