1. End User License Agreement
THIS “YC GAMES END USER LICENSE AGREEMENT” (HEREINAFTER REFERRED TO AS THE “EULA”) IS A LEGAL AGREEMENT BETWEEN YOU AND YC GAMES SERVICE PROVIDER. THIS AGREEMENT SHALL HAVE LEGALLY BINDING FORCE. YOU AGREE THAT THIS EULA IS ENFORCEABLE LIKE ANY WRITTEN CONTRACT SIGNED BY YOU.
PLEASE READ THIS FOLLOWING LICENSE AGREEMENT (“EULA”) CAREFULLY. YOUR ACCEPTANCE OF THESE CLAUSES MAY CAUSE DIFFICULTIES OR LOSSES TO YOU WHEN YOUR ACCEPT THIS AGREEMENT OR USE OUR GAME SERVICES, SO PLEASE MAKE SURE TO DOUBLE CHECK THE TERMS BEFORE YOU ACCEPT THE AGREEMENT OR USE THE GAME SERVICE. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS EULA, DO NOT INSTALL OR USE THE GAME. YC GAMES IS ENTITLED TO AMEND THE TERMS OF THIS EULA WHEN YC GAMES DEEMS NECESSARY, AND THE UP-TO-DATE VERSION IS AVAILABLE ON RELEVANT WEBSITE. BY CONTINUING TO USE OUR GAME SERVICES AFTER THE AMENDMENT OF THE TERMS OF THIS EULA, YOU WILL BE DEEMED TO HAVE ACCEPTED THE AMENDED EULA.

2. Eligibility and Registration
The Services we offer have certain age restrictions and may require an outside account. When you give us information, you need to make sure it stays up-to-date. Also, do not share your account with others without our permission.
[1] Age.
You must be at least 18 years old or such other minimum age as is applicable in the jurisdiction you live in to create a Game Account or use our Services [as defined below]. If you are at least the relevant minimum age but are not legally considered as an adult in your jurisdiction, you must ask one of your parents or legal guardians to read this EULA and accept it on your behalf. Parents and guardians are responsible for the acts of their minor children when using a Game Account they created, or any of our Services. They need to be responsible for your use of the Game Account and our Services at all time.
You are not entitled to create or use a Game Account, or use any of our Services on behalf of a legal entity or for a commercial purpose.
[2] Account Creation.
To access parts of a Game, you may need to create an in-game account (your "Game Account "). Your Game Account, if applicable, is separate from any account you may have with any App Store (your "App Store Account"). You are able to create your Game Account using an existing account you have or your email address. To the extent you create your Game Account through the use of a third party account [for example, your account of Facebook or Google], we may access certain personal information that the third party provides to us such as your email address and name to help create your Game Account. Further information about use of third party accounts is provided in the Privacy Policy at.
3. Limited Use License
We hereby grants to you a limited, personal, nonexclusive, nontransferable, non-assignable and fully revocable license to use the Game and any Content for your individual, non-commercial, entertainment purposes. You will be responsible to your own expenses when using the game software. If you in breach of any YC Games Terms, the following license will be automatically revoked and no compensation will be paid by YC Games.
(1) Any unauthorized copy, adapt, modify, translate, publish, publicly perform, publicly display and distribute in whole or in part of the Software and its Specification, reverse engineer, or other attempt to extract the source code of the Software in whole or in part is illegal and will be treated as a serious breach of this EULA. We reserve the rights to pursue its legal liability.
(2) Our company only generally license user to use the Software on his/her own computer in specific platform. User shall not copy to others computers. If user himself/herself has other computer, it can be an exception for single computer using.
(3) Service Limits Based on Where You Live.
We may restrict, modify, or limit you access to and use of certain Content, Virtual Goods, an entire Game. All of the Services depend on the territory in which you are located.
4. Refunds
Subject to applicable law is: all Games, Virtual Goods and/or Game Currency, have no monetary value and are not redeemable, refundable, or eligible for any other alternate remedy for any "real world" money or anything with monetary value, unless they are defective, unavailable, or do not perform in accordance with the specifications we provide; [ii] we may revoke your license of Games, Virtual Goods or Game Currency at any time consisting with this EULA without notice or liability; or [iii] by purchasing and using any Games, Virtual Goods or Game Currency, you hereby waive any statutory right to purchase the applicable Game, Virtual or Game Currency and you agree that you will therefore not be eligible to receive a refund (or any alternative remedy) in relation to such Game, Virtual Good or Game Currency.
If applicable law does not allow you to waive such withdrawal rights, you hereby agree that upon purchase and delivery of your Game, Virtual Good or Game Currency, such withdrawal rights will terminate immediately as permitted by applicable law
5. Beta Testing
From time to time we may offer a beta version of one of our Services [a "Beta"]. Betas are not guaranteed to work properly, and may make other parts of your system not work properly as well. You acknowledge and agree to the following terms in addition to the rest of this EULA:
[a] We may automatically delete or modify the information stored on your computer related to the Beta for any reason at any time during the duration of the Beta test;
We may terminate the Beta test at any time, which would then render your Beta unplayable or unable to function properly. When we terminate a Beta, you must delete the local Beta instance on your computer and all documents and materials you received from us in connection with the Beta;
[c] Termination of a Beta by us is not a grounds for any kind of refund and your participation in a Beta does not entitle you to any compensation or any free Services, including any Content and Game Currency;
[d] When we release a full (non-Beta) version of the particular Game, we may allow you to continue using the full version of the Game. If it is allowed by us, your continued use of the Game will no longer be subject to this Section 11, but will still be subject to the rest of this EULA.
6. Suggestions and feedback
We hope to hear from you, no matter good or bad. It can help us improve! However, if you give us feedback, we need to be free to use it without paying.
We welcome your feedback, comments and suggestions on improving the service ("Feedback"). You can submit feedback to us by sending an email to [bos@ycgame.com].
7. DMCA/Copyright Policy
We respect copyright law and hope that our users can do the same. It is our policy to terminate game accounts of users who repeatedly infringe or are deemed to have repeatedly violated the rights of copyright holders, where appropriate.
8. Warranty Disclaimers
We don't make any guarantees about the Services.
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, THE YC GAMES PARTIES EXPLICITLY DISCLAIM ANY IMPLED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
The YC games parties make no warranty that the services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. The YC games parties make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness or reliability of the services.
9. Limitation of Liability
This section limits what you can recover from us in a dispute.
YC Games parties do not accept any responsibility to the fullest extent permitted by applicable law:
[a] LOSS OF PROFITS,
LOST REVENUE,
[c] LOST SAVINGS,
[d] LOSS OF DATA,
[e]ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THIS EULA OR THE SERVICES, OR THE DELAY OR INABILITY TO USE OR LACK OF FUNCTIONALITY OF THE SERVICES, EVEN IN THE EVENT OF ONE OF A YC GAMES PARTY'S FAULT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, INDEMNITY, PRODUCT LIABILITY, BREACH OF CONTRACT, BREACH OF WARRANTY, OR OTHERWISE AND EVEN IF THAT YC GAMES PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES TO THE MAXIMUM EXTENT.
Notwithstanding the foregoing, certain countries, states, provinces or other jurisdictions do not allow the exclusion of certain warranties or limitations of liability above, so the above may not apply to you.
10. Indemnity
If someone sues us based on your breach of this EULA or your access/use of the Services, you agree to defend us or pay for our defense in that lawsuit.
You agree to indemnify, pay the defense costs, and hold the YC Games Parties and their employees, officers, directors, agents, contractors, and other representatives harmless from all claims, demands, actions, losses, liabilities, costs and expenses (including, without limitation, attorneys' fees, costs, and expert witnesses' fees) that arise out of or in any way connected with: [a] your access to or use of the Services; any claim (if true) would constitute a breach by you of the EULA. You agree to reimburse us for any payments or loss suffered by us, whether in a court judgment or settlement, based on any matter covered by this Section 20.
11. Game service and users’ code of conduct
Subject to your compliance with this EULA and relevant laws and regulations, YC Games hereby grants you a limited use license.
You fully understand and agree that under this EULA, you are granted the rights to use all the game items, game currency, game equipment which are parts of the YC Games services. Your purchase and use of the above events shall comply with the requirements of this EULA and the specific rules concerning the game.
You fully understand and agree that, you shall be responsible for all your game actions. You shall comply with the laws and regulations when use the YC Games services. Using the YC Games to engage in any illegal conduct is seriously prohibited.
A friendly game environment is expected to be set up and maintained by you. Without the prior written permission from YC Games, you are prohibited to take the following actions when using the game services:
(1) Interrupting the normal operation of YC game services in any way;
(2) Using any illegal cheating tool;
(3) Implying or falsely claiming to be internal employees of YC game;
(4) Making unauthorized transaction or sharing of game account;
(5) Making unauthorized transaction of game virtual currency, game equipment, game currency and other game item;
(6) Hacking other user’s game account, or stealing his/her game item;
(7) Spreading illegal or inappropriate information;
(8) Breaching any term of this Agreement; o
(9) Conducting any other misconduct which is widely recognized within the industry, no matter whether or not such misconduct is explicitly stipulated in this Agreement or the Game Rules.
Any violation of this agreement will lead to an account banning measure. Banning measure including but not limited to the following:
(1) Warning
(2) Suspension
(3) Termination (deletion of your account)
You acknowledge and agree that YC game is entitled to determine the methods and the duration of the ban based on the severity of you violation.
Termination
This agreement is effective from the earlier of the date you purchase, download or use the Game, until terminated according to its terms.
Termination by YC Games will be effective upon notice to you. Termination or deletion of your Account (if any), or YC Games decision to permanently discontinue offering and/or supporting the Game may be taken at any time in its sole discretion. YC Games will handle the termination of the game operation in accordance with the relevant provisions issued by the Chinese government regarding termination of online games, so as to protect the legitimate rights and interests of the users.
12. Governing Law.
This agreement shall be governed, construed, and enforced in accordance with the laws of China, without regard to its conflict of laws rules. You hereby agree that exclusive jurisdiction for any dispute or claim with YC Games or relating in any way to this agreement and any other YC Games Terms. Your use of any YC Games game Services resides in Shanghai Putuo District Court. You further agree and expressly consent to the exercise of personal jurisdiction in Shanghai Putuo District Court in connection with any dispute or claim involving YC Games or its affiliates, employees, contractors, officers, directors, vendors and content providers.
13. No Assignment
You cannot transfer or assign this EULA to anyone else.
You may not assign or transfer this EULA, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer this EULA, without such consent, will be null and void. Notwithstanding according to the title of this Section, we may freely assign or transfer this EULA without restriction. Subject to the foregoing, this EULA will bind and inure to the benefit of the parties, their successors and permitted assigns.
14. Miscellaneous
This EULA is our whole agreement (no outside promises). The official version is English. If parts of this EULA don't apply, the rest remains as much as possible. If we don't enforce part of this EULA, it doesn't mean we won't in the future or we won't enforce our other rights.
[a] Entire Agreement.
This EULA and any other document or information referred to in this EULA constitutes the entire and exclusive understanding between you and us regarding the Game and supersede any prior oral or written understandings or agreements.
Language.
The original language of this EULA is in English; any translations are provided for reference purposes only.
You waive any right you may have under the law of your country to have this EULA written or construed in any other language.
[c] Severability.
This EULA describes certain legal rights. You may have other rights under the laws of your jurisdiction. This EULA does not change your rights under the laws of your jurisdiction. As noted above, limitations and exclusions of warranties and remedies in this EULA may not apply to you because your jurisdiction may not allow them in your particular circumstance. In the event that certain provisions of this EULA are unenforceable to be held by a court or tribunal of competent jurisdiction, those provisions will only be enforced to the fullest extent permissible under applicable law and the remaining terms of this EULA will remain in full force and effect.
[d] No Waiver.
Your and our actions or inactions will not create any other rights under this EULA except as what is explicitly written within this EULA. Our failure to enforce any right or provision of this EULA will not be considered a waiver of such right or provision.
The waiver of any such right or provision will be effective only if in writing and signed by one of our duly authorized representatives. Except as expressly set forth in this EULA, the exercise by either party of any of its remedies under this EULA will be without prejudice to its other remedies under this EULA or otherwise.

13. No Assignment
You cannot transfer or assign this EULA to anyone else.
You may not assign or transfer this EULA, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer this EULA, without such consent, will be null and void. Notwithstanding according to the title of this Section, we may freely assign or transfer this EULA without restriction. Subject to the foregoing, this EULA will bind and inure to the benefit of the parties, their successors and permitted assigns.
14. Miscellaneous
This EULA is our whole agreement (no outside promises). The official version is English. If parts of this EULA don't apply, the rest remains as much as possible. If we don't enforce part of this EULA, it doesn't mean we won't in the future or we won't enforce our other rights.
[a] Entire Agreement.
This EULA and any other document or information referred to in this EULA constitutes the entire and exclusive understanding between you and us regarding the Game and supersede any prior oral or written understandings or agreements.
Language.
The original language of this EULA is in English; any translations are provided for reference purposes only.
You waive any right you may have under the law of your country to have this EULA written or construed in any other language.
[c] Severability.
This EULA describes certain legal rights. You may have other rights under the laws of your jurisdiction. This EULA does not change your rights under the laws of your jurisdiction. As noted above, limitations and exclusions of warranties and remedies in this EULA may not apply to you because your jurisdiction may not allow them in your particular circumstance. In the event that certain provisions of this EULA are unenforceable to be held by a court or tribunal of competent jurisdiction, those provisions will only be enforced to the fullest extent permissible under applicable law and the remaining terms of this EULA will remain in full force and effect.
[d] No Waiver.
Your and our actions or inactions will not create any other rights under this EULA except as what is explicitly written within this EULA. Our failure to enforce any right or provision of this EULA will not be considered a waiver of such right or provision.
The waiver of any such right or provision will be effective only if in writing and signed by one of our duly authorized representatives. Except as expressly set forth in this EULA, the exercise by either party of any of its remedies under this EULA will be without prejudice to its other remedies under this EULA or otherwise.
