DAWN OF EMBERS - END USER LICENCE AGREEMENT

This agreement is between you and DTX Studios LLC ("we", "us"), the developer and publisher of Dawn of Embers (the "Game"). By installing, launching or playing the Game you agree to it. If you do not agree, do not install or play the Game.

When you obtain the Game from us or an authorised store, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game for your own non-commercial entertainment, under this agreement and the terms of the store you obtained it from. The Game is licensed to you, not sold. Streaming and posting videos or screenshots of your play, including monetised videos and streams, is allowed and encouraged.

Except where the law expressly allows it, you may not:

• Copy, sell, rent, lend, sublicense or otherwise distribute the Game or any part of it
  
• Reverse engineer, decompile or disassemble the Game, or extract its assets for use outside the Game
  
• Use cheats, bots, automation, exploits, modified game files or third-party software that gives an unfair advantage or interferes with other players
  
• Tamper with save files, match results, ratings or any part of the ranked ladder
  
• Attack, overload or try to gain unauthorised access to our services or other players' machines
  
• Use the Game or its content to train artificial-intelligence models, or for any commercial purpose we have not approved in writing

• Online features require an Epic Games account, which is governed by Epic Games' own terms. You are responsible for activity on your account
  
• Your display name must follow our naming rules and must not impersonate anyone or contain offensive content. We may reset a name that breaks these rules
  
• Multiplayer matches are hosted by players, so the machines in a match connect directly and can see each other's network addresses
  
• Results of ranked matches, your rating and your display name appear on public leaderboards
  
• We may change, suspend or end online features, and we will give reasonable notice where we can. The Game's single-player content does not depend on our servers staying online

In chat, names and play, do not harass, threaten or abuse other players, post hateful, sexual or illegal content, share other people's personal information, spam or advertise, or deliberately ruin matches for others. You can Block and Report any player from their chat line. We may warn, restrict ranked access, reset names, or suspend or terminate the online access of accounts that break these rules or this agreement. Where it is proportionate we will tell you why, and you can reply to support@dawnofembers.com.

The Game, including its code, art, audio, music, story, characters and names, belongs to DTX Studios LLC and its licensors and is protected by copyright and other laws. Everything not expressly licensed to you in this agreement is reserved. Dawn of Embers is built with Unreal® Engine; Unreal® is a trademark or registered trademark of Epic Games, Inc. in the United States of America and elsewhere.

We may release patches and updates that add, change or remove features, rebalance gameplay, or reset ranked seasons. Some online features may require the latest version. The Game may not be compatible with every hardware or software setup.

You can end this agreement at any time by uninstalling the Game. We may end your licence or your access to online features if you seriously or repeatedly break this agreement. Sections 5, 9, 10 and 12 continue after it ends.

To the extent the law allows, the Game is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise that it will be uninterrupted or error-free. Nothing in this agreement limits rights you have under consumer law that cannot be excluded, including, if you live in the EU or the UK, your statutory rights for digital content that is faulty or not as described.

To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for loss of data, profits or goodwill, arising from the Game, and our total liability to you is limited to the amount you paid for the Game. None of this limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

If you obtained the Game through Steam, the Epic Games Store or another store, that store's terms govern your purchase, payment and refunds. Pre-orders bought on our website are covered by the terms in our FAQ at https://dawnofembers.com/faq. If this agreement conflicts with a store's mandatory terms, the store's terms apply to that conflict.

This agreement is governed by the laws of the State of Connecticut, USA, without regard to its conflict-of-law rules. If you are a consumer living in another country, you also keep the protection of the mandatory laws of that country and may bring a claim in its courts.

We may update this agreement, for example when online features change; the date at the top will change and material changes will be announced in the Game or on our website before they take effect.
