This End-User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and [Your Company Name] ("Developer," "we," "us," or "our") for the software application known as Synthasia (the "Game").

By installing, using, or otherwise accessing the Game, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Game.


We grant you a limited, non-exclusive, non-transferable, revocable license to use the Game for your personal, non-commercial entertainment purposes, subject to the terms of this Agreement.


a. Game Ownership: We retain all right, title, and interest in and to the Game, including all underlying code, assets, and intellectual property.

b. Ownership of Generated Content: The Game allows you to generate unique content, including but not limited to text, narratives, character interactions, and images ("Generated Content"). We acknowledge that you own the copyright to the unique, original expression in the Generated Content that you create during your gameplay sessions.

c. License Grant to Developer: In consideration for your use of the Game, you hereby grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your Generated Content for any purpose whatsoever, including for commercial purposes, without any compensation to you.


You agree not to use the Game to create, upload, or share any content that:

• Is illegal, fraudulent, or promotes illegal activities.
  
• Is hateful, harassing, abusive, defamatory, obscene, or threatening to others.
  
• Contains sexually explicit material.
  
• Infringes upon the intellectual property rights (including copyrights, trademarks, or patents) of any third party.
  
• Attempts to mimic or impersonate real individuals without their consent.

You are solely responsible for your conduct and any Generated Content you create.


We reserve the right, at our sole discretion, to review, moderate, and remove any Generated Content or User-Created Worlds (as defined below). We may suspend or terminate your access to the Game for any violation of this Agreement without prior notice.


a. AI Content Disclaimer: The Game utilizes generative artificial intelligence, which may produce unexpected, inaccurate, or offensive content. The Generated Content does not represent our views. We make no warranties regarding the quality, accuracy, safety, or appropriateness of the Generated Content.

b. AS-IS Basis: The Game is provided "AS IS" without any warranties of any kind, express or implied. We do not warrant that the Game will be error-free or uninterrupted.

c. Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall we be liable for any direct, indirect, incidental, or consequential damages arising out of the use or inability to use the Game.


The Game relies on third-party AI services to function. Your use of the Game constitutes your acknowledgment that your prompts and other data may be processed by these services. You agree that your use of the Game is also subject to the terms and privacy policies of these providers. (e.g., OpenAI, Pollinations.ai, etc.)


The Game includes an editor that allows you to create your own worlds ("User-Created Worlds"). If you choose to share your User-Created Worlds on Steam Workshop or any other platform:

• You grant every user of that platform a license to download, play, and use your User-Created World.
  
• You grant us a license to host, display, and manage your User-Created World on the platform.
  
• You represent and warrant that your User-Created World complies with all terms in this Agreement, especially the User Conduct and Content Restrictions.

Your use of the Game is also governed by our Privacy Policy, which can be found at www.frozenpepper.it. By agreeing to this EULA, you also agree to the terms of the Privacy Policy.


This Agreement is effective until terminated. You may terminate it at any time by uninstalling the Game. We may terminate this Agreement immediately and without notice if you fail to comply with any of its terms.


This Agreement constitutes the entire agreement between you and us concerning the Game. If any provision is held to be unenforceable, the remaining provisions will remain in full force and effect. This Agreement shall be governed by the laws of Italy.
