PLEASE READ CAREFULLY BEFORE INSTALLING GAME "FAST DUST" ("the Game").
THIS END USER LICENSE AGREEMENT MAY BE UPDATED FROM TIME TO TIME. FURTHER USE OF THE GAME, AFTER INFORMING ABOUT NEW VERSION, MEANS THAT YOU AGREE TO ALL OF ITS TERMS.
IN ORDER TO PLAY THE GAME, YOU MUST AGREE TO ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL THE TERMS IN THIS AGREEMENT, YOU CANNOT INSTALL OR USE THE GAME.
§1 OWNERSHIP
1.1 The game is protected by copyright law (Intellectual Property Rights), international agreements and conventions regarding the protection of copyrights and other rights.
1.2 All ownership of the Game including: image, sound, computer code, derivative works, titles, objects, concepts, musical compositions and other content embedded in the Game, as well as the ownership title to all copies, belongs to Beniamin Skowroński ("BINARY GIANTS") who is The Developer of the Game or to his licensors.
§2 LIMITED USER LICENSE
2.1 The game is not sold. The Developer grants you a revocable, non-exclusive, non-transferable and limited license to use one copy of the Game solely for your own use. You does not receive any rights or property titles other than the limited license specified in the terms of this Agreement. Commercial use of the Game is prohibited.
2.2 You are responsible for making any fees for the required equipment and for incurring other costs that may be necessary to gain access to the Game, including Internet access charges and other costs incurred to gain access to any part of the multiplayer, network or intended for download.
2.3 This agreement or the use of the Game will not grant you any future rights to the game, it's extension, continuation or similar and related products.
2.4 You fully accepts that The Developer may change, modify, suspend or disable the use of the Game or any part of it at any time by it's own decision. The Developer may also, without warning and liability, introduce limits to certain functions or restrict you the access to part or all of the Game.
2.5 You are not allowed to:
a) copy the Games, except for one allowed backup copy;
b) borrow, sell, lease, license, distribute or otherwise transfer or make the Games available to any other person, whether partially or fully;
c) use the Game or any part of it for commercial purposes, including commercial websites, service establishments or any other premises where multiple users may access the Game, none of which has purchased the Game;
d) perform reverse engineering, obtain source code, decompile, disassemble or create secondary works from the Game or any part of it, neither in whole nor in part;
e) remove, deactivate or disregard any information about ownership or designations contained in the Game;
2.6 You may use the Game only on one device at the same time.
§3 SECURITY
In order to use the Game, you must have an Internet connection and you have to agree to the use of access management function.
§4 COLLECTION OF DATA
4.1 In order to effectively determine the causes of problems related to the game code and for statistical purposes, The Developer will automatically collect the following data from the moment you start using the Game:
a) version of the Game;
b) language used in the Game;
c) the name of operating system;
d) computer's name and / or Steam user id;
e) IP address and / or MAC address of the network card;
4.2 By installing the Game, you agree to the collection of the above information by The Developer.
§5 TERMINATION OF THE AGREEMENT
5.1 This license will apply as long as you use the Game or run it.
5.2 You may terminate this Agreement at any time by uninstalling the Game and destroying all components and copies of the Game from your computers and other relevant devices.
§6 USER ONLINE BEHAVIOR.
6.1 The Developer does not check the content posted by users on the chat within the Game and on other network chats and websites and does not take any responsibility for the content generated by users in connection with the Game. And also does not take any responsibility for refusing to delete such content by website administrator.
6.2. You take full responsibility for the manner in which you use the Game, as well as for all communication and activity related to the Game, including the content you share.
6.3 The Developer retains the right to suspend access to the Game without notice if you violates the provisions of this Agreement.
§7 LIMITED WARRANTY
The game may contain errors and imperfections, The Developer does not give any warranties or guarantees, you fully accept that you use the Game only on your own responsibility. The game is delivered in the form "As it is". You accept that other statements or claims of any kind, in this regards, are not binding for The Developer.
§8 LIMITATIONS OF COMPENSATION
You agree that the amount of financial liability of The Developer in any disputes will never exceed the actual price paid for the license to use the Game and only in case where the Game was bought legally in one of the shop listed on the website: http://www.fastdust.com.
§9 LIMITATION OF LIABILITY
9.1 You release, The Developer and its licensors, employees, managers and directors from any liability related to any claims, damages, losses and expenses, legal expenses, resulting directly or indirectly from your actions or omissions during the use of the Game in connection to the terms of this Agreement.
9.2 You agree that The Developer will not be liable for any kind of damage, resulting from the possession, use or breakdown of the Game, including damage to property, loss of profits, loss of reputation, failure of a computer or other device, lost or damaged files, and other data lost as a result of possession of the Game, improper work, damage to the computer and to the fullest extent permitted by law, will be exempt from compensation for personal injuries.
9.3 You are obliged not to expose, through your own actions, The Developer to any costs resulting from random events and other situations which could not be foreseen in this Agreement and to cover all damages in the event of breaking any of the provisions of this Agreement.
§10 COMPENSATION
The Developer will have the right to take actions leading to compensation in relation to the violation of this Agreement, in addition to other means, The Developer is entitled to undertake in accordance with applicable law.
§11 APPLICABLE LAW
YOU AGREE THAT THIS AGREEMENT IS SUBJECT TO POLISH LAW. POLISH COURT, APPROPRIATE FOR THE DEVELOPER HEADQUARTERS WILL HAVE EXCLUSIVE JURISDICTION OVER DISPUTES ARISING FROM THIS AGREEMENT.
