IMPORTANT: NSFWho.exe is an adults-only fictional entertainment product. Please read this Agreement before installing or playing the Game.

This End User License Agreement (the "Agreement") is a legal agreement between you and Faphalla ("Faphalla", "we", "us", or "our") concerning your use of NSFWho.exe, including any authorized updates, patches, downloadable content, manuals, and related files supplied by us (collectively, the "Game").

By purchasing, downloading, installing, launching, or otherwise using the Game, and by selecting "I Agree" where that option is presented, you agree to this Agreement. If you do not agree, do not install or use the Game and seek any available refund through the authorized storefront, subject to its rules and applicable law.


You may use the Game only if you are at least 18 years old and have reached the age of legal majority where you live. The Game contains explicit sexual themes, nudity, mature language, fictional surveillance, hacking, coercive or manipulative themes, and other material intended solely for adults. All characters depicted in sexual contexts are fictional and are represented as adults.

You are responsible for complying with local age restrictions and content laws and for preventing minors from accessing the Game through your devices or accounts. If possession or use of the Game is unlawful where you are located, you are not granted a license to use it there.


Subject to this Agreement and any applicable authorized-storefront terms, Faphalla grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the Game for your private, non-commercial entertainment on devices you own or control. The number of permitted installations and any household-sharing rights are governed by the storefront through which you obtained the Game. The Game is licensed, not sold.

You may make backup copies only to the extent permitted by applicable law or the relevant storefront. No ownership interest in the Game or its intellectual property is transferred to you.


Except where applicable law expressly permits an activity that cannot be restricted by contract, you must not:

• Copy, reproduce, distribute, sell, rent, lease, lend, sublicense, publicly perform, or commercially exploit the Game or any substantial part of it;
  
• Extract, scrape, export, repackage, or redistribute artwork, animations, videos, audio, dialogue, source code, data files, characters, or other Game assets as standalone content;
  
• Reverse engineer, decompile, disassemble, translate, derive source code from, or otherwise attempt to discover the underlying structure of the Game, except to the limited extent expressly allowed by mandatory law;
  
• Circumvent access controls, age gates, license checks, encryption, copy protection, or other technical measures;
  
• Modify the Game to introduce malware, unauthorized telemetry, unlawful material, or functionality intended to harm other persons, systems, or networks;
  
• Use the Game, its fictional tools, dialogue, clues, commands, or scenarios to facilitate unauthorized access, stalking, harassment, doxxing, exploitation, fraud, or any other real-world unlawful conduct; or
  
• Remove, obscure, or alter copyright, trademark, attribution, or other proprietary notices.

Unless Faphalla publishes separate modding rules, you may create and share non-commercial mods, guides, fan art, and other fan works that require a lawfully obtained copy of the Game, provided that they do not include or distribute substantial standalone Game assets, imply official endorsement, bypass paid or restricted content, or violate law or third-party rights.

You must not use the Game or its assets to create or distribute content that sexualizes minors, depicts real persons sexually without their consent, or is otherwise unlawful. Faphalla may withdraw this permission for a particular fan creation where reasonably necessary to protect rights, users, or the Game.


You may capture and share screenshots and gameplay footage, including commentary, reviews, livestreams, and platform-monetized videos, provided that you obtained the Game lawfully, add meaningful original context or presentation, comply with the hosting platform's adult-content rules, do not distribute the Game itself or standalone extracted assets, and do not state or imply that your content is officially endorsed by Faphalla.

This permission does not grant rights to third-party music, fonts, images, software, or other materials that may be separately licensed. You are responsible for any permissions required for those materials.


The Game, including its software, structure, user interface, stories, characters, dialogue, visual elements, audio, videos, puzzles, fictional websites, names, logos, and documentation, is owned by or licensed to Faphalla and is protected by copyright, trademark, and other applicable laws. All rights not expressly granted under this Agreement are reserved.

Third-party names and marks are the property of their respective owners. Their appearance does not imply sponsorship, affiliation, or endorsement unless expressly stated.


The Game presents a fictional computer operating system, fictional people, fictional files, fictional communications, and simulated investigative or hacking activity for storytelling and puzzle-solving. Unless expressly identified otherwise, names, characters, organizations, systems, events, messages, credentials, websites, and scenarios are fictional. Any resemblance to actual persons or events is coincidental.

The Game is not cybersecurity training, professional advice, relationship advice, medical advice, or authorization to access any real account, device, service, or network. Do not test commands, passwords, techniques, or scenarios from the Game against systems you do not own or lack explicit permission to use.


The current offline release is designed not to transmit gameplay data or personal data to Faphalla and does not require a Faphalla account. The Game may create save files, preferences, logs, or other technical files locally on your device. You are responsible for maintaining any backups you need. Uninstalling the Game, clearing application data, or changing devices may delete or make local progress unavailable.

Your storefront, operating-system provider, payment provider, or device platform may independently process data under its own terms and privacy notice. Faphalla is not responsible for those independent activities.

If a future Game version adds online, analytics, account, cloud, or AI features, Faphalla will provide any additional privacy information required before that processing begins.


The authorized storefront through which you obtain the Game may set separate rules for payment, downloads, refunds, account access, device sharing, cloud services, and platform conduct. Those rules govern your relationship with the storefront; this Agreement governs your license from Faphalla.

If there is a conflict, mandatory law applies first, followed by any storefront term that the storefront requires to control, and then this Agreement to the remaining extent.

The Game may include third-party software or content governed by separate notices or licenses supplied with the Game. Those terms apply to the relevant component and take priority over this Agreement only for that component. Nothing in this Agreement limits rights granted under an applicable open-source license.


Faphalla may provide patches, updates, compatibility changes, balance changes, fixes, or content revisions. Updates may modify or remove features where reasonably necessary for security, legal compliance, compatibility, content licensing, or continued development, subject to the description made at purchase and your mandatory consumer rights. Faphalla will provide updates required by applicable mandatory law.

Alpha, beta, demo, test, and early-access versions are unfinished and may contain bugs, incomplete content, placeholder assets, save incompatibilities, or features that change before final release. Any limitations clearly disclosed on the store page form part of the expected nature of that version, without excluding rights that cannot legally be excluded.

You are responsible for installing available updates within a reasonable time after being informed of them. If you fail to install an update supplied to maintain conformity, your remedies may be affected only to the extent permitted by applicable law and only where you received adequate installation instructions.


The Game is intended for compatible hardware and operating systems identified on the relevant store page. Subject to mandatory law and express promises made at purchase, Faphalla does not guarantee compatibility with every device, peripheral, modified operating system, virtualization layer, or future system update.

The Game may contain flashing images, rapid transitions, visual noise, and intense or sexually explicit material. Stop playing and seek appropriate assistance if you experience discomfort, dizziness, nausea, eye strain, or other adverse effects. Use suitable screen settings, take reasonable breaks, and follow any health advice applicable to you.


Game progress may depend on solving puzzles, interpreting clues, or making choices. Faphalla does not guarantee that every player will discover all content, reach every ending, or complete every puzzle without outside assistance. This does not limit remedies for a defect or lack of conformity under mandatory law.


Nothing in this Agreement excludes, restricts, or modifies any guarantee, remedy, or other right that cannot lawfully be excluded or restricted.

In particular, where you are a consumer, the Game must conform to the contract and you retain the remedies provided by applicable consumer law, including the Norwegian Act relating to the provision of digital services to consumers (digitalytelsesloven) where it applies.

To the maximum extent permitted by law, and except for express promises made on the applicable store page, the Game is provided on an "as available" basis. Faphalla disclaims implied warranties only to the extent that such warranties may lawfully be disclaimed. No statement in this section converts disclosed pre-release limitations into a waiver of mandatory rights.


Nothing in this Agreement limits or excludes liability where doing so would be unlawful, including liability for intentional misconduct or gross negligence where applicable, or any liability and consumer remedy that cannot be limited by contract.

To the maximum extent permitted by law, Faphalla is not liable for indirect, incidental, special, or consequential losses that were not reasonably foreseeable when you accepted this Agreement, or for losses caused by unauthorized modifications, incompatible third-party software, failure to install required updates, misuse of fictional hacking content, or breach of this Agreement.

For users acting in the course of a business, Faphalla's total aggregate liability arising from the Game or this Agreement is limited to the amount paid for the Game during the twelve months preceding the event giving rise to the claim. This business-user cap does not apply to consumers where it would reduce mandatory rights.


This Agreement remains effective until terminated. You may terminate it at any time by ceasing use and uninstalling all copies of the Game.

Faphalla may terminate the license if you materially breach this Agreement and, where the breach can be remedied, fail to remedy it within a reasonable time after notice. Immediate termination may occur where reasonably necessary to address serious unlawful use, security threats, or deliberate circumvention of access controls.

Upon termination, you must stop using and delete all copies under your control. Sections concerning ownership, restrictions, liability, disputes, and other provisions that by their nature should survive will continue. Termination does not remove rights or remedies that accrued before termination and does not affect mandatory consumer rights.


This Agreement is governed by the laws of Norway, without regard to rules that would apply another country's law. The courts of Norway have jurisdiction, subject to the consumer protections below.

If you are a consumer, this choice of Norwegian law does not deprive you of mandatory protections available under the law of the country in which you habitually reside, and nothing in this Agreement prevents you from bringing proceedings in any court or using any alternative dispute-resolution process available to you under mandatory law.

Before starting formal proceedings, you and Faphalla are encouraged to try to resolve the issue through the support channel on the storefront where you obtained the Game.


Faphalla may update this Agreement for future versions or where reasonably necessary because of changes to the Game, law, storefront requirements, security, or business operations. The updated version will state its effective date and will be made available with the Game or on an official distribution page.

A change will not retroactively remove vested rights or materially reduce consumer rights without any notice or consent required by law. If you do not agree to a change that lawfully requires your consent, you may stop using the affected future version.


If any provision is found invalid, unlawful, or unenforceable, it will be enforced to the maximum lawful extent or severed, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. Headings are for convenience only.

You may not assign or transfer this Agreement except as permitted by the storefront or mandatory law. Faphalla may transfer this Agreement as part of a genuine sale, reorganization, or transfer of the Game or business, provided that the transfer does not reduce your mandatory rights.

This Agreement, the applicable store-page description, any component-specific license notices, and the authorized storefront terms constitute the relevant agreements concerning your use of the Game. They do not override representations or consumer rights that cannot lawfully be excluded.
