End-User License Agreement ("Agreement")

PLEASE READ THE FOLLOWING END USER LICENSE AGREEMENT (“AGREEMENT”) BEFORE INSTALLING WARFALLEN. BY INSTALLING, COPYING, AND/OR OTHERWISE USING THE GAME SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT AS SET FORTH BY FROSTY ELK AB, ORG.NR. 556959-7601, KAROLINERSTIGEN 9, 141 43 HUDDINGE, SWEDEN AND ITS AFFILIATED COMPANIES (COLLECTIVELY, “FROSTY ELK AB”).
License
Frosty Elk AB grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use WarFallen solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.

Technical Protection
WarFallen may include measures to control access to WarFallen, control access to certain features or content, prevent unauthorized copies, or otherwise attempt to prevent anyone from exceeding the limited rights and licenses granted under this EULA. Only licensed installations of WarFallen can be used to access online services, including downloading updates and patches. You may not interfere with such access control measures or attempt to disable or circumvent such security features. If you disable or otherwise tamper with the technical protection measures, WarFallen may not function properly.
Your license will immediately terminate should you attempt to circumvent any DRM protection for WarFallen.
Reservation Of Rights
Frosty Elk AB reserves all right, title and interest in WarFallen, including but not limited to all copyrights, trademarks, trade names, patents, titles, characters, character names, stories, story lines, locations, location names, artwork and graphics, audio, animations, text assets and any other intellectual property therein.
User Created Content
WarFallen may allow you to create content, including but not limited to gameplay maps. In exchange for your use of WarFallen, and to the extent that your contributions through use of WarFallen give rise to any copyright interest, you hereby grant Frosty Elk AB an exclusive, perpetual, irrevocable, fully transferable and sub-licensable worldwide right and license to use your contributions in any way and for any purpose in connection with WarFallen, including the rights to reproduce, copy, adapt, modify, perform, display, publish, broadcast, transmit, or otherwise communicate to the public by any means whether now known or unknown and distribute your contributions without any further notice or compensation to you of any kind for the whole duration of protection granted to intellectual property rights by applicable laws and international conventions. You hereby waive any moral rights of paternity, publication, reputation, or attribution with respect to Frosty Elk AB's and other players' use and enjoyment of such assets in connection with WarFallen under applicable law. This license grant to Frosty Elk AB, and the above waiver or any applicable moral rights, survives any termination of this EULA.
Modifications to WarFallen
Frosty Elk AB reserves the right to modify, suspend or discontinue, temporarily or permanently, WarFallen or any service to which it connects, with or without notice and without liability to you.
Term and Termination
This Agreement shall remain in effect until terminated by you or Frosty Elk AB.
Frosty Elk AB may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.
This Agreement will terminate immediately, without prior notice from Frosty Elk AB, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the WarFallen and all copies thereof from your mobile device or from your desktop.
Upon termination of this Agreement, you shall cease all use of the WarFallen and delete all copies of the WarFallen from your mobile device or from your desktop.
Severability
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Internet Connection
WarFallen may require an internet connection to access internet-based features, including but not limited to uploading and downloading user generated content. Without an internet connection, such features may cease to work properly.
Seizure Warning
In rare instances, some users may experience seizures when exposed to certain light patterns or flashing lights. Exposure to certain light patterns or backgrounds on a video monitor may induce an epileptic seizure, even in persons who have no history of prior seizures or epilepsy.
Amendments to this Agreement
Frosty Elk AB reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material we will provide at least 30 (changes this) days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Restrictions
You agree to, and you will not permit others to:
- A. You agree not to distribute, sell, lease, rent, loan or otherwise transfer or assign WarFallen, or any copies of WarFallen.
- B. You agree not to copy, reproduce, decompile, disassemble, derive source code from or reverse engineer, in whole or in part, WarFallen, or to prepare derivative works based on WarFallen without the express prior permission of Frosty Elk AB.
- C. You agree not to modify or cause to be modified any files that are part of WarFallen in any way not expressly authorized by Frosty Elk AB.
- D. You agree not to make a copy of WarFallen on a network that is accessible by users other than yourself, including but not limited to public file sharing networks.
- E. You agree not to remove or alter any trademark, logo, copyright or other proprietary notices, legends, symbols, or labels in WarFallen.
- F. You agree not to transport, export or re-export into any country that may result in a violation of local import/export laws or regulations.
- G. You agree that Frosty Elk AB does not warrant the performance of WarFallen on your specific Personal Computer.
- H. You agree that Frosty Elk AB does not warrant that WarFallen will run permanently or uninterrupted on your Personal Computer.
- I. You agree that Frosty Elk AB does not warrant against interference with your enjoyment of WarFallen; that WarFallen will be uninterrupted, virus-free or error-free, or that WarFallen will be compatible with third party software or that any errors in WarFallen will be corrected.
- J. You agree that Frosty Elk AB is not liable for delays or difficulties that are due to circumstances beyond its control.
- K. You acknowledge and agree that your exclusive remedy for any dispute with Frosty Elk AB is to stop using WarFallen.
- L. No oral or written advice by Frosty Elk AB or authorized representative shall create a warranty.
- M. At some point in the future WarFallen may go out of date, and Frosty Elk AB makes no commitment to update WarFallen.
