Kazehita Art LLC is the publisher of this title. When you download the title you receive a license to use the software. This license is subject to the terms of this EULA, which is an agreement between you and Kazehita Art LLC.
BY INSTALLING HEARTFALL - a Tale in Three Lives YOU ARE ACKNOWLEDGING THAT YOU HAVE READ THIS EULA, AGREE TO ITS TERMS AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, PROMPTLY DELETE THE SOFTWARE FILES FROM YOUR DEVICE AND CEASE ANY AND ALL USE OF THIS SOFTWARE.
1. Limited Use License
Heartfall - a Tale in Three Lives (henceforth called “HEARTFALL”) is the software and any files that are provided with it contains copyrighted material of Kazehita Art LLC & its licensors, licensees or suppliers. Your continuing license to use HEARTFALL is conditioned on your compliance with this EULA. If you violate any of the terms of this EULA, all of your right to use HEARTFALL will immediately end, with or without any further notification.
2. Permitted User Modifications and New Creations
You are permitted to make modifications to HEARTFALL or develop spin-off software of HEARTFALL so long as the following conditions are met:
Your creations must be distributed for free.
Your creations must not contain any sexually explicit, obscene, threatening, defamatory, hateful, racially or ethnically offensive imagery or libelous, material that discriminates on the basis of race, color, religion, sex (including transgender status, sexual orientation, and pregnancy), national origin, age (40 or older), disability or genetic information of any first or third party, or other illegal material, material that is scandalous or invades the rights of privacy or publicity of any third party.
Your creations must not contain any trademarks, copyrighted work, or other recognizable property of third parties without their written authority.
Your creations must not be used by you, or anyone else, for any commercial exploitation including, but not limited to in-game advertising, other advertising or marketing for any company, product or service.
Creations will not be supported by Kazehita Art LLC. Your creations must include a statement to that effect.
Your creations will also be subject to this EULA.
3. Commercial Exploitation.
You may not use HEARTFALL, or any mods/spin-offs created for or from HEARTFALL for any commercial purposes without the prior written consent of Kazehita Art LLC, or if it falls under our permitted uses.
Permitted uses include:
1. Streaming the game to an audience and receiving donations from said audience, as long as it is transformative in nature.
2. Recoding your playthrough of the game and collecting ad revenue/donations by an audience who is viewing the recording, as long as it is transformative in nature.
4. Restrictions on Use
You may not rent, sell, lease, barter, sublicense or distribute HEARTFALL. You may not delete the copyright notices or any other proprietary information.
You may not use HEARTFALL or any of its documents, contents, or related content for AI training UNDER ANY CIRCUMSTANCES.
7. Copyright.
Heartfall and all copyrights, trademarks and all other conceivable intellectual property rights related to the Heartfall are owned by Kazehita Art LLC or its licensors, licensees or suppliers and are protected by United States copyrights laws, international treaty provisions, and all applicable laws, such as the Lanham Act. Heartfall must be treated like any other copyrighted material, as required by 17 U.S.C. #101 et seq. and other applicable law.
Kazehita ART LLC and its licensors, licensees or suppliers do not claim intellectual property rights related to or as a part of other creator’s concepts, personas, identities, and brands that are referenced within Heartfall, nor does it claim the exclusive rights to do so.
9. Disclaimer of Warranty
You are aware and agree that use of HEARFALL and the media on which it is recorded, if any, is at your sole risk. HEARTFALL is provided “AS IS.” KAZEHITA ART LLC. EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US OR ANY OF OUR AUTHORIZED REPRESENTATIVES CREATES A WARRANTY OR IN INCREASES THE SCOPE OF THIS WARRANTY. NO AGENT, DISTRIBUTOR OR OTHER SUPPLIER OF HEARTFALL HAS THE AUTHORITY TO MODIFY OR AMEND THIS WARRANTY WITHOUT EXPRESS WRITTEN AUTHORIZATION FROM KAZEHITA ART LLC.
10. Limitation of Liability
UNDER NO CIRCUMSTANCES, INCLUDING WILLFUL ACTS OR NEGLIGENCE, SHALL KAZEHITA ART LLC. OR ANY OF ITS OFFICERS, EMPLOYEES, DIRECTORS, AGENTS, LICENSORS, LICENSEES, SUBLICENSEE, SUPPLIERS OR ASSIGNS BE LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF THE SOFTWARE OR RELATED DOCUMENTATION. THERE WILL BE NO LIABILITY FOR ANY PERSONAL INJURY, OR FOR INTENTIONAL INJURTY COMMITTED BY YOU OR ANY OTHER PERSON WHO PLAYS OR OBSERVES SOMEONE ELSE PLAYING HEARTFALL. HEARTFALL IS A SOFTWARE THAT IS PROVIDED FOR FREE THAT YOU PLAY AT YOUR OWN RISK.
11. Controlling Law and Severability.
This license is governed by and construed in accordance with the laws of the State of Colorado, USA. Exclusive venue for all litigation shall be in Colorado, USA. If any provision of this EULA is determined to be unenforceable by a court or other tribunal of competent jurisdiction, such provision will be enforced to the maximum extent permissible and the remaining portions of this EULA will remain in full force and effect.
13. Acceptance of Terms
By using the software which includes instructions to read this EULA, you agree to all of the terms of this EULA.
