End User License Agreement

Welcome to UNSPELLED. This End User License Agreement ("Agreement") governs your access to and use of UNSPELLED, including its online matches, voice and text communication tools, single-player and bot modes, updates, and any other feature or service we provide in connection with the game (together, the "Game").

By installing, launching, or otherwise using the Game, you accept this Agreement. If you have not yet reached the age of majority in your place of residence, you may only use the Game with the permission and supervision of a parent or legal guardian.

Article 1. Scope

This Agreement governs everyone who installs or plays the Game.

Rules, announcements, community guidelines, or other instructions we publish through the Game itself, our store page, our website, our social media channels, our Discord server, or any other official channel are incorporated into and form part of this Agreement.

We reserve the right to add, modify, suspend, or discontinue any feature, mode, name, delivery method, supported platform, or term of this Agreement at any time.

Article 2. Your Setup and Equipment

UNSPELLED is primarily an online party-brawler, and also offers offline single-player and bot matches.

You are solely responsible for obtaining and maintaining the hardware, operating system, internet connection, platform account, and any other resources needed to run the Game.

Performance may vary, or the Game may not function correctly, depending on your device, network conditions, platform, our server availability, or changes made by third-party services we rely on.

We make no promise that the Game will run flawlessly on every setup, remain available at all times, be free of defects, or match every player's expectations.

Article 3. Playing Online

Online matches place you in a lobby, room, or server together with other players, where the objective is to whittle away opponents' name-letters and limbs until only one name remains.

While playing online, treat other participants with basic respect and help keep matches fun, fair, and safe for everyone.

The following are not allowed during online play:

1. Insults, slurs, threats, harassment, discriminatory remarks, or deliberate provocation aimed at other players
2. Deliberately stalling matches, going AFK to disrupt play, or otherwise sabotaging a match for reasons unrelated to normal strategy
3. Running cheat software, hacks, modified game files, third-party injectors, macros, or automation scripts
4. Abusing bugs or unintended mechanics to gain an edge, harm other players, or throw off game balance
5. Any action that degrades our servers, network performance, matchmaking, or leaderboard integrity
6. Pretending to be another player, a staff member, or any other person or organization
7. Collecting, exposing, or mishandling another player's personal details
8. Using matches to solicit dates, advertise, promote a business, or push political or religious messages
9. Any behavior that keeps us or other players from using the Game as intended
10. Any other conduct we reasonably consider inappropriate

To keep online matches fair and safe, we may inspect match logs, communications, in-game conduct, matchmaking history, chosen names, and related account information as needed.

Article 4. Accounts

Playing UNSPELLED may involve linking a platform account, choosing a username or in-game character name, and generating save files, statistics, and other account-linked data.

Keeping your login credentials secure is your responsibility. Do not lend, share, sell, or otherwise hand control of your account to anyone else.

Except where caused by our intentional misconduct or gross carelessness, we bear no responsibility for losses resulting from your account being compromised, mismanaged, or accessed by someone else.

Article 5. Voice Chat, Text Messages, and Other Communication

The Game offers live voice chat and may also include text messaging, quick-chat phrases, profile fields, room names, and similar communication tools. Whatever you say or share through these tools is your own responsibility.

Do not use any communication feature to transmit content that:

1. Insults, threatens, discriminates against, or harasses anyone
2. Is sexually explicit, graphically violent, or otherwise offensive in content or tone
3. Reveals someone's personal details, such as a home address, phone number, or email
4. Links to outside websites for advertising, scams, or spam purposes
5. Promotes crime, self-harm, or other dangerous behavior
6. Is designed to target, impersonate, or damage another player, staff member, or third party
7. We otherwise find inappropriate

Because voice communication happens live, we cannot practically monitor or archive every conversation. We may still take action based on player reports, voluntarily submitted recordings, or other evidence brought to our attention.

Except where our own intentional misconduct or gross carelessness is the cause, we are not responsible for conflicts, harm, or other issues that arise between players over voice or text communication.

Article 6. Names and Identifiers

Your chosen in-game name doubles as your health total, making it a central part of gameplay. Usernames and character names may not:

1. Impersonate a real person, brand, organization, or fictional character in a misleading way
2. Contain slurs, threats, harassment, or discriminatory language
3. Contain sexual or otherwise obscene wording
4. Include anyone's personal or contact information
5. Copy a third party's trademark or copyrighted material
6. Otherwise conflict with any part of this Agreement

Where we determine a name breaks these rules, we may reset, rename, hide, or otherwise restrict it, or apply any of the measures described in Article 11, without advance warning.

Article 7. Content You Create

"Your Content" refers to usernames, character names, profile details, comments, room titles, and anything else you generate, submit, or display through the Game.

Ownership of Your Content generally stays with you or whoever legitimately holds the rights to it.

We generally stay out of Your Content when it is used only temporarily, for personal in-game expression or communication.

That said, if you choose to publish, distribute, or let others access Your Content outside the Game — for instance through screen recordings, clips, or streams — you take on full responsibility for that decision.

By using the Game, you give us a non-exclusive, royalty-free license to store, copy, display, adapt, publish, and otherwise use Your Content to the extent reasonably needed to run, maintain, secure, improve, and promote the Game.

If we believe Your Content breaks this Agreement, or if we receive a complaint, legal notice, or takedown request from a third party regarding it, or if we otherwise think action is warranted, we may remove, hide, restrict, or otherwise act on that content, on related features, or on your account, without prior notice.

We are not, however, obligated to actively review, archive, or respond to every piece of content players generate.

Article 8. Ownership, Recording, and Sharing Gameplay

All rights to the Game itself — code, art, music, trademarks, and other intellectual property — belong to us or to the third parties who licensed them to us.

You are free to record, screenshot, stream, and publish your own gameplay, including for monetized content, subject to any separate content-creator guidelines we may issue later.

If your username, comments, streams, or shared content incorporate someone else's trademark, artwork, music, likeness, or other protected material, that inclusion is entirely your own responsibility. Nothing in this Agreement should be read as our endorsement or authorization of any rights infringement.

Whenever you post or stream anything related to the Game, you're expected to follow the relevant platform's rules, applicable law, third-party rights, and any guidelines we separately publish.

Should a dispute, legal claim, takedown notice, or other issue arise out of something you posted, shared, or streamed, you are responsible for resolving it at your own cost. Except where our own intentional misconduct or gross carelessness caused the problem, we bear no liability for it.

The following types of posts or streams are not permitted:

1. Anything that otherwise breaks this Agreement
2. Material shared specifically to infringe someone else's rights
3. Content meant to harass, defame, or publicly shame a rights holder, another player, or us
4. Promotion or distribution of cheats, hacks, modified files, unauthorized access tools, or similar
5. Content encouraging exploitation of bugs for unfair advantage
6. Material intended to damage the Game's reputation or disrupt its operation without justification
7. Unauthorized commercial use of Game assets or materials
8. Any other content we deem inappropriate

If a rights holder or other third party notifies us of a problem with something a player posted or shared, or if we otherwise think it necessary, we may remove, restrict, or otherwise act on the content, related features, or the player's account, without advance notice.

Article 9. Reporting Bugs and Exploits

Feel free to report, discuss, demonstrate, or ask questions about bugs, glitches, or unexpected behavior you encounter — we welcome that feedback and don't prohibit discussing such issues in good faith.

However, you may not:

1. Use a known bug or exploit to gain an unfair advantage
2. Deliberately use a bug to disadvantage or harm other players
3. Take actions that seriously damage game balance, rankings, matchmaking, or server stability
4. Build, distribute, sell, or promote cheats, hacks, modified files, or similar tools
5. Publish specific instructions for attacking our servers, gaining unauthorized access, or reverse-engineering the Game
6. Use bug reports as cover for harassing, doxxing, or publicly shaming another player
7. Spread false claims about bugs or issues in a way that damages the Game's reputation or normal operation
8. Take any other action intended to cause us or third parties harm

Even legitimate bug discussion must stay within the bounds of applicable law, third-party rights, and the rules of whatever platform you're using to share it.

Article 10. Conduct We Don't Allow

While using the Game, you agree not to:

1. Break any applicable law or act against public decency
2. Commit or encourage criminal or otherwise illegal acts
3. Harm the reputation, dignity, privacy, or interests of us, other players, or any third party
4. Attempt unauthorized access, disrupt our network, or reverse-engineer, tamper with, or modify the Game
5. Create, use, distribute, or promote cheats, unauthorized bots (aside from our official AI opponents), macros, or similar tools
6. Illegitimately obtain, alter, transfer, or sell save data, statistics, or other account-linked data
7. Sell, trade, or lend your account or associated data for money or anything of value
8. Exploit bugs or unintended mechanics to gain an unfair edge or disrupt game stability
9. Interfere with other players' matches beyond what the Game's own combat and sabotage mechanics intend
10. Spam, troll, or otherwise disrupt the community with repetitive nuisance behavior
11. Spread false information, impersonate someone, commit fraud, or direct players to malicious external sites
12. Make unauthorized commercial use of the Game
13. Interfere with how we operate, secure, or manage the Game
14. Use the Game in ways we never intended
15. Engage in any other conduct we reasonably consider inappropriate

Article 11. How We Respond to Violations

If we believe you've broken, or are likely to break, this Agreement — including in response to a third-party complaint, legal notice, or our own review — we may take any of the following actions without advance warning:

1. Issue a warning
2. Remove, edit, or hide a name, profile, comment, or other content
3. Restrict access to chat, voice, matchmaking, or other features
4. Limit your ability to join matches
5. Adjust, reset, or remove stats, rankings, or rewards
6. Suspend your account temporarily or permanently
7. Block your access to the Game entirely
8. Share relevant information with platform operators or law enforcement where appropriate
9. Take any other action we consider necessary

Except where caused by our own intentional misconduct or gross carelessness, we are not liable for any inconvenience or loss these actions cause you.

Article 12. Servers and Availability

Because UNSPELLED depends heavily on online connectivity, parts or all of the Game may be temporarily or permanently unavailable due to server issues, maintenance, outages, updates, or changes on platforms we rely on.

We may pause, interrupt, adjust, or shut down any part of the Game without prior notice, as circumstances require.

We do not guarantee constant uptime, uninterrupted matchmaking, flawless voice or text communication, permanent data storage, or that our servers will run indefinitely.

Article 13. Updates and Balance Changes

We regularly update the Game to fix bugs, adjust balance, improve anti-cheat systems, add or remove features, or for other operational reasons.

These updates may change combat mechanics, limb and name interactions, maps, controls, visuals, and other aspects of gameplay.

Playing the Game means accepting that its content and feel may evolve over time, and that an earlier version's experience isn't guaranteed to persist.

Article 14. Save Data and Records

Save files, match history, rankings, achievements, and other Game data may be lost, corrupted, altered, or reset due to hardware issues, server problems, platform changes, connectivity issues, updates, or bugs.

We cannot guarantee that your data will always be preserved, complete, or recoverable.

Where necessary — for example, due to a rules violation, bug fix, or operational need — we may correct, remove, reset, or limit access to your data.

Article 15. Purchase and Future Monetization

UNSPELLED is sold as a single upfront purchase. At the time this Agreement takes effect, there are no additional in-game purchases available.

We may introduce paid downloadable content, cosmetics, or other purchasable items in the future. If we do, this Article will govern those purchases as well, and we'll aim to give reasonable notice through the Game or its store page beforehand.

Any purchase you make — now or in the future — is subject to the refund policy and terms of the storefront or platform you bought it through.

Unless the law or a platform's own policy says otherwise, purchases are final and cannot be refunded, exchanged, or converted to cash.

We may adjust the availability, price, or content of anything purchasable for operational or balance-related reasons.

Article 16. Data We Collect

To operate, secure, improve, and support the Game — including handling support requests, investigating problems, and enforcing this Agreement — we may collect and store certain information about you.

This can include device and account identifiers, match history, error logs, communication records (including voice clips submitted as part of a report), content you've created in-game, purchase records, and details from any support requests you send us.

We handle this information in line with applicable privacy laws and our separate privacy policy.

Article 17. No Warranty

We don't promise that the Game will be complete, accurate, secure, uninterrupted, bug-free, fit for any particular purpose, or free of third-party rights conflicts.

To the fullest extent the law allows, and except where our own intentional misconduct or gross carelessness is responsible, we are not liable for damages, disputes, lost data, missed opportunities, network or hardware failures, conflicts between players, third-party claims, or any other harm connected to your use — or inability to use — the Game.

If a dispute with a third party arises from content you created, posted, shared, or distributed through the Game, resolving it is your responsibility, at your own expense.

You use the Game at your own risk, and any dispute you have with a third party because of that use is yours to resolve.

Article 18. You Agree to Cover Our Losses

If your violation of this Agreement, or your use of the Game, causes us or a third party to suffer loss, damages, expenses, or a legal claim, you agree to resolve the matter yourself and reimburse us for any resulting damages, costs, and legal fees.

Article 19. Ending or Changing the Game

We may modify, pause, or permanently shut down all or part of the Game at any time, for business, technical, legal, or other reasons, without advance notice.

If that happens, features like online play, matchmaking, leaderboards, saved content, or data syncing may stop working.

Except where our own intentional misconduct or gross carelessness caused it, we are not liable for any resulting loss or inconvenience.

Article 20. Updating This Agreement

We may revise this Agreement whenever needed.

Any revised version takes effect once we publish or announce it through the Game, our website, our store page, or another appropriate channel.

Continuing to play after a revision takes effect means you accept the updated terms.

Article 21. Governing Law and Disputes

This Agreement is governed by the laws of India.

Any dispute connected to the Game or this Agreement will be subject to the exclusive jurisdiction of the courts located where Zync Studios is registered or headquartered in India.

Article 22. Getting in Touch

Send questions, bug reports, or other inquiries through the contact channel we designate for that purpose.

We aren't obligated to reply to every message, and we decide the content, timing, and manner of any response at our own discretion.
