Valdrys is a small game with an online world behind it. These terms are short because the relationship is simple: you buy a licence to play it, you may not abuse it, and the world it runs in is a service that one person operates.

1. What you are buying
You are buying a personal, non-exclusive, non-transferable licence to download and run the Valdrys client and to play on the Valdrys server. You are not buying the game itself, a copy you may pass on, or a guarantee that the world stays online forever — see section 6, which is the section that matters most in a game like this one.

The licence is yours alone. You may not sell, lend, rent, sub-licence or give away your copy, your key or your account, and you may not redistribute the client or bundle it into anything else.

Where you bought Valdrys through a storefront, that storefront's own terms apply alongside these — including its refund policy, which is the one that governs refunds. Nothing here replaces it.

2. What you may not do
  • Attack, overload or attempt to gain unauthorised access to the server or other players' accounts.
  • Automate play with bots or scripts, or exploit a bug for advantage instead of reporting it.
  • Harass, threaten or abuse other players, or post content in chat that is illegal, hateful or sexual.
  • Impersonate Valdrys - Valdrys Games or another player.
  • Sell, buy or trade accounts, characters or in-game items for real money.
  • Extract the game's assets for use elsewhere. Much of the art is licensed to this project specifically and is not yours to redistribute — see the credits.

3. Your account
Keep your password to yourself; anything done with your account is treated as done by you. Accounts that break these terms may be suspended or removed, with or without warning, at the operator's discretion.

4. Your characters are not property
Characters, items, currency and progress exist on the server and are licensed to you for play. They are not your property, have no monetary value, and cannot be sold or transferred. Buying the game buys the licence in section 1; it does not buy the contents of your bags.

The game is in development: balance changes, items may be altered or removed, and — though it is avoided wherever possible — data can be lost. If a wipe is ever necessary it will be announced in the news beforehand.

5. User content
You are responsible for what you type. Character and guild names that are offensive, impersonating or unusable may be changed or removed.

You keep whatever rights you have in what you write. So that the game can work at all, you give the operator a non-exclusive, royalty-free licence to store, transmit, display and moderate the things you type or name — chat messages, character names, guild names and crests — for the purpose of running Valdrys, and for keeping the moderation and audit records that make running it possible. It goes no further than that: it is not a licence to publish or sell what you write.

6. The world is a service, and it can end
This is the part to read before you buy. Valdrys is an online game: the world runs on a single server, operated by one person, and there is no uptime guarantee. It may be unavailable, restarted, rolled back, or discontinued entirely. When the server stops, the game stops — there is no offline mode, and buying a licence does not buy a promise that the world will still be there next year.

If Valdrys is ever shut down for good, the intention is to say so on the news page and on the store page with as much notice as circumstances allow. That is a statement of intent, not a contractual term, and it is written here so nobody has to guess.

7. No warranty
Beyond your statutory rights as a consumer, and beyond the storefront's own guarantees and refund policy, the game is provided "as is", without warranty of any kind, express or implied, including fitness for a particular purpose.

8. Limitation of liability
To the fullest extent permitted by law, the operator is not liable for any indirect or consequential loss arising from your use of the game, including lost progress or lost data.

Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded — including death or personal injury caused by negligence, fraud, and your rights under consumer protection law. If you bought Valdrys as a consumer, those rights stand whatever this document says.

Where liability can lawfully be limited, the operator's total liability to you for any claim connected with Valdrys is limited to the amount you paid for it in the twelve months before the claim arose.

9. Who owns Valdrys
Valdrys — its code, its art, its name and its world — belongs to the operator or is licensed to the project by others. Nothing you buy transfers any of that to you. Third-party assets are used under their own licences, which are listed in the credits; those licences are not yours to re-use by virtue of owning the game.

10. Who may play
You must be old enough to agree to these terms where you live, and at least 13. If you are under 16, or under whatever age counts as a child for data protection where you live, you need a parent or guardian's permission. What the game stores about you is described in the privacy policy, which forms part of these terms.

11. If your account is closed
If your account is suspended or removed for breaking these terms, you are not entitled to a refund of anything you paid, and characters and items on that account go with it. This does not affect your statutory rights, and it does not affect the storefront's own refund policy, which is the one that governs refunds.

12. Your responsibility for what you do
If somebody brings a claim against the operator because of something you did in breach of these terms — what you posted, who you harassed, an account you sold — you are responsible for that claim and its reasonable costs. This applies only to your own breach, and only to the extent the law allows it to apply to you as a consumer.

13. Which law applies
Where you bought Valdrys through a storefront, that storefront's agreement governs your purchase — including where and how a dispute about the purchase is heard. These terms govern your use of the game and the server, and they do not override it.

If you are a consumer in the EU or the UK, nothing here removes your right to rely on the law of the country you live in, or to bring a claim there.

14. The rest
If any part of these terms turns out to be unenforceable, the rest still stands. Not enforcing something once does not waive it. These terms, together with the privacy policy, are the whole agreement between you and the operator about Valdrys. The operator may transfer them to somebody else who takes the game on — for example if it changes hands — and will say so in the news if that happens; you may not transfer them.

15. Changes
These terms may change. Material changes update the date above and are announced in the news. Continuing to play after a change means you accept it.
