END USERS LICENCE AGREEMENT
Please read the following terms and conditions carefully before using this Game Software. Your use, distribution or installation of this copy of Worbital indicates your acceptance of this License.
Game Software here means Software, image files, all accompanying files, data and materials received. Worbital is a Video Game. It includes graphics, game rules, text, animation, characters, virtual items, locations, sounds, music and other elements, commonly found in games.
If you do not agree to any of the terms of this License, then do not install or use the Game Software Worbital.
The warranty covers defects in the software, which prevents successfully installing the software in the buyer's PC or Console. Warrantee does not cover fitness of purpose, not meeting of expectations or needs in the mind of the buyer.
This Game Software is for personal use (linked to your Steam Account) only and may be installed and used on only one device per license owned at a time. Its component parts may not be separated for use on more than one computer / console. All components accompanying the software are copyrighted by TJR Games Oy and may not be taken apart, modified, used or published with other software or means except with the Game Software and may not be distributed or copied in any manner.
This Game Software, all accompanying files, data and materials, are distributed "AS IS" and with no warranties of any kind, whether express or implied. The user must assume all risk of using the program. This disclaimer of warranty constitutes an essential part of the agreement.
Any liability of TJR Games Oy will be limited exclusively to refund of purchase price. In addition, in no event shall TJR Games Oy, or its principals, shareholders, officers, employees, affiliates, contractors, subsidiaries, or parent organizations, be liable for any incidental, consequential, punitive or any other damages whatsoever relating to the use of Worbital.
In addition, in no event does TJR Games Oy authorize you to use this Game Software in applications or systems where Worbital's failure to perform can reasonably be expected to result in a physical injury, or in loss of life. Any such use by you is entirely at your own risk, and you agree to hold TJR Games Oy harmless from any claims or losses relating to such unauthorized use.
This Agreement constitutes the entire statement of the Agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings, purchase orders, agreements and arrangements. This Agreement shall be governed by the laws of Finland.
TJR Games Oy is the owner of the copyright of this Game Software, all of its derivatives, title and accompanying materials are the exclusive property of TJR Games Oy. All rights of any kind, which are not expressly granted in this License, are entirely and exclusively reserved to and by TJR Games Oy. You may not rent, lease, transfer, modify, translate, reverse engineer, decompile, disassemble or create derivative works based on this Game Software. You may not make access to Worbital available to others in connection with a service bureau, application service provider, or similar business, or use this Game Software in a business to provide file compression, decompression, or conversion services to others. There are no third party beneficiaries of any promises, obligations or representations made by TJR Games Oy herein.
You may not disclose to other persons the data or techniques relating to this Game Software that you know or should know that it is a trade secret of TJR Games Oy in any manner that will cause damage to TJR Games Oy.
This Game Software and all services provided may be used for lawful purposes only.
Transmission, storage, or presentation of any information, data or material in violation of any Finnish, State or City law is strictly prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. You agree to indemnify and hold TJR Games Oy harmless from any claims resulting from the use of this Game Software, which may damage any other party.
Social Media and Streaming License. You may publicly display the Game on online video streaming websites, such as YouTube, Facebook and Twitch, and social media, such as tweeting a GIF or posting a screenshot on Facebook, on a commercial or noncommercial basis. You cannot display the game through any other medium, such as television, among others, without first obtaining TJR Games Oy’s written consent. TJR Games Oy may terminate or modify the social media and streaming license granted to you at any time without giving a reason and without compensation and will not be liable to you for any loss you incur as a result of termination, such as lost profits.
Privacy Policy & GDPR
We use Unity Analytics, Unity Cloud Diagnostics and Game Sparks to collect some non-identifiable user data for analytics and error reporting purposes. We do not use the data for any other purpose or share or distribute it with any other parties. Unity Analytics and Unity Cloud Diagnostics allow opting out and viewing collected data through in-game link. Software Updates
TJR Games Oy may update or otherwise modify Worbital electronically at TJR Games Oy’s discretion, or require the user to install patches, updates or fixes to Worbital (“Updates”). Updates may change the Game Software’s terms, conditions, features, items, mechanics, or any other element of Worbital. The user is required to install such Updates before the user will be able to proceed to play Worbital. If the user fails to install the new release, TJR Games Oy will not be responsible in any way for the user’s inability to play Worbital, and the user shall not be entitled to receive a refund of any prepaid fees or any other form of compensation.
Online Behavior
When using Worbital, your behavior towards fellow players must comply with all laws, regulations and rules of the jurisdiction in which you reside.
Account Names
The player may not use a name that falsely refers to a connection with TJR Games Oy, contains personal information, is offensive, defamatory, vulgar, obscene, sexual, racist, or reprehensible in an ethnic or otherwise manner. You may not use spelling or alternative spelling to circumvent this restriction. TJR Games Oy may change any name that violates this provision without notifying you, and may take further disciplinary action in the event of repeated violations, including termination of the account.
