Terms of Use for CHEFARZT

1. Provider and Scope

The provider is Valentin Kays, trading as eiz9r industries, Anemonenweg 14, 38315 Hornburg, Germany. The publisher name used is eiz9rgames. Contact for support, data protection and legal matters: support@eiz9r.de.

To the extent that they have been validly agreed with you, these terms govern the use of CHEFARZT and the multiplayer services we offer. They do not automatically amend your separate agreements with Valve concerning Steam. Your mandatory statutory rights remain unaffected.

The agreed scope of the service is determined by the information and terms validly agreed at the time of purchase. A mere change to the store description or this version of the text does not automatically change existing entitlements.

2. Nature and Intended Purpose

CHEFARZT is a humorous entertainment game about a deliberately exaggerated portrayal of everyday medical life. It makes no claim to be medically accurate, complete or up to date and is not intended for medical advice, treatment, professional training or reliable exam preparation.

Actions rated as correct in the game are not medical recommendations. Game content must not be applied to real patients. The Medical Notice explains this intended purpose.

The absence of a medical intended purpose does not override agreed requirements concerning the technical functionality of the game.

3. Use of the Game and Protected Content

Within the scope of your lawfully acquired entitlement, you may install and play CHEFARZT. Platform features included in your entitlement remain recognised.

To the extent that parts of the game are legally protected, they must not be reproduced, published, distributed or sold as standalone products without the appropriate permission. Statutory permissions to use them and rights under separate licences remain unaffected. This applies in particular to permitted backup copies, legally permitted examination of the program and legally permitted decompilation.

Separately licensed third-party components are subject to their respective licence terms. These are not restricted by the game’s general terms of use.

4. Conduct in Multiplayer

When using our multiplayer services, you must not threaten, deliberately harass or discriminate against other participants, or infringe their rights. In particular, you must not publish other people’s personal or confidential data without authorisation.

Attacks on our services, unauthorised access and manipulations that harm other participants or deliberately disrupt shared gameplay are prohibited. Reports of security vulnerabilities through our contact channel are welcome; this does not constitute permission to carry out attacks or access other people’s data.

5. Measures in the Event of Violations

In the event of proven violations, we may take appropriate measures concerning our multiplayer services to the extent permitted by law. The nature, scope and duration of these measures depend on the severity, impact and any recurrence of the violation.

Where reasonable, a warning will be issued first. Where there is a specific and substantial threat to other people or the service, an immediate temporary restriction may be necessary. Contractual services will be permanently terminated only where the statutory requirements are met.

To the extent legally permitted, affected persons will receive an explanation and may request a review via support@eiz9r.de. Statutory claims and remedies remain available.

6. Updates and Online Operation

We provide necessary updates to the extent required by law or contract. A compatible client version may be required for shared online play. We will inform you of such version requirements in the update notes or when a connection is established.

Where possible, we will announce scheduled maintenance in advance. Temporary restrictions may occur, in particular during necessary maintenance or security measures. This does not exclude statutory rights in the event of disruptions or defects.

These terms do not authorise us to arbitrarily remove promised essential features or permanently discontinue services owed to you at our sole discretion. Changes beyond necessary maintenance will be made only on a sound contractual and legal basis; required information and any applicable termination rights will be preserved.

7. Statutory Rights in Respect of Defects, Liability and Refunds

The statutory provisions concerning defects and liability apply. In particular, these terms do not exclude liability for damage caused intentionally or by gross negligence, or for death, personal injury or harm to health caused by fault.

The description of the game as satire and the Medical Notice do not restrict mandatory statutory claims.

The applicable Steam rules govern platform refunds. These terms do not restrict any additional statutory rights. Reporting a problem to us is not an additional prerequisite for exercising statutory rights.

8. Data Protection

The privacy policy provides information about the processing of personal data. Acceptance of these terms of use does not constitute blanket consent to optional data processing. Where consent is required, it will be obtained separately.

9. Changes to These Terms and Final Provisions

A new version of the text does not become part of an existing contract merely through publication, silence or continued use of the game. Contractual amendments are subject to the statutory requirements.

Applicable law and jurisdiction are determined by the statutory provisions. No exclusive place of jurisdiction is established to the detriment of consumers.

If a provision is invalid, the statutory consequences apply. An invalid clause is not automatically replaced by the provision that is most economically favourable to the provider.

CHEFARZT is a humorous computer game that depicts everyday medical life in a deliberately exaggerated game world. It is intended for entertainment and makes no claim to be medically accurate, complete or up to date.

Medical terminology, conditions, examinations, procedures, medications, workflows and decisions are used for gameplay and humour. They may be simplified, altered, unrealistic or entirely fictional. Even depictions that appear realistic must not be understood as reliable medical information.

No Medical Advice or Training

CHEFARZT is not intended for the diagnosis, prevention, monitoring or treatment of diseases in real people. It does not provide individual medical advice and is not intended as a reliable medical reference or for professional training or exam preparation.

Game content must not be used as a basis for actual treatment decisions, the use of medication or medical procedures. The game is no substitute for qualified medical advice, professional training or practical instruction.

Game Rules Are Not Treatment Guidelines

An answer or action rated as “correct” in the game is an assessment within the game and does not confirm its medical correctness. Points, titles, promotions, examinations and achievements in the game do not certify any knowledge, abilities or professional qualifications in the real world.

The portrayal of everyday hospital life is satirical. It makes no claim to depict actual people, institutions or professional practices accurately.

Real Health Concerns and Statutory Rights

For actual health concerns or medical questions, consult qualified medical professionals rather than this game.

This notice describes the intended entertainment purpose. It does not restrict your statutory rights against the provider and does not contain a blanket exclusion of liability.

PRIVACY POLICY FOR CHEFARZT

The details concerning the provider, contact information, documented local files, the use of DeinServerHost and the non-use of Steam Cloud have been incorporated. The sections below expressly marked for release approval checks do not assert unknown facts. The proposed retention rules have not yet been demonstrated to be implemented. This version therefore does not yet replace a complete privacy policy for the released build. Release approval checks G1–G5 are included in the accompanying package.

This notice concerns CHEFARZT, our own multiplayer services and the handling of enquiries about the game. These must be distinguished from independent processing by the Steam distribution platform and from other services offered under eiz9r.de.

2. Local Saved Games, Settings and Online Profiles

The following standard user data folder is documented for the main game on Windows:

This folder belongs to the respective Windows user account and is separate from the installation folder. %APPDATA% refers to that account’s AppData Roaming folder.

The “saves” subfolder contains single-player saved games with recorded game progress, including the player character, in-game day, points and saved progress in individual modules. One previously documented file is called “slot_1.json”. File names and additional save slots may differ between game versions. Backup files and separate migration copies may contain earlier states.

The “settings_v014.cfg” file contains profile-wide settings and the completion status of the one-time data protection briefing. This status is separate from career saved games. Filing the documents records that the briefing was displayed, not consent to optional data processing.

The “multiplayer” subfolder stores the local online profile and connection information. Documented files include “profile.json”, backup and temporary versions where applicable, “connection.json” and, where applicable, certificate or trust files. Profile files may contain credentials for regaining access to an online account. Do not publicly share these files, reconnection tokens or private keys.

The purpose of this local storage is to save and resume the game as requested by you, retain settings and reuse online access. Section 25(2), no. 2 TDDDG applies to access to the device that is strictly necessary for these purposes. Where we process personal data to perform our contract with you, the legal basis is Article 6(1)(b) GDPR. Any processing beyond this requires a separate assessment and, where necessary, consent.

Local Retention Period and Deletion

Saved progress and settings are retained between program launches and updated when you save. Program updates are intended not to reset these user files. Automatic deletion of local saved games based on their age is not guaranteed.

You can remove the files in File Explorer after completely closing the game. To do so, press “Windows + R”, paste the folder path shown above and confirm with Enter. Removing an individual saved game also requires removing its backup and migration copies. To remove all data stored in this user data folder, you can remove the entire “Chefarzt” folder. This will result in the loss of the saved games, settings, briefing status and local online credentials stored there. Any backup you retain elsewhere remains a copy of the data.

Deleting local files does not automatically delete a server-side account or an online campaign. Without retained valid credentials, it may prevent you from regaining access. Uninstalling the game alone does not demonstrate that all user files or separately created backups have been removed.

3. Multiplayer and Server-Side Storage

When you connect to our multiplayer service, the IP address required for communication and technical connection data are processed. Online accounts, login or reconnection data and saved campaigns, including the game state required for shared gameplay, are also used to operate and resume online play.

Online accounts and campaigns are additionally stored on the respective server installation. They are not merely transient data associated with a single connection; the documented server operation preserves them during updates. Separate server installations may maintain separate data sets.

The purpose is to establish the connection, associate online access with the relevant account and conduct or resume the requested shared game. Where personal data is necessary for the performance of the contract for these purposes, the legal basis is Article 6(1)(b) GDPR. The respective online function is not possible without the necessary connection and account-association data.

You can send a request to erase personal data stored on the server to support@eiz9r.de. Describe the online account or campaign concerned without sending passwords, tokens, private keys or unredacted profile files. Your entitlement to make the request must be verified securely, but without unnecessary collection of data. Statutory requirements, necessary exceptions and other people’s rights in shared data must be taken into account.

4. Retention, Technical Logs and Backups

Online accounts and saved campaigns are retained to provide and continue the online service owed under the contract. If that purpose ceases to apply and no other necessary legal basis exists, personal data will be deleted or genuinely anonymised. Valid erasure requests will be handled without undue delay. No fixed inactivity period will be introduced that deletes paid game entitlements or shared campaigns without further review. The necessity of storage must be reviewed at least monthly and upon termination of an account or the service.

Session data needed only for an active connection or a limited reconnection process will be removed once that purpose ends. Data needed for a saved game, a transaction check that remains necessary or a security incident must be kept separate and is subject to the applicable rule. A mere loss of connection therefore does not automatically delete a campaign.

Our own ordinary technical operational and security logs will be limited to necessary information and, as a general rule, deleted no later than seven days after collection. For specifically documented security incidents, necessary extracts may be retained separately with appropriate protection for as long as required for the investigation or pursuit of legal claims. Their necessity will be reviewed at least monthly and when the matter is closed; extracts that are no longer needed will be removed. No blanket, indefinite archive of data for possible future use is planned.

Where necessary, technical logs are used for troubleshooting, secure operation and the prevention or investigation of specific misuse. The legal basis is Article 6(1)(f) GDPR, with the legitimate interest in the secure and reliable operation of the service. Routine storage of complete message contents or access tokens is not part of the proposed standard logging.

Our own backups will be deleted or replaced within a limited recovery cycle, no later than 30 days after their creation. Backups must not serve as a permanent user archive used in parallel. Personal data deletions that have already been carried out will be reapplied before restored data is returned to production use. Separately justified retention of a minimal body of evidence must not be replaced by retaining complete backups indefinitely.

5. Steam and Steam Cloud

CHEFARZT is distributed through Steam. Valve is responsible for independent processing within the Steam service, for example in connection with platform accounts, purchases and operation of the platform. Further information: https://store.steampowered.com/privacy_agreement/?l=german

CHEFARZT does not use Steam Cloud synchronisation. CHEFARZT does not back up saved games or synchronise them between devices via Steam Cloud. This must be distinguished from our own multiplayer server data and from any backups you independently set up.

6. Hosting and Recipients

DeinServerHost states that its publicly offered Windows virtual servers are located near Frankfurt am Main, Germany. This statement by the provider does not yet constitute individual evidence of all storage, backup or remote-access locations under our specific contract.

The hosting provider is engaged as a server infrastructure service provider to deliver the service. Where it processes personal data on our behalf, the requirements for processing on behalf of a controller must be met. This text does not assert that a data processing agreement has already been concluded. Any infrastructure or security processing carried out by the provider under its own responsibility must be distinguished from this.

7. Support and Electronic Communication

When you contact support@eiz9r.de, sender and contact details, the content and time of your enquiry and any documents you send are used to handle the enquiry. Do not send real patient data, confidential health information, passwords, access tokens or private keys. Also redact screenshots and logs before submitting them.

Contract-related enquiries are handled on the basis of Article 6(1)(b) GDPR. For other matters, Article 6(1)(f) GDPR applies, with the interest in providing an appropriate response. Article 6(1)(c) GDPR, in conjunction with the respective obligation, applies to compliance with statutory obligations concerning access to information, data protection or other matters.

Email hosting and message delivery service providers are a potential category of recipients for electronic communication. The actual mailbox provider, any forwarding arrangements, technical service providers, processing locations and contracts must be established for this processing. The mail infrastructure used cannot reliably be inferred from the address support@eiz9r.de or from the multiplayer hosting provider.

Ordinary closed support cases for which there is no other necessary basis for retention will be deleted no later than 90 days after final handling. If they cease to be necessary earlier, they must be deleted earlier accordingly. Documents subject to statutory retention requirements will be stored separately and only for the applicable purpose. Classification is based on the actual type of document; neither every support email nor a saved game is, merely for that reason, a record subject to tax-related retention requirements.

8. Further Data Transfers, Analytics and AI

ChatGPT was used as a development and design tool for the game. This must be distinguished from transferring data from the running game or from support handling to an AI service.

9. Your Rights

Subject to the statutory requirements, you have rights of access, rectification, erasure, restriction of processing and data portability. Where processing is based on legitimate interests, you may object on grounds relating to your particular situation; the statutory conditions for continuing the processing must still be assessed.

Where processing is based on consent, that consent may be withdrawn at any time with effect for the future. This does not affect the lawfulness of prior processing. Contact support@eiz9r.de regarding your requests. Any electronic method actually used to obtain consent must also allow consent to be withdrawn just as easily; filing the data protection document does not replace such consent.

You may lodge a complaint with a data protection supervisory authority, in particular in your place of habitual residence, place of work or the place of an alleged infringement. Requests to exercise your rights will be handled in accordance with the statutory requirements. The statutory response period is not a blanket permission to postpone a required erasure until the end of that period without a reason.

10. Changes

This notice will be updated when our processing changes. Publishing a new notice does not, in itself, create consent or a new legal basis. Existing statutory rights remain unaffected.

The offline retrieval of engine licence information actually present in the existing data protection briefing module has been checked. No claim is made that a complete licence inventory of the submitted Steam build has been established.

1. Game Content

CHEFARZT was developed by Valentin Kays under the trading name eiz9r industries as an independent game project. The publisher name is eiz9rgames. AI tools, including ChatGPT, were used as development and design tools when creating original content.

To the extent that intellectual property rights exist in the original game design and its components, they belong to Valentin Kays or the respective rights holders. Statutory permissions to use them and separate licences remain unaffected. This does not assert intellectual property rights in every individual AI-assisted component, nor any official endorsement, review or co-publication by the provider of a development tool.

2. Godot Engine

CHEFARZT uses the Godot Engine under the MIT licence. The engine’s licence does not automatically make the entire game open-source software. The corresponding copyright and licence information applies to the engine included in the respective program.

The existing “Running Godot Engine” document tab retrieves the version, engine licence text, copyright information and full licence texts of the third-party components recorded within the engine, all offline. It uses the engine that is actually running rather than asserting one fixed version number for all future builds.

The full MIT text below has been taken from the existing legal text. It applies to the Godot Engine; it is not an additional blanket exclusion of liability or warranty towards purchasers of CHEFARZT.

Their respective licence terms apply in addition and must not be restricted by general game rules.

You can send reports of potential rights infringements to support@eiz9r.de. Where possible, specify the game version, the element concerned and the basis for your report. Use of this contact channel is not a prerequisite for exercising statutory rights.
