EXFIL END USER LICENSE AGREEMENT

PLEASE READ THIS END USER LICENSE AGREEMENT ("EULA") CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR USING EXFIL ("THE GAME"). BY DOWNLOADING, INSTALLING, OR USING THE GAME, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS EULA. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT DOWNLOAD, INSTALL, OR USE THE GAME.

This EULA is a legal agreement between you ("User" or "You") and Misultin Studios Srl. ("Misultin", "We", or "Us") regarding the Game, including any updates, patches, downloadable content, or related services.

Subject to your compliance with the terms of this EULA, Misultin Studios Srl. grants you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the Game on your personal computer or compatible device for your personal, non-commercial entertainment purposes.

This Game is licensed, not sold, to you for use only under the terms and conditions of this EULA. All rights not expressly granted herein are reserved by Misultin Studios Srl.

In order to provide you with the full EXFIL experience, we need to collect and store certain data related to your gameplay. This data is essential for the purposes outlined below and will never be shared with third parties or used for any purpose other than providing you with the Game's services.

Data We Might Collect:

• Your SteamID and profile name.
  
• Your in-game match history and the content of those matches.
  
• Information about the in-game content available to you (such as skins, characters, and items).
  
• Details of any in-game transactions you have made.
  
• Basic information about the hardware you use to play the Game.
  
• Information about achievements you have unlocked.
  
• Communications using in-game channels and any messages you submit through in-game reporting tools.

How We Use This Data:

• To provide a persistent player profile where you can unlock content and track progression milestones.
  
• To allow you and other players to access match histories, watch live or recorded games, and view leaderboards.
  
• To offer customer service and technical support.
  
• To create aggregate data for maintenance, balance improvements, and overall enhancement of the Game experience.
  
• To permanently ban users from joining hosted games.
  
• To assign administrative privileges to players in hosted games.

You agree to use the Game in compliance with all applicable laws and not for any unlawful purposes. You shall not:

• Copy, distribute, sell, resell, transfer, or sublicense the Game, in whole or in part, except as expressly permitted by this EULA.
  
• Make additional copies of the Game to allow others to use it, except through authorized family sharing features.
  
• Modify, reverse engineer, decompile, or disassemble the Game without express permission from Misultin Studios Srl.
  
• Create any derivative works or content based on the Game without express permission.
  
• Use the Game in connection with any material that is offensive, including but not limited to pornographic, racist, vulgar, obscene, defamatory, libelous, abusive, or discriminatory content.
  
• Use, develop, distribute, or sell cheats, bots, hacks, or any unauthorized third-party software designed to modify or interfere with the Game.
  
• Exploit the Game or any of its parts for commercial purposes without express written consent from Misultin Studios Srl.
  
• Use the Game to harass, abuse, or harm another person or group.
  
• Engage in any activity that disrupts or interferes with the Game's servers or networks.
  
• Attempt to gain unauthorized access to the Game, accounts registered to others, or the computer systems or networks connected to the Game.

You are permitted to share the Game only through authorized family sharing features provided by the platform (e.g., Steam Family Library Sharing). Any other methods of sharing the Game are prohibited.

Users who access the Game via family sharing ("Shared Users") are also bound by this EULA. The primary user ("Sharer") acknowledges that any violations or penalties applied to a Shared User may also affect the Sharer and all other Shared Users sharing the license.

The Game may allow you to create and share User-Generated Content such as gameplay videos, streams, and other media ("UGC"). By creating or sharing UGC, you agree that:

• You may publicly display UGC through social media channels, whether monetized or not.
  
• You grant Misultin Studios Srl. a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, distribute, transmit, and publicly display your UGC.
  
• Your UGC will not contain material that is illegal, offensive, or infringes on the rights of any third party.
  
• You will not sell, rent, license, distribute, or exploit your UGC for commercial gain without express permission from Misultin Studios Srl.
  
• You acknowledge that all rights, title, and interest in any elements of your UGC that are based on or derived from the Game are owned by Misultin Studios Srl.

You acknowledge that Misultin Studios Srl. may collect, store, and access personal data related to your use of the Game, as detailed in the Data Collection Policy paragraph. We are committed to protecting your privacy and will comply with all applicable data protection laws.

You have the right to request access to your data, correct any inaccuracies, or request deletion of your data by contacting us at info@misultin.com.

To maintain a fair gaming environment, we may implement anti-cheat measures that detect and prevent cheating and unauthorized modifications of the Game. These measures may include monitoring gameplay and scanning for unauthorized third-party programs during your use of the Game. By using the Game, you consent to the deployment of such anti-cheat measures.

We may release updates, patches, or modifications to enhance the Game, fix bugs, or add new features. These updates may be automatically applied without prior notice. While we strive to provide support for the Game, we are under no obligation to provide specific support services.

The Game may require the use of third-party platforms or services (e.g., Steam). Your use of these services is subject to their respective terms and conditions. Misultin Studios Srl. is not responsible for the actions or policies of third-party service providers.


Disclaimer of Warranty:
THE GAME AND ALL RELATED SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. MISULTIN STUDIOS SRL. EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MISULTIN STUDIOS SRL. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE GAME.
NOTHING IN THIS EULA LIMITS OUR LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM OUR NEGLIGENCE OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY LAW.

This EULA is effective until terminated. You may terminate it at any time by uninstalling and ceasing all use of the Game and destroying any copies in your possession.

We may terminate this EULA immediately if you fail to comply with its terms. Upon termination, you must cease all use of the Game and destroy all copies. We reserve the right to terminate this EULA and your access to the Game at any time for any reason.

In the event of termination, you will not be entitled to any refunds or compensation, and you will lose access to any in-game content or virtual goods.

This Agreement shall be governed by and construed in accordance with the laws of Italy, excluding its conflict of law principles and the United Nations Convention on Contracts for the International Sale of Goods.

We may update or modify this EULA from time to time. Any changes will be effective immediately upon posting the revised EULA within the Game or on our website www.misultin.com. Your continued use of the Game after such changes constitutes your acceptance of the new terms.

You agree not to engage in any behavior that Misultin Studios Srl., at its sole discretion, deems to be inappropriate or offensive, including but not limited to:

• Harassment, abuse, or threats toward other players.
  
• Using offensive or discriminatory language or content.
  
• Sharing illegal or infringing content.
  
• Cheating, exploiting, or engaging in any activity that gives an unfair advantage.
  
• Displaying an in-game name or using in-game communication channels in a manner that is pornographic, racist, vulgar, obscene, defamatory, libelous, abusive, or promoting hatred or discrimination.

Violations may result in temporary or permanent restrictions on your access to certain or all features of the Game.

• Entire Agreement: This EULA constitutes the entire agreement between you and Misultin Studios Srl. regarding the Game and supersedes all prior agreements.
  
• Severability: If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  
• Assignment: We may assign this EULA at any time. You may not assign your rights or obligations under this EULA without our prior written consent.
  
• No Waiver: Our failure to enforce any provision of this EULA shall not be deemed a waiver of future enforcement of that or any other provision.
  
• No Third-Party Beneficiaries: This EULA does not confer any rights on any third party.

By downloading, installing, or using EXFIL, you acknowledge that you have read, understood, and agree to be bound by this EULA.
