§ 1 Scope
These terms apply to the use of the online game Moto Racing Manager, including all associated pages and features. Terms of the user that differ from these do not apply.
§ 2 Account and minors
An account is required in order to play. The contract of use comes into being as soon as the account has been created and the e-mail address confirmed. There is no entitlement to the creation of an account.
Anyone under 18 needs the permission of a parent or guardian in order to use the game. By registering you confirm that this permission has been given.
Your login details must be kept secret. One account per person is permitted — several accounts held by the same person distort the rankings and the race series in which everyone competes against each other.
§ 3 Costs
Use is currently free of charge. Should paid content be added later, it will be expressly marked as such before purchase; no costs arise without a separate order.
§ 4 In-game currency and virtual items
Credits, motorcycles, parts and all other items in the game are part of the game and not property in the legal sense. They have no monetary value, cannot be paid out or exchanged, and trading them outside the game — for money or for other consideration — is not permitted.
§ 5 Conduct in the game
The following in particular are not permitted:
the use of programs, scripts or automation that play the game for you or feed it false data;
exploiting bugs for your own advantage. If you find one you are welcome to report it — anyone who exploits it loses the advantages gained from it;
insulting content, content harmful to minors, incitement to hatred or unlawful content in names, team designations and all other freely chosen text;
passing on, selling or sharing accounts, and creating secondary accounts;
acts that disrupt operation — automated mass requests, circumventing suspensions, attacks on the servers.

§ 6 Suspension and termination
You can delete your account yourself at any time; this ends the contract. The provider may terminate the contract giving 14 days' notice.
In the event of a breach of § 5, advantages may be withdrawn and the account may be suspended temporarily or — in the case of serious or repeated breaches — deleted. Before a permanent suspension the reason will be given and, as far as the circumstances allow, you will have the opportunity to respond.
§ 7 Availability and changes to the game
The game is under continuous development. Content, rules and balancing may change, and features may be added or removed. There is no entitlement to a particular set of features or to uninterrupted availability; maintenance work will be announced where possible.
Game progress may be reset in the course of major changes. This will be announced in the game beforehand.
§ 8 Liability
The provider is liable without limitation in cases of intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.
In cases of ordinary negligence the provider is liable only for a breach of material obligations — those whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may rely — and then limited to the foreseeable damage typical of this kind of contract at the time the contract was concluded. Liability is otherwise excluded.
The provider is liable for the loss of game data only to the extent covered by the paragraphs above. Under § 4 game progress has no value of its own.
§ 9 Changes to these terms
We may change these terms. We will notify you of changes at least six weeks before they take effect, by e-mail or in the game.
Changes apply only if you agree to them. If you do not agree, you can delete your account at any time; we may terminate the contract giving four weeks' notice. Until then the previous terms continue to apply to you.
Changes to the game itself — content, rules, balancing, features — are governed by § 7 and are not a change to these terms.
§ 10 Final provisions
German law applies. Mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected. Should any provision be invalid, the remainder of the contract remains in force.
