End-User License Agreement for Monolith Graphics Software
IMPORTANT-READ CAREFULLY:
This End-User License Agreement ("EULA") is a legal agreement between you and Monolith Graphics for the software accompanying this EULA, which includes computer software and may include associated media, printed materials, and online or electronic documentation ("SOFTWARE"). By exercising your rights to use the SOFTWARE, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE.
SOFTWARE LICENSE: The SOFTWARE is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE is licensed, not sold.
GRANT OF LICENSE: This EULA grants you the following revocable, non-exclusive, non-transferable, limited rights: You may install and use a single copy of the SOFTWARE for use on a single computer. Optionally you may store or install the SOFTWARE on a storage device, such as a network server, for the purpose of making a backup; however the same license may not be shared or used concurrently on different computers or servers. Sufficient licenses must be acquired for each copy of the SOFTWARE in use. You may not reproduce or distribute the SOFTWARE. File-sharing is forbidden. You may not reverse engineer, decompile, or disassemble the SOFTWARE.
TERMINATION: Without prejudice to any other rights, Monolith Graphics may terminate this EULA if you fail to comply with its terms and conditions. In such event, you must destroy all copies of the SOFTWARE and all component parts, and you may be held liable for damages that arise through improper use.
COPYRIGHT: All title and copyrights in and to the packaging and SOFTWARE (including but not limited to any images, text, and code incorporated into SOFTWARE), the accompanying printed materials, and any copies of the SOFTWARE are owned by Monolith Graphics. The SOFTWARE is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE like any other copyrighted material.
DISCLAIMER OF WARRANTIES: Monolith Graphics expressly disclaims any warranty for the SOFTWARE. The SOFTWARE and any related documentation are provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, and non-infringement. The entire risk arising out of use or performance of the SOFTWARE remains with you.
LIMITATION OF LIABILITY: In no event shall Monolith Graphics or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the SOFTWARE, even if Monolith Graphics has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
JURISDICTION: If you acquired the SOFTWARE in the United States, this EULA is governed by the laws of the State of Ohio. If you acquired the SOFTWARE outside the United States, then local laws may apply.
