The software within this agreement includes the meaning of all files which are developed by installing the SPRG Studio and its related data. The SapphireSoft may grant the non-exclusive right to use for the software if the user agreed with the whole contents of this agreement.
Article 1 License agreement of the right of use
1. If the user agrees to comply with this agreement, the SapphireSoft will grant non-exclusive right of use of the software to the user.
Article 2 Author's copyright etc.
1. The author's copyright, trademark and patent and any other intellectual property rights related to the software belong to SapphireSoft exclusively.
2. The user can create project files (.srpgs file) and data files (.dts file) by using this software. The user can release, rent, and/or sell these folders including the project files (.srpgs file) and the data files (.dts file) as a game which the user created.
3. The user can include files inside the Script folder of this product, runtime files (runtime.rts) and game files (game.exe), only to release, rent and/or sell the games which are created by the user. However, the right of these files complies with No.1 of Article 2 in this agreement.
Article 3 Prohibited matter
The user cannot behave in the following ways:
1. Obtaining this software illegally and installing it.
2. Duplicating the software.
3. Releasing, lending and selling the software.
4. Re-creating the software (such as reverse engineering, decompiling and disassembling etc.).
5. Developing illegal games by using the software.
Article 4 Disclaimer
1. The software may not guarantee that there are no defects etc. regarding executed contents. For any consequential damage, any incidental damage or any lost profits which are caused by using the software, SapphireSoft does not bear any responsibility.
Article 5 Support
1. SapphireSoft provides the user with our support service for the software by email or website (for responding to inquiries etc.)
2. SapphireSoft decides whether to provide its software support service and if SapphireSoft will respond to the inquiry or not, as well as the period of responding.
3. SapphireSoft can decide if SapphireSoft ends the support service for the software.
Article 6 Termination of the agreement
1. This agreement will be terminated at the time the user uninstalls the software.
2. If the user violates any of articles mentioned in this agreement, SapphireSoft can cancel this agreement unilaterally. If the damage occurred to SapphireSoft caused by the user's violation of this agreement, the user shall pay compensation of the loss to SapphireSoft.
3. If this agreement is terminated or canceled, the user is deemed to renounce the software as well as the game which was created by using the software.
Article 7 General Information
1. SapphireSoft can change the specifications of the software without obtaining permission from the user or without notifying the user.
2. The software has the purpose of creating original games, not to assist to create alternative fictions.
3. The software is used Ogg Vorbis.
4. This agreement complies with the laws of Japan. The resolution of the dispute takes place in the Japanese court.
